Let's Lock Up Mom and Dad—for the Heck of It
Nevada state Sen. Joe Heck (R-Las Vegas) thinks people who grow marijuana—even one or two plants for personal consumption—in homes where children are present should do serious time. A bill he has introduced would send them to prison for up to 15 years. Heck recently explained his reasoning to the Senate Human Services and Education Committee:
You are exposing children to dangers when you are selling any illegal substance out of your house or growing any illegal substance out of your house, so you should be held to the higher penalties. If a guy has a couple of [marijuana] plants in there [now], he could be out in a week. But if there is a child present, with this, now he could serve five to 15 years for exposing that child to the dangers of this activity. The very behavior of small children puts them at risk around these materials, including marijuana. As any parent knows, the first place a toddler places anything they find is in their mouth. What if this object is a marijuana plant?
The dangers associated specifically with growing an illegal substance, of course, stem from the fact that it is illegal. Hence growers run the risk of arrest and imprisonment, which certainly would have a negative impact on their children. Heck's solution: Put the parents away for 15 years instead of a week. As for the risk that toddlers might munch on the marijuana while it's growing, the legal substance known as liquor poses a far more serious poisoning hazard, but most parents somehow manage to keep it away from the kids, along with the drain cleaner and the handguns.

I wonder how long it will be before Heck or someone like him holds up a child who turned his parents in for a couple of pot plants as a "hero of the state"?
apparently it's better for a child to grow up parentless than in proximity to some house plants. y'know, importance of family and all.
This is retarded. You can eat all the pot you want, and you won't get high. The THC doesn't release until it reaches a certain temperature. Hence, why I have to put bud in brownies if I want to eat it, and can't sprinkle some bud over the top of my spaghetti.
Parents who risk jail time for something as obvious as pot plants have serious problems. Regardless of whether it should be legal (it should), there's no excuse for risking jailtime when you have a kid. That said, on what planet is more jailtime a good solution?
OH GODDAMNIT!
How much bullshit can these asshats sling before someone calls shenanigans on them.
This guys got his head so far up his ass he can lick his own tongue. Jacob nails him on the major errors. I'll just reiterate, the problem is it's illegal, and everything Sen. (see you in) Heck wants to do makes it much worse.
Screw you guys, I'm going home.
What if this object (eaten) is a marijuana plant?
It bet it would be safer for a child (or anyone) to eat a marijuana plant than to eat any ot the following:
Chrysanthemums
Caffir Lily
Poinsettia
English Ivy
Hydrangea
or
Azaleas
As any parent knows, the first place a toddler places anything they find is in their mouth. What if this object is a marijuana plant?
And what if they put poinsetta, angels trumpet, devils trumpet, or tomato plants in their mouth?
A bill he has introduced would send them to prison for up to 15 years.

