Lee County Deputies Tied Suspect to a Chair, Gagged Him, and Pepper-Sprayed Him to Death
From Fox 13 in Tampa comes the horrifying story of Nick Christie, a 62-year-old Ohio man who was detained by the Lee County Sheriff's Office for being publicly intoxicated. While Christie's wife asked that he be taken to the hospital, Lee County cops decided instead to strip Christie naked, tie him to a chair, cover his face, and then pepper spray him repeatedly, until he died:
The District 21 Medical Examiner ruled his death was a homicide because he had been restrained and sprayed with pepper sprayed by law enforcement officers. But to this day, nobody has ever been charged with a crime, and the Lee County State Attorney cleared the sheriff's office of any wrong doing.
It's been more than two and a half years and his wife still can't accept what happened.
"I was shocked. This was something out of a horror movie," says Joyce Christie. She said her husband was depressed and was showing signs of erratic behavior a few days before leaving for Florida.
She called authorities and pleaded with them to take her husband to a hospital and be given his medications. Instead, he was taken to jail for disorderly intoxication.
Her lawsuit alleges he was pepper sprayed 10 times over a 48-hour period, at times while in a restraint chair.
Monshay Gibbs was a deputy trainee at the jail at the time. In a video deposition, she testified that she thought the way Nick Christie was treated was excessive.
"He had a spit mask on and was naked," she said on the video while under oath. Gibbs testified that Christie pleaded with guards to take off the spit mask because he couldn't breathe.

Actually, police officers used to be called police officers and law enforcement officers. The term "peace officers" didn't come into common usage until the 1960's.

Prison is where you go once you've been tried, and sentenced to serve a year or longer (ie, for a felony).
They should be in jail on remand (awaiting trial). Then they should be tried. If found guilty they should serve appropriate prison sentences. Even if they (morally) deserve the death penalty for this, I don't trust the state with that power for it will surely be abused in other cases. And I wrote "if" to give them the benefit of doubt, as one should in a society of just laws, even in cases where there is incontrovertible evidence of guilt (ie, here).
We've seen this all before. They will go on paid leave, then face misdeameanor charges and be given very deferential treatment by the prosecutors and courts. Then a slap-on-the-wrist sentence which during which they will be housed separately from the general inmate population because they're special.
If President Obama were true to his stated principals, Eric Holder would be onsite right now overseeing a federal investigation which would hopefully result in criminal and civil actions in federal court. But you're not going to see that, either, because it's an election year and all and he wouldn't want to look bad with the security moms.

There are criminals policemen in my family and I have to tell you it is common practice, at least in Texas for the criminals to carry a "throw down", which is a small caliber untraceable weapon, or a knife that can, in the event of a scrapping they are losing they cam throw it down then pull out their weapon and kill them. I can't say how many do this, but it is common.
I've heard stories about that, too. The problem is proving it. When a non-cop says it you're labelled an anti-cop bigot. The cops almost never turn in their own.
And even if you did hear one of your relatives admit to having a throwdown, it's not enough. He'd have to have said he had a throwdown weapon and told you he'd used it during a specific incident. And you'd be just one voice. The police would close ranks to protect their own.
And then you'd start to have a string of bad luck. Traffic stops, zoning violations, basic intimidation. Anything to both send a message and destroy your credibility.

Basically cops have a license to kill anyone they want. Even if they do flat out murder you chances are it will result in a lawsuit that will cost the taxpayers not them. Worst case, they get some BS manslaughter conviction a few months in jail. In San Fransisco the guy flat out murdered the guy and he got manslaughter. Here, they torture a person to death and no charges.
These events have to have an effect on the culture. It is like a war. In a war people necessarily disassociate themselves from the enemy. If you think their people, it is hard to kill them. Same thing happens with cops. You deal with pretty lousy people and make your living off of human suffering, you have to disassociate yourself from them. Nothing against cops for that. EMTs do the same thing. Anyone in a life or death job does. The problem is that you have to have strict discipline and strict consequences for misbehavior or things quickly get out of hand.
So here we have cops who by the nature of their jobs and for their own sanity necessarily disassociate and dehumanize the people they deal with. And they are union protected and subject to little or no discipline or consequences for their actions. That is a recipe for murder.

There is probably something to be said for only being a cop for five or ten years and get out of it. It is a tough job. You necessarily have to separate yourself from it or you will lose your mind.
Cops deal with the worst of the worst every day. You have to disassociate from that to some degree.
But if they stick with it for 20 years, they can retire in their 40s with full pension.
And I find the new young ones are often the worst. But I'm thinking of the small town cops where I live who rarely have to deal with the "worst of the worst".

My favorite so far is to make every DA serve as a public defender half of the time. Though that could backfire in some ways, I suppose.

