Judge strikes down administration's use of Alien Enemies Act: A Trump-appointed federal judge in Texas ruled that the president's use of the Alien Enemies Act (AEA) to deport Venezuelans is unlawful, in a ruling that has big implications.
The decision by Judge Fernando Rodriguez Jr. "amounted to a philosophical rejection of the White House's attempts to transpose the Alien Enemies Act, which was passed in 1798 as the nascent United States was threatened by war with France, into the context of modern-day immigration policy," per The New York Times. Rodriguez argues that "the President's invocation of the AEA through the Proclamation [which invokes the act and designates the Venezuelan gang Tren de Aragua a foreign terrorist organization] exceeds the scope of the statute and is contrary to the plain, ordinary meaning of the statute's terms."

"The Proclamation makes no reference to and in no manner suggests that a threat exists of an organized, armed group of individuals entering the United States at the direction of Venezuela to conquer the country or assume control over a portion of the nation. Thus, the Proclamation's language cannot be read as describing conduct that falls within the meaning of 'invasion' for purposes of the AEA," writes Judge Rodriguez, so "[President Donald Trump's] Proclamation exceeded the statutory boundaries that the AEA establishes."
"The President cannot summarily declare that a foreign nation or government has threatened or perpetrated an invasion or predatory incursion of the United States, followed by the identification of the alien enemies subject to detention or removal," adds Rodriguez. "This decision correctly recognized that the president cannot simply declare there's an invasion and invoke a wartime authority during peacetime. As the court recognized, Congress never intended this law to be used in this manner," said American Civil Liberties Union (ACLU) lawyer Lee Gelernt in response to the ruling. (The ACLU has so far filed suit in Texas, New York, Colorado, Pennsylvania, Nevada, Washington, and Georgia challenging the Trump administration's use of the AEA.)
Rodriguez declined to rule on the factual matters asserted by Trump, such as the degree to which Tren de Aragua's activities are controlled by the Venezuelan government.
Unless the decision is overturned when appealed, federal authorities will now be barred from deporting any Venezuelans in the Southern District of Texas via the Alien Enemies Act. It remains to be seen how other judges will rule, but this is a significant defeat for the Trump administration.

But "your kids will have less stuff and it'll be harder for you to afford" is…not a winning sales pitch to voters in the slightest, and I think Trump underestimates how much people will chafe at the idea that they must go backward, to a time when smartphones and toys and groceries were just harder to afford.
Also, you know who buys a lot of kids' toys? Families with a bunch of kids. That's not materialism run amok, that's operating at scale. You know, the very types of families the Trump administration is looking to boost. We have a birthrate that's below replacement, and a lot of folks aligned with the MAGA right are worried about this (for good reason, in my opinion). Making families poorer, and making it more expensive to buy toys—and clothes, and school supplies, and sports equipment, and art supplies, and rubber duckies, and strollers, and car seats—is one of the worst pro-natalist policies I can think of.

Saxbe is making a broader point about how "ethnonationalism" is not really what pro-natalism is about, despite leftist detractors frequently claiming that those who are worried about the birthrate merely want to preserve White America.
Scenes from New York: "Just weeks after launching strict enforcement of New York City's mandatory composting program, the Adams administration has abruptly suspended most fines, signaling a major policy shift from penalties to education and outreach," reports QNS. "The abrupt change, announced just weeks after strict enforcement began, marks a significant reversal in the city's approach to implementing its new mandatory composting program."
Composting for all households across the city became mandatory back in October, but the crackdown only started last month, resulting in sanitation enforcement issuing over 4,000 tickets in the first two weeks to buildings that didn't comply. It's unclear why they've mostly suspended enforcement, though it might be due to the program's unpopularity as well as Mayor Eric Adams' bid for reelection.
As for me and my house, no amount of "education" will convince me that my scarce time and kitchen space ought to be spent on composting. Sounds like a curbside feast for rats, and a silly use of my limited relaxation hours. (And as a Stosselite, I am wired to be skeptical.)

What made the immigration wave of the last century work was that the people who left their European countries by and large wanted to become Americans. Sure, they were proud of their heritage, but they forced their kids to learn to speak English, they strived to make their own way.

Or, we might argue that the demands from the native population in response to previous waves of immigration were too openly coercive and conformist at least from a social point of view. I think what Liz and most of the press are missing is that there is a relatively large chunk of Americans (notably Gen X and Gen Z) who are okay with suffering short term economic pain in exchange for a more stable economic outlook. We voted for disruption because we knew the status quo would only result in catastrophe. I'm still not sure if Trump's methods will lead to the desired outcome, but I'm not going to panic until we've given it at least a couple years (not barely 100 days).
There may be voters willing to endure the austerity -but Trump clearly isn't. He gave up on pricking asset bubbles when he cited the bond market. He's been jawboning the Fed to keep bubbles and subsidized interest rates going. Don't need to wait years to see if he will grow some balls. I honestly think it is going to come down to the 'lived experience' (I hate that term) of the real middle class over the next year - not what the press touts. I remember how in 2008 we were continuously told how the stock market was booming and the economy was great, we should just ignore our lying eyes. I also remember that same narrative just a couple years ago with inflation. We all know that the economic concerns of the elite class (inc. journalists) is different from the average day Americans.
Basically, it comes down to employment and grocery prices. Tariffs may impact the latter, but I think the real story is what is going on with immigration. My H1-B holders have told me that the process for getting renewed is getting a lot stricter, which implies some subtle changes that will impact labor supply.

Garcia never had the opportunity to challenge or cross-examine the anonymous 'informant' who claimed he was in a gang.
The judge in this case was not an Article 3 judge, it was an 'immigration judge' that worked for the executive branch.
The defense he was expected to give was for him to prove that he was NOT in a gang. Of course one cannot prove a negative. How would you prove that you are NOT in a gang, especially since you don't have the opportunity to challenge the one person who is claiming that you are?
At that same incident where he was arrested in front of a Home Depot for loitering, supposedly with actual gang members, the 'informant' also claimed he was a suspect in a murder investigation (he wasn't), and that he was a member of a branch of MS-13 that operated out of New York, but Garcia had never been to New York.
So the evidence that he was in a gang is very weak, but the judge accepted it because the 'due process' standard that Garcia was subjected to is a sham.
