New Restrictions on Vaping, Trans Fats, Food Labeling in FDA Commissioner's Agenda: Reason Roundup
On the upside, agency promises to review over-the-counter drug rules, approve more new drugs, and liberate French dressing.

The FDA's new regulatory agenda. The U.S. Food and Drug Administration (FDA) is proposing a slew of changes to food, medicine, and e-cigarette regulation, with very few bright spots. Top items on Commissioner Scott Gottlieb's upcoming food and tobacco agenda include declaring war on e-cigarettes, banning all partially hydrogenated oils (a.k.a. trans fats) in food, further micromanaging the use of the word "healthy," and reconsidering some food standards laws.
The only potential upside there from a deregulatory perspective is the last point, which would could cut down on what Gottlieb calls "old-fashioned" and burdensome requirements. These "standards of identity" rules have driven recent controversies over vegan mayo and almond milk. Gottlieb has previously supported increasing enforcement of such laws when it comes to milk, aiming to exclude nut, seed, and other plant-based products—and even animal milk that doesn't come from a cow—from using the milk label. But his agenda shows interest in revoking outdated standards of identity for French dressing and frozen cherry pie.
When it comes to trans fats and food labels, Gottlieb writes,
we're following up our earlier actions on partially hydrogenated oils in foods with a rulemaking that proposes to remove the remaining uses to further reduce deaths from coronary heart disease. We're also working on updating the definition of the claim "healthy" on food labels so it reflects current nutrition guidelines and to encourage its use.
On smoking products, including e-cigarettes, Gottlieb promises "aggressive steps to address the epidemic of e-cigarette use among youth, through our Youth Tobacco Prevention Plan. This comprehensive plan aims to stop youth use of, and access to, tobacco products—especially e-cigarettes. Significant regulatory and research efforts related to access, marketing are already underway and new steps are forthcoming." He also mentions "standards for characterizing flavors in tobacco products; requirements for tobacco product manufacturing practices; implementing product standards for testing battery safety and battery management systems of e-cigarettes; creating registration and product listings for tobacco products; and, administrative detention of tobacco products."
Last week, the FDA sent out a warning to HelloCig about Viagra and Cialisis containing vape products.
Meanwhile, local news programs and "wellness" gurus are touting the benefits of vaping your vitamins.
Gottlieb does offer some potentially positive changes on the health device and drug approval front, including:
- "exploring the amending and/or repealing of existing medical device software regulations to create brighter lines between products we actively regulate, and those that don't fall under our purview," and
- "rulemaking to broaden the kinds of drugs that can be made available without a prescription."
So far in 2018, "the FDA has approved 45 novel drugs and biologics, close to our total of 46 in 2017, which was the most approved in more than 20 years," the FDA commissioner notes.
We have record-setting numbers for the total amount of generic approvals in a fiscal year, with 971 total approval actions, including 781 final approvals, and 190 tentative approvals. These totals include 95-first time generic approvals.
This week, an FDA panel preliminarily approved "a new kind of opioid for pain," sufentanil, that "is five to 10 times more potent than fentanyl….The panel vote is not the final step of approval, but the FDA regularly follows the committee's lead." The nod of approval to the sublingual synthetic opioid is already causing controversy but it may offer rapid pain relief to patients who have trouble swallowing.

A Walmart food-safety exec will head the FDA's new Office of Food Policy and Response. In other shakeups at the FDA, Stephen Ostroff, deputy commissioner for foods and veterinary medicine, will retire in January 2019. His role—"a significant food safety and nutrition post at the agency," according to Politico—will be filled by Walmart VP of food safety Frank Yiannas, who's been pushing blockchain tech's role in preventing food contamination.
"Yiannas' role will be different than Ostroff's, with a new title that reflects an ongoing effort to reorganize FDA so the heads of centers, such as the Center for Food Safety and Applied Nutrition, report directly to the commissioner instead of to deputy commissioners," Politico reports. He'll head a newly created Office of Food Policy and Response, pending the conclusion of an ongoing review process.

FDA asks for comment on global cannabis restrictions. Last week, the FDA put out a public announcement seeking comment on marijuana reclassification as it relates to international drug treaties. "So far, the agency says it has received more than 2,100 comments—a small fraction of which have been published," reports Marijuana Moment.
The comments range from personal anecdotes about how cannabis has helped patients to arguments about the economic benefits of legalization. Others put the issue more bluntly:

…The comments will be considered as the United States responds to the United Nations World Health Organization. That response will help inform the international group on "whether to recommend that certain international restrictions be placed on these drugs" or whether that should be reclassified under international drug treaties.

