Public Health Measures Enforced by Violence Aren't as Healthy as Governments Pretend
When will Americans learn?

Was it really just a few years ago that Americans started to agree that cops are too militarized, too in-your-face, and too likely to target people who can't fight back? When legal experts warned that law is always violent and cautioned that we needed to think twice before making rules to be enforced by armed police?
For a brief time, we seemed to be taking the dangers of official force to heart. Then the pandemic came along, and we started repeating all the old mistakes. Now, rulers and the public are learning, again, that it's unlikely you'll make the world a better place by twisting people's arms.
As COVID-19 spread across the country, and states and localities tightened the screws on what people were and were not allowed to do as part of efforts to limit viral transmission, politicians quickly went to their happy place: threatening people with violence for not doing what they're told.
"My message to the Jewish community, and all communities, is this simple: the time for warnings has passed. I have instructed the NYPD to proceed immediately to summons or even arrest those who gather in large groups. This is about stopping this disease and saving lives. Period," New York City Mayor Bill de Blasio threatened, infuriated that city residents weren't marching in lockstep to his dictates.
His soulmate in Chicago, Mayor Lori Lightfoot, took a similar tone. "Don't make us treat you like a criminal, but if you act like a criminal and you violate the law and refuse to do what's necessary to save lives in the middle of a pandemic, we will take you to jail. Period," she snarled in response to reports that some people continued to attend house parties.
Threats to arrest people for violating stay-at-home orders are especially ironic, given reports of rapid contagion in crowded jails and prisons. Mass imprisonment, it seems, isn't a great public health tactic.
Even before unhygienic cells enter the picture, arrests of social-distancing scofflaws are perilous, too.
Cops across the country busted people for "social-distancing violations" including hanging out with friends, playing with their children in public parks, and failing to wear face masks. Police in Brooklyn "cuffed a mother and pinned her to the ground" because her mask was around her neck instead of over her nose and mouth.
Everybody is potentially on the receiving end of such treatment, but cops always lean most heavily on the people they prefer to target—often members of minority communities who are less able to push back.
"Of those arrested, 35 people were black, four were Hispanic and one was white," The New York Times reported after a spate of especially brutal enforcement of rules allegedly intended (we were told) to protect people's health in New York City.
All of this, every bit of it, could have been predicted by anybody paying attention to discussions about laws and law enforcement over the previous decade.
"On the opening day of law school, I always counsel my first-year students never to support a law they are not willing to kill to enforce," Yale Law School's Stephen L. Carter wrote in 2014 after New York City cops killed Eric Garner during a confrontation rooted in suspicion that he was illegally selling loose cigarettes. "I remind them that the police go armed to enforce the will of the state, and if you resist, they might kill you."
Carter penned his piece as legal experts and journalists warned that the country has too many laws and too much law enforcement. An estimated 70 percent of Americans have committed a crime that could land them behind bars, Rutgers University's Douglas Husak wrote in his 2008 book Overcriminalization: The Limits of the Criminal Law.
The cops hired to put all of those Americans behind bars were increasingly trained and equipped more like an army of occupation than like keepers of the peace and are deployed accordingly, as former Reason staffer Radley Balko pointed out in Rise of the Warrior Cop: The Militarization of America's Police Forces.
"We can see cops stopping and arresting people, roughing people up, and administering street justice. We think, 'Good. They're getting the bad guys off the streets,'" Balko commented at the 2017 Reason Media Awards ceremony. "What we don't see: The orders from mayors and senior officials in cities like Baltimore, St. Louis, and Chicago for police to initiate mass arrests, usually for petty offenses, sometimes for no offense at all."
But we are seeing that with a vengeance now, in terms of arrests of "bad guys" guilty of failing to put a bit of fabric over their faces, or of spending time with friends in defiance of edicts to the contrary. Of illicitly reopening businesses they hope to save, or of venturing out for sunshine and open air when politicians have commanded that they stay confined to their homes. In the name of public health, of limiting contagion, and saving lives, government issues edicts to be enforced by those who "go armed to enforce the will of the state."
That turns out to be not so terribly health-friendly, some officials belatedly concede.
"What we've been doing is we really are encouraging education and voluntary compliance," Seattle Police Chief Carmen Best said last week after discussing the risks of jamming people into jail cells where they're likely to get infected. "But we also know that we can't arrest our way out of a pandemic."
"Absent a serious danger to the public, NYPD will not take enforcement actions for failing to wear face coverings," Mayor Bill de Blasio announced after a flurry of videos of people having their health protected by cops grinding their faces into concrete. This, just weeks after he threatened mass arrests.
That's a welcome, though hardly universal, reversal among government officials whose go-to reaction is always to punish dissenters and force compliance with rules, even when that leads to a chain of worsening consequences. Maybe this time the contrast was too great between public health goals and decidedly unhealthy criminal enforcement. Flattening noses, after all, isn't synonymous with flattening the curve.
I'd like to think that we'll take a lesson from this and back away from a reliance on laws, orders, and edicts which must be enforced with violence that exacts a bloody toll of its own. More likely, though, the next crisis will yet again feature officials shocked—shocked!—that their efforts to impose their will have costs measured in violence, injuries, and death.

