If You're Going to Arizona, Be Sure to Have a Passport in Your Car
My column tomorrow is about the recent revisions to Arizona's new immigration law, which I don't think will do much to discourage the sort of racial profiling practiced by Maricopa County Sheriff Joe Arpaio. One change I did not have space to discuss is a reduction in the penalty for legal residents who fail to carry their immigration papers. In the original version (PDF) of the law, this new state offense was punishable by up to six months in jail and a fine of $2,500, the usual penalty for a Class 1 misdemdeanor. In the revised version (PDF), the maximum penalty is a $100 fine plus 20 days in jail, 30 days for repeat offenders. The new penalty corresponds to the one for the federal version of the offense, presumably with the goal of making the law more likely to withstand legal challenge.
Another thing I noticed: The law recognizes a driver's license from another state as proof that one is not "an alien who is unlawfully present in the United States," but only if that state "requires proof of legal residence in the United States before issuance." According to this fairly recent summary, about half a dozen states don't. So Latino drivers from, say, Michigan could be in for a real hassle if they happen to be pulled over in Arizona, even if they are native-born U.S. citizens. Considering that a perfectly legal visitor from Mexico was nabbed by Arpaio's deputies and detained for almost nine hours even though he presented several forms of ID, including a valid visa, Latinos from states that don't meet Arizona's criteria probably should carry a passport. Or just avoid Arizona.
Finally, a correction: Last week I noted Linda Chavez's concern that Arizona's law requires all state and local government agencies to be on the lookout for unauthorized residents. She apparently was relying on an earlier version of the law, which ambiguously referred to "a law enforcement official or agency of this state or a county, city, town or other political subdivision of this state." The version signed by Gov. Jan Brewer instead refers to "a law enforcement official or law enforcement agency."

I've never been to AZ but isn't there a high probability the cop is a "legal latino"? Almost no native-born Hispanics and few legal residents are going to look and act like recent immigrants from Mexico.If you live in a racially and ethnically diverse community the "greenhorns" are pretty obvious.

As a legal inmigrant, I'm opposed to illegal inmigration. I opposed it in my own country, and I opposed it in my country of adoption. Still, that does not justify racial profiling.

The only ones who may get screwed in AZ are Native Americans, who may look Mexican, speak Spanish and are already protected by the Treaty of 1794 (Jay Treaty) which the US ignores in Violation of the UN treaty protecting indigenous peoples. Only the US and CA have failed to acknowledge this Treaty.

What I failed to realize is that a valet or maid could be a participant. Truly, the rich aren't like the rest of us.
You had better hope that she has all of her proper paperwork with her... its a FELONY for transporting an unauthorized alien. This law works with the presumption of guilt based on some hokey LEO 'reasonable suspicion' where they can detain her until they verify. At that point they now have 'probably cause' to believe you are committing a felony becaue they suspected she was an unauthorized alien and she didnt have her paperwork to prove otherwise, they could detain you too. Which means your car gets towed at your expense. Of course, when it is all said and done several hours to several days later and you care cleared, you get your car back... provided you pay the towing and impound fees.

Federal law requires foreign nationals to carry their immigration papers and visas on their person at all time.
I'm not sure this is the case for legal residents.
But in either case, it doesn't REQUIRE local law enforcement officials to ask. It only requires you to have the papers in case they do.
So before this law was passed in AZ, law enforcement officials were NOT supposed to ask if an immigrant had proof of their immigration status?

Some of the people stopped and asked for papers are going to be legal residents and Americans, who will be fucked if they don't happen to have valid proof of residency on them.

You do not need an ID to vote (by law, AFAIK, they cannot ask for one). You can fly without an ID, even today. And I have never been asked for an ID when entering a federal building... but then, I've only been to a courthouse and some post offices.

Did you read the post? A driver's license does not necessarily prove legal residency. In neighboring New Mexico, you don't have to establish your residency to get a license. This means that any New Mexican resident not carrying their passport or military ID in Arizona can be legally detained.
Only about 1/5 Americans even has a passport, a number that is probably lower in a rural state like New Mexico. And an even small percentage of the population carries a military ID.

It does? I thought it says that Cops can ask if a person has proof of immigration status during a routine stop. Not randomly pulling over people cause their brown, but specifically during any routine stop. If a person is a US citizen then they would normally have some type of ID that can verify them already. A drivers license or even a state ID would be a valid proof of residency. This is a lot to ask for? It's already against the law to drive without your drivers license in your possession.

It has to meet the standards of a "Terry Stop".
It actually is not limited to stops - it can be ANY lawful contact which could be something as simple as walking up and asking an officer for directions - which you know... is reasonable suspicion that the person is not from around here.

