Court Thwarts Trump's Attempt To Exclude Undocumented Immigrants From Census

A federal court has thwarted an executive order that said undocumented immigrants should not be counted in the 2020 Census. In a Thursday ruling, the court noted that President Donald Trump's July 21 order runs contrary to America's historical method of tallying an area's population—a count that matters for purposes of determining how many seats in the U.S. House of Representatives that area gets. The judges ordered the secretary of commerce not to enact the order.
"Throughout the Nation's history, the figures used to determine the apportionment of Congress—in the language of the current statutes, the 'total population' and the 'whole number of persons' in each State—have included every person residing in the United States at the time of the census, whether citizen or non-citizen and whether living here with legal status or without," states the decision, penned by a three-judge panel from the U.S. District Court for the Southern District of New York.
"We declare the Presidential Memorandum to be an unlawful exercise of the authority granted to the President by statute," the judges concluded.

The case—New York Immigration Coalition v. Trump—was brought by the national American Civil Liberties Union (ACLU), the New York Civil Liberties Union, the ACLU of Texas, and Arnold & Porter on behalf of the New York Immigration Coalition, Make the Road New York, CASA, the American-Arab Anti-Discrimination Committee, the ADC Research Institute, and FIEL Houston.
"The constitutional mandate is clear—every person counts in the census," said Dale Ho, who directs the ACLU's Voting Rights Project, in a statement. "Undocumented immigrants are people—and nothing President Trump does or says changes that fact."
"The court order bars work by the Census Bureau that would allow it to produce a separate count excluding people in the U.S. illegally," notes The Wall Street Journal:
There isn't a citizenship question on the census, after the Supreme Court last year blocked the president's plan to add one. To carry out the president's latest order, the bureau had planned to match census responses with citizenship-verified records from state and federal agencies to estimate how many people in each state weren't legal residents.
This, the judges ruled, would violate the law that requires Commerce Secretary Wilbur Ross, who supervises the bureau, to send a single set of numbers—a "tabulation of total population by States"—to the president. The memo also violated the law because "so long as they reside in the United States, illegal aliens qualify as 'persons in' a 'State' as Congress used those words," the panel ruled.
The Trump administration can still appeal the decision. Meanwhile, the Associated Press reports that "around a half dozen lawsuits around the U.S. were filed by states, cities, immigrant advocates and civil rights groups challenging its legality and constitutionality" of Trump's July 21 order. "The New York case is the first to get a ruling, but there are other issues the New York judges didn't address that could be addressed in the other court cases."

If you aren't a citizen, you don't get representation, and the census decides how representation is divided up.
Imagine the case of the Rotten Boroughs in 19th century Britain, where some MPs were sent to Parliament with 14 votes cast. Suppose your Congressional district is East LA and you are elected into office by 6500 votes. Total. That plus the 400 votes for your opponent are how many people are registered to vote in your district. Not the vote total found in most other districts, but imagine the money saved campaigning.
The Democrats have been historically in favor of a serf population to bolster numbers in their districts but who are ineligible to vote.

It would have to be fixed by constitutional amendment, as the language of the census clause is pretty clear: "the whole Number of free Persons"

There is no law requiring the count of those illegally here.
“Free persons in a state" refers to state residents, not people physically present. You're not a state resident if you're in the country illegally. Illegals should not be counted under the Constitution.

What kind of taxes? Because illegal aliens still pay sales, and sometimes other taxes such as property taxes.
The Indians had to register with Indian affairs. They had (have) their own separate census. Per your own idiocy, without such a census, there's no way to know who's paid what tax.
Or rather, should the ~50% of US Citizens who pay no net income tax not be counted in the Census? This number includes many retirees, low income working families, etc.
Moreover, immigrants are required to apply for a Tax ID # and file a Federal Income tax return, regardless of whether they are off-status or working legally on the books.

It's anti-democratic and morally reprehensible.

Read the judges ruling, he cites no law. For some reason he brought up the citizenship question rulings year which has no bearing on the counting question he presided over. His primary thesis was historical norms, not law or constitution.

If you're in the country illegally, you're not a "free person", since you can be removed from the country at any time, and you have neither the rights nor benefits of a free person; the US Constitution applies to illegals only in a limited way.

Part of the problem with not counting the illegal residents may also be the estimation method that the Trump administration wants to use. Has estimation been used in the census? Isn't it supposed to literally be a _count_ of persons.

