Supreme Court Weighs Whether Postal Service Can Force Christian Employee To Work on Sundays

Can businesses force Christian employees to work on Sundays? That's the issue at the center of a legal battle hitting the Supreme Court today. The case concerns a mail carrier in Pennsylvania, Gerald Groff, who was told he must start working on Sundays. "He declined, saying his Sundays are for church and family," reports the Associated Press:
U.S. Postal Service officials initially tried to get substitutes for the man's shifts, but they couldn't always. When he didn't show, that meant more work for others. Ultimately, the man quit and sued for religious discrimination.
The Civil Rights Act of 1964 requires employers to accommodate workers' religious beliefs when it does not pose an "undue hardship." And the Supreme Court held in 1977 —in Trans World Airlines v. Hardison—that anything more than "a de minimis cost" is legitimate grounds for denying religious accommodations.
The big question now is whether the Court of 2023 will echo that earlier decision or take a more expansive view of what sorts of religious accommodations are proper.
It's certainly more than "a de minimis" burden on many businesses to allow any employee who says Sundays are for church and family to avoid work that day, especially when it comes to small businesses or industries where weekends are the busiest time. And it would follow that if companies can be forced not to schedule certain Christian workers on Sundays, they must make accommodations for some non-Sunday religious observances, too.
It doesn't seem like much of a stretch to imagine that this would constitute an "undue hardship" for many businesses.
But defining "undue hardship" isn't an exact science.
Groff wants the Court to say that an accommodation must involve "significant difficulty or expense" for an employer before it counts.
The case is Groff v. DeJoy.
The central legal questions, per SCOTUSblog, are:
(1) Whether the court should disapprove the more-than-de-minimis-cost test for refusing religious accommodations under Title VII of the Civil Rights Act of 1964 stated in Trans World Airlines, Inc. v. Hardison; and (2) whether an employer may demonstrate "undue hardship on the conduct of the employer's business" under Title VII merely by showing that the requested accommodation burdens the employee's coworkers rather than the business itself.
At Volokh Conspiracy last month, Chapman University law professor James Phillips made a case for reversing the Hardison decision. When Groff sought not to work Sundays, "the USPS initially trained and required others to work in his stead on Sundays," notes Phillips. "It is hard to see how this inconvenience rises to the level of an 'undue hardship.'"
Here's attorney Adam Unikowsky making the opposite case. "It is an 'undue hardship' when employers are forced to inflict more than de minimis harm on non-religious co-workers to accommodate the religious practice of religious employees," writes Unikowsky. And it's an undue hardship "when employers are forced to pay more than a de minimis amount of cash, out of pocket, to accommodate the religious practice of religious employees."
Interestingly, it was the liberal justices in 1977 who objected to the narrow definition of undue hardship.
"As a matter of law, I seriously question whether simple English usage permits 'undue hardship' to be interpreted to mean 'more than de minimis cost,'" wrote the 1977 Court's two most liberal members, Justices William J. Brennan Jr. and Thurgood Marshall.
Meanwhile, "the more centrist and conservative Justices in the majority disagreed," notes UCLA law professor Eugene Volokh. "What a difference the last 45 years have made! As with the question [of] whether the Free Exercise Clause entitles religious objectors to exemptions from religion-neutral laws, it looks like the ideological polarity of this issue has flipped. Justices Thomas, Alito, and Gorsuch have called for reconsidering the TWA v. Hardison decision (and Justice Kavanaugh has hinted that he might agree)."

2. If you aren't employed yet than you weren't fired. If you were employed and they change your schedule, if you don't accept than your eligible for unemployment/severance pay.

I am a manager at a large firm. I make accommodations all the time. At times due to religious considerations. Others due to regulatory requirements. We have people work weekends. We have some that can not. We force nobody to do so. Usually it is extra pay for those who want to.
He worked many years without this as a requirement. They even accommodated him until other workers complained about it. There is zero business need requiring him yo work Sunday as they operated that way for years. In this case there is no overriding concern for a government entity to require his religion to be violated. Full stop.

1. Everyone having Sunday off was a universal American tradition until about 30-40 years ago.

2. We know that the post office accommodates Friday and Saturday sabbaths for Muslim and Jewish employees.

Regarding the postal worker. The USPS spent decades without Sunday work. He started during this time. They changed days worked to accommodate clients like Amazon. They could instead work multiple shifts in offices. They also have plenty of workers that don't have religious concerns.

I don't really see the conflict. If the required hours for a job conflict with your religious practices, get a different job.

Maybe it's different because USPS is a quasi-governmental employer. But in general, I don't see why that is a problem. If I decide my business works best if everyone works on Sunday from now on, that's my decision.
If you are 7 days a week how is a hardship to set schedules which you are already doing in order to have schedules? If your business is only Sunday fine. That's not what this is.

Problem is those things will never be let go on dem rub election systems as they are so fruitful. Even many GOP boards are on board because they don't want to be called racist by wapo or the NYT.
A manned drop off system for 20 days with voter ID confirmation would be so much better and reduce any fraud or lazy voter badgering immensely. No GOP candidate is calling for those reforms. No GOP electoral/legislative group is either.

