A 69-Year-Old Great-Grandmother Was Arrested at Disney World for Carrying CBD Oil
She uses it for her arthritis.

Disney World—where kiddie coasters, cartoon royalty, and overpriced food options abound—is colloquially known as "The Happiest Place on Earth."
Hester Burkhalter would likely disagree. The 69-year-old great-grandmother was arrested outside of Magic Kingdom and spent 12 hours in jail last month after security officials found CBD—short for cannabidiol—oil in her purse. The compound is derived from cannabis but does not contain the psychoactive component, THC, found in marijuana.
In other words, it can't get you high. But it supposedly can alleviate a plethora of medical conditions, including joint pain and anxiety.
"I have really bad arthritis in my legs, in my arms and in my shoulder," Burkhalter tells Orlando's local Fox affiliate. "I use [CBD oil] for the pain because it helps." She reportedly had a doctor's note in her purse when security officials flagged her, but law enforcement detained her regardless.
While the charges have been dropped, Burkhalter's attorney, Ben Crump, says he plans to sue Disney and the Orange County Sheriff's Office on her behalf, alleging "illegal detention, false arrest and a violation of her civil rights," WESH 2 reports.
Her misfortune sheds light on the murky legal territory surrounding CBD use, as regulations often conflict and as people increasingly flout local restrictions on the harmless substance. The Farm Bill—signed by President Trump in 2018—legalized hemp and CBD at the federal level. In Florida, it remains illegal without a prescription, although CBD-infused cocktails and shops selling the compound continue to pop up across the Sunshine State.
"Today in Orlando, we were able to go into the store and buy CBD," said Crump—who also represented Trayvon Martin's family—at a press conference last week. "It's all over Orlando. It's all over Florida."
CBD use remains a point of contention even in places that have legalized marijuana. In California—where cannabis use is permitted both medically and recreationally—public health officials seized $140,000 worth of CBD-infused drinks from Vybes beverages.
That same cognitive dissonance is alive and well in Florida. "A little drop of oil, with the CBD, is a felony," Jennifer Synnamon, a Florida attorney, told the local Fox affiliate. "Meanwhile, you can have up to 19.9 grams of leaf-marijuana, and it's a first-degree misdemeanor."

What is the threshold age for this being outrageous? If the grandma was 55, would it still be equally outrageous?
More so, because great grandma would have had her at 14.

It's outrageous at any age.
Law suits against Disney and "the authorities" strike me as more than a little appropriate, though respecting suits brought against law enforcement, "immunity"of one kind or another they perhaps improperly enjoy might work as an undeserved shield.
Another question is the following:
How is it that “security officials”, or any other manifestation of bureaucracy run wild that afflicts this country happened to search the ladies handbag?
It was literally a gateway drug in this case.
Why doesn't CBD oil contain THC?

CBD can be made from Cannabis or from Hemp. The preferred brand uses cannabis. The THC (psychoactive) element can be either THC-A or THC. THC-A is not psychoactive while THC is. The reason CBD from Cannabis is preferred is due to a benefit called the entourage effect. This is the combination of THC, Terpenes, and CBD These elements (other than CBD) are not found in Hemp. BTW, While THC-A won't get you high, it will certainly reduce inflammation, and provide on the spot pain relief.
I used a bottle of CBD -- I don't think it affected me positively or negatively.
Hemp is cannabis. The distinction between hemp and marijuana is purely legal and has only to do with THC content.
Outrageous. And shocking that they found it in her purse. My wife's purse was hardly glanced at when we went to Epcot in March; even she can't usually find what she wants in her purse, there is so much in there.
Maybe it was Grandma's pot leaf hand bag that instigated a deeper look.
Perhaps, but I do not see how having something like that could justify a reasonable suspicion. It's not hard to imagine people who like the way marijuana leaves look, or think that marijuana should be legalized, but nonetheless don't use it themselves.
Seriously, I was digging through my wife's purse last summer looking for a snack for my kid and I found a Blockbuster gift card. "Oh, I guess I need to clean my purse out."
My daughter-in-law was denied entry at Disneyland, in Anaheim, because they found a tube of ointment, that contained CBD, until she took it back to her room at the Disney hotel.
And this was after California had legalized marijuana.
Silly grandma. She should have known to decant it into an old liquid aspirin bottle.
BTW, can sniffer dogs detect CBD oil? Asking for a friend.
Just a wild guess, but probably so. I'm not sure if it's the THC in the pot the dog is smelling. It's probably the whole thing, plant, fibers etc.

Considering the frequent claims of sensitivity for drug dogs well below 90% specificity, there's a very real question about whether the dog isn't just smelling that his owners really want to search the purse whether it's got drugs in it or not.
Since you can't face your accuser and elicit their testimony, evidence detected by a dog should never have been allowed in a courtroom.
Animals can pick up on the most subtle of indications by the one the get rewarded for pleasing. There is no way to know if that is what the dog is reacting to.
You sure don't get to ask them.

Dogs are useful for finding things you want to find. Not for establishing that the thing you want to find is present. They should be used only after probable cause for a search has been established.
Sniffer dogs can detect whatever the handler tells them to detect.

I'm not sure where Disney is liable and the story doesn't clarify it. All we know is that she was arrested outside Disney World...which means NOT on Disney property.... and she's suing them anyway. This smacks of a sleazy money grab by an unprincipled attorney.
The bag screening is most certainly done on Disney property. Given their profile, its not the least bit shocking they looking for obvious signs of weapons or explosives. I am surprised they identified this liquid as CBD oil; I'm guessing it was still in the original bottle. If FL law is unclear as alluded to, I'm sure Disney will err on the side of over precaution. I struggle to see how she would have a credible case against Disney.
Is anyone going to ask how the hell they new she had this "illicit" substance on her? What she searched? Did a drug-dog point her out? did she just volunteer this information n casual conversation? Was she overheard talking about it? Wtf?
Is it a mandatory search for admittance? If so, was the product purchased in FL? If so, wouldn't it be logical to assume it was legal? If not purchased in FL but in a state where it is legal how is anyone going to know all the tens of thousands of laws of each state? Not even LEOs know the law, much less care; they just go by their prejudices as if they were the law and the public lets it happen.
The security guard could have refused admittance and sent her on her way on confiscated the oil until she exited or ignored it.

Drug legalization--the fig leaf issue for libertarians who have turned into progressive statists.
I don’t think you can be a libertarian and a progressive statist at the same time. That would be like being an atheist Christian fundamentalist.
But I guess what you’re saying is some progressive statists claim to be libertarian to sound cool simply based on their stand on drug legalization and nothing else.
The idea that someone would pretend to be libertarian to seem cool seems pretty absurd.
Pretty much no one besides libertarians supports drug legalization in general anyway. A lot of progressives support limited legalization of marijuana, but that's where it stops for the most part. Some might want to decriminalize posession of harder drugs, but almost none want legalization.
After grandma's arrested, jailed at Disney for carrying CBD oil, I have no idea if I can legally order it or not. CBD oil is legal in America, but at the same time not. If that makes sense… Which it doesn't. Is mailing CBD oil legal?