Again, the law doesn't ask cops to arrest people for standing around or going for a jog. It says if they are arresting them and they don't have legal immigration cards they can enforce a Federal Law.

There's a chance the police might think that about anyone's id. As a general rule the cops have computers in their patrol cars and can check it out immediately. Better get your drivers license photo updated, sugar britches.
As Mr. Sullum pointed out, a license from several states, including neighboring New Mexico, does not establish residency. Can you think of any other form of ID that you have with you normally that might verify residency?
Before this law was passed, if a cop pulled someone over, they were to ask for your licence, if you didn't have one they were to ask for ID. Don't have that, they were only allowed to give you a ticket for driving without a license, but couldn't ask about your legal status.

Yup, Green Card holders are supposed to carry our Green Cards on our person at all times- but I've never been asked for mine except at the border.
No legal immigrants do not have to carry their papers, but everyone is required to carry ID of some sort. The really amusing part, that everyone is missing, is that AZ is a no-hassle state, so if you aren't doing anything wrong, you can legally refuse to show ID. I know, I have done so!!

Thx u Alabama - Someone finally got it right. All AZ is trying to is to enforce a Federal Law that the Federal Gov't doesn't seem to feel is an importment issue. If a Federal ICE Agent pulls someone over government in AZ, CA, TX, FL or wherever and ask about their immigration status, nobody gives a crap. But now that a cop in AZ does the same thing - now the whole state is racist. But if the Fed. Gov't agent does it then he or she also most be a racist. And if that person is a racist. And when you get a catastrophic illness (or even, like, a non-catastrophic illness) and your medical bills require your insurance company to pay out amounts far beyond what you have ever paid in premiums, are you going to call them and insist that they not use other, non-ill policy holders' money to pay for your expenses. Have you tried leveraging that advantage to get free stuff?If you get taken for Hispanic (by which I assume you mean mestizo) or middle eastern, you could try to identify yourself with a native american tribe, and get all sorts of goodies from the federal government. You might not feel all that good about yourself for it, but getting stuff at someone else's expense is always fun.

I live in Texas, I can tell you that the reason the border states have poor education ratings is because half the population doesn't speak English. This results in a lowering of standards for everybody because it's too difficult to teach.
Because their are only a finite amount of resources on this planet, evolution has given everyone a gene that says "try to kill everyone that's different from you". This is why diverse areas of the world have more problems then homogeneous ones. The countries with the lowest crime rates are homogeneous Japan/Korea while South Africa, the "rainbow nation" is so diverse that women are more likely to be raped then learn how to read. Soon, thanks to pro-immigration people like you, everyone will be living in gated communities where we can't ever feel safe.
Finally I think the reason economic freedom is so rare in the world is because the wealth it generates attracts hordes of socialists who overwhelm the culture that created it before they have time to understand WHY that area had jobs/wealth and assimilate (which probably takes 3 generations)

I was illegal for nearly 10 years in this country (thanks a lot, INS). The police entered my life a few time during that time, and not once did they ask for my green card, although apparently they COULD under federal law. Why? I probably liked a dorky little Asian kid at the time. Perfectly harmless.
I'm kinda with Pablo here - it is disappointing to see the libertarians buy into scaremongering like this. I probably have a better chance of getting shot by a trigger happy cop (who interpreted a cell phone in my hand as a weapon) as a citizen NOW than getting hauled by a rogue Arpaio type during my illegal days.
I said this before, and I'll say it again. Your real enemy is the INS, red tape, and their SLOW legalization process. They're the reason why so many Latinos opt for illegal border crossings in the first place. (Reason was quick to recognize this) Now they're worried about getting pulled over by AZ cops for looking and smelling foreign.
I didn't have my green card when during my freshman year at college, meaning I wasn't eligible for financial aid. My parents had to sell their cars and borrow heavily from relatives abroad. That's the real kind of crap illegals have to deal with, not this immigration raid and racial profiling nightmare dreamed up by the Latinos. Some slick lawyer will have a field day pointing to the "no racial profiling" language in the new law the minute they try to deport anyone.

For F*&%ck's sake what a bunch of whiney little pussies. I lived outside the US for almost 10 years. Everywhere I went I needed to have identification and many countries required a visa. No problem just carry it and just get it simple or don't visit or live there.
My wife is from Asia it was not an easy process to get her into America and it took a fair amount of time and money but we did it the proper way.
One of the first questions she asked,"Who are those men standing around in the supermarket parking lot?"
I explained they were illegals looking for work. She explained in her country illegals so blatantly breaking the law would be round up and deported.

All that has to be done is wait for a legal resident of Latin origin to be stopped and detained for no papers. Refuse to identify as you are resident. Then take the f'ers to court and invalidate the law. Simple.
