Air Force Captain Assaulted for Not Knowing His Neighbor
Capt. Nicolás Aquino is a model Air Force officer who plans to devote his entire life to military service. His family fled Paraguay before he was born and sought refuge in the United States because of the rights the US Constitution offered.
However, those rights weren't afforded to him last December when Sheriff's Deputy Ivan Rodriguez physically assaulted Aquino on his own property. The deputy reportedly believed Aquino was a burgler even after the Air Force officer repeatedly told Rodriguez he was the property owner.
Reason TV first reported on this May 22, 2014. Original write-up below:
Capt. Nicolás Aquino attends the Naval Post Graduate School in Monterey, California, and plans to devote his life to military service. His family fled Paraguay to escape a brutal dictatorship before he was born, and they came to America because of the rights the U.S. Constitution offered.
"That's one of the many factors in terms of why I wanted to serve this country, so I could uphold those ideals, that I could fight, that I could give back to the community and make sure that [my family] can keep those freedoms," says Aquino.
Aquino says he works everyday towards protecting these rights. That, he says, makes his entanglement with law enforcement these past few months even more infuriating.
In December 2013, Aquino was at home when he noticed Sheriff's Deputy Ivan Rodriguez outside his property. Apparently, one of Aquino's neighbors didn't recognize him and called the Sheriff's Department to report a suspicious person. According to Aquino, Rodriguez didn't identify himself and didn't clarify why he was at Aquino's address. After some conversation, Aquino asked if he was being detained, and the officer said yes. Thepolice report claims that Aquino asked this in a "confrontational tone."
"The officer, he appears to have been offended at the idea that a citizen would question his authority or would even ask any questions," says Aquino's lawyer, Steven Liner. "Everything that Nicolás was doing, to me is sort of like textbook 'OK, I'm going to be respectful, I'm going to answer questions, but I'm also going to insist that you answer questions for me, because I am within my rights on my property to ask these questions.'"
Even after Aquino provided his military ID and offered to get his utlity bills to show proof of address, Rodriguez remained unconvinced that Aquino was not a burglar and moved to physically detain him.
"He just grabbed my wrist without any warning, without provocation, put me in a choke hold," says Aquino. "I still have fluid buildup in the back of my right ear, a right head contusion, abrasions and contusions on the elbows, knees, and hip."
The officer then proceeded to put Aquino in handcuffs and search his wallet. He finally concluded that he did, in fact, live there.
"The officer did not apologize. He pulls me over to the side of the driveway and he does basic victim blaming, and he says it was my fault for not knowing my neighbors. He then states that he had wanted to tase me if he had a taser, and he would have shot and killed me if he had drawn his weapon, and he would have been fully justified in killing me," says Aquino.
After the incident, Aquino thought he could put the nightmare behind him. Two months later, however, he was notified that there was a warrant out for him for resisting arrest during the incident. Aquino was dumbfounded but decided to fight back.
"I was not aggressive or confrontational in any way," says Aquino. "Are we supposed to bend over and, excuse my French, just take it? Just because a person is on a power trip and feels that he can bully you into submission?"
Liner says no, citizens need to stand up for their rights. "This is an opportunity for all of us to talk about how it is that citizens have an absolute right to ask questions and that police officers should be respectful and civil and act lawfully, which means not using force unless it is really called for," he says.
Once word got out about the arrest, the public flocked to support Aquino. The DA seemed unconvinced at that point that a jury would side with Rodriguez, and he dropped the charges. This is a victory for Aquino, but the DA still appears to defend the officer's actions. The DA's office declined Reason's request for an interview.
Aquino plans to continue fighting and is filing a civil claim against Monterey County for damages.

I would venture to say that the unaccountability, and the fact that these cops have to know that if they actually get sued and lose, that it's the "civilians" who actually pay, probably makes them laugh. Serious question for any legal types out there: Is it possible that police employment could require the officer to carry some kind of Thug Insurance in order for taxpayers to stop getting put on the hook for this shit. My ex is a doctor, and she is a fine one, whatever our other disagreements, and has never set a foot wrong but she pays out the ass for malpractice insurance as a condition of her vocation. If that's ok I can't see how cops would be impossibly different, beyond FY civilian, of course.
It would require a major change, but I could support (a) requiring LEOs to be licensed, and (b) requiring that they carry insurance to keep their license.

