Video: Key West Police Arrest and Try To Handcuff 8-Year-Old Child

Three police officers in Key West, Florida, arrested an 8-year-old at school and tried, but failed, to handcuff the child, body camera footage released on Sunday showed. That arrest is now the subject of a federal civil rights lawsuit.
Tallahassee civil rights attorney Ben Crump tweeted the footage of the 2018 incident on Sunday:

The video shows the officers telling the child he is going to jail, lightly patting him down, and attempting to put handcuffs around his wrists. The boy's wrists are too small, though, so the officers allow him to walk out of the school uncuffed.
"You understand this is very serious, OK?" one of the officers tells the boy. "And, I hate that you put me in this position that I have to do this. OK? All right? The thing about it is, you made a mistake, now it is time to learn from it and grow from it. Right? Not repeat the same mistake again."
Crump, who is also representing the family of George Floyd, later tweeted that his law firm and the firm, Devon Jacob, are representing the child's mother, Bianca Digennaro.
"My son has a disability, and the authorities tried to make him a criminal for being 8-years-old and disabled," Digennaro said at a press conference announcing her lawsuit this morning. "I'm here because I refuse to let them make him a convicted felon."
Digennaro's lawsuit names the Key West police officers, the city, and several officials at Gerald Adams Elementary School as defendants. The suit alleges the arrest of Digennaro's son, who had been diagnosed with oppositional defiant disorder, adjustment disorder, and other emotional disorders, violated his Fourth and 14th Amendment Rights, as well as his rights under the Americans with Disabilities Act.
"Some authorities within the school and police department thought it was appropriate to arrest and charge an 8-year-old special needs kid—64 pounds, three-and-a-half-feet tall—with a felony because he was having a mental health crisis," Crump said in a press conference this morning. "We're here because we want to know who thought this was appropriate."
The Miami Herald reported that police arrested the boy, who has not been named because he is a minor, on a felony battery charge on Dec. 14, 2018, after he allegedly punched a teacher in the chest:
"According to the arrest report, the boy's teacher said the boy was not sitting properly in his cafeteria bench seat. The teacher asked him several times to sit down out of concerns for his safety.
After not complying, the teacher asked him to sit next to her. He refused and told her, 'Don't put your hands on me.'
She then told the boy to walk with her. As he did, he told her, 'My mom is going to beat your a--,' and then he punched her with his right hand, according to the report."
Digennaro says that the Monroe County District Attorney's office pursued felony charges against her son for nine months before prosecutors dropped the case.
Moral outrage aside, Crump and Jacobs say the law is on their side. In 2017, a federal judge ruled that a Kentucky school resource officer acted unreasonably when he handcuffed two children, ages 8 and 9.
The Key West arrest isn't the first time Florida police have made headlines for arresting small children. An Orlando school resource officer (SRO) sparked national outrage last September when he arrested a 6-year-old girl.
Reason reported in June on the expanded use of SROs in Florida following the mass shooting at Marjory Stoneman Douglas High School in 2018—and a troubling number of arrests and uses of force against children with autism that followed.
Civil liberties groups and disability advocates say the increase in school police, and a renewed zeal for zero-tolerance policies for petty disturbances, have fueled the "school-to-prison" pipeline and led to disproportionate enforcement against minorities and students with disabilities. Scrutiny of the role of SROs has only increased following the police killing of George Floyd in Minneapolis. Activists have been pushing school districts across the country to shrink or totally abolish their SRO programs and redirect the funds toward student services.
According to data from the Florida Department of Juvenile Justice, Florida police arrested 2,781 children between the ages of 5 and 12 in fiscal year 2018–2019, the latest year for which data are available. The youngest was a 5-year-old Hispanic boy. He was charged by the Osceola County Sheriff's Office with felony aggravated assault.