Yes but the argument could be made that Britain's blockades were a larger drain on our economy, as Germany was also a trading partner before the war. Unlike WWII, WWI didn't have a "good" side. Most of the human atrocities supposedly committed by Germany turned out to be British propaganda to keep the US from joining Germany's side. It was a strong possibility until the end of 1915, and remained a possibility through 1916, the British blockade was very unpopular and German immigrants made up a large percentage of the population (and Irish immigrants who didn't exactly love England). The German navy made the decision to resort to unrestricted submarine warfare, and even then the actual barbarity of it was overhyped by the British (who also used disguised armed trawlers in much the same tactics as German Uboat commanders). This is what eventually soured US support for Germany. England had been considered a hostile or potentially hostile power for over a century whereas Germany had never been a hostile nation. The history books don't do a good job of describing how close the US came to fighting on Germany's side because the Anglophiles won that debate. And WWII and the Nazi atrocities and aggression memory holed US support for Germany during the early parts of WWI.
Wilson was a huge Anglophile and one of his main reasons for declaring neutrality in 1914 was because he was scared that the US population would side with Germany because of the British blockades.
I wonder how different history would have been if Germany had US manufacturing and raw goods, as well as our Naval assets to back it up.
Hitler probably never have come to power, if US and Germany had prevailed, which is very likely as the combined US fleet and German fleets, and the US shipbuilding capabilities would have dwarfed the British fleet. Also, the UK depended heavily on food and manufactured goods from the US and Canada. The US likely would have invaded Canada (they had actual war plans to do exactly that if the US entered on Germany's side). The US would likely have absorbed Canada (long a dream of many 19th century American politicians and early 20th century ones as well) and many of the British Caribbean holdings (and possibly some of the French ones as well). Germany would have demanded territory in central Europe from the Russians, and Austro-Hungary would have absorbed the Balkans and many of the Russian backed central European Countries. Also, England and France would likely had to have given up some of their African colonies and Middle East colonies to Germany and the Ottoman Empire. Italy would likely have been forced to turn over some of their northern provinces to Austro-Hungary, and possibly some of their African colonies.
Depending on how long the war lasted, and how costly it would have been (it is quite possible that US intervention in 1915 would have drastically shortened the war because English Naval dominance would have been sorely tested if not outright broken) if the Tsar would have been deposed.
Wilson would likely also not have had an excuse to get his League of Nations founded if the war had been shorter. And Japan, having declared for the Allies may have been checked or confronted much earlier by the US. This has implications for China's, Korea's and Vietnam's modern history.

Joe Coppo was a dad and a man about town in the town I grew up in. He coached baseball every year and most everyone wanted to be on his team; he had a reputation for working well with the kids who weren’t the best players and being thrilled when one of them got a hit or made a play. I was never on his teams but knew him and his sons through baseball.
Tim Stackpole was FDNY and was childhood friends with my father. In ‘98, he was on the roof of a massive fire in Brooklyn when it collapsed, killing two other firefighters. He was in the hospital and rehab for the next three years before returning to FDNY in March 2001 and was promoted to Captain less than a week before 9/11. After miraculously surviving the ‘98 fire, he was killed when the towers collapsed.
Finally Steve Siller was FDNY. He grew up in the same neighborhood where my father’s family used to live. He had finished his shift and was on his way home when he heard what was going down, and he turned his car around to go help. By then the Brooklyn Battery Tunnel had been closed to traffic, so he put on all his gear and ran through the tunnel to the WTC, about three miles, and was killed when the towers collapsed. Every year, there’s a great 5K in NYC that’s organized by his parents. People and firefighters come from all over to retrace his steps through the tunnel to the new WTC. I’ve run it a few times and my most vivid memory was overhearing a father tell his young son before the race “Don’t worry, there’s only good people here today.”
We could go on forever about what our country did wrong afterwards, but to me that’s for another day. To me it feels important now more than ever not to lose sight of the fact that those who suffered most that day were doing nothing but trying to be do their best, to be good people.

Yeah, there's a medium where parents can maintain oversight and still provide enough freedom for kids to broaden their boundaries. At some point, if you don't accept that keeping your kids locked away from the world isn't the best way to raise a functioning adult, you're going to end up with a kid that's severely emotionally and intellectually stunted, and will lash out when that bubble isn't provided. That's a big issue with a lot of these Antifa protesters in particular--most of them were raised in very privileged circumstances and never had to learn how to deal with adversity in a healthy way. The fact that they aren't suffering the consequences of destroying their community isn't helping one bit, because they continue to think they deserve to act however they want.

But the Houston Texans decided to stay in the locker room for both the national anthem and the black national anthem. They wanted to disrespect the national anthem, but they didn't want to do that and then rub it in by standing during the black national anthem--so they hid in their locker room.
The Miami Dolphins have also apparently decided to stay in the locker room both during the national anthem and the black national anthem.
I don't know what your hometown team is planning to do during the national anthem and the black national anthem this weekend, but I know what I'll be doing. If your team is too ashamed of America to come out and stand up during the national anthem, then I'm too ashamed to have them on my TV screen. And if your team is hellbent on disgracing a national anthem that makes everyone who sings it question whether the country is free and whether we've brave enough to do whatever it takes to make it free again, then that's even worse.

