A Police Officer Killed a Man for Firing 'Celebratory' Shots Into the Air. Now, He Faces a Federal Lawsuit.
"Defendant Huber intentionally fired his service weapon at Decedent and killed him with gunfire while Decedent posed no threat of death or serious bodily harm to Defendant Huber," the lawsuit states.

Around midnight on New Year's Day 2022, an Ohio man was shot and killed by a police officer for firing "celebratory" shots into the air. Now, his widow has filed a federal lawsuit against the officer and local police department, claiming that police violated her husband's constitutional rights by using unnecessary, excessive force.
"For decades, United States Supreme Court has interpreted the Fourth Amendment to the United States Constitution to prohibit a police officer's use of excessive force during the arrest of a citizen," the lawsuit states, adding that police deprived "Plaintiff of his well-established right to be free from excessive force, per the authority cited herein."
Near midnight on December 31, 2021, 46-year-old James Williams fired shots into the air from the porch of his Canton, Ohio, home. According to the lawsuit, this is a common occurrence on New Year's Eve within the town. In fact, the complaint notes that earlier in the evening, before Williams fired any shots, Canton police received a radio broadcast alerting them of another man that was firing shots into the air as "celebratory fire for New Years."
When Williams "join[ed] in that activity," a nearby police officer—Robert Huber—heard gunfire and drove to the front of William's home, which had a 6-foot fence surrounding the porch. According to the lawsuit, Huber then walked up the steps of the porch and looked through a window, where he saw Williams walking through the house while holding a rifle. The complaint states that Huber then backed off the porch and onto the street, where he activated his body camera and radioed for backup.
According to the lawsuit, Huber heard gunfire shortly after and approached the fence around the porch with his gun drawn. Without any verbal warning to Williams, Huber fired at the fence, striking Williams in the chest. The complaint states that Huber then shouted, "Shots fired, shots fired," and, "Police! Get down now! Police! Get down now!"
The complaint states that Williams then staggered into his living room, in view of his children, where he died shortly thereafter. The suit states that Huber did not attempt to provide medical care to Williams at any point.
"Defendant Huber intentionally fired his service weapon at Decedent and killed him with gunfire while Decedent posed no threat of death or serious bodily harm to Defendant Huber," the lawsuit states. "Huber fired at Decedent through a wooden fence which blocked Defendant Huber's view of the scene in front of him, putting at risk the lives of Decedent, Plaintiff, and their children."
Huber has not been disciplined or charged in connection with the shooting. Last September, a grand jury declined to charge Huber, sparking protests in Canton. "While the Stark County Prosecutor has failed in obtaining justice for James, we will not stop until we do," read a statement from the family's legal team.
While Huber seems unlikely to face criminal charges, this latest lawsuit is the final legal avenue for William's family to hold police accountable for his death. (A previous lawsuit was dismissed for Williams' widow's failure to obtain legal counsel.) However, it's unclear whether they will succeed in obtaining a settlement, as wide-ranging qualified immunity protections guard police from civil lawsuits. For now, accountability for Huber, or the police department that failed to discipline him, seems far-off.
"I really feel that there was no justice for James Williams and his family," said Canton City Councilwoman Chris Smith after the grand jury's decision. "There was no justice. I am disappointed in this system."

I'm still not sure about the merits of the lawsuit, but nobody ought to be firing celebratory bullets into the air, because gravity.
IIRC correctly from MythBusters, if the bullet goes straight up, and it has to be almost perfect, it will tumble on the way down at terminal velocity. Otherwise it will travel in an arc and still be fast and deadly when it comes down.
I saw something similar. It's not the ones going perfectly up then reaching zero momentum and coming down. Its the ones fired at an angle, because they then have a parabolic arch to the flight path that allows them to keep speed and trajectory. The analogy they used was tight spiral football.

You do not remember correctly. It will come down at approximately terminal velocity for any steep angle of fire. It does not have to be "almost perfect" straight up.
As for terminal velocity, look up any of the many, many videos debunking the 'pennies off the Empire State Building" myth. Getting hit by a stray bullet falling to earth would hurt but is very, very unlikely to kill you.