Wow, see the Off-Label Intended Use Rule nx? This is something I'd not known was in the works, arose from a vape case, & IS FUCKING HUGE!! The rule at issue is whether the feds can treat off-label uses of products as "intended"; this is how they go after a vast # of products, based on purveyors' knowledge of consumer knowledge of uses of such products. If we can get this single under-the-radar change accomplished, it will vastly deregulate food & drug law in this country. It'll accomplish much more than most of the supposed deregulatory moves being touted.
Do you realize how much freedom we'll have if we can get authorities to limit what they consider intended uses of products to just those on the label? Or even to those advertised?

I'm in the trucking business and while we have not seen regulations eliminated, existing rules are are being modified in ways that have benefited my little business greatly. And Obama regulations in the pipeline seem to be on hold. So from my business perspective Trump is doing what he promised to do. On the other hand this FDA guy, after a promising start, is turning out to be another asshole statist. Still better than what we would have had with Clinton so far. I'm hoping Trump shitcans this clown after the midterms but I see no indication that he will. .

While it's true that civil liability can and does act as a deterrent to negligent behavior and insurance companies encourage their policy holders to act proactively to prevent certain things, it is also true that criminal negligence, from reckless endangerment to negligent homicide, is a real libertarian thing. Anyone who thinks libertarians don't think people should face criminal penalties for violating other people's rights doesn't know anything about libertarians.

There are all sorts of problems with labeling.
For one, it's expensive and becomes a barrier of entry into the market, or, in other words, it becomes a means for the government to harass all sorts of people for doing things that shouldn't be illegal.
They already go after people for cooking food at home and bringing it somewhere to feed the homeless. How long before they go after small farmers for selling home made, gourmet ice cream at the farmer's market for not having an accredited laboratory certify every new flavor batch for trans fats or whatever else comes down the pike next week?
If the market cares about trans fats, competitors will differentiate their products by labeling them saying that their products don't have them--and then they'll charge a premium over the competition for the lack of them. At best, forcing labeling is nothing better than inflicting your preferences on others in the market. At worst, it's rent seeking.

I don't disagree with the labeling too much, but it doesn't have to be mandated and, when it is mandated, the labeling and the banning go hand-in-hand de facto. Expiration dates are not really mandated in any real way and, depending on the food, it can and does become acutely toxic much after the expiration date.
Moreover, government mandated labeling is doubly retarded as for every study showing that trans fats are bad, there's at least one government-implemented dietary policy that is/was worse.
CLA is a trans fat that is widely touted as being beneficial to human health, especially heart disease.

Libertarians are against government forced labeling.
As we see now, there is so much labeling that much of it does not mean anything or is not helpful.
Meanwhile every bit of labeling costs the company, therefore the consumer, more money.
Libertarians hate coerced labeling because it distorts the market. Forcing everybody to post calorie counts costs money, and if some people want carb counts and don't care at all about calorie counts, they probably won't be served since the money was already spent.
In a free market, some business wouldn't label anything and pass the savings on to the consumer, others would label calories for people who think that is relevant, other business would post carb counts, etc...
A free market is going to provide what the consumer wants. The government is going to provide whatever pin headed notion gets paid for most effectively.
Speaking only for myself, but my problem is simply that with this or any regulation the government (and lovers of government intervention) just never know when to quit.
It is a lot easier to consistantly label preprocessed packaged food than it is for fresh food prepared on site with a number of different options. Mandating labeling creates an inherent bias for the processed food. It limits choice in an indirect fashion that may not even be intended by the supporters of the policy.

It just seems odd that 3,000 people just up and leave at the same time and if they're slowly building to some critical mass over some portion of time, why don't they have their documents and how, precisely, do you know when the caravan has officially assembled and departed?
If we were talking about 3,000 people in Myanmar, there'd be a village burned to the ground, or similar, and the total population would of the village would've been like 5,000 people or something. When it was a surge of children under one president and a surge of adults under the next, it kinda had the air of randomness. But the fact that these 3,000 people just decide to up an leave at the same time, and that it keeps happening is a bit bizarre and, thanks to the media, unexplained.
