The Laken Riley Act Reminds Us: If a Law Is Named After Someone, It's Probably Bad
Riley's murder was an atrocity. But the law bearing her name is a grab bag of authoritarian policies that have little to do with her death.

There's a popular mantra among skeptics of government power that goes like this: If a law is named after a person, it's probably bad.
Usually pegged to a victim whose story is genuinely tragic, and for whom compassion is warranted, such legislation often gives lawmakers license to enact authoritarian policies while using a bill's raw emotional packaging as both a shield from criticism and as ammunition to criticize those who don't get on board.
The Laken Riley Act, which moved closer to passing the Senate on Friday, is no exception. Drafted in response to the death of Laken Riley, a Georgia nursing student murdered last year by an unlawful immigrant named Jose Ibarra, the bill has become a grab bag of draconian policies that have little, if anything, to do with Riley's death, but will likely soon be enshrined into law in her name.
Prior to murdering Riley, Ibarra had been arrested for shoplifting. So the thrust of the bill begins there: It requires any undocumented immigrant to be held in federal detention without bail—they would not be granted a hearing by default—and be subject to deportation if they are arrested for a theft-related crime.
"ICE [Immigration and Customs Enforcement] will no longer have discretion to release individuals with those arrests, and will be required to hold them in detention without access to bond while they go through the removal process," says Aaron Reichlin-Melnick, a senior fellow at the American Immigration Council. "That aspect of the bill also applies even if the person was later acquitted or had charges dropped."
The latter part raises obvious due process concerns, and it applies to children, people protected by the Deferred Action for Childhood Arrivals (DACA) program, and those in the U.S. on temporary protected status. The former stipulation, meanwhile, potentially carries some rather dire unintended consequences: ICE has warned that the legislation may force the agency to release alleged offenders who pose significantly greater risk of danger, because detention centers can only hold but so many people. Lawmakers may be well-meaning as they seek to mandate that resources be funneled toward shoplifting suspects—as opposed to, say, people accused of more violent crimes—because one unlawful immigrant previously arrested for shoplifting ended up committing a terrible act. But that does not mean it is wise.
What's more, in what arguably has little connection to Laken Riley, the act bearing her name also permits state attorneys general to file lawsuits challenging any decision to grant someone immigration parole, and, perhaps more significantly, to sue secretaries of state in an attempt to block legal migration from "recalcitrant countries."
"The goal of this provision is to make it easier for states to challenge federal programs that grant visas or parole (temporary legal entry, employment, and residency in the US), such as the Biden Administration [Cuba, Haiti, Nicaragua, and Venezuela parole] program for people fleeing horrific violence and oppression in four Latin American nations (including three ruled by brutal socialist dictatorships)," writes Ilya Somin, a professor of law at George Mason University, at The Volokh Conspiracy. "Last year, a conservative federal judge ruled against a lawsuit brought against the program by a coalition of red states, on the ground that the latter lacked standing due to not having suffered the requisite 'harm' because of the program." The Laken Riley Act will make such standing much easier to find, and it will potentially allow attorneys general to sue to block visas from, say, India, a "recalcitrant country," as debates about high-skilled immigration continue to fracture much of the "new right."
"If all the bill did was mandate the deportation of migrants convicted of petty theft, it would make sense for many Democrats to back it, if only because there's so little political upside in defending the rights of undocumented shoplifters," writes Michelle Goldberg at The New York Times. But despite its wide-reaching implications, many Democrats have backed it—enough to likely get the GOP-led bill over the finish line—in what is almost certainly due, at least in part, to how the legislation came to be.
"You have to meet people where they are, even if your ideological priors might lead you in a different direction," Rep. Ritchie Torres (D–N.Y.), who voted in favor, told the Times. "I do worry that when we vote against bills like the Laken Riley Act, we run the risk of seeming out of touch with most Americans on the issue of immigration and border security."
What happened to Riley was an utter tragedy. But lawmakers should be more concerned about bad laws than bad optics.