This investigation has apparently been going on for about three years! They obviously don't have jack shit in the way of evidence of actual wrongdoing, so they're now releasing this "news" to the public simply to embarrass him.
Come to think of it, what if I had a friend over house-sitting for me while I was on a trip? Is he subject to arrest by a "conscientious peace officer" if he can't prove he has permission to be there?
I'd think possession of the front door key, and no evidence of a break-in, should be proof enough that you have permission to be at the house. Maybe they could try to contact the rightful owner just to be sure.
But this wasn't about that. It was about Aquino not respecting his authoritah. The cop wanted deference, and when he didn't get it, he got pissed. The cop would have done it to an 80-year-old white lady if that's who wasn't kissing his ass when he wanted it kissed.
This is why encounters with the police are so dangerous. Much of the time, it's probably fine. But you get the wrong pig on the wrong day in the wrong mood, and...who knows. You just can't ever know if the cop that just pulled you over for speeding is in a horrible mood because his wife just left him. For a guy that looks a lot like you.

Aquino looks like a white Hispanic which I believe justifies anything and everything that happened to him. In his shoes, I might be having a chat with one of my neighbors and perhaps suggesting to the cop that if he really wants to compare guns and badges, Aquino's crew might be up to the task.
There was a time when every reputable P.D. gave psyche evaluations prior to hiring officers. They must have been fairly stringent tests as I have worked around several Security personnel who were such because they did not pass them.*
I do not know if those tests have gone by the wayside due to budget cuts, or if Police Departments have radically changed what is considered desirable for a police officer's profile but, something is wrong. There are far too many complaints re: overuse of force, use of deadly force before using anything else, groups of officers on one "suspect", and it keeps going on and on.
If Police Departments are skipping this step in order to hire more police, to what good? Does it really help us as a community or a society in general if those who are supposed to protect us have the same same psyche profile as those we are to be protected from? There are too many issues of the same ilk happening to think officers are being carefully screened in all departments. I think this is something that needs to be investigated nationwide. Am I alone on this?
* I am not implying that all Security Personnel are those that have been rejected by or have failed police department psychological evaluations. My experience in working around these individuals was 30 years ago, I am sure they were the exception to the rule, and that things have changed considerably in the security field. I mean no inference otherwise.

Washington State Police bust left-lane squatters
I have mixed feelings about this.

Don't get me wrong--Pacific NW drivers are the worst drivers, as a whole, that I've ever seen--but it's still not the pigs' job to "correct behavior".
I will say that I've had a few recent encounters with the WSP and they have been unfailingly polite. I even had one react without a blink to the fact that I was armed. I can only hope that that's a WSP cultural thing and not just chance.
I'd still take Pacific NW drivers over Boston drivers. Pac NW drivers are boring, hidebound sticklers for rules, but Boston drivers are aggressive assholes that will actively harm their own commute to prevent you from changing lanes.
There's an etiquette to NE driving, jesse, and it can be confusing to those who aren't from there. If you violate it, it pisses people off. This is why people think NYC drivers are "rude", when in fact they're pissed off because you did something that's considered rude, and you don't even realize it.
What a load of twaddle. That's true of everywhere, but even LA where we regularly spend hours stuck in traffic is more forgiving for people who don't know the local etiquette. Partly because we're saddled with a mix of the worst drivers from everywhere else and old Asian women who live in Diamond Bar.
I will say I absolutely respect people who can get around by car in NYC; I know I don't have the nerves for it. And I certainly won't be trying Boston or its environs by car ever again.
The NE etiquette is simple: don't waste anyone else's time. You're looking for a parking spot, and drive slow down a side street because you're not sure what's a parking spot or a hydrant or a loading zone, and there are people behind you? ULTRA RUDE. You're not sure if you can go down the next street and block the intersection while trying to figure it out? ULTRA RUDE. You dilly-dally after a red turns green and don't get through as fast as you can, thereby causing the person behind you to miss getting through while it's still yellow? ULTRA RUDE.
You just have to realize that that's what it's about. If you do anything that inconveniences other people, because you're confused/stupid/lost/whatever, that is your fucking problem and it is incredibly rude to slow/block other drives because you have a problem.
Yeah, you'll find people complain about the same shit here.
Ask an LA what they think about people making a right turn from the lane instead of the parking lane, or slowing down a block before a dedicated turn lane making you miss the straightaway light*, and watch them blow a gasket.
*As I type this I'm fantasizing about bludgeoning a Leaf driver in my neighborhood who has done this to me twice now.