It is so sad to see supposed libertarians revert to name calling. But M. Kirkland is correct when he posits that there is some hypocrisy going on here in terms of the moralists claiming to be conservatives. Conservativism, however, is based on a long view of finite resources. To the extent that a conservative views the population as a depletable resource, it follows that anti abortion measures might in fact be conservative... until you see the other side of the coin which is that the very act of engaging the machinery of government to enforce a high cost oversight program on private, personal reproductive decisions (regardless of how you look at them from a moral perspective, they ARE private AND personal) you deplete more of another scarce resource, and that is governance capital. With respect to border walls, it is ironic to say that on the one hand depopulation of the country is a problem warranting a hard line on reproductive choice, yet a source of population replenishment also must be cut off at the border. It is ironic but not hypocritical, as there is a peculiar moral hazard when it comes to the type of individuals who MAY be seeking to enter the country illegally. The moral hazard of exploiting a system where the sovereign who is providing for their welfare is not the sovereign to whom they own their life's loyalty and diligent efforts to obey that sovereign's laws, honor it's cultural normal, and respect it's society.
So in terms of how the state should be operating, we can say quite simply that anyone who is not in favor of doing away with the broken machinery of government, an allowing impacted communities are allowed to weigh individual merit on a case by case basis, is a statist. But here's the problem. These people who are calling names and cyber-bullying in these comments... these are the very people who would usurp the judgement of the community and bend it to a particular self-serving direction -- either a moralist direction or one based on profiteering (e.g., keep out cheap immigrant labor to bolster inflated domestic wages). When you have an "educated" society (everyone here knows how to read and write and least!) capable of such idiocy, then the difference between being a statist and a libertarian is that in both cases we eat the crap sandwich, but in the case of the former, it's the government bullying everyone, and in the latter, it's the local sociopaths bullying the people who don't advance their interests.

If the measures are not enforced by violence, then they are not public health measures. That is what the government does; tells people to comply with edicts and uses violence on them if they don't. If you are not comfortable with that, then you should not want the government involved at all.
So the problem here isn't that the government is enforcing public health measures with violence. The problem here is that those health measures are no longer important enough to justify using violence to enforce them. If you have a problem with someone being sent to jail for doing something, then don't run to the government and ask it to try and stop it. It is really that simple.

I can never get a straight answer. Are the lockdowns about defeating DEATH PLAGUE 2K19 or just making sure the hospitals aren't overwhelmed? Because every time I point out that the lockdowns don't seem to be doing squat in containing the virus (perhaps because bandanas, surgical masks, and other random face covers that aren't N95-grade masks don't meaningfully impede virus transmission) I get told that it's really about reducing strain on the hospitals, but when I point out that hospitals are all fucking empty because people are afraid of catching DEATH PLAGUE 2K19 at them I get told that the lockdown is about defeating the virus.

Balko shouldn't speak or write about excess force ever again, given his wholesale support of shutdown measures (not to mention disdain for those who opposed them), which, as a commentator above points out, could not have happened without the threat of . . . excessive force.
There are no public health exemptions to our Constitutional Rights. When you order a sick person to stay home, it's a quarantine. When you order millions of healthy people to stay home, it's mass house arrest. That is a clear violation of the Fifth Amendment - "nor shall any person... be deprived of life, LIBERTY, or property, without due process of law" If they held 300 million hearings before a judge, I didn't hear about it and I sure missed mine.

I would also question to specific issues:
1) There is a claim that the city officials required nursing-home patients to be returned to those homes from hospitals; if true, that is pretty much guaranteed to be an infection- (and death) multiplier.
2) I want to see the guidelines defining death from the flu.
Suffice to say, absent some solid explanations, no statistician is going to accept one metropolitan area as the locale of 25% of the national cases and deaths.
Truly. We could have taken no action at all and been better off than we are now.
Government screws up everything it touches. I don't want it getting involved in anything more than what it does... well, of course, I don't want it involved in most of that either. Government doesn't solve problems... it is the problem.

The left isn't really concerned about police overreach, just as they never cared for abused women when they accuse democrats. It's all about politics and fetish on racial issues.
Since most of the shutdown protesters are white and nominally "pro Trump", they will receive no sympathy from the media. If a cop arrests a mother for playing with her daughter at an empty playground, it becomes some muted local news. A republican governor urging citizens to snitch on undocumented aliens would be derided as the next Hitler, but if Blasio does the same on social distance violators and threatens Jewish communities, it will go unnoticed.
What more can be said? Half the nation is incapable of perceiving injustice if it doesn't involve race or gender. The FBI lied to put surveillance on a political opposition, and the media barely raised an eyebrow. The left thinks the shutdown is noble cause to save grandma's life that's worthy of sacrifice. They were, and always will be, collectivist. Their obsession on race is ethnocentrism, not individual autonomy.

DeBlasio is the criminal after waiting weeks to announce a lockdown in the city with the greatest number of highly susceptible people, he precipitated the most rapid rise in contagion seen in the US (perhaps in the world) . Now five weeks later the rate in NY is down to pre-lockdown levels. BUT that level is still twice the rate of that in CA which has twice as many people.
I think many believers will be asking if it was all worth it once we get passed this and the hindsight glasses come on.
