Sanders Delegates Banned From Bashing Biden on Social Media

Plus: "Obscene" cartoonist gets probation, U.S. teen births plummet, a reopening win in Ohio, and more...


After delegate drama in 2016, Democrats aren't taking any chances this time. Sen. Bernie Sanders (I–Vt.) has asked at least some of his 2020 delegates to sign a pledge saying they won't denounce Democratic party leaders or other candidates, won't be argumentative with anyone on social media, and won't speak to the press without explicit approval.

"Your role as delegate comes with a series of responsibilities and requirements," states the Sanders delegate agreement, published by The Washington Post. It includes a social media policy, a code of conduct, and a non-disclosure agreement for delegates.

Failure to follow these policies could lead to "disciplinary action, including but not limited to your removal from the delegation," it states.

"Social media postings have the potential to generate media coverage," notes the Bernie 2020 Delegate Social Media Policy. "If a member of the media contacts you about a posting of any kind: ​do not respond," and instead forward it to Sanders press staff.

Assume everything you post is 'on the record' and will be attributed to the Candidate and the Campaign.

[…] Do your best to avoid online arguments or confrontations. If engaging in an adversarial conversation, be respectful when addressing opposing viewpoints or commenting on the opposition.

[…] Refrain from making negative statements about other candidates, party leaders, Campaigns, Campaign staffers, supporters, news organizations or journalists. This Campaign is about the issues and finding solutions to America's problems. Our job is to differentiate the senator from his opponents on the issues—not through personal attacks.

The Sanders delegate code of conduct contains variations on these same themes.

"I will engage with other delegates, superdelegates, party leadership, and elected officials with respect and a spirit of cooperativeness, even if I disagree with them," states one plank. "I will remain professional even in the face of criticism. I will listen, and not force my opinions on someone if they are not interested in engaging."

"I will acknowledge my own biases and how they might influence me," states another part of the code of conduct. "Biases can influence our decisions, thoughts, and behaviors without us even noticing, until we make a conscious effort to do so."

Chris Liquori, a Sanders delegate from New Hampshire, told the Post, "I think the campaign is trying to avoid, you know, a walkout or some really bad optics a la 2016."

Is it good optics for the Democrats to stifle internal divisions and try to silence members who may be upset with the party's status quo? Not all delegates think so.

"Some of the wording was really stifling what to say," Lori Boydston, a Sanders delegate from Colorado, told the Post. But she said the Sanders people have been willing to talk with delegates about their concerns and try to make changes. "What we really want to do is make sure we're still talking about issues."

But many in the Democratic Party establishment—especially those who've made a hobby of hysterics over "Bernie Bros"—are psyched about the attempt to silence Sanders supporters.


The first U.S. cartoonist to be jailed on obscenity charges has finally completed his probation. Cartoonist Michael Diana was convicted of distributing obscene comics in 1994 (for a comic called "Boiled Angel" that explored the "Gainesveille Ripper" serial murders). After a weekend in jail, a judge sentenced him to three years probation. But a probation violation in 1998 led to a new warrant for his arrest.

"Now, 26 years later, Diana's attorney, Luke Lirot, said Wednesday that his client has finally completed probation," reports the Tampa Bay Times. More:

Diana told the Tampa Bay Times he's relieved. Every time he flies back to New York from another country, he said, he is held up by Homeland Security because of his outstanding warrant. They usually turn him loose upon learning Pinellas authorities won't extradite him over a misdemeanor charge.

He's continued painting and drawing the same things that originally got him in trouble, he said, but now the rest of the world has seemingly caught up. These days he sees Adult Swim shows on the Cartoon Network or images in video games that aren't that different from his 1990s work.

"Everything seems more open now," he said.


Gyms in Ohio will be allowed to reopen, following a lawsuit filed by Ohio's 1851 Center for Constitutional Law on behalf of local gyms. In a Wednesday ruling, "Lake County Court of Common Pleas Judge Eugene Lucci enjoined Ohio Department of Health Director Amy Acton from penalizing the plaintiffs or similar businesses for violating the lockdown, provided 'they operate in compliance with all applicable safety regulations,'" notes Jacob Sullum.

"The director has no statutory authority to close all businesses, including the plaintiffs' gyms, which she deems non-essential for a period of two months," opined Judge Lucci. "She has acted in an impermissibly arbitrary, unreasonable, and oppressive manner and without any procedural safeguards."

• New data on U.S. fertility finds that teen birth rates continue to plummet. "The birth rate for teenagers aged 15–19 declined by 5 percent in 2019 to 16.6 births per 1,000 females," the Centers for Disease Control and Prevention (CDC) reports. That's a 60 percent decline in teen births since 2007 and a 73 percent decline since the teen birth peak in 1991.

Birth rates were down in older age groups, too, marking record lows for U.S. 20-somethings. For women in their early 30s, the 2019 birth rate remained relatively unchanged; it increased slightly for women in their late 30s and early 40s. See Reason's Ron Bailey for more details.

• A new poll shows Joe Biden easily beating Trump in the 2020 election. The Quinnipiac University poll, conducted May 14-18, found voters preferred Biden to President Donald Trump 50 to 39 percent. "Democrats go to Biden 88—5 percent, Republicans go to Trump 87—8 percent, and independents go to Biden 47—36 percent."

    An FBI offer to pay former British spy Christopher Steele to collect intelligence on Michael Flynn in the weeks before the 2016 election has been one of the more overlooked revelations in a Justice Department inspector general’s report released in December.

    The reference to the FBI proposal, which was made in an Oct. 3, 2016, meeting in an unidentified European city, has received virtually no press attention. But it might have new significance following the recent release of government documents that show that Steele peddled an unfounded rumor that Flynn had an extramarital affair with a Russian woman in the United Kingdom.