Had to deal with that shit when I lived in CT. Fethers up there - empty 5 lane freeway and some idiot is doing 5 below the speed limit in the left lane. Then, as you move around him will try to cut you off.
Multi-laned roads aren't designed to be "pick a lane," they are supposed to be pass on the left, and the lanes are progressively faster as you move leftwards. People going too slowly in the far left lane do create a hazard. It doesn't make any difference if the person in the far left lane is going over the speed limit, you are not there to slow him down, move over and drive in the lane which is the speed you desire.
For fun, drive in Italy, Spain, Germany or France some time. They take the "drive on the right, pass on the left" extremely seriously. It can be quite difficult to stay in the left lane for any extended period, because there are drivers going 100+ mph coming up at you all the time. It's very fun but can also be quite frightening.
We're not in Germany. While I always let cars driving faster than me pass on the left, I do it out of politeness. If I'm doing the speed limit plus 10 mph in the left lane, then nobody can have a claim to my position in the left lane. The drivers, including those who want to go faster, are responsible for the politicians who imposed very low speed limits in the US. I won't feel bad if I don't let you pass me right away.

You have no right to exceed the speed limit. It's in the same manual. And as an American citizen you're to blame that the speed limits are so low.
Do you ever notice the signs along the road that say "Slower traffic keep right"? That means you, if you are going slower than other people, regardless of the actual speeds. And why should it be any of your business if other people are exceeding the speed limit? Get out of their way, and move to the right.
Actually, you should be happy that people are going faster than you are, they will be the ones to get the tickets. I like getting out of the left lane to allow a leadfoot to pass, then can follow a safe distance behind him for awhile, knowing that he is the cop bait and I should be OK. If I would try your method, I'm at risk for both road rage and a ticket myself.
I just don't see any reason to block the left lane by going slower than other drivers. Your mantra that no one has a right to exceed the speed limit is meaningless unless you work for the Highway Patrol.

One time I was driving with a friend who stalled his car, and immediately a cop was in the window asking what happened. He pushed us into a parking lot and then drove away.
Another time in the same city a cop picked me up while I was walking home from the bar, gave me a ride home, and then drove away.
In both cases I was flabbergasted. I was expecting the usual treatment of being asked a bunch of questions, run for warrants, searched, and then being told how he was going to eventually get me sometime for something. Yet none of that happened. He gave some help and then drove away.
I may have met the mythical good cop.
Around here we have a good many of those. Of course, like anywhere, we have more that are not.
I had a cop pull me over (legitimately for speeding) and then when I was pleasant about the whole thing (it was legit) and then tell me he takes most of his vacation time in late summer and I might want to think about contesting it.
I witnessed an accident my second day in town (1998). IMHO, I went above and beyond. Guy got T-boned at a light. I grabbed a guy (in uniform) and told him to call 911. I ran to the scene, on the edge of a steep hill, they guys legs were broken and the car (in neutral) was starting to roll backward down the hill. I got behind the car and held it there until someone else showed up and got it in gear. At the bottom of the hill was the Missouri River. I hung out for like an hour to give a statement, which this nice female cop took.
Fast forward 6 months later. It's maybe a week after the MT speed limit went from reasonable and prudent to 70 mph. I wasn't thinking, was gabbing with my buddy, forgot to turn on my RADAR detector and was going 82ish. Guess who pulls me over?
She goes, I remember you. Wanted to thank you again for hanging out and helping that day. Here's your ticket.

There are good cops. But they're not all powerful, and can't change it all by themselves. In a corrupt society, with a corrupt government, you can't tell all the good guys to commit suicide.
But I understand the sentiment. I know all sorts of completely law abiding, just people who wouldn't hurt anyone or steal a dime, but they say the same thing, in the same tone of voice "I fucking hate cops."
No. There are no good cops. If there were good cops, then they would stop the bad cops. No one stops the bad cops, which means there are no good cops.

Cops love to choke people. I don't get it, but they think it's really fun. Remember that former cop in an article a while back who bragged about choking people until they shit their pants? Or more recently that cop who choked some guy in handcuffs while his buddies did nothing? And when I've heard cops talk amongst themselves about shop, they talk about choking like it's the best thing in the world. They just love having a person in a position where they both know the cop can kill them, and nothing else will happen. It's not so much that power corrupts, but that it's a magnet for sociopaths.

My favorite part of the story is where the cop basically tells him "You know, I can kill ya if I wanna."