Juvenile arrests have been declining nationwide since the mid-1990s, mirroring a national drop in crime. That's true in Florida, too. However, while overall numbers have dropped, arrests in Florida schools plateaued and started to tick back up in 2017.
Meanwhile, the proliferation of cell phone videos, police body cameras, and social media has led to numerous incidents involving SROs abusing their power that have gone viral. In February, an officer at a high school in Camden, Arkansas, was relieved of duty after a video showed him putting a student in a chokehold and lifting the student off the ground. Last December, a North Carolina SRO was fired after he brutally body-slammed a middle schooler. In November, a sheriff's deputy with Florida's Broward County was arrested and charged with child abuse after a video showed him body-slamming a 15-year-old girl at a special needs school.
In response to a request for comment, a spokesperson for the Monroe County School District said, "Due to the possibility of this matter becoming a legal issue in the future, we have been advised not to make further comment about the incident at this time."
Key West Police Chief Sean Brandenburg told the Herald that, "Based on the report, standard operating procedures were followed."
"If that's his message," Jacobs replied, "he should hand in his resignation."

If you don't want to handle these situations the way they were handled when I was growing up---the teachers and/or the principal would get hands on with the kid, sometimes involving the 'Board of Education'---then the cops are going to have to do it. Letting the little bastard run around amok, isn't one of the choices.
Frankly, had that happened when was I was a kid, the child would have been made to physically comply or be removed from the school. Or both. Old men, some of whom may have been in WW2 or Korea, didn't take any shit off a kid like that.

When the kid told the teacher that his momma was going to kick her ass, he was being honest and polite. He was right.

This is true (and I support any adult's right to hit a child if the adult is in physical danger from the child). The teacher lost it and broke the rules. When the child acted as he is expected to act (he is severely mentally disabled) she doubled down and broke the law. Then the school and the cop also doubled down and broke the law.
This is specifically child abuse. Put the abusers in prison.
The vast majority of studies show no positive and some negative effects from spanking. Again, most people who actually work with kids and see them thrive and succeed believe it's counter-productive to use violence as a behavioral tool.
I'm not cut out to be a police officer or a soldier, so I'm not. If you're not cut out to control children without hitting them, you shouldn't be around children.

Per the story, it is very possible the teacher did get hands on with the kid and the kid responded with an appropriate punch to the chest and was arrested ala the McCloskeys.

When I was a kid, a teacher once slapped me, then lost a few windows in her classroom. If it had been a male teacher, he'd've gotten a fist or bat in his face or the school would have burned down or his car would have gone up in flames or he'd be ambushed and beaten.
I finally got thrown out when I was 15. Though I would cit school all the time anyway. Worked for a year or so then joined the Army, got my GED and high school equivalence certificate a year BEFORE my "class" graduated, volunteered for Vietnam. Hated authoritarian ideologies.

I've seen that term pop up a couple of times recently. Apparently it is a real thing and has been for a while now, but I have to wonder if this is the new ADD/ADHD. IOW, is this the new thing that kids are going to be diagnosed with in droves when in reality only a few actually have it, like ADD was in the 90s? It seems like they're constantly coming up with new ways to overly pathologize childhood.
One problem with that sort of shit is that it basically gives the kid a built in excuse for all of his bad behavior instead of learning, for example, that it's wrong to hit people. Instead of being held accountable for his bad behavior he'll grow up never facing any consequences for his actions because he "has a condition." Basically, people like that grow up and join Antifa.

First off, ancient story.
Second, this was an eight year old kid. Sixty four pounds. Troubled kids sometimes do that. Teachers should NEVER call the cops on their students, no matter how disruptive, unless an actual violent crime has been committed. And even then a sense of proportion needs to be maintained. Yes a punch is violent, but this was an eight year old sixty four pound kid.
Side note: I was a kindergarten teacher once. I had a special needs kid in my class. He sometimes hit me. I didn't like it, not at all. But not once did I ever consider calling the cops on him. It's unthinkable. Maybe if I were a high school teacher and the kid was sixteen. Proportionality is needed. There is no excuse to ever call the cops on an eight year old.
Other side note: Same age in second grade, I was "fake" arrested by a cop. I suppose they thought it was cute at the time. I was a bit rowdy in lined up to get back into the classroom, and the visiting cop "jokingly" handcuffs me. Of course my hands slipped out of the cuffs. I did an abracadabra move and pretended I was Houdini. Cop was mildly amused. It was a half joke on the cop's part. Thinking back on it, that Barney Fife was clearly in the wrong. But I also think of the massive gulf between then and now, how the cop culture has changed. What was once a joke in poor taste by Officer Friendly back in the very late 60s, would now be considered standard operating procedure by Officer Tightass. Hell, a cop could get fired for NOT arresting an eight year old!