    The FBI offered to pay a private investigator to investigate an American citizen they considered a political enemy. They had no probable cause or legal way to open an investigation themselves, so they tried to use tax money to get a private investigator to do it for them.

      The polls of party affiliation are pretty consistently around 35% I, and then 30% R and D with the remaining five percent switching back and fourth between the three categories pretty much at random.

      So that poll over samples Democrats by around 6% and Republicans by 4%. In other words, it over samples Democrats by 1/5th more than what they actually are in the country (36% rather than 30%). That means Biden’s 50% in that poll is more likely 40% in reality. Meanwhile, it under samples Republicans by 1/7th. So that means Trump’s 39% is more likely around 45% in the actual electorate.

      But that is not all. Trump has a consistent and large enthusiasm lead over Biden. Poll after poll shows around 55% of Trump supporters are “very enthusiastic” to vote for him while less than 40% of Biden’s supporters say the same. Only 15% of Trump supporters say they are not enthusiastic at all to vote for Trump while a quarter or more Biden supporters say that.

      Put it all together and it looks like Trump has a very significant lead among the actual electorate.

                One of the real messes that could happen but never has is a major party nominee dropping dead in September before the election. It is highly debatable whether a party could get another person on all of the state ballots in time to replace a dead nominee. It would be a complete cluster fuck.

                Maybe the Democrats figure they are going to lose anyway and want such a cluster fuck as a way of stealing the election or claiming a Trump win is not legitimate. That is a possibility. But, once Biden is the nominee, they won’t be able to replace him without going through an enormous cluster fuck that might result in their replacement not even being on the ballot in a lot of states.

                I don’t think they will do that. I think they are going all the way with Biden.

Though it would be novel, I can’t imagine that there are laws that would bar the vice-presidential nominee from appearing on the ballot as their party’s nominee for President.

                  Such an example has to have happened before in elections for lower offices; how was it handled in those affected states?

I think it was the Atlantic (I read it a few weeks ago but can’t find it in their search) that recently wrote an op-ed that all the Dems need is for Biden to survive long enough to win. They just need to Weekend at Bernie’s past the finish line so that he can sit in a corner and drool while the enlightened members of the party make up all the policy for him. It was stunning. 320 million plus people in the country to choose from and they literally need to write articles like that as the best argument they can make about their candidate.

                  2. Because the VP is running for their own office. The VP and the President are two separate office with two separate elections. Being on the ballot as a VP doesn’t get you on the ballot as a President.

                    For the bait and switch plan to work, it has to be like Speechless describes it where Joe wins the election and is sworn in and then either resigns or is run out of office. Then the VP candidate assumes the office.

There is strong social pressure, especially when dealing with universities, to dislike the man or if you do support him, to do so reluctantly or with excuses. In a situation where a person has significant social pressure for one side or the other, no poll is valid.

        Please note that there are 17% no-choice for independents, compared to 6% Republican and 7% Democrats. Given that there is a strong social pressure to not say that you support Trump, that would suggest that the majority of these no-choice responses are going to Trump.

    A paper published on 30 January in The New England Journal of Medicine (NEJM) about the first four people in Germany infected with a novel coronavirus made many headlines because it seemed to confirm what public health experts feared: that someone who has no symptoms from infection with the virus, named 2019-nCoV, can still transmit it to others. That might make controlling the virus much harder.

    Chinese researchers had previously suggested asymptomatic people might transmit the virus but had not presented clear-cut evidence. “There’s no doubt after reading [the NEJM] paper that asymptomatic transmission is occurring,” Anthony Fauci, director of the U.S. National Institute of Allergy and Infectious Diseases, told journalists. “This study lays the question to rest.”

    But now, it turns out that information was wrong. The Robert Koch Institute (RKI), the German government’s public health agency, has written a letter to NEJM to set the record straight, even though it was not involved in the paper.

    The letter in NEJM described a cluster of infections that began after a businesswoman from Shanghai visited a company near Munich on 20 and 21 January, where she had a meeting with the first of four people who later fell ill. Crucially, she wasn’t sick at the time: “During her stay, she had been well with no sign or symptoms of infection but had become ill on her flight back to China,” the authors wrote. “The fact that asymptomatic persons are potential sources of 2019-nCoV infection may warrant a reassessment of transmission dynamics of the current outbreak.”

    But the researchers didn’t actually speak to the woman before they published the paper. The last author, Michael Hoelscher of the Ludwig Maximilian University of Munich Medical Center, says the paper relied on information from the four other patients: “They told us that the patient from China did not appear to have any symptoms.” Afterward, however, RKI and the Health and Food Safety Authority of the state of Bavaria did talk to the Shanghai patient on the phone, and it turned out she did have symptoms while in Germany. According to people familiar with the call, she felt tired, suffered from muscle pain, and took paracetamol, a fever-lowering medication. (An RKI spokesperson would only confirm to Science that the woman had symptoms.)

She didn’t. The key to winning elections is to get people out to vote for you. But Hillary couldn’t get people excited enough to go find a polling place.

They were left with nothing.

      2. I live in PA and as a small business owner I applied for the PUA unemployment benefits which is a different website and system than the normal PA unemployment. It took them almost 2 months from the cares act passing to get the website up, and then it took another 3 weeks from then to actually be functioning enough to accept weekly claims. So anyone in PA who owns a business and is ineligible for normal unemployment had to wait nearly 3 months to see anything.

        Also in PA the normal unemployment website was overrun and shutdown due to traffic increases. Then after questioning the state admitted it hired a contractor in 2014 to update the state unemployment system by 2018. They never finished it, and after 6 years of failing to complete the project which is 2 years behind schedule, the state announced it wouldn’t penalize the contractor…
