In Case Your School Isn't Zero-Intolerant Enough
By now, we're almost numbed to stories like this one, in which an 11-year-old boy who was told by his therapist to draw pictures instead of act up when he was upset ended up being hauled off to the principal's office after drawing some stick figure violence and the phrase "teacher must die." But what gives this Drudge-bait a little extra oomph is that when the school proved to be insufficiently hardass about the incident, the cops came in.
The school was aware that the boy was in treatment, determined he was not a threat, notified his parents and sent him back to class. His mother, "Jane" was shocked when Arvada Police showed up at their home later that night.
She says she told her son to cooperate and tell the truth, but was horrified when they told her they were arresting him and then handcuffed him and hauled him away in a patrol car. His mother says she begged police to let her drive her son to the police department and to let her stay with him through the booking process but they refused.
They put him in a cell, took his mug shot and fingerprinted him. He says he thought he was going to jail and would never be able to go home again. […]
At first school officials did not want to press charges, but changed their mind when police called them later that night. A juvenile assessment report shows he's never been in legal trouble before and is at low risk to reoffend. […]

I always tell clients that there is almost never anything to be gained by giving a statement to the police. If they are asking for one that means that they do not currently have enough evidence to arrest you--if they did you would already be in custody.

If you aren't sitting in a jail cell pending formal charges and bail, the cops don't have you. Therefore, don't give them anything. The only informaiton you are obligated to give the police is your legal name.

I would prefer to think that a decent human being, if working as a police officer, would flat-out refuse to haul a child off to jail for drawing a picture, relinquishing his job if need be.

No you didn't contradict yourself, you just led us to the obvious conclusion.
I'm sure the justification is as a "scared straight" sort of thing, but even if that stuff really worked it would be a wholly inappropriate thing to do with a child struggling with some degree of mental illness.
I can tell you from experience that the only thing locking a kid up who is having mental troubles (whether in jail or the psych ward) will accomplish is to have that kid never tell anyone about the troubles he's having again. The next time this kid sees his therapist, that person is going to play hell getting him to talk about anything.
What if the drawing had been of teacher in the center of a bukakke circle?

Meanwhile kids can still draw a picture of themselves shooting dogs if they're interested in a fasttrack to a law enforcement career.

I graduated from high school in Fairfax County, but that was before the advent of zero tolerance. Not that I'd have gotten into trouble like this, but I'm glad I missed that whole atmosphere.

Just one point of interest your post reminded me of: Arvada is practically next door to Columbine, so the folks around there are still a little nuts on this subject. Lovely people otherwise, but "once bitten twice shy" and all that.
Nixon era here. We had on campus student smoking areas in my high school. Students actually handled starter pistols as props in plays. Tom Lehrer's Vatican Rag was played over the PA system before school by the Radio and TV club one morning, Jethro Tull's Cross Eyed Mary on another.
We were the most free high school students up to and after us.

I graduated in Alabama in '84. Lots of us carried pocket knives then--most guys in the South just do that--and lots of us had shotguns, .22s, .30-30s in the trunk or the back of a pickup, esp. during hunting season. None of us shot up the place either.

Clearly, something's missing from this story, and usually the things that go missing from stories like this are things that paint the school or the police in a bad light.
Pure speculation on my part: I predict it will come out that (at least) one of the boy's classmates mentioned the incident to a parent, who called police.