I think about being a young black man who has come into a town where he is idolized and celebrated, only to be treated like shit by a local cop one day and being powerless to do anything about it- or finding out that his son or brother had even less recourse when it happened to them. At the same time, punishing me, the person celebrating you, is not going to help. I- and millions of fans- was giving you the tools necessary to affect change. You make millions that could be donated to social change organizations. You could be speaking out in a respectful way about race and the like while still doing the things that make you celebrated. Instead, you take away the thing that made you celebrated as if it was a "Gift" that you can withhold. Well, that isn't the way it works. We actually were involved in a trade, and if you want to take away the stuff for which you were celebrated (and paid) then don't expect to be celebrated any more. *shrug*.
It's not like DeShaun, JJ, and Patrick are going out there thinking "f*** the fans, we're more important than them..." but that's the message they're sending.

That was a big reason Tebow's demonstrative praying on the field was so grating. I don't doubt his faith is sincere, but you don't glorify God by allowing your act of devotion to be turned into a meme by the media.
I don't think these organizations or the players realize how much of a disconnect exists between the guys on the field and the people in the stands/watching on TV.
As late as the 1970s, a lot of NFL players, black and white, had to work offseason jobs to make ends meet. They and the fans were both legitimate working-class people, who often rubbed elbows in the same bars and greasy spoon diners off the field. Hell, even Vince Lombardi sold insurance in the offseason.
Now, thanks to TV money and free agency, games are expensive enough that usually only upper middle class and wealthy people can afford season tickets, but blue-collar and regular middle class people would still try and go to 1 or 2 games a year, maybe more for sports like baseball. The latter would still make time to watch the games on TV at home or at the sports bar, and buy the merchandise and jerseys because that was "their team," regardless of who played for them. They supported ludicrous tax breaks for these organizations because sports fandom was the last vestige of community bonding left in the 20th century as people became increasingly socially isolated.
That shit is going to be coming to an end. The next organization that tries to blackmail a city into giving it a sweetheart deal on a lease or they walk, is a lot more likely now to be told, "Well, bye," without any regrets other than from the local journalists covering the jock beat, who are now seeing their job security flash before their eyes.
The NFL actually has some competition now too.
Not just college, but the XFL is going to start up again after being bought by The Rock (aka the most charismatic human being alive today).
If the XFL just does what it was doing last spring, and stays away from woke bs, they're going to become a real alternative.
The NFL will eventually win, but it will be costly.
The NFL is making the same mistake, as you allude to above, that elites often do: they think the opinions of their peers, including players and corporate sponsors, are common. And they don't realize that commoners don't think they should be disrespected.
And disrespect to the fans is exactly what the woke bs is.
But even in the face of boos, they'll say the fans are wrong - never considering that those fans have a legitimate perspective and they're not wrong for getting a different message than the "unity" insisted upon.
Because the "unity" being pushed is unity via submission.
Maybe Average Joe doesn't think America is inherently racist and evil.
And Average Joe isn't buying the idea that the millionaires preaching to him while he just wants to enjoy football are as oppressed as they claim to be.

Smith came back with the point that, you could tell your audience to eat shit all you want, but if they decide, "Okay, fuck you then, I'm not watching this or spending money anymore," then what? Your platform is essentially destroyed because people aren't buying what you're selling, and now you're not making any money, either.
There's been quite a bit of "fuck the fans if they don't like it" going on and it's amazing to me. The fans booed the "moment of unity" last night and I've already seen plenty of "HOW DARE THEY!!!" coverage of it.
The fans are the only reason the NFL exists. The fans' willingness to buy tickets, beer and nachos is why Patrick Mahomes can make $500m. $500m he can spend creating a great deal of positive change if he so desires.
Those fans can certainly find other ways to spend that money and time if you give them enough reasons to. These players can be woke AF and making professional lacrosse money if that's the route they want to go.

I have taught my kids from a very young age to show respect especially to people in uniform. And at around 12, I also show them videos about how to deal with cops in a way that protects your rights. The two are not mutually exclusive.

