Newark Mayor Arrested for ICE 'Trespassing'

Whose jurisdiction is it anyway? If you ask Ras Baraka, mayor of Newark, New Jersey, a federal Immigration and Customs Enforcement (ICE) facility operated by the private prison company GEO Group may have been violating city laws, having failed to obtain required permits and a certificate of occupancy. Baraka showed up with city inspectors this past Tuesday, returning the next day too.

If you ask Trump administration officials, lawmakers were "assaulting" ICE officers, even "body slamming a female ICE officer," according to Department of Homeland Security spokeswoman Tricia McLaughlin.

"We want them to follow our rules, follow our laws," Baraka (who is running for governor, trying to carve out a left-wing lane) told The New York Times on Tuesday. The facility, he added, had also barred city fire and health inspectors on Monday. So Baraka and three U.S. representatives showed up, along with immigration rights protesters, trying to pressure ICE and the GEO Group into allowing inspections to happen.

The facility, Delaney Hall, is right next to Newark Liberty International Airport, and has variously served as a prison, migrant detention facility, and halfway house.

Baraka was arrested on Friday, and McLaughlin says arresting more lawmakers "is definitely on the table."

"The Mayor of Newark, Ras Baraka, committed trespass and ignored multiple warnings from Homeland Security Investigations to remove himself from the ICE detention center in Newark, New Jersey this afternoon. He has willingly chosen to disregard the law. That will not stand in this state. He has been taken into custody," declared Alina Habba, the interim U.S. attorney for the District of New Jersey in a statement. "NO ONE IS ABOVE THE LAW."

It's possible that Baraka is playing a political game, trying to curry favor with voters who despise the Trump administration's agenda. Indeed, I'm open to the idea that it's political stunts all the way down. But it would be good to have greater transparency about what goes on at federal migrant detention facilities. You can believe the Trump administration has a mandate to undo Biden-era border policies and to conduct large numbers of deportations, and still think that cruel, inhumane treatment of migrants—if that is what's happening at Delaney Hall—is not part of that mandate.


Scenes from New York: Sorry to have so much Newark today—like, way more Newark than anyone could ever want—but Newark Airport has been dealing with disturbing radar outages that jeopardize the safety of planes in the air. The most recent one occurred just before 4 a.m. this past Friday and lasted for 90 seconds. A similar 90-second outage happened on Monday, April 28, during peak transit hours. Some of the air traffic controllers "have taken time off to recover from the stress of multiple recent outages" said the Federal Aviation Agency (FAA), which just compounds the staffing shortage troubles that are already plaguing the airport. United CEO Scott Kirby characterized this as them "walk[ing] off the job." (United is Newark's largest carrier.)

"In the past few days, on more than one occasion, technology that FAA air traffic controllers rely on to manage the airplanes coming in and out of Newark airport failed—resulting in dozens of diverted flights, hundreds of delayed and canceled flights and worst of all, thousands of customers with disrupted travel plans," Kirby said, following the initial radar failure. "Unfortunately, the technology issues were compounded as over 20% of the FAA controllers for EWR walked off the job. Keep in mind, this particular air traffic control facility has been chronically understaffed for years and without these controllers, it's now clear—and the FAA tells us—that Newark airport cannot handle the number of planes that are scheduled to operate there in the weeks and months ahead."

Being unable to track planes' locations and communicate with pilots for that long in such a crowded airspace makes it seem like only a matter of time before a horrible accident takes place.

The reductions will last for 90 days but talks will be continuing, so it's not clear what the final deal will look like. (China will also remove seven rare earths from its export control list, which was a huge priority of the American delegation, as multiple industries could have faced substantial disruptions.)

      This sort of jurisdictional issue happens all the time across all levels of government, and the way that it usually works is, the 'larger' government tells the smaller one to fuck the hell right off. For instance, when the county is building a new police station within a municipal boundary, the town doesn't have much to say about it. Or if the state is building an office building in the county, etc.