The culture in a lot of places is that all of the accused are "criminals" and the defense attorney's are abetting said criminals rather than doing their jobs and the whole point is to put as many of these "criminals" in jail to protect the public by any means available.
In that kind of culture, a DA looks at this case and sees the guy as a criminal not a human being. And he sees the issue here being that cops need to be allowed to do their jobs without DAs interfering lest some criminal go free.

No it is not. There is no general federal criminal law. The feds cannot prosecute a ordinary assault or murder without there being some kind of federal nexus, i.e. committed on federal land or an assault against a federal official.
When a cop murders someone there is no federal nexus, unless you can prove he did it with the intent of violating that person's federal rights. Even then the prosecution is for violating the rights not for the underlying assault. See the Rodney King case as an example of this. The cops in that case were not convicted of assault, they were convicted of violating King's civil rights and one of the elements of that case was that they attacked him because of his race.
If you think this is not true, produce for us the federal law or case that shows that cops or anyone can be tried in federal court for simple assault or murder.

Just to clarify:
1. A spit hood does not gag someone given it does not enter the mouth. It is designed to prevent them from spitting and allow them to still breath unobstructed. If an inmate can ask for the spit mask to be removed then they are clearly able to breath.
2. Just because on inmate or that inmate's family asks to be taken to the hospital does not mean they have the right to go there. They are in custody and as such their freedom of movement is restricted. If the jail staff (including the medical staff) deem it necessary to move an inmate to the hospital then it will happen.
3. Most jails have a full time medical staff who reviews all inmates being booked in. I know for a fact that the LCSO jail does and as part of their duties, the medical staff checks on people who are in restraint chairs every few hours.
4. Case law does support physically restraining someone for extended periods of time if they are a danger to themselves or others. Case law also supports taking reasonable measures to maintain control of a disorderly subject in a corrections setting including the use of force.
5. Just because you don't like something doesn't mean it is criminal or wrong. Before you make a knee-jerk judgment on an incident you need to take a breath, calm down, and then come up with a logical argument for or against after you have reviewed the facts and made an effort to educate yourself on the topic.
The only real question here is if it was appropriate to continue to apply pepper-spray while the inmate was in the chair. Based on what is put forth in the article and the news story, that is in doubt. No one has been able (or willing) to say if it was applied while in the restraint chair or before he was put into the chair. That it was applied while in the chair is only implied at this point.

The ME's diagnosis of homicide is all the "education" I need on this topic.
Homicide is the killing of one human being by another. The act of homicide is not inherently a criminal one. For it to be a criminal act there needs to be the intent to kill or an act of gross negligence which leads to the death of someone (usually referred to a manslaughter).
Lets say your are out shopping and being a law abiding, Second Amendment loving citizen, you are carrying a firearm. You go into a grocery store and while waiting at the checkout a man wielding a rife enters the store and begins shooting people.
You act! You use your firearm you shoot the gun wielding subject several times. After four shots you are able to end the threat to your and other people's lives. You later find out that the subject dies while at the hospital. You have committed the act of homicide.
Was your intent to actually kill the gun wielding subject? Most likely the answer is no. Your intent was to stop the threat to people's lives. Given that your intent was not to actually kill (assuming you do no walk up to the incapacitated gunman and put a round in his head) the subject but to simply stop the threat which means that your act of homicide is not a crime.
In this corrections setting, was the intent of the officers to kill the inmate. The answer is pretty obviously no. Did their gross negligence lead to the inmate's death. The answer is most likely no but that has yet to be determined.
So the ME's finding of homicide does not mean a crime took place. It just means that the inmate's death was caused by the actions of another human being.
Why was he stripped naked?
That is not clearly answered with the information we have right now. Getting placed into the chair to begin with is a pretty big deal and is very disruptive to the running of the facility. Ending up in the chair was probably a multistage process beginning with the inmate being somehow posing a danger to himself or others or being disruptive to the running of the facility. As part of preventing him from having any object to use to that end he was most likely stripped down and placed into a solitary cell. He probably continued to be disruptive and the decision was later made to place him into the chair. Additionally, clothing can get in the way of the chair straps so even if he went straight into the chair they might have taken his shirt and pants off to prevent that.
"There was no complete video for state officials to review before they decided not to prosecute Lee County sheriff's deputies who re-strained and pepper-sprayed inmate Nicholas Christie eight times over two days before Christie's March 31, 2009 death.