There have been many examples of illegal immigrants who committed crimes shielded from deportation authorities.
In California the DA even refused to charge illegals with crimes that could get them deported, giving them more protections than even citizens.

Personally, I like this approach as a manifestation of exile. Rather than jail people for many crimes, the libertarian solution is to send them away.

If you closet xenophobes really wanted to do something about illegal immigration, you'd make legal immigration easier. Not the open borders strawman where anyone can come in without being vetted at all, or the asylum seeking strawman that doesn't want to work.

Even with increased legal immigration it likely would not affect illegal immigration one iota as those who cross illegally are not in the same class as legal immigrants. Most illegal aliens are poorly educated and low skilled while legal immigrants most often are better educated with useful skills and training. Increasing the number of legal immigrants would not change those facts.
Illegal aliens who work are responding to a demand for illegal alien workers. Legal resident aliens are not desirable for the roles illegals fill. Legal aliens would not be able to compete with illegals for those roles. That's why greatly improved border security and immigration enforcement are necessary preconditions for a more rational and orderly immigration policy. As long as there is strong demand for illegals, it doesn't matter what our rules are if foreigners can literally walk around them.
Legal immigrants gollow the same regulatory labor costs as citizens. Illegals don't. Shocking, corporations want reduced regulatory costs for employment. How about reducing regulatory costs instead? And as we've seen not only is there reduced regulatory labor costs, the illegal immigrants are even getting subsidized. Whereas legal immigrants can lose their visa if they become a public charge.

What they are responding to is the higher standard of living in the USA. Those jobs could be filled by American citizens or automated. The jobs are currently filled by illegal aliens because illegal aliens will work for wages and working conditions barely above slavery and do so in part because American taxpayers subsidize them through government benefits.
Legal immigrants on the other hand provide skills that are needed. Expanding legal immigration as currently constituted would affect illegal immigration not one iota.
The one option of increased immigration which could be argued for is a return to the Bracero program which allowed temporary work visas( 6 months to a year tops time) where the immigrants return home after their visa expires and they sign paperwork that prohibits them from citizenship until after they have returned to their home countries for a designated period of time ( I would make it a 3-5 year period).
But in order to make that work, border security and immigration enforcement will have to be greatly improved. As I've said, it doesn't matter what our procedures are if invaders can literally walk around them.

There is no such thing as an "undocumented immigrant." Logically, if someone is undocumented, they can't be an immigrant. If you're detained for an alleged crime and we find out you're undocumented, then whether you're guilty of that crime is a moot point. You're out of the country. ICE now can't let you go and escape from some sanctuary state where they can stay hidden for years.

All this bill really does is say if you are here illegally and come to our attention you will be put at the head of the line for deportation. It doesn't matter that they might be innocent of the other crime because the crime that they are guilty of requires deportation in any event. This bill just means that a priority is being set for some of the low hanging fruit.

I say just open up Sheriff Arpaio type prisons. Military tents, cost and blankets, basic food ( cold cereal for breakfast, soup and sandwich for lunch and stew for dinner), no TV or other unnecessary amenities. Just the bare basic necessities and no more. Place them on the border so those seeking to cross illegally can see their future.

Almost all of the Federal laws and the regulations engendered under them violate the Constitution enumeration of powers, are unconstitutionally broad and vague, or represent unwarranted extensions of Federal power over state privileges by returning some of the unconstitutionally acquired tax revenues taken from the states in exchange for their "voluntary" compliance.
CURRENT law prohibits releasing someone illegally in the country for ANY reason. Even those that have applied for asylum are legally required to be detained until the application has been fully processed.
Aside from mandating deportation if convicted, EVERYTHING this article claims the bill would enact is ALREADY LAW.
"Reason" is not reasonable on this issue. Illegal aliens arrested should be automatically deported, period.
