Rest in peace: Dick Cheney, vice president to George W. Bush, neocon extraordinaire, and rather poor marksman, died this morning at 84 due to complications of pneumonia, as well as cardiac and vascular disease.

Cheney "consistently defended the extraordinary tools of surveillance, detention and inquisition employed in response" to the terrorist attacks on 9/11, writes the Associated Press. He took the role of veep and transformed it into something much more muscular and assertive, shaping the Bush administration's approach to the war in Iraq. He was no fan of transparency in government and he was a huge proponent of expanding executive power.

"In 34 years," Cheney said in January 2002 on ABC's This Week, "I have repeatedly seen an erosion of the powers and the ability of the president of the United States to do his job….One of the things that I feel an obligation [to do], and I know the president does too, because we talked about it, is to pass on our offices in better shape than we found them to our successors. We are weaker today as an institution because of the unwise compromises that have been made over the last 30 to 35 years."

"As chief of staff under President Gerald Ford in 1975, [Cheney] saw the power of the presidency diminished on his watch," wrote Financial Times' Caroline Daniel back in 2006. "By 1989, he had forged his own critique of Congressional overreach in foreign policy. 'When Congress steps beyond its capacities, it takes traits that can be helpful to collective deliberation and turns them into a harmful blend of vacillation, credit claiming, blame avoidance and indecision,' he warned. 'The presidency, in contrast, was designed as a one-person office to ensure it would be ready for action,' capable of 'decision, activity, secrecy and dispatch.'"

Tariffs up for consideration: Tomorrow, the Supreme Court hears arguments in the case that will decide whether President Donald Trump overstepped his powers when he used the International Emergency Economic Powers Act to unilaterally levy tariffs on a whole host of nations.

"This is all about foreign policy. This isn't 1789 where you can clearly delineate between trade policy, economic policy, national security policy and defense policy. These things are all completely interconnected," a first-term Trump adviser told Politico, articulating the MAGA-world vision of why the usage of IEEPA is defensible. "To diminish the tools he has to do that is really dangerous."

The justices may well disagree. But if they don't, and Chief Justice John Roberts rules in Trump's favor, he will incur a huge loss of credibility that will say a lot about the Court's posture toward Trump and his second term.

"Just two years ago, Roberts led the Supreme Court in rejecting a similar claim of unilateral executive power by then-President Joe Biden," writes Reason's Damon Root. "If Roberts now allows Trump to get away with the same kind of executive overreach that Roberts previously stopped Biden from getting away with, Roberts' credibility as a principled judicial arbiter will be sullied forever."

Credibility hit aside, there are other reasons why the Court should reject the arguments put forward by the administration. "The constitutional authority 'to lay and collect Taxes, Duties, Imposts and Excises' as well as the authority 'to regulate Commerce with Foreign nations,' are assigned exclusively to Congress, which means that Trump is wielding power that the Constitution did not grant to him," argues Root. "His tariffs thus deserve to be struck down for violating both the constitutional separation of powers and the nondelegation doctrine." They also "violate the major questions doctrine, which says that before the president may wield significant regulatory power, the president must first point to a clear and unambiguous delegation of such power to him by Congress"—but tariffs appear nowhere in the IEEPA, so the administration will have a very hard time making that case.

If the justices don't rule in Trump's favor, it seems likely that his people will come up with alternate routes to do pretty much the exact same thing: "The White House has already laid some of the policy groundwork under those authorities, such as the 1970s-vintage Section 301, which the U.S. used against China in Trump's first term," per Politico, "or the Cold War-era Section 232, which allows tariffs on national-security grounds." They might spend more time investigating other countries' trade practices in an effort to gain leverage and secure more favorable deals. There's also Section 338, "a rarely used provision that's been on the books for nearly a century" that could let the president "impose tariffs of up to 50 percent on any country, if he can explain how they are engaging in 'unreasonable' or 'discriminatory' actions that hurt U.S. commerce." Such things would also probably be challenged in court, but Trump could run his way through all these different approaches, test them out, impose trading havoc in the meantime, and possibly find some means of imposing his desired protectionist agenda.

Where there's a will, there may unfortunately be a way.


Scenes from New York: Yep. Zohran Mamdani appearing on the ballot twice is predictable: He is the candidate both for the Democratic Party and the Working Families Party. I am curious about what effect Cuomo being in the second row will have, to the extent that such a thing can be studied. (And I've never been asked for ID when I've voted in New York, which always rubs me the wrong way.)

    Dick Cheney Has Died

    Former US congressman, SecDef, and VP Dick Cheney is reported dead. I think it is fair to say he was one of the stronger, more effective policy-influencing VPs in modern American history. Cheney was 84 years old.

      CBS News this morning led off with a remembrance of that quail-hunting incident, before even announcing that he had passed. I was left to wonder if it was the 20th anniversary of that story or something.

      I have no great love (or hatred) for the guy, but I found that to be quite gauche.

      They did at least end the segment by interviewing a guy who said that he 'transformed' the VP role into what we have today, with more involved Veeps. Whether that's a good thing or not, he didn't speculate or elaborate.