Additionally, LCSO never even reported his death to the State Atty's Office, which is SOP when there is a death. They tried to say he technically "died" after his wife bonded him out, because she pulled the plug days after his brain death. Therefore, no death to report.
They didn't even alert the judge who was arraigning him--he was on the docket a week later.
There was a mental health BOLO issued for him when they arrested him for trespass, so he should have been taken to hospital, not jail.
Witnesses also said they heard and saw him wheezing, claiming he couldn't breathe, and turning purple.
Witnesses also said that they put a spit mask on him because they pepper sprayed into his mouth.
"Joyce Christie was so concerned she says she contacted the Lee County Sheriff's office and issue a welfare BOLO (Be On The Lookout). Ms. Christie even had the sheriff of her home town contact Lee County to stress the seriousness of her husband's condition and the fact that he needed to take his medication.

That forecast proved true.
Joyce says her husband couldn't remember her number, or his son's. Two days later on March 27, he was arrested again for trespassing.
This time when officers took her husband into custody, Joyce says they locked his medications in his truck and never retrieved them.
Joyce frantically flew to Fort Myers March 28, but police would not let her see Nick. She says they wouldn't even tell him she was there. Finally, an officer suggested she could bond him out of police custody.
When she finally was allowed to see her husband it was too late.

How is it in doubt? I haven't seen anything that says the cops dispute that claim, not that I've seen it all.
I'll take the medical examiners word for it, for now. The cops could convice me otherwise by showing the full video.
It is a very normal thing (and a good idea) for police departments not to comment about an ongoing lawsuit/investigation. Just because they decide not to testify in the 'court of public opinion' does not mean they are automatically guilty of whatever they are accused of. Even in a situation like this the burden of proof lies with the accuser. If the accuser does not present evidence to say a thing happened then you cannot presume that it did.
Also, please refer to my earlier post about the ME's finding of homicide and people's general misunderstanding of how that word is used.
Would you apply the same standard that you express here to every person that is suspected of every crime? Of course, if a non-cop had done any of this, they would up shit creek. Let's say it was a fair and normal world we live in and at the very least a mundane that did this would be arrested and the bail would be set very high indeed. There would be an investigation and the prosecutor would try his damndest to drill the suspect into dust. Charges would be loaded up and the suspect would be threatened with the death penalty nad convinced to plea bargain for life in prison. But the people who committed this act here were not mundanes, they were gods, therefore they are not arrested and no criminal charges are filed.
Why would a non-cop be restraining someone in a chair? Joe citizen does not have the authority to restrain someone as set forward in this story (in jail and in the chair). Law enforcement does given there is probable cause to believe the subject did commit a crime. You are putting fourth a ridiculous standard of comparison.
There is also precedent in multiple Florida courts ruling that using pepper spray on mentally ill inmates violates the Eighth Amendment, and that any officers who do it are not eligible for qualified immunity.

I had a cop enter my home unwarranted because he didn't understand the situation fully from a neighbor's 911 call, came in the house to wake me up, and then beat me when I told him to get out of my house until he had a warrant. Now I'm facing charges for resisting arrest. They threatened to use the audio tapes from the police cars outside to convict me, until I got a good lawyer...now they mysteriously lost all 3 tapes. So they have no evidence but the cop's word, and I have plenty of evidence...but I still had to pay 10,000 bail and my lawyer to prove THEM wrong, when I'm supposed to be innocent until proven guilty?

My cousin was in jail ( Taylor County Florida) and while we where working on getting him released I contacted the ACLU and was told that Florida is the worst state for prisoner and civilian rights violations by POLICE OFFICERS. I am sure in the 7 years since then its only gotten worse. Those should get the death penalty for 1st degree murder.

I have a solution for this kind of shit: Every person serves an equal term as a policeman in their community. This would mean every person would probably work 3-4 shifts a year in their community as a cop. Do we even know the names of all the officers involved with the death of this man? And how is it that the ME ruled this a homicide and the DA cleared all the officers of all charges? How does this happen?

Simple! It's called "prosecutorial discretion", which has become synonym with "legal cronyism and malfeasance".
If you want another glaring example, just marvel at the fact that no Wall Street banker, nor mortgage bank has been criminally prosecuted by Bush or Obama's DOJ when every real expert knows that there has been rampant fraud and fiscal evasion. (and that is for starter only!)
THe sad fact is: prosecutorial discretion is so blatantly abused today that our system of justice is multi-tiered; those with influence or connections escape the cosequences of their crimes while the rest of us are subjected to one of the most merciless and unfair system of justice in the Western World.
This is just disgusting I live in Lee County and this is just screwed up.To serve and protect my ass.Their should be charges brought against these animals.They think because they have a badge they can do as they please with no punishment,well obviously it works because no one has even gave concern about this man dying while in police custody.People piss and moan about no respect for law enforcement well this is a reason why they are worse then the criminals they arrest!My sympathy goes out to this mans family LCSO can suck a dick
How in the world could this incident have happened over such a long period of time with no one being charged.
This is an outrage and the murders should be brought to trail. It doesn't matter that they're law enforcement officers. They broke the law when they murdered this defenseless man and they need to be held accountable.
