The Former Cop Who Killed George Floyd Will Get $50K Annual Pension Even if Convicted of Murder
The family of George Floyd probably won't be able to successfully sue Derek Chauvin in civil court because of qualified immunity, but they will help pay for the killer cop's retirement.

The former Minneapolis police officer who suffocated George Floyd to death on May 25 will be able to receive a taxpayer-funded pension even if he is convicted of murdering Floyd.
Derek Chauvin, who was captured on video kneeling on Floyd's neck for more than eight minutes while Floyd struggled to breathe and eventually died, was fired from the Minneapolis Police Department and subsequently arrested and charged with second-degree murder and manslaughter. Many states have laws allowing public employees' pensions to be partially or fully revoked if an individual commits a felony offense while discharging their public duties, but Minnesota does not.
As a result, CNN reported Friday, the 44-year-old Chauvin will be able to start drawing a pension at age 50, though the benefits would not be fully vested until he turns 55. The exact amount of his pension is unknown—and his termination from the department may affect some of the calculations used to determine the eventual payout—but CNN reports that Chauvin is likely to be eligible for about $50,000 annually based on his final pay and years of service.
If he were to live to 78, the average life expectancy for men in the United States, Chauvin could be expected to draw more than $1.1 million from the pension system—and that's without accounting for any cost of living increases.
Not all of that would be coming from taxpayers, of course. Public pension systems are funded in three ways: by employees who contribute a portion of their paychecks, by the employers (which is to say taxpayers), and by investment earnings. Police in Minnesota contribute 11.8 percent of their own pay to the pension system every year. That portion is Chauvin's money and should be returned to him. Police Departments, however, contribute 17.7 percent of each employee's salary to the retirement fund too—and the public is on the hook for making up any funding shortfalls that might occur.
Those numbers are higher than in many other places, but that's probably why the Minnesota Public Employees Retirement Association is nearly fully funded, unlike many other public pension systems. Also, police in Minnesota do not pay into Social Security or receive benefits from the federal retirement program.
Understanding Chauvin's pension helps shed light on the broader implications of public retirement costs around the country. An employee like Chauvin is afforded a retirement package that allows him to collect a pension even if he pursues other work after his retirement, and that cannot be revoked even for the most egregious violations of the public trust. It's vastly different from what most private sector workers can expect to receive.
Many states have narrowly tailored laws that allow for pensions to be revoked if public officials abuse their positions, but those laws are usually targetted at preventing corruption rather than police misconduct. Even Florida's pension forfeiture statute, which says that public employees can lose their pensions for a "breach of public trust," was insufficient to prevent the Florida deputy who failed to confront a shooter at a Parkland high school from getting a pension in excess of $100,000 annually.
If Chauvin were to be convicted of murder in Florida (or several other states), he'd probably be in danger of losing his pension. Instead, taxpayers in Minnesota will pay for his retirement even if he's spending part (or all) of it behind bars.
That only adds insult to injury for the family of George Floyd. Qualified immunity could prevent them from successfully suing Chauvin in civil court for compensation, but a small portion of their taxes will be used to pay for the killer cop's retirement.

I don't know how I feel about this. According to the rules he did "earn" his pension before he killed Floyd.
If the courts sentence him to jail + no pension that's one thing, but extrajudicial punishments tacked on by posturing bureaucrats or politicians is another.

The only reason the public might be 'paying' for this retirement benefit in the future, is the further fiscal chicanery of state governments which have all failed to properly fund their future liabilities.
For the rest of us, our 'earned' retirement benefits are earned precisely because cold hard cash is moved from our wallets to an investment account. Contrast with the bulk of public servant retirement plans, they are funded with paper wishes and unicorn farts, which the public will have to pay. And that is not Chauvin's fault, but the fault of Minnesota politicians.

