Kamala Harris Says Her Opposition to Marijuana Legalization Is 'Not True.' We Have the Receipts!

For most of the presidential candidate's political career, she was absolutely dead set against full legalization.

Democratic presidential candidate and California Sen. Kamala Harris stopped by I Heart Radio morning show The Breakfast Club for a chat about her campaign ambitions. She found a friendly questioner in Charlamagne tha God, and they talked at length about the kind of attacks she's been facing over her record as a former prosecutor in San Francisco and the state's attorney general.

Part of the interview appeared to be a bit of straw man attacking, or at least time spent on claims that weren't actual critiques of her record. There's apparently a meme out there that states that Kamala Harris as a prosecutor "set a state record" for prosecuting black men. I can find little evidence of this meme online other than a single picture and a response on Medium from somebody saying that this likely isn't true. California's prison population declined during the time that Harris was attorney general.

There are a lot of legitimate critiques of Harris' background as a prosecutor, so picking the most absurd claim to give her space to hit back on is a little odd. In addition, he lets her weigh in on some absurd claim out there that she's not really black and was raised in Canada. The 44-minute interview does delve into a few more issues, and he gives her space to promote the criminal justice reforms she really does support. She mentions crafting legislation to try to eliminate the use of cash bail in the states—an effort on which she's partnered up with Sen. Rand Paul (R-Ky.) to try to send federal grants to states to research changes.

But then things get truly odd when Charlamagne funnels her into pretty much flat-out deceiving us about her record on marijuana legalization. Here's the clip:

For those who can't watch, Charlamagne says there's a rumor going around that she's against marijuana legalization and she says that's "not true." If you listen carefully, the two of them are circumspect about how they're approaching this. They are talking about Harris' current position on marijuana legalization. She states very clearly that she is in favor of legalizing marijuana.

But that's a significant change of her position in the last 10 years, and the show simply does not grapple with any of it, treating Harris as though she's ahead of the curve on legalization.

She's not. She is playing catch-up and has been publicly supporting legalization for all of a year.

Harris has a lengthy history as a prosecutor in California of opposing marijuana legalization. She opposed Proposition 19, the first failed attempt in California to legalize recreational use of marijuana. Here's a quote from her campaign manager when she was running for attorney general in 2010, when Prop. 19 was on the ballot: "Spending two decades in court rooms, Harris believes that drug selling harms communities. Harris supports the legal use of medicinal marijuana but does not support anything beyond that."

In 2014 she actually laughed at a reporter in response to the very idea (pushed by her Republican opponent) of legalized recreational use.

For almost the entirety of Harris' political career, she has been against legalizing pot. Like a lot of politicians, she has only recently come around to recognize the reality that whatever damage marijuana use might cause pales in comparison to the harms created by the government enforcing marijuana laws.

It's not all that much different from various Democratic leaders coming around over the past decade to support same-sex marriage recognition. The issue here in this interview is that Harris is clearly wanting to present herself as being some sort of cutting edge candidate (she admits to smoking pot once in college) when her actual record on marijuana is anything but.

          1. Drug legalization has been heavy opposed by Democrats and the left in general. Whites and affluent people of color of the correct political persuasion have nothing to fear when toking up. Everyone else can go suck bong water as far as the Democrats are concerned.

            Back during the first marijuana initiative in California, I was genuinely shocked at the number of my left leaning friends who were adamantly opposed to the idea. Those who weren’t were overjoyed by the notion of something new to tax. Literally no one within the political activist sphere gave a shit about the freedom and liberty issue. It was either giving too much freedom to people or a new source of revenue. Non-political types were different. When medical marijuana was legalized, San Francisco still managed to zone it out of existence for much of the first two years.

            The left is NOT friends with freedom, not even freedom to ingest herbs that everyone and their grandma know is perfectly safe.

          Hillary is a consummate political veteran, Obama campaigned extensively for Hillary, and she outspent Trump by about 4:1.

          The media pretty much daily ran negative pieces on Trump, there was a “Nevertrump” movement in the GOP.

          And she *still* lost to Trump, losing 5 states that Obama had carried twice.