        He was the most intelligent person in the white house in the 21st century, and it's not particularly close. But given his consistent abuses of power and the fact that he was at least 50% responsible for the administration that destroyed conservatism, I'm gonna lean towards hatred.

      One of the charts in that post showed SNAP funding changes by state since 2019. Most states / territories were up less than 1.8x (which is a lot) and none were down, but there were a few which were significantly over 2x, and one (Minnesota) was nearly 4x.

          I didn't see anywhere that you said that, but you defended Sarc saying it, trying to minimize the awfulness of his statement. You ascribed a joke attempt to his statement, when there is zero evidence that it was meant as a joke.

          Sarc of course has a right to say it, and you have a right to defend his saying it. But I (and presumably others) will certainly draw conclusions by your words and actions, and one of those conclusions is that you appear to NOT think that rape and getting fired from a federal job are wildly disparate things. Another is that you do not appear to think that Sarc was maliciously wrong for implying that rape is just something you get over.             No. The reason Sarc picked rape, I think, is exactly because they are disparate. It is a technique to show the principle on which a something is based is not sound because it doesn't hold up in extreme situations.

            Sarc didn't say it's just something you just get over, he said rape victims will eventually be fine. I do not think that's maliciously wrong, i think it's demonstrably true.

                I didn't mean to imply a joke, I meant to imply speech rather than a physical and violent crime.

If you have NO enforcement of the law, then that leads to a state of anarchy, in which no one's liberties are effectively protected. If you have TOTAL enforcement of the law, then that leads to a police state, in which again no one's liberties are effectively protected. So there must be some balance between NO law enforcement and TOTAL law enforcement.     We increased almost 40% on this program in just a couple of years under the Biden administration.

    We have found thousands and thousands of of illegal use of the EBT card. We have been moving people off of SNAP. We’ve got almost 700,000 people, I think, we’ve moved off just since the president took office. We’ve arrested about 118 people. So this has been ongoing.

    We found one guy in six different states getting benefits. We found about 5000 people that are dead who are still getting benefits.

                I have cable and a DVR. Mostly it's for sports. I like to be able to record the game and start it about an hour later so I can cut out the commercials and halftime/intermissions. By the time I get to the end of the game it's live. Also, the NHL Center Ice package (so I can watch my Pens games) is crazy cheap now, about $60 for the season.

                I don't spend much on anything, so this luxury isn't hurting me. But I will admit, the majority of what I watch on my tv is YT and podcasts that I cast to my tv from my phone, so I probably don't need cable/DVR.

      They didnt shut down the govt last time because they are the party of govt agency loving, big gov loving, govt is the answer to everything people. And they knew shutting down the govt despite the fact that they normally lament govt shutdowns (they have cried about every one) and previously blamed R's for when Obama was in charge.

      Fast forward to now, Schumer and the squishy dems got a ton of shit for NOT shutting the govt down, by their radical, tear everything down and watch it burn 70 IQ base, and now they gave in to the retards who cant think 5 minutes from the next action they take.

      They didnt have a plan, they didnt really even have an ask, and they just lost everything, ending up hurting their base anyways, and got literally nothing from it, other than showing everyone how much they dont need govt (other than the welfare queens).

      Truly one of the biggest political own-goals of our time.

          Like the problem is just NYC. Minnesota automatically registers you to vote when you get your drivers license, and there's no requirement you're a citizen. MN House hearing member proved that an illegal immigrant can in fact vote, and the guy she's interrogating admits it in a roundabout way.

          1. You get your drivers license, no citizenship requirement.
          2. The driver's licensee signs that they're "eligible to vote" You're automatically registered to vote.
          3. During the voting process, they show their driver's license which only proves they are who they say they are.

          A California senator claimed it wasn't "widespread" and he was challenged by another who literally showed him the website where you sign up and register to vote, and the website literally allows you to register to vote by clicking the box underneath each question about social security or driver's license: I don't have one-- which allows you to proceed to register to vote. All of this, 100% of it was created because white liberals claimed that black people were too stupid to navigate public life and therefore would disenfranchised by ID requirements.

          The ONLY question remaining is NOT "are illegal immigrants able to register and vote" the only remaining question is, "how much are they participating". That's the only question left. To be completely honest about how many illegals are actually voting, one must at least acknowledge that it's possible that many illegal immigrants are choosing to not participate in this process, which they are literally... legally able to perform-- legally by following the simple process many states have laid out to allow them to register. The debate has pretty much been settled as to whether they're able to register to vote (at least in several states) and the answer is a clear, ringing, resounding "yes".

          Edit: the question about how much they're actively participating will allow Reason to bask in the warm, comforting womb of step 2: Ok, it's happening, but it's not as bad as you say.

        "So Dick Cheney, the man who built his career on wars and deception, ended it by voting for Kamala Harris? No wonder the modern GOP wanted nothing to do with him. The ultimate neocon relic dying politically long before he died physically fitting end to a disastrous legacy," wrote another commenter on X.

    The judge was blistering in his criticism of the police, saying their testimony lacked “credibility” and that they had in fact targeted Tommy for political reasons, which is illegal.

    Incredible outcome.