        Let's stipulate that the city of Newark had some authority to regulate the detention center. Wouldn't the mayor have to follow due process to enter the building? Wouldn't he have to obtain a search warrant from a court? He couldn't just enter whenever he wanted could he?

          In school, I had a roommate who was vegan. He used to eat a pre-packaged enchilada meal and go on with "How can you drink that?" when I'd go through half a gallon of milk in a day. Not an athlete in HS, never once went to the recreational facilities (where I was, between the gym and intramural sports, twice a day), and was the proto-typical definition of "skinny fat" or "Normal-weight obese" before anybody generally had a conceptualization of such physiques.

          But he sure was sure that he was doing better by his body or the environment or something by not eating meat, consuming eggs or dairy, and only owning the one leather belt that came with the suit his grandparents bought him.

        Even if this wasn't nonsense, which to be clear it is, then it would beg the question of why ships hadn't left yet. Tariff policy doesn't explain that decision, but a decision by Chinese officials to slow production as their own hail mary negotiation ploy could.

        Selling even a few things under higher tariffs is still better than those same goods sitting in a cargo yard for years, at least if markets were making decisions rather than the CCP.

        My son works for a large company headquartered in Germany with a large presence in the US and also Canada and Mexico. Most of the manufacturing is done in Europe. He described to me, with some amusement, the employees sorting through serial numbers of various product components trying to figure out the tariff that applies. No question that supply lines have been disrupted. I asked him if the business was in jeopardy and he said no fucking way. I don't know when Germany will hammer out a deal but it will happen and the economy on the other side has the potential to be a lot better than what came before. My son is not MAGA but he agrees with that assessment. Meanwhile with every new deal the markets rocket up. Tariffs were always a negotiating tactic designed to disrupt the current assumptions and produtive negotiations are happening. And the economy is responding. This is what abolish looks like.

    What's odd about it?

    Traditional refugee/asylum policy, the sort that was assumed when the current treaties and laws were written, and which was adopted in wake of the horror that was the Holocaust following the refusal of other countries to take in Jewish refugees from the Nazis in the 1930s, was that when a distinguishable minority group was being actively persecuted by its government, we would let members of that group in.

    And there was a broad consensus in favor of that, even from people who were strongly skeptical of mass immigration in general.

    There were, necessarily, all sorts of edge cases, sure. Those edge cases were systematically exploited by lawyers and activist judges to produce precedents that produced results where an immigration judge would, say, rule that someone was a member of a criminal gang, and thus as a consequence of their gang membership, that someone could not be deported to his homeland -- because back in his homeland he might be killed by a member of a rival criminal gang.

    Protecting criminals from gang warfare was, of course, not at all what the agreed refugee/asylum policy was supposed to do, and so there are many people, even general immigration skeptics, who strongly object to the abused version of the system, but still are perfectly happy to give asylum to members of a distinguishable minority group who are being actively persecuted by their government.

    So let me get this straight.

    The feds dare not challenge sanctuary city's refusal to assist them in deportation, even when they release known criminals back into the population, but a sanctuary city can march to a federal facility and demand entrance.

    It's abhorrent for ICE to raid factories where illegal workers might be exploited, but a mayor has some moral mandate to inspect federal detention center in the name of transparency.

    Donald Trump blustering about Canada being 51st state is some serious breach in protocol and sovereignty, but a democrat senator travelling alone to El Salvador, demanding a meeting with their president to pressure him into releasing their own citizen, and threatening sanctions against them is.... A-ok.

    A major presidential candidate convicted on less than unanimous guilty votes (4 votes required for multiple counts he was never charged with) is just an oopsie, while the Maryland Man saga is a constitutional crisis? The violation of due process being that we accidentally sent him back, after the court granted him reprieve of deportation to his OWN country, despite having ruled that he was a gang member and denied his asylum claim based on gang retaliation?

    You can't really go after the government for "picking and choosing winners" when you condone doing the same for your chosen people. Immigrants do not deserve any more rights than
    natives. The IRS wouldn't let me not pay owed taxes for 16 years, which is how long the Maryland Man stayed in this country while being eligible for deportation.
