Another Gitmo Detainee Is Released
…after eight years of imprisonment. The ruling came last month, but its relevance is magnified by Charlie Savage's report in the New York Times yesterday that Obama has essentially dispensed with his campaign promise to close down Guantanamo.
What's most significant about this is that Hassen is now the 36th detainee who has won his habeas hearing since the Supreme Court in 2008 ruled they have the right to such hearings -- out of 50 whose petitions have been heard. In other words, 72% of Guantanamo detainees who finally were able to obtain just minimal due process (which is what a habeas hearing is) -- after years of being in a cage without charges -- have been found by federal judges to be wrongfully detained. These are people who are part of what the U.S. Government continues to insist are "the worst of the worst" who remain, and whose release is being vehemently contested by the Obama DOJ.

Because the Geneva Convention allows countries to hold uniformed soldiers of declared enemies as POWs.

The unofficial version -- you know, the one they don't dare advance in a court of law -- is that Obama thinks they are guilty, but there isn't enough evidence to actually convict them, so a * slight * bending of the Bill of Rights is necessary to protect Obama's ability to retain hawkish independent and Democrat votes the American Public TM.
It is important to acknowledge that this is a continuation of previous Executive policy. This is in danger of becomming accepted by the American People as the way the system is supposed to work.
An Executive who operates by his own interpretation of the law, and a Congress that no longer feels bound by the limits on Government outlined in the Constitution.

A major corporation advertised a contest entry with every purchase.
I made a purchase, and asked for my contest entry.
I was then told that, even though I was standing next to a poster-sized advertisement saying that it was with any purchase, some purchases didn't count.
This annoyed me, and even though it was only 5 bucks, if you annoy me I will crucify you for it if I can, even if it's only 5 bucks.
And I'm asking the question about what the actionable damages are because if I can fuck these guys for the cost of the prize, I'd love to.

The best are the ones with an asterisk next to the appealing part of the deal, and then no explanation of what the asterisk means anywhere on the advertisement. In that case I guess it's equivalent to a six-year-old crossing her fingers behind her back.
So when I say "...could easily be shown to be..." in violation, I don't mean that it was obvious in advance. I mean that the discrepancy between their advertisement and my experience makes it an open-and-shut case of false advertisement and an unfair and deceptive trade practice. So go fuck yourself.
Not the amount of the prize, certainly, but there could be fairly sizable damages, depending on the severity of the offense. Those UDAP laws often involve per-violation penalties ($11,000 is a popular amount) along with fees and treble damages.
IANAL, but agreeing with Pro Libertate---it really depends on the text of the consumer protection statutes in your state.

God GTMO is a mess. I'm glad these guys are getting their day. I also fear we will be seeing some of them again. Of course, you could make the argument we created our own karma if we do see them again.
I'm still glad we are at least seeing something that resembles US law with respect to GTMO.
So why are they doing this? It can't be for propaganda purposes, because nobody knows who's there. If they just wanted it to be known that some person or persons were there, they could just hold onto one, or simply hold onto none and lie about it, because nobody can ever prove them wrong.
Therefore it seems the administration's experts are just deluded. A judge looks at the same evidence they have, or likely even less, and concludes they're nuts.
The remaining possibility is that the judges are nuts, or have something against the administration.
The only other other possibility I can think of is that the news people are lying -- that they've made up this story from whole cloth, secure in the knowledge that, since nat'l security is involved, you can't trust any denial on the part of the judges or the admin.

Most people had more realistic expectations about Obama's ability to change the direction established by the Bush administration than that, particularly in the context of the current climate in the legislative branch. 18 months isn't a lot of time to undo some of these messes.