Ah, but marijuana growing parents are sending the "wrong message" to their children.
Can the Nevada Senate just pass a bill forbidding Sen. Heck to come within 1,000 feet of any other citizens?
Dammit! Arggggh!
I propose a law making it illegal to justify a new law on the base argument of "it's for the children". Punishment: DEATH!
What a tool. Automobiles are pretty friggin' dangerous too.
I tried to understand this guys logic and now my head hurts.
This is one area where I agree with the majority here.
The only thing good I can see here is that the more insane the laws proposed, the more it will push the average joe in the direction of being in favor of ending the WoD.
Cab and Tym make a good point. Obviously the health of the children isn't the concern on the part of the state here. There are plenty more common and less guarded houseplants that could seriously hurt a person if ingested.
Confidential to my non-believing heathen brethren: Let's rekindle that war on Christmas! We'll start by banning pointsettias!
Dan T.: You'd think that wouldn't you...somehow I have a lot less faith in the average joe's bullshit detector and ability to resist the "for the children" mentality.
It's a well known fact that Nevada hates children.
I don't know what you're all talking about. Finally we have a politician who cares enough about children to do something stupid and pointless ont heir behalf.
Hey, it could be worse. He could be trying to ban spanking.
This bill is the natural reducto ad absurdium result of combining child abuse prevention with the drug war.
"You are exposing children to dangers..." like being shot in the face by a policeman.
Tym,
Nice logrolling. Check the first plant under M on your list. I think it's probably just there because it's illegal, but still.
Thinking about drug laws seems to produce a great deal of positive feedback. The legislator in question is probably a sensible person, but there's just something strange and anomalous about drugs laws (and probably some other kinds of law) that invites thinking like this.
Crap. All of those plants are poisonous? How did any of us survive childhood? LOL.
Jacob Sullum,
Do you know what Heck's position on adoption by gay people is?
Dan T.: You'd think that wouldn't you...somehow I have a lot less faith in the average joe's bullshit detector and ability to resist the "for the children" mentality.
True, but don't you think in general more people are weary of the WoD than they were 10 or 15 years ago?
Tym,
Nice logrolling. Check the first plant under M on your list. I think it's probably just there because it's illegal, but still.
Agreed, I spotted that after I posted it. Honestly, I just googled "Poisoness Plants" and cut and pasted the first list I found.
Not to mention that fact that growing up with a parent in prison has proven to be just GREAT for most children!
So they are saying it is better to grow up in the foster care system than with loving parents who just happen to choose a pharmacologically safer alternative to alcohol. The logic or lack thereof never ceases to amaze me.
No, Tym, I don't think anyone views it that way. Rather, I think they view jail as the unfortunate thing you have to go thru with in order to make the threat real enough to be a deterrent. Like war or violence in general -- it's always bad, but only results when deterrence fails, and if you back away from war, you have no deterrent.
Well, if he really wants kids to stay away from pot, he should just declare that in Nevada, marijuana is a leafy green vegetable. Then no kid on earth will touch the stuff.
Interesting. This comes from a state where out and out legalization of marijuana is closer than any other state in the country.
TP Goiter: Perhaps that is why he's pushing this. Trying to rekindle the marijuana is bad for the children sentiment.

It's possible, but the gubament was in their this most recent election with a ton of ad money (which is interesting that in that it's not caught in the "Fair use" racket) and the legalization side still picked up what, 8 percentage points?
Concerned Dad: Where did you learn how to grow such primo buddha?
Surly Son: I learned it from you, Dad! I learned it from you!
This reminds me. I once tried to smoke a mix of Cocklebure, Corn Cockle, Corn Lily, False Hellbore, Cow Cockle, and Creeping Charlie, and it didn't do a damned thing. Talk about a rip-off.
As any parent knows, the first place a toddler places anything they find is in their mouth.
Hmmm...that sounds like a good cover story.
A few more laws like this and no one in their right mind is going to have kids. It's just too risky.
Thomas Paine's Goiter,
... the gubament was in their this most recent election with a ton of ad money ... and the legalization side still picked up what, 8 percentage points?
The only reason that much was picked up was because the penalties for too much usage, or usage around kids, would have been more heavily penalized. Remember, this is the same state where it is now illegal to smoke (tobacco) in any public establishment. Exceptions are made for casinos (no, not the convenience stores that have video poker machines, or restaurants or movie theaters in the casinos), brothels (not legal in Clark or Washoe counties or Carson City), bars that serve NO prepared food (like sandwiches, for instance), and smoke shops, where minors are not permitted.
Grotius,
Do you know what Heck's position on adoption by gay people is?
Well, considering that Nevada has one of those fucktarded "Defense of Marriage" acts written into its Constitution, that's really a moot point. I would be surprised if any court in this state would grant adoption to a single person instead of a married couple. I would not be too surprised if a court decided to take a kid away from a lesbian who had a kid through insemination.
I personally think its a big ruse to suggest that the folks in Nevada are way too retarded,(as evidenced by there legislators), to recieve the countrys nuclear waste....oh....and what are they gonna do with the kids? Farm them out to foster care in Wyoming?
If I ever run for President, part of my platform will be: "anything you can grow in your back yard is legal."
Why doesn't any politician put forth legistlation that would call for the immediate execution of any Politician or Civil Servant found guilty having broken any laws or infringed on a Citizens civil rights.
I think we need a ZERO Tolerance law for these folks since obviously they can not police and prosecute themselves very well. After all think of all the children looking up to these folks as role models. Lets execute them for the children. This model seems to work well for any of their assbackwards ideas. Lets apply it back to them.
