Tonight Donald Trump was asked by Fox News anchor Bret Baier, "What do you think of eminent domain?" Here was the GOP frontrunner's answer:
I think eminent domain is wonderful, if you're building a highway, and you need to build, as an example, a highway, and you're going to be blocked by a holdout, or, in some cases, it's a holdout—just so you understand, nobody knows this better than I do, because I built a lot of buildings in Manhattan, and you'll have 12 sites and you'll get 11 and you'll have the one holdout and you end up building around them and everything else, okay? So, I know it better than anybody. I think eminent domain for massive projects, for instance, you're going to create thousands of jobs, and you have somebody that's in the way, and you pay that person far more—don't forget, eminent domain, they get a lot of money, and you need a house in a certain location, because you're going to build this massive development that's going to employ thousands of people, or you're going to build a factory, that without this little house, you can't build the factory—I think eminent domain is fine.

Baier: In 2005, you said you agree with the Kelo case in the U.S. Supreme Court 100 percent. And that basically upholds eminent domain, and—
Trump: If eminent domain—number one, a person has a house, and they end up getting much more than the house is ever worth. You know, eminent domain is not like you—they take yours…. [some Club for Growth insults redacted here]
So. If you have a road or highway, you gotta do it. If you have a factory where you have thousands of jobs, and you need eminent domain, it's called economic development.
Baier: Bernie Sanders, when the decision came out, he said, he spoke out against the Kelo case, he said, "The result of this decision will be that working families and poor people will see their property turned over to corporate interests and wealthy developers."
Trump: It's not right! It's not right. Look, they get, the money—you know the way they talk, people would say "Oh, it's turned over." It's turned over for four or five, six, 10 times sometimes what it's worth! People pay them a fortune. But sometimes you have people that want to hold out just for the—most of the time, I will say, I've done a lot of outparcels, I call them outparcels. Most of the time, they just want money, okay? It's very rarely that they say "I love my house. I love my house. It's the greatest thing ever." Because these people can go buy a house now that's five times bigger, in a better location. So eminent domain, when it comes to jobs, roads, the public good, I think it's a wonderful thing, I'll be honest with you. And remember, you're not taking property, you know, the way you asked the question, the way other people—you're paying a fortune for that property. Those people can move two blocks away into a much nicer house.
Baier: I know, but if they don't want to sell….
Trump: Well, look, I mean, if they don't want to sell, I feel—

Trump: I think it's a great subject. It's a very interesting subject. I fully understand the conservative approach. But I don't think it was explained to most conservatives.
In Trump's beloved Kelo case, you may recall, the thing called "economic development" didn't actually lead to any, and the working-class homeowner really did love the house that was bulldozed by the government at the behest of a wealthy developer.
Trump's endorsement of the Supreme Court's 5-4 expansion of the constitutional phrase "public use" to include private development is not surprising, given his line of work and prior reliance on the goliath-vs.-David practice. And his assertion that conservatives (let alone libertarians, or progressives like Bernie Sanders) just need the subject "explained" better to them is not just condescending, it's ignorant: Kelo sparked a widespread public backlash, and its economic-development rationale has been massively unpopular for a decade. For good reason.

That also sounds like bullshit. All courts require is for the government to pay the market value of the property, which is a shitty measure given that you have an unwilling seller.
And What Trump says is not necessarily the case. Several year's ago, when I still originated residential mortgages, one of my clients was purchasing a home with a down payment derived from the sale of her home under eminent domain laws. The state was buying the property and the agency they used to evaluate and execute the transfer was clearly trying to get the property at fire sale prices.
The property was to be used as part of a highway extension through the city where I live. Near as I could tell, as a number of years had passed since the state budgeted for the purchase of the relevant properties, prices had appreciated and their funds were being spread thin. Of course the answer for them is to try and swindle the landowners.
Although it wasn't actually part of my job, I helped her navigate their valuation dispute process successfully and get market value. Definitely no double market value or more payout. I doubt that actually happens very often. I imagine that only works with people who made the right campaign donations.
That's perhaps why Trump is so confused. People who are politically connected can move ahead of development projects and buy up cheap property for resale at a nice profit. Those who aren't just get bulldozed for less than actual market value.

Trump's success proves Republican voters aren't as dumb as Democrats. They're not "taking one for the team" with "the most conservative candidate who can win" this time. I've pointed out before how he talks in staccato repetition of "Key Words", rarely making complete sentences. His "conclusions" rarely have any necessary connection to the preceding shotgun blast of statements... only by inference, or feeling.

Worse than his flat-out lying about how eminent domain works is his economic ignorance in saying the victim is paid "more than the property is worth" when what something is worth is a subjective opinion and, if it is true that the price being paid is higher than the value of the property, why the hell would the price be paid? Is that how Donald does business, paying more for stuff than what it's worth to him? I doubt it, however high a price you may pay you pay it because what you're getting is worth even more than that.
So I see Gillespie has published yet another "The Libertarian Moment is upon us!" article. Personally I get the feeling that while there are significant elements of society that are disenchanted with the status quo I'm not certain that the change they desire is very libertarian (see Trump and Sanders).
Also I would be a lot less cynical about the "Libertarian Moment" if I found evidence that people stop believing that the Great Depression was caused by Hoover's "do-nothing" attitude and solved by FDR's New Deal. There can't be much of a libertarian moment if people believe that libertarianism would destroy the economy.
And tying in with that well the Guardian articles and comments on the Greek Crisis were pretty eye-opening to me. "Neo-liberalism" is literally genocidal they say as tax cuts, spending cuts, deregulation and privatization will destroy civilization. Thing is the basic idea is generally believed by most people. Until people stop thinking this way I will be more optimistic.

My small burg has managed to pull eminent domain out like traffic tickets due to the lack of space for expansion. One thing I've noticed is that it's the one issue which seems to find agreement within both party lines.

Trump will win the presidency if he gets the GOP nomination, but it's harder to tell whether he'll get that far. More Republicans dislike him than like him. I do agree with Adams on Trump's persuasion skills, but I think his background in hypnotism causes him to put more stock into it then is supported by reality.

I used to do tri-tip once a week. I have it down to a science.
On the coast, they use Red Baron rub. Up in the hills, it's just salt, pepper, and garlic, which is sold pre-mixed from one of the best steak houses in that region.
I don't have a wheel grill, but I've found a way to make it even better: Oak smoked, sous vide, and then grill seared.
I was really surprised to find out that they don't sell tri-tip at every Costco. I thought it was a nationwide thing.
The leftovers are even better: Tri-tip ranchera. It's the beef and salsa from the beans mixed together and served over toasted bread.

The state was buying the property and the agency they used to evaluate and execute the transfer was clearly trying to get the property at fire sale prices.
The property was to be used as part of a highway extension through the city where I live. Near as I could tell, as a number of years had passed since the state budgeted for the purchase of the relevant properties, prices had appreciated and their funds were being spread thin. Of course the answer for them is to try and swindle the landowners.
Although it wasn't actually part of my job, I helped her navigate their valuation dispute process successfully and get market value. Definitely no double market value or more payout. I doubt that actually happens very often. I imagine that only works with people who made the right campaign donations.
That's perhaps why Trump is so confused. People who are politically connected can move ahead of development projects and buy up cheap property for resale at a nice profit. Those who aren't just get bulldozed for less than actual market value.
