Adam Kokesh in Jail: The Theater of the State
As I'm sure he on some level wanted, the treatment of libertarian activist Adam Kokesh in the American legal system (after a symbolic, nominal, and harmless apparent violation of a gun law on video led to an excessive and violent assault on his home--the same type of violation when committed by a mainstream journalist like David Gregory led to nothing at all) makes a compelling show of what getting embroiled in The System means.
You will consent--even if you don't.
Kokesh was scheduled to be arraigned Wednesday, but reportedly refused to leave his holding cell. He finally made his appearance before a judge the following morning, but had to be carted in on a wheelchair because he refused to cooperate.
"He happened to be in a wheeled chair because he did not want to walk," First Lieutenant Steve Elbert of the Fairfax County Sheriff's Office told WTOP News.
When he was wheeled before a judge to be arraigned, Kokesh reportedly refused to speak.
"I'll take your silence as your consent," a Fairfax County judge told him, according to WJLA News.
A possibly relevant essay by me from 2001 on how William Cooper went out in his fight against the government.

But David Gregory didn't possess psychedelic mushrooms ALSO!
Power is the grooviest trip of them all.
Stealing that line.
The state continues to make my rape case for me. It's impressive.
she can't say no if her mouth is duct taped.
I'll take your muffled grunts as your consent.
Putting the lotion in the basket is consent.
"I'll take your refusal to cooperate as consent."
Which is exactly what the judge has made a case law precedent.
He was asking for it! Dressing in that wheelchair like that.
Is a rape case part of a matched luggage set with a Magic Murder Bag?
But...but...Armstrong State University policy.
How do you know he didn't? Who knows what an armed raid on his home would have found.
Three felonies a day!
My money is on homemade dog-fucking pictures.
Just like the bigshots at the CDC
I do not understand. If I met a physically attractive scientist, I would swear off kids and animals forever. What's wrong with this guy?
regarding the theater of the state, if you like Cowen's theory of it being technology

I have hope statecraft fades b/c of it in future

Kokesh, 31, will likely now stay in a northern Virginia detention facility until a preliminary hearing scheduled for October 2 is held.
Speedy trial FTW. 8-(
Wait, do you need consent to be put on trial?
Yes, but it's automatic.
The state routinely puts inanimate objects on trial.
That's the miracle achievement of Democracy. If you play along, it counts as active consent. If you don't play along, but don't actively resist, it counts as tacit consent. If you do resist, it means you acknowledge the authority of the people you're resisting, which counts as consent. There is literally no way not to consent!
Social contract, Hugh. Social. Contract.
Yeah, I'm still waiting on that countersigned Social Contract in the mail.
They'll take your waiting as consent. As will Warty.
Yep. You guys don't get that, under specific and fantastical conditions, you would totally consent in full. It's, like, obvious and there's no argument against it.
Similarly, if you ignore every fact about yourself or the world as it currently exists, it'll be clear to you that the bum outside deserves your things.
Duh, by moving to Somalia.
the way things are going, I would rather carve out a little state in Somalia than have to deal with this one.
You might want to try Ukraine first. You could look for Groovus' body.
good idea. I like a good murder mystery.
Actually a friend of mine just moved to Kiev and he really likes it. But he has a decent consulting job there.
But how can I move to Somalia? I need my ROADZ!
You know what? I'm getting tired of all this "roads" stuff. Have you ever seen anyone build a road without government? Never happens. How are you going to get the appropriate permits and zoning? Who is going to enforce your confiscation of land on which to build the road? How will you find unionized workers to operate your construction equipment? And how will you guarantee that people drive on your road rather than willy-nilly all over the countryside?
Privatized roads? Never happen.
/this message brought to you by the Coalition for Circular Reasoning, with help from a grant by tge Ministry of Truth.
Funny thing on that, I was looking at some photos in the Seattle Times in their 'photos of the day' section, and they had a picture of some new Somali police recruits, marching in a parade. The road they were on? Yeah, dirt. So people are right, no government = no roads. Somehow no government = a police force, but they still don't have a road to walk on.
Government ROADZ are why we don't already have flying cars.
It's like being shot by a police officer, there's no "unjustified" scenario.
Were you armed? Yes. Justified.
Were you armed? No. Did the officer perceive a 'reach'? Yes. Justified.
Were you armed? No. Did the officer perceive a 'reach'? No. Did the officer reasonably fear for his or her life? Yes. Justified.
Wait, silence is consent to a judge? Why aren't there one million feminists protesting outside his courtroom?
his courtroom
SEXIST!
I see you might like to subscribe to my newsletter, the Enthusiastic Consent Daily.
Apparently STEVE SMITH consents to purchasing a subscription as well.
"I'll take your silence as your consent,"
That would look good on the Presidential Seal.
I wish Putin or some nice latin American country would offer me citizenship
I daresay all of the Reason commenters would sign a petition asking Russia to give you refuge. Or North Korea, we're not picky.
Having read some of your other posts here, I find myself wishing the same.

What?! Not CHILD ABUSE?!
There must be obstruction of justice in there also, right? That just goes with the territory.
If one of the cops strained an arm when putting Kokesh in the wheelchair - boom, assault on an officer.
Sedition - that's awesome.
no filming without a permit?
I admire principled protest as much as the next guy, but when you prostrate yourself in the path of a tank, you'd do well to know who's driving it. Adam is going to get run over by the crypto-fascists, and no person of principle will be able to do a thing to stop it.
There are things that could be done - but we won't.
Smokin' marihuana Is more fun than drinkin' beer
But a friend of ours was captured
And they gave him thirty years
Maybe we should raise our voices
Ask somebody why
But demonstrations are a drag
Besides we're much too high
Crypto?
Well, they don't have it printed on their business cards... so...
Was the arrest really made due to the video? Could they not have been blanks? Or creative edits?
I hope he sues the crap out of them- and wins.
Adam vs. the Man, indeed.
He should have spoken simply to say "I don't consent" and leave it at that.
If you want me to eat them for you, give me no sign... Thy will be done.
Why is there a two year old article reposted on a Thursday with two year old fucking comments? It's bad enough that I gotta check the comment dates on the weekends.
ANd now it's gone. WTF?
NEVER MIND! DAMN YOU HUGH!
