Prosecutors Agree He Shot a Man in Self-Defense. They're Still Trying To Put Him in Prison.

A New York City man is facing several years in prison after killing someone who'd broken into his apartment.
But perhaps most interesting is that, at his arraignment last month, prosecutors did not dispute that LaShawn Craig acted in self-defense when he fatally shot Timothy Jones. Instead, they hit Craig with several charges related to the criminal possession of a weapon, because he did not have a license for the handgun he used to protect himself.
On November 17, Craig, who has no criminal history, was standing outside his building talking to a neighbor when he heard his home alarm go off. After returning to his residence, he found Jones—wearing a mask and gloves—who, after Craig ordered him to leave, reached into his pocket. (It was later determined that he had a Taser.) Craig then fired several shots, after which he called 911.
Law enforcement reportedly labeled the shooting a "justified homicide." While obviously a tragic situation, that's clearly the correct decision. Which also makes the government's choice to prosecute him for criminal possession of a weapon, a violent felony, all the more preposterous. Put differently, Craig should spend years in prison, law enforcement says, not because he used his weapon improperly, but because he used it without first jumping through the barriers—which are both time consuming and financially burdensome—required to register a gun with the government.
Craig is far from the first such defendant. This past summer, Charles Foehner, an elderly New York City man, shot a man attempting to mug him. Soon after, he learned that prosecutors would seek to have him die in prison. But it wasn't because he hadn't acted in self-defense. He had, the proof of which was caught on video. It was because police searched his apartment after the shooting and found that only some of his weapons were licensed with the government.
Jones, whom Craig killed, reportedly had over 20 prior arrests for grand larceny, robbery, and domestic violence, among other convictions; Cody Gonzalez, whom Foehner killed, had at least 15 prior arrests. Like Craig, Foehner has no criminal record. And yet Foehner, if convicted on all charges, would go to prison for far longer than Gonzalez would have had he survived.
Opposition to New York's gun licensing scheme has, refreshingly, attracted some strange bedfellows. The 2022 Supreme Court ruling in New York State Rifle & Pistol Association, Inc. v. Bruen paralyzed parts of New York's restrictive licensing rules governing concealed carry. Among those cheering that result: progressive attorneys.
The year prior, The Black Attorneys of Legal Aid, The Bronx Defenders, and Brooklyn Defender Services submitted an amicus brief, asking the high court to incapacitate New York's approach to concealed carry. As I wrote in June:
They offered several case studies centered around people whose lives were similarly upended. Among them were Benjamin Prosser and Sam Little, who had both been victims of violent crimes and who are now considered "violent felons" in the eyes of the state simply for carrying a firearm without the mandated government approval. Little, a single father who had previously been slashed in the face, was separated from his family while he served his sentence at the Vernon C. Bain Center, a notorious jail that floats on the East River. The conviction destroyed his nascent career, with the Department of Education rescinding its offer of employment.
Now LaShawn Craig will have to add his name to the unenviable list of people who used his gun to protect his life and was prosecuted for it anyway.

Missing the tragedy here. Guy breaks into a house, armed with a weapon, and is shot when he reaches for the weapon. Seems like an ideal outcome.

We had a similar situation here in Spokane a little over ten years ago. A local plumber was loading up his SUV to go out on service calls for the day and a 25 year old with multiple felonies and misdemeanors jumped in the plumber’s vehicle that was warming up.
The plumber thought the perp was turning to shoot at him while driving away in the vehicle, so the plumber drew his pistol and shot the guy in the head. Turns out the scumbag robbed a plumber that was also a crack shot. The per died and our asshole DA prosecuted the plumber for manslaughter.
A year later when it went to trial, the jury came back with a ‘not guilty’ verdict after about 30 minutes of deliberations. The defense then requested a finding of ‘innocent’. The jury further deliberated and agreed to that the next day.
I can’t help think that none of this had to happen of the lazy ass prosecutor had kept the hive in jail for the long list of crimes of which he was already convicted. Instead of trying to put the innocent plumber away for ten years,