    I may have my timeline wrong, but wasn’t the decline in prison population under Harris to due the federal government telling California that their prisons were way too overcrowded and needed to start release low level offenders? If so, how in the hell does she get credit for that?

    1. She’s not getting credit for it, but it does mean it would be very hard to back up an accusation that she “set a state record” in prosecuting black men.

      1. Prosecution doesn’t always lead to prison time, though.

              “I think they don’t understand who black people are,” Harris replied. “I’m not going to spend my time trying to educate people about who black people are. Because right now, frankly, I’m focused on, for example, an initiative that I have that is called the ‘LIFT Act’ that is about lifting folks out of poverty,” she said, detailing her plan for a $6,000 tax credit for middle class Americans.
              “I’m black, and I’m proud of being black,” she said at a later point in the interview. “I was born black. I will die black, and I’m not going to make excuses for anybody because they don’t understand.”

        A California prisoner in another state should be under no authority of that other state. That other state has no authority over that conviction or the prisoner’s appeals. In other words, the prisoner is a slave to another state that did not pass judgment or issue a punishment.

        If states want to make everything illegal and lock people up, then that state needs to pay for it and be responsible for housing the prisoners…legally.

        100% unconstitutional if you ask me.

        After spending hundreds of millions of dollars (outspending GOP by 2-1 by some reports), with huge chunks backed by billionaires like Tom Steyer and Michael Bloomberg, Democrats did indeed retake the House.

        Before the election, Congress was 51-47-2 in the Senate (GOP-Dem-Ind) and 235-193-7 (GOP-Dem-Vacant) in the House. After, is 53-44-2 in the Senate and 199-235 in the House. Republicans lost 41 seats in the House and gained 2 seats in the Senate.

        Compare to 1996, in Bill Clinton’s first term. Before the election, Democrats had 53-47 majority in the Senate and 258-176-1 majority in the House. After that election, Republicans had a 52-47 majority in the Senate and a 228-206 majority in the House. Democrats lost 52 seats in the House and 1 in the Senate.

        In Obama’s first term, before the 2010 elections, Democrats had a 56-42-2 majority in the Senate and a 255-179 majority in the House. After the elections, they had a slim 51-47-2 majority in the Senate and a 193-242 deficit in the House. Democrats lost 62 seats in the House and 5 in the Senate. They would go on to lose the Senate majority, too, in 2014.

  13. It’s obviously too early to start making bets, but Harris seems most likely to be the favorite Democratic contender – at least among the female candidates. Not that I like any of them. I didn’t vote for Trump – I voted for Gary Johnson.

    Not sure i can bring myself to vote for Trump, but I have real concerns about how far left many Democrats have moved.

  14. What makes me mad is when people, like in the above video, defend pot legalization for all the wrong reasons. They always say it should be legal because the laws against it hurt minority groups “disproportionally.” It’s like people can’t even give a good argument(and I think there is one) without playing the race card.

      Is in not enough to say that legalization of a widely used (and highly beneficial) plant would be good for everyone involved for all sorts of reasons?   21. Democrats will say absolutely anything to get elected. Just look at how often Clinton changed her position depending on her audience. She flipped so often that interviewers had to frequently ask where she stood on any particular issue because they genuinely had no idea.
    Harris is exactly like every other Dem. She will shift and squirm all the way to the primaries. If she is eventually confirmed as the democratic nominee, her own record will destroy her. Trump will certainly win in 2020. His own economic record will ensure this.

  24. She used to be always to the right of the far left group that she hung out with. Remember, President Obama also said he was against legalization. Democrats have always played coy with that issue to avoid giving rabid Republicans an easy target. Now, since the political landscape has changed, she is changing her tune, which is not a surprise. What is alarming is her recent embrace of some fairly far left positions, and I think she believes that big government is the solution to all our problems. That change in her political stance dwarfs any concerns that I may have about her originally opposing legalization of marijuana. President Trump promised to legalize marijuana, then hired Jeff Sessions. That didn’t work out at all! I still see 0 action from the Trump administration on this issue, despite his previous promises. Guess he wants to please the religious crowd more than he cares about keeping his word. I would rather see some one flip flopping towards personal liberty than the other way around.