Again, the same people freaking out about this, would also freak out if the school teacher had slammed the kid to the ground after the first punch. (Or, more likely, gotten one of the older men to do it for her.) Which is what would have happened had I been stupid enough to take a swing at a female teacher back in the late 70s when I was in elementary school. If the teachers can't touch the kids then they're going to have cops do it.

Yes, expel the kid. Note the light years of distance between expelling the child and arresting and cuffing the child. If you can't tell the difference you have no business being either a teacher or a parent.

One of the issues causing these problems is the “mainstreaming” of children with special needs. Back in the 70s if a child had special needs they would be in a special class with a teacher who was trained to deal with these kids. This also acted as a deterrent for rowdy kids, they did not want to be put in that class and have to ride the short bus. When children have no consequences for their actions you end up with behavior like this, just look at what is happening in Portland and Seattle, when they can assault people, destroy building and there is no consequences they will just escalate until someone really gets hurt or killed.
I also went to a school with the paddle threat like some other posters and it worked. The coach had the scary one hanging on the wall, don’t remember the name on it but it was named. And you know what, don’t ever remember him having to use it…just the threat of it was enough to keep us inline.
The school failed to follow the plan, and failed to contact his father who was at the school at the time.
The parents did everything right.

You think a kid where that's the first thing he thinks of to tell the teacher about his parents, has parents that care whether the little hellion learns to behave or not? Refusing to carry out work under your employment contract is not "breaking the law", it's a contract violation. However, so is trying to force employees to do something they aren't qualified or were hired for, like dealing with violent kids. No. But that makes me more objective as an outside observer. From my objective observations: 1) Don't have kids until you have the TIME to spend supervising and guiding them, 2) Don't have kids until you have the emotional maturity to provide your kids with emotional support and deal with inevitable frustration, 3) Set the example for your kids you want them to emulate, 4) Read and learn all you can about child development and child psychology, 5) Have realistic and reasonable expectations, 6) Be prepared to spend a few hundred thousand dollars per kid over their lifetimes.
20+ years teaching junior college (freshman & sophmore) math. I substituted once for AP calculus in a high school. The students were nowhere near as well-behaved as college students. I upped the difficulty of the course material, holding them responsible for mathematical proofs. That kept them in line, focused on the course material. I didn't have to eject any students.

I would assume you and your kids are pretty normal and none of you suffer from ODD, ADD and severe emotional issues such that you have a plan from the state to create a special environment.
I suspect the teacher violated the rules, then the kid told her she was going to be in trouble so she escalated by grabbing him and calling the police.
Remember, dad was on site but never called. He was there to help but they never called him. This isn't about neglect at home. This is about an over-entitled agent of the state going Karen on an 8 year old handicapped kid.
Kids with these kinds of issues are generally live in abusive chaotic environments and/or were exposed to drug use during gestation. The child's statement was "My mother is going to kick your A**", right before HE punched the teacher.
That came from somewhere. Given that his mom has her own experience within the justice system, I am highly skeptical that this was a school induced issue.
As I read it, before he said "My mother is going to kick your A**" he said "'Don't put your hands on me.'".

I suspect this over entitled government agent lost it when he acted like a kid with severe ADD (hyperactivity and not sitting still) so she grabbed him. I think at that point, she was screwed for violating the rules realized it and called the cops to 'cover it up' and get some Karenesque payback.
Because bullies always blame the victim. Always.
I don't know for sure, because I wasn't there. But I have seen this enough to seriously question the teacher who called police on a disabled 8 year old kid.