Also, their was the story about two decades ago about folks who had moved into the new housing projects on the east side of Coeur d'Alene that were loosing their koi fish to osprey that were nesting in one of the city parks so these (largely from out of state that had moved into CDA for its 'scenic beauty') complained to IDFG, who replied 'they're a threatened species and the whole lake area is designated critical habitat, so there's nothing we can do'. I think some of them complained that IDFG wasn't doing the job taxpayers pay them for, to which the reporter replied IDFG is almost exclusively funded through the sales of hunting and fishing licenses and most of those complaining didn't purchase hunting or fishing licenses.
Also, my Brother In Law is a large mammal biologist for IDFG and he used to be stationed in the Lewiston office, which district extends to the Benewah-Latah county divide, so he had to deal with the academia class from Moscow and Pullman often. They would call and complain 'you're elk (and he said that is generally how they referred to them, as if elk belong to fish and game and listened to them) ate all my (overpriced) fruit trees/roses/ornamental shrubs of your choice what are you going to do about it?'

They don’t have to be licensed as Same Day Surgery Clinics or have admitting privileges at the local hospital like most outpatient surgery centers in most states, and ENB was pretty clear that when states like Texas tried to pass laws to require abortion clinics to abide by the same rules as other same day surgery clinics that that was a draconian restriction on abortion. One of her primary arguments is it would reduce the number of abortion clinics in smaller markets because fewer hospitals to get admitting facilities to. Of course there's two problems with that argument, there aren't a plethora of same day surgery clinics in those areas either, and no one decries the fact you can't get liposuction or a breast lift in Bumfuck, Texas. Second, if there is an emergency during an abortion, the lack of a close inpatient medical facility creates a much higher risk for mortality for the mother. And abortions do carry a risk of adverse outcomes greater than most outpatient surgeries.

No, it’s not a tragic situation at all, obviously or otherwise. He shot and killed a criminal who broke into his apartment. That’s a cause for applause, not a reason for lament. One fewer violent criminal no longer at large and available for “catch and release” by the local gendarmerie to commit additional crimes. If this case does not, once and for all, make it to the Supreme Court where the idiotic New York laws requiring the registration of guns is struck down and any criminal charges reversed, then there is no justice left in America.

One of the things about self defense that makes me wonder - How high does the risk to oneself need to be to justify the use of deadly force? The typical standard uses vague "reasonable[ness]" language. As in, would a hypothetical "reasonable" person feel threatened with great bodily injury or death in the same situation? If it were possible to know, in that split second you need to decide on how to respond, what the odds of your death were, what would be the threshold of reasonableness? 1 in 10? 1 in 100? 1 in 1000? 1 in 1,000,000?
The intruder here had a taser, so that is definitely a potentially deadly threat, but the odds would be lower than if the intruder had a gun or a knife. What if the intruder didn't reach for anything? He's still a potentially deadly threat, since a person defending themselves in their home couldn't know what the intruder might do next and waiting to find out carries risk.
I haven't checked lately, but it used to be required to decline combat, and be unable to flee (either due to tactical position or infirmity).
Meet those two conditions and if the attack continues, take them out.
That assumes being in public (and in states that don't have stand-your-ground laws, I believe). Castle doctrine means you don't need to flee your home.
It doesn't really answer my question, though. An "attack" could constitute someone swinging a fist or trying to shove you. I don't think that would meet the "reasonable person" standard for being a threat of great bodily harm or death to warrant deadly force. But, you could fall after being punched once or shoved and hit your head on something and die, right? Might be really unlikely, but still possible, so is there some objective measure of this or is it all subjective?
My understanding is if a Felony or Lethal Force is being committed/threatened. Home Invasion falls under Felony. I'd also say it falls under Lethal Force. Anyone who robs a house while knowing someone is in it, is either crazy or going to be violent.
Google is your friend. In California, you can use deadly force in self-defense if you reasonably fear great bodily injury or death, and there is no duty to retreat from a fight. In Pennsylvania, the use of deadly force is justified if the person believes that such force is necessary to protect themselves against death, serious bodily injury, kidnapping, or sexual intercourse compelled by force or threat. Well, gun control is the law of the land, and as long as it is being enforced, it certainly needs to be enforced when people are found to have killed someone with an unlicensed gun.

Why does it need to be enforced? They didn't need to search his place, all the evidence needed was already in plain view. Whether he had other weapons he did not use was irrelevant to the question of whether he acted in self-defense.