Definitely, and that is to his credit. And I strongly believe that this was because people not blinded by TDS were able to see his successes for what they were. The local slav population near me went from 10% voters and 90% apathetic to 90% voters 10% apathetic in a few short years because of his success.
I agree that the postal vote is hot garbage. Our local school board election went sour on the mail in votes alone. But to get it to go away, those who oppose it need to win elections. As you pointed out: Ronny D. in Florida won the election and then was able to clean up the mail in fiasco. I don't see him "calling for it", but I see him having taken action on it. Winning at the state and local level is how you do that.
We have a county board member in my county who won by running a campaign on "stopping Trump." I know it's stupid that people vote for that crap. But for every new person Trump motivated and brought in, he motivated 10% more for his opposition. He can't win because he is a turnout machine for his opponents. He is such a powerful turnout machine for his opponents that people in purple counties can run on "opposing him" and win. Then they go ahead and extended early and mail in voting like they did in my county.
Harping on voting systems is not a winning strategy right now, in part because the Republicans have lost the moral argument around voting thoroughly. They've accepted the left's premise that voting is a "right." Until they realize your vote is not a right, but instead is your share of political force, they will lack the moral fortitude it takes to push back this tide. The culture around voting needs to change first, and there is not enough time between now and 2024 for that to happen.

The problem I have with Sandra is not the claim that Trump can't win in 2024. That's a logical argument to make. The problem I have is his insistence that Trump "lost" the 2020 election with no caveats whatsoever. That is not an honest argument. The 2020 election was completely unprecedented. Mass mail in ballots. Election laws illegally changed by politicians. Widespread Ballot harvesting. The sheer numerical improbability of the official results. The last "normal" national election was in 2016 and Trump won. But within days of the 2020 election Reason was claiming that it was conducted flawlessly. End of story. That is not rational thinking.
We learned a couple of things in 2020 that few of us realized. One is that our state legislators, probably with good intentions, empowered the executive to rule like tyrants. The other is that no matter how many people believe an election was fraudulent there is no mechanism by which they can be assured otherwise. Lately I've been seeing ads by a Trump PAC claiming DeSantis wants to shut down SS and Medicare. It's the same tired shit that the Ds have been doing for at least half a century. He's not going to win my vote with this crap. I'm very comfortable with the idea that Trump's time has passed. But if he's the nominee I'll still vote for him. Not that it will make any difference.

Many of us exceedingly objectively pointed out he’s Paul von Hindenberg or Friedrich Ebert at worst, that he isn’t and wasn’t, and still isn’t, a “next in line” Neo-Lib/Con, and that almost certainly, what would come as a reaction to him would be worse.
Similarly, in the 2000 election, my allegations about “rigging” have been about the continued and alarmingly rapid/expedient corrosion of the culture of elections and voting in 2019. As I continue to point out, going forward, whomever your ideal political outsider/independent was, the mountain they’ve got to climb as the result of what’s been done to Trump is now 10X higher and gotten so largely de rigueur. Not only is objective voter reform entirely out for at least several elections, anyone in Trump’s shoes could face spying and raids from the FBI, frivolous lawsuits from a motivated DA, and flat out opposition lies passed off as actionable intelligence (unless, of course, they are similarly the puppet of some similarly powerful regime plucking strings from behind the scenes), rampant prosecutorial fishing expeditions aimed at anyone and everyone around him/her.
None of which is to say that Trump *should* win a second election, but a portion of the reason that mountain is now 10X higher is because of the people who don’t want Trump to win. A stance that is outwardly indistinguishable from the people who are just indifferent to the fact that the mountain is 10X higher.
Again, it’s not about Trump, or COVID, or fraudulent votes. It’s about the surprising number of Americans that actively participated riots in the streets, literally ratted out the Jews in the attics, and knowingly separated people from their families, locked them in homes and camps, forcibly covered their faces until they died, and, after having done all of that, want to act like nothing happened and/or everyone owes them amnesty for their mistakes.

We really need a Douglas MacArthur or George Patton who’s going to (metaphorically) execute every last one of those people and use their guts to grease tread back to the other side of every coast and border where we hang a sign as warning to Russians and other Communists. I'm pretty appalled myself about how few people have been fired over any of these debacles. But it seems that "voters" don't want people to be fired. Again citing my own local school board. The school board approved pornography in the middle school library, and released a "gender support plan" that made informing the parent optional about gender transitions. This support plan included a line about how the school will help "facilitate barriers" between parents and the children if it will help the transition. And the folks who voted for this all retained their seats. Their margin of victory? The mail in votes. People who voted in person voted against them. Driving around the district, the yard signs that supported the more conservative candidates outnumbered the incumbents by 2 to 1.
The local Democrat party put out an email with a website where you could type in your district and they wouldn't endorse anyone, but they would tell you who the far-right, racist, bigoted candidates were. The mail-in machine acted accordingly.
These are the rules it seems, and we're powerless to change them. I don't think 2020 and 2022 were clean. But I don't think complaining about it is a good strategy.

My first “real” job was at a large nationally known publically traded insurance company. When I started my hours were 9-5 with a 45 minute lunch , so I worked 7 hours and 15 minutes a day. Within 6 months of starting they changed the entire company over to an 8 hour day with an unpaid 45 minute lunch. This is basically a pay cut for everyone. But it wasn’t negotiable, I could accept the pay cut or quit. So I guess I don’t understand why everyone thinks that the change to delivery on Sunday is at all an important factor. Companies make business decisions all the time that screw over their workers, and they are within their rights to do that.

Halfway through all of a sudden we hear a truck start up, high beams on, they pull up to us and we cant actually see them at all, as our car is off and their lights are blaring. Then you hear someone yell, with some nice country twang, "Get the fuck off my property and dont come back!" at which point I scurry into the front seat, pants around ankles, and hightail it the fuck out of there.

I've had some neighbors tell similar stories about couples in their driveways. My own daughter was caught by the sheriffs; parked with her BF at a nat'l forest gate. The local kids know better than to venture up a driveway. 🙂
