A Pot of Money to Piss On
Last fall Marc Emery, Canada's self-proclaimed "Prince of Pot," reached a plea deal with the U.S. Justice Department, agreeing to serve five years in federal prison for the crime of selling marijuana seeds to Americans via the Internet. But the Drug War Chronicle reports that Emery is still hoping to avoid deportation, which Canadian Justice Minister Rob Nicholson can block if he concludes that the punishment Emery faces is grossly disproportionate or that his prosecution was politically motivated. There is strong evidence on both counts. While Canada treats selling cannabis seeds as a minor offense punishable (if at all) by modest fines, the U.S. government depicted Emery's Vancouver-based business as part of a criminal conspiracy that could have sent him to prison for life. And after Emery was busted in 2005, then-DEA Administrator Karen Tandy made it clear that he was targeted for his political activism as much as his seed sales, declaring:
Today's arrest of Mark [sic] Scott Emery, publisher of Cannabis Culture magazine and the founder of a marijuana legalization group, is a significant blow not only to the marijuana trafficking trade in the U.S. and Canada, but also to the marijuana legalization movement. His marijuana trade and propagandist marijuana magazine have generated nearly $5 million a year in profits that bolstered his trafficking efforts, but those have gone up in smoke today. Hundreds of thousands of dollars of Emery's illicit profits are known to have been channeled to marijuana legalization groups active in the United States and Canada. Drug legalization lobbyists now have one less pot of money to rely on.
In light of the huge gap between Canadian and U.S. policy regarding cannabis seeds, and given the evidence that the U.S. government is seeking to punish Emery for his outspoken criticism of marijuana prohibition, there seems to be a persuasive case for preventing his extradition. Canada's Extradition Act says the justice minister "shall refuse to surrender a person when that surrender could involve unjust or undue or oppressive actions by the country to which he is being extradited." Nicholson is supposed to make a decision by May 10, but he could ask for an extension.
Emery's cause has attracted support in Canada's parliament. "Many dedicated individuals have collected approximately 12,000 petitions reflecting a strong belief that Mr. Emery or any Canadian should not face harsh punishment in the U.S. for selling cannabis seeds on the Internet when it is not worthy of prosecution in Canada," M.P. Libby Davies, a New Democrat who represents Vancouver East, said last month. Liberal M.P. Ujjal Dosanjh, former attorney general of British Columbia, said "it appears to me that we have assisted a foreign government arresting a man for doing something that we wouldn't arrest him for doing in Canada."

As an American, I'm appalled that my country's leadership is seeking to punish this man. He broke no laws in America; his acts took place on the soil of Canada. We have no legal standing on which to seek his extradition. I hope that the Canadian leadership does the right thing and denies this extradition.

Prohibition is a sickening horror and the ocean of incompetence, corruption and human wreckage it has left in its wake is almost endless.
Prohibition has decimated generations and criminalized millions for a behavior which is entwined in human existence, and for what other purpose than to uphold the defunct and corrupt thinking of a minority of misguided, self-righteous Neo-Puritans and degenerate demagogues who wish nothing but unadulterated destruction on the rest of us.
Based on the unalterable proviso that drug use is essentially an unstoppable and ongoing human behavior which has been with us since the dawn of time, any serious reading on the subject of past attempts at any form of drug prohibition would point most normal thinking people in the direction of sensible regulation.
By its very nature, prohibition cannot fail but create a vast increase in criminal activity, and rather than preventing society from descending into anarchy, it actually fosters an anarchic business model - the international Drug Trade. Any decisions concerning quality, quantity, distribution and availability are then left in the hands of unregulated, anonymous, ruthless drug dealers, who are interested only in the huge profits involved.
Many of us have now, finally, wised up to the fact that the best avenue towards realistically dealing with drug use and addiction is through proper regulation which is what we already do with alcohol & tobacco, clearly two of our most dangerous mood altering substances. But for those of you whose ignorant and irrational minds traverse a fantasy plane of existence, you will no doubt remain sorely upset with any type of solution that does not seem to lead to the absurd and unattainable utopia of a drug free society.
There is an irrefutable connection between drug prohibition and the crime, corruption, disease and death it causes. If you are not capable of understanding this connection then maybe you're using something far stronger than the rest of us. Anybody 'halfway bright', and who's not psychologically challenged, should be capable of understanding that it is not simply the demand for drugs that creates the mayhem, it is our refusal to allow legal businesses to meet that demand.
No amount of money, police powers, weaponry, diminution of rights and liberties, wishful thinking or pseudo-science will make our streets safer, only an end to prohibition can do that. How much longer are you willing to foolishly risk your own survival by continuing to ignore the obvious, historically confirmed solution?
If you still support the kool aid mass suicide cult of prohibition, and erroneously believe that you can win a war without logic and practical solutions, then prepare yourself for even more death, corruption, terrorism, sickness, imprisonment, unemployment, foreclosed homes, and the complete loss of the rule of law and the Bill of Rights.

See, while leniency for seed sales might be Canada's practice, it's not actually Canada's law. If such sales were not punishable by more than a year in prison under Canadian law, the U.S.-Canada extradition treaty itself would declare him ineligible for extradition.
If the Canadian Parliament really wanted this guy's actions to go unpunished, they could simply amend Canadian law to reflect that, and he'd be ineligible for extradition. Clearly, the Canadian Parliament actually doesn't have any problem with U.S. courts and prosecutors enforcing Canadian laws that Canada's courts and prosecutors refuse to enforce.

We have the same constitutional inheritance as you guys, actually, although (like most of the ex-British Empire) we started to give up on it earlier than you, in the post-WWII era. Frankly, though (and having lived in both countries), at this stage I'd say that NZ (for all its flaws) is freer -- economically and socially -- than the US now.

What I think is most shocking is that an employee of a federal law enforcement agency thinks it's within her province not just to enforce the current law, but to prevent the law from being changed. That is just so far over the line I don't know where to begin.

The creepily unstable tone of DEA Administrator's public statement on Emery's arrest is revealing. She actually employs puns. This is so wrong, & yet somehow appropriate. It's as if she doesn't know whether to think he's wreaked such evil that she was obligated to destroy him, or that does it's all a joke. What a ghoul.

"Marc Goes to Jail on Monday Morning, May 10th...but we hope to have him out on bail again the same day. Marc's bail conditions require that he turn himself in at 9am on May 10th, or when the Justice Minister makes a decision about the extradition. The prosecutor claims that the Justice Minister has all day on the 10th to make a decision, so Marc can get out on bail after 1pm our time (4pm Ottawa) unless he's ordered extradited.
The Justice Minister must apply for more time to make the decision if he doesn't do it by the 10th. We would seek to have Marc released on bail for the same amount of time the Minister receives as an extension (likely 30 to 90 days).
I think we have to have the bail paperwork done and signed by our four sureties in different cities before they court will release Marc, but it seems that's not likely to be done by 4pm if the bail hearing happens after 1pm... That means Marc would be sent to North Fraser pretrial for the night and we'd have to get him out the next morning, hopefully.
Apparently it's possible that he might be able to get out on Monday without us having to finish all the paperwork first... but I don't know how that would work out... so I guess we'll just wait and see how it unfolds on Monday. Follow updates from me on Facebook.
