Two New York Cases Lend Credibility to Trump's Complaint of Partisan Persecution
Neither Manhattan D.A. Alvin Bragg nor New York Attorney General Letitia James can explain exactly who was victimized by the dishonesty they cite.

As Donald Trump tells it, all of the civil and criminal cases against him are part of a Democratic conspiracy to keep him from returning to the White House. Although some of the many charges against him involve credible allegations of serious crimes, they have been overshadowed recently by two New York cases that are much weaker.
In 2016, Manhattan District Attorney Alvin Bragg says, Trump "corrupt[ed] a presidential election" by concealing embarrassing information from voters. And according to New York Attorney General Letitia James, whose lawsuit resulted in a staggering "disgorgement" order against Trump last week, he defrauded lenders and insurers by habitually inflating the value of his assets.
Bragg and James, both Democrats, argue that Trump was dishonest, which will not come as news to anyone who has been paying attention to the persistent gap between reality and his public statements on matters large and small. But neither Bragg nor James has been able to explain exactly who was victimized by the misrepresentations they cite.
Bragg's criminal case, which is now scheduled for trial on March 25, charges Trump with 34 counts of falsifying business records. Each of those is based on an invoice, check, or ledger entry that allegedly was designed to disguise Trump's reimbursement of a $130,000 payment that Michael Cohen, his former lawyer, gave porn star Stormy Daniels shortly before the 2016 election to keep her from talking about her alleged affair with Trump.
Falsifying business records—in this case, mischaracterizing the payments to Cohen as compensation for legal services—is ordinarily a misdemeanor. But Bragg is charging Trump with 34 felonies, each punishable by up to four years in prison, because he allegedly was trying to cover up "another crime."
Bragg says the "criminal activity" that Trump sought to "conceal" included "attempts to violate state and federal election laws." That claim is based on legal interpretations so iffy that Bragg's predecessor, Cyrus R. Vance Jr., rejected them after lengthy consideration.
Explaining why he nevertheless is trying to convert one hush payment into 34 felonies, Bragg complains that Trump "hid damaging information from the voting public during the 2016 presidential election." Although Bragg says that offense is "the heart of the case," it is not a crime: If Daniels had simply agreed not to talk about the alleged affair after Trump asked her nicely, the result would have been the same.
James' case likewise lacks any measurable injury to a specific victim, which is not required by the New York law she used to sue Trump. Although she presented plenty of evidence that Trump overvalued his properties and exaggerated his wealth, she did not show that lenders or insurers suffered any losses as a result.
Most notoriously, Trump claimed his apartment in Manhattan's Trump Tower was 30,000 square feet, nearly three times its actual size. He valued Mar-a-Lago, his golf resort in Palm Beach, based on the assumption that it could be sold for residential purposes, which the deed precluded.
New York County Supreme Court Justice Arthur Engoron also found that the Trump Organization had treated rent-stabilized apartments as if they were not subject to that restriction, assumed regulatory permission for construction that had not in fact been approved, failed to discount expected streams of revenue, dramatically departed from estimates by professional appraisers, and counted Trump's limited partnership interest in a real estate company as cash even though he could not access the money without the company's consent. But the sum that Engoron ordered Trump to pay, which totals nearly half a billion dollars with interest, was styled as "disgorgement" of "ill-gotten gains," not as compensation for damages.
That's because James was not able to identify any damages to lenders or insurers, which she was not legally obliged to do. As in Bragg's case, the striking absence of any injury commensurate with the punishment lends credibility to Trump's reflexive complaint that he is the victim of a partisan vendetta.

It is certainly possible to look at this through the lens of selected prosecutions, but the fact remains these are viable cases and Trump seems to lose. I can also suggest other reasons for the prosecutions. First is cascading effects, one prosecution leads into the next. We see these with cases against well known people like Harry Weinstein, where successful prosecutions in one case bring up the next. Trump shady business practices are catching up to him and success in one prosecution shows his weakness that leads to the next. Second is Trump's failure to use good legal strategies for these cases. When the prosecutor has the evidence the defendant deals. Instead, Trump by himself and through his lawyers acts badly in court and in publics. This may get him points with the public, but not with the judge or jury. And so more loses. As cases move forward, evidence will come to light, Trump will act badly, and the act will wear thin.

It didn't have a material impact on his loans per bank testimony. The judge used rates of unsecured loans vs secured loans. Trump never signed an unsecured loan. The judge then added all profit from sales of the properties after hundreds of millions in renovation costs for the buildings.

In my experience buying and selling properties, a lender asks for a range of value and then gets an assessor to make a determination. If a lender relies on the claimed value, that's not someone with whom you want to do business.

I think the cases so far against Trump are so weak they will eventually be thrown out or downgraded. Alvin Bragg's case especially. Dems know this already, but the process is the punishment they are going for. They want to tie him up in legal actions to derail his political campaign.
So, one case is decided and cannot be thrown out. It can be appealed, but that is not a do over and it will require work to get the aware repealed or reduced. What is the argument for the appeal? It very possible this get turned down for appeal.

Another basis could be who the award goes to. Both James and Erdogon said the banks were the victims here, that they lost out on $170 million in revenue. Also the amount went up after the Judges summary ruling. Does the AG have any evidence to back up that increase?
As you will note the article says that the law does not require a victim. So, the Appeals court would have to invalidate the law for the no victim defense to work. As for who gets the money, there are many government fines and this is one of those. So, again there is precedent for the government getting the penalty. It is worthwhile to note that while Judge Ergoron might have imposed a lifetime exclusion from doing business in NY he chose only a 3 year suspension and this will reduce any claim that the penalty is too harsh.
BTW - It did not escape my attention that for a 77 year old man the 3 year suspension could be a lifetime suspension.

The Eighth Amendment prohibits excessive fines. Absent a victim, $355 million seems excessive.
I don't see why the loan thing is confusing to people. The interest rates on loans are based on risk to the lender. That's how credit scores work, and why when you take out a loan it's based on your credit score and assets. So if Trump inflated his assets, he presumably paid less interest to the lenders than he would have had he told the truth and they'd set the terms of the loans on the basis of his actual financial state, rather than what he told them.
And this is the reason for the penalty, to remove any gains Trump made from cheating. If you're in a bike race and you cheat you don't get to keep the trophy and prize money.

The value of assets is entirely in the realm of opinion. It's literally just what a buyer would pay, and that's highly variable.

Trump has also argued that the bank was happy to have his business.
“We expect clients provided information to be accurate,” Williams testified. “At the same time, it’s not an industry standard that these financial statements are audited they largely reliant on the use of estimate. That said, we account for that and make some adjustments as a conservative measure.”

There are banks that don't do business with Trump. It not the case that banks testified for Trump but rather a single bank, Deutche Bank. So, it would be wrong to extrapolate that any bank.

The fact that a bank testified for him and that the bank did not use Trump's numbers might be enough to get the summary judgement kicked out on appeal. Then NYS would have to go to trial if they wanted to continue.
Trump gave the bank X, the bank used Y instead, why should Trump be on the hook for X? Wouldn't Y be the correct value?