I would LOVE to see the police unions disbanded for protecting thug cops (among other reasons). I think that whenever a cop (or a prosecutor) can be shown to have hidden evidence or otherwise broken the rules to get a convict, he should be looking at serious jail time. I think that qualified immunity should be based on a ‘reasonable man’ standard, so it would protect cops who did something wrong but understandable, and leave idiots dangling in the breeze.
And I think that such reforms, while possible, will take a long time, and the War on Drugs would have to stop first.
At the same time, I think that far too much leeway is allowed to ‘protesters’. You have a right to peaceably assemble. Peaceable assembly should not stretch to throwing dangerous objects, damaging property, and setting fires. Not even to burning flags, unless you get a fire permit; the typical burned flag is a beach-towel sized (or larger) sheet of petrochemical cloth that MELTS as it burns and sooner or later an errant wind is going to wrap some poor sod in flaming, sticky cloth and kill him.
I think that since the 1970’s there has grown up a culture of Hobby Protesters; people for whom this is a pastime, like Civil War Re-enactment. They block streets, assault people, set fires, and generally get away with entirely too much.

The way it works in Massachusetts is a crime committed in the course of his job, and then a hearing before the pension board, which he could then appeal to court. This is a stated policy and has been for decades -- he knew it.

The idea that Floyd's family should be free to sue the police who murdered him for damages is perfectly valid. The suggestion that people aren't entitled to the benefits they earned per the terms of their contracts because they broke some unrelated law is unjust and childish.

I've stood up for the rights of terrorists not to be tortured. I think the right to free from cruel and unusual punishments extends to arsonists and rapists, too. I have little sympathy for murderous cops, but their contractual rights are just like mine. My rights shouldn't arbitrarily be rescinded just because I committed a crime either.
Because the family of George Floyd should have every right to sue the cops who murdered him for damages, that doesn't mean anything and everything you want to do to those cops is appropriate, constitutional, or ethical.

How can a judge decide if someone gets their pension as part of sentencing? If I'm convicted of murder, can the judge really just arbitrarily decide that the state will claim ownership of my house as part of my punishment too?
The idea that they lose their pension as part of sentencing for a crime that's unrelated to the conditions of their pension makes more sense than the idea that they automatically lose their pension by fiat without due process. If it were a function of their union contract, that might make sense--but then I'd need to believe that these cities and states make their cops accountable in this one way but unaccountable in all the others. Why is this one way so different?
The most plausible explanation is that the claim by "Á àß äẞç ãþÇđ âÞ¢Đæ ǎB€Ðëf ảhf" is coming out of his ass, and there are no jurisdictions with a law that deprives cops of their property without due process like he says. Maybe there really is something going on here, or maybe the way this has been handled for a long time is based on a bad decision. As I understand the plan, they're taking a vote on June 26th. They're establishing a Truth and Reconciliation commission. They're initiating a charter commission to change the city charter to allow for the annulment of the police department as its presently constituted, and then they're initiating a new model of violence prevention. All of this is meant to be put on the ballot in November.
I will make one prediction about all this. If they manage to make the November election in Minneapolis about whether or not have a police department, it will bring people to the polls who don't usually bother. Yeah, disaffected Democrats who want an end to the police will show up more than they usually do, but everybody to the right of Representative Ilhan Omar who shows up to vote to keep the police department running is a potential Trump voter, too.

Careful to describe things like taking the taser and pointing it as "allegedly" and "the GBI claims that"... just to be accurate.
I dunno... maybe I'm wrong about this, but I don't think there's ever been a case of someone fighting police, taking a weapon off of them, pointing it at them and getting shot where the following investigation did not find that the shooting was justified.

He is likely going to have to get a regular job which will have Social Security, which means Floyd's family will be paying taxes for his retirement anyway, or do you want to take away any means for him to support himself financially permanently? If that is the case, the death penalty might be cleaner.

The duration without (10-min) any sympathy on Chauvin's part while arrestee is not fighting I'd consider out-of-order perhaps even to the extent of serving time. But this whole "murderer", "choking", "brutality" just doesn't hold water.

Wouldn't matter if they could bring a civil suit and won. Retirement funds in some states can not be used in a civil ruling and even in the one's where they can, there is a minimum threshold and I highly doubt $51K a year would qualify.
See OJ Simpson's civil case. The Goldman/Simpson families haven't seen hardly a dime yet he draws a 1/4 million in retirement each and every year.