It's late 80s early 90s slang. My take is that it means more "be cautious" than "stop".
If you wanted to be technical about it, it should be "cover your brake".
I'm not sure exactly what the initial thought process was for the figurative use of this phrase (obviously it's unlikely much formal thought was actually put into it), but yes, I believe it generally is used to mean "slow down, start thinking about shit and pay attention." One meaning could derive from the use of a tap on the brakes to turn off cruise control and possibly start a gradual deceleration. That is what I generally think of when the phrase is used I guess- when I realize I need to start slowing down and/or taking more direct control (potentially bad road conditions coming up, cop, traffic ahead, speed limit change, etc.), I "pump" the brakes once to kill the cruise and, if hit sufficiently hard, give a little immediate braking effect in addition to coasting. "Tap" the brakes would probably be and equally effective, and perhaps more accurate, term to use when most people say "pump."
Another use of the term I remember, though I'm not sure if it makes sense here, is from before ABS when you would "pump" the brakes when trying to stop quickly in slippery conditions. Basically trying to manually do what ABS does- slow down as rapidly as possibly without simply locking up the wheels and making them slide by rapidly applying more and less pressure to the brakes. When I was younger and ABS was relatively new, I remember older people having a hard time getting out of that habit when they hit the brakes in the snow since they had always been taught to pump like a MFer. ABS works best when you just apply constant pressure and let it do the work, and that was hard to get used to.
In the Long Ago time, there were cars without anti-lock brakes. Jamming those brakes---which were often drums, to boot---often resulted in locking up the wheels, and a slide into whatever you were trying to avoid by braking in the first place. Accordingly, people pumped their brakes, which allowed them to decelerate, yet still maintain control.
It's about as old and irrelevant a metaphor as 'dropping a dime on someone.'
Or a little icon of a floppy disk for saving a file. Or a record scratch sound effect in a movie to indicate an unpleasant surprise.

It says nothing about citizenship, true, and I don't think anyone's asking that the enumeration be limited to citizens. But they don't count persons who are only transiently at a location either, i.e. just passing thru on business, tour, visiting, etc. The Constitution doesn't say not to count people in their hotel rooms, does it? Yet they've always drawn the line between resident and non-resident. Why not draw the line at legal residents instead of residents generally?

They don't count non-residents as "population", so why would they, in a legal process, count illegal residents? The only reason this ostensible oversight occurs in the wording of the Constitution is that at the time it was written there were practically no rules about who was entitled to reside in the country, and its drafters didn't anticipate attempts to pack states with persons who would be legally excluded from residency. They anticipated the Indian question and the slave question, but they didn't anticipate this one.

Well, I suppose that might be technically true if you accept that for the first few censuses Indians weren't considered human beings. Otherwise, you might have to conclude that this is a false statement and the census has not in fact always counted "every person".

You might be off by several orders of magnitude on your cost estimating.
Given that every positive test can, because of contact tracing, theoretically result in some number of additional tests for people who wouldn't otherwise be tested (since they are not even a little bit sick), the perverse incentive for the testing labs to find as many positive cases as possible couldn't be more clear.

To whatever extent California's efforts to limit the release of greenhouse gasses into the atmosphere have been successful, we need to subtract how much has been released in the atmosphere due to wildfires that could have been avoided if it weren't for environmental regulations that, for instance, made it practically impossible for power companies to maintain their lines in such a way that winds wouldn't blow branches into their lines and spark fires.
If Sacramento really cared about greenhouse gas emissions, they'd ignore the tree huggers--at least well enough to let power companies maintain their power lines in a responsible manner.

Unfortunately, a lot of those trees, which should be removed, are on private land. Unless PG@E gets written permission from the land owners, they have no choice but to “trim” them. I spent ten grand removing trees on my property. Not that it did any good….
Aren't the lines on an easement that allows tree-trimming and removal, whether or not the property owner wants it? They are in Texas, and it is a great way, so I've read, of getting rid of problem or diseased trees. Just tell the electrical co-op that the tree is interfering with their lines, and they'll move quickly to take it out.
A lot of CA's problems stem from overall forestry mismanagement, and not from PG&E's shortsightedness. Not that PG&E is an especially well run utility.

From my experience, even ASKING PG@E to remove a tree, is no guarantee at all that it will be done. Getting them to trim one can also be a bit of a challenge. It took me two years of complaints from myself and my tenant to get a tree trimmed. Funny though, two weeks after the Carr Fire, they were, all of a sudden, all over it.
It was also sort of - well, ironic -- to see them removing trees in the Paradise area. Lots of crews removing trees. That was two weeks AFTER the Camp Fire.

California power companies are essentially government-run monopolies.
They literally have their prices set (or approved) by Sacramento. Same for capacity, method of power generation, everything. They make almost no decisions in the operation of their business.
And they're effectively run by Sacramento at the behest of tree huggers among others.

Something about their reasoning completely lacks context. You can't just contradict federal immigration law to give yourself more political power.