And that 'steep angle of fire' is the kicker here.
From what I can tell the chances of maintaining a ballistic trajectory increase at less than 80 degrees, depending upon other factors. So while that's not almost perfectly straight up, it's close enough for government work. I certainly wouldn't want to be hit by one, or have it hit my roof.
Which is the very interesting part of it. Some rifles have a very high rate of twist and greatly over stabilize a projectile. As a result the orientation of the bullet doesn't change much so if it goes out at 45 degrees it will essentially be falling sideways at the end. Those that don't spin fast enough may find that the differential drag between the pointy nose and wide base induces a torque on the projectile but due to torque induced precession it won't nose over but will begin to rotate orthogonal to it's new direction of travel and may ultimately tumble or orient itself to a better aerodynamic angle to the relative wind. This becomes especially hairy at trans-sonic velocities and many projectiles won't make the transition well but the few that do can maintain a velocity a few hundred fps above their tumbling or super-stable cousins. The biggest issue is building a roughly 5,000 yard range where accurate studies could be performed on, let's say, a Mk 262 5.56 NATO with a muzzle velocity of 2750 fps.
Unfortunately I don't see DEN being up for sale any time soon and the altitude may actually mean it's not long enough. EDW or VCV might pass but I'm not holding my breath on those either.
Oh, I should say my ballistic software shows a Mk 262 starting at 2800 fps has a max range of a bit over 4400 yards (2.5 miles) and will have an impact velocity of 425 fps with an energy of 31 ft lb which is about what you’d get from a really good .22 PCP pellet gun at the muzzle. Could it kill? Sure, I’ve had several dinners served up by a far lesser pellet gun and it would definitely leave one hell of a mark if it hit you and, like all gunshots, it depends greatly on where you get hit so it may easily prove fatal.
The Ohio BCI report says that the rounds were not all being fired at a steep angle and there were a crap-ton (technical term) of rounds being fired.

It's dangerous and silly, don't get me wrong, but nowhere near as dangerous as police departments across the country have led you to believe.
'What goes up must come down' is still true, but what might go up at 3000 fps, must come down at terminal velocity, which is significantly less lethal at 150 fps. Still, plenty fast enough to injure someone.
Also, that's just the external ballistics analysis. When you factor in AOE geometry and terminal ballistics, it's still a stupid idea but hardly reasonably dangerous. Terminally, if hit, you're more likely to be killed top-down but given the same point-density, you're ~10X less likely to be hit top-down. However, AOE, in order to achieve the same top-down point density as horizontal you have to fire exponentially more bullets.
Unless it maintains ballistic properties. The terminal velocity is different based on the orientation. If fired straight up or at an angle close to normal, then the terminal velocity will be about 150 fps, however if it is fired at a "not steep enough angle" it will maintain ballistic properties

This seems like the responding officer wasn’t familiar with the local custom of firing celebratory shots on New Year’s Day, because he was acting like it was a hostage situation. I wonder if this officer was a rookie at the time of the shooting.

I like the last sentence, kids in big cities were 3 times more likely to die from firearms than kids from small towns. Per Capita, there are more guns in small towns than big cities. Which kind of argues with their assertion earlier that it's because of more guns being available as a possible factor. Gee what happened in 2020 and beyond that didn't happen in 2019 that could be another cause (especially with regards to suicide)?

According to the news reports, they received 911 calls about the shooting. So this doesn't even appear to be a case of a cop strolling down the street, seeing something he didn't like and opened up. He was responding to a call of crazy shooter firing shots in his home. I'm not convinced this is a hill Reason should be dying on.

Um, I just watched a video of the shooting, and if he was firing shots "into the air" from his porch, unless he was firing them through the porch roof, he'd have had to fire those shots at an alarming angle that would be decidedly "not straight up". This is another edgiest of the edge cases here.
Skip to 1:44 and you get a sample of just... how many rounds the Williams family was firing into the air. Let's just assume that high capacity mags are a thing in Canton, Ohio.

So, watching that video of the officer's body cam, that is indeed a shit ton of shots. We can't tell if it was all from the Williams' house, since it's allegedly a very common way to celebrate (?), but plenty of it clearly was.
But, the only thing that you can tell from the officer's position on the opposite side of a privacy fence is that he was in fact shooting into the air and not in anyone's specific direction. (Not that that's a good idea either)
Given the situation and the fact that it was New Year's Eve, my read is that while the homeowner is clearly not a paragon of gun safety, this particular officer panicked, did not announce himself, and shot blindly through a privacy fence, with no idea what was potentially in his line of fire. And he was specifically aiming in the direction of someone, even if he couldn't see them.
So, bad shoot.

After observing the man with an AR, the body cam shows the police officer reporting it and calling for backup; he then starts to return to confront him. On the way back to the home, you hear shots being fired from the home in rapid succession and police - out in the open - followed procedure and responded to an active shooter and fired at the source of gun fire. No one was shot for firing 'celebratory shots'.
Is it really "procedure" to fire through a fence where you can't see your target?

Here's an idea...just don't break the law and you won't have to interact with the police and risk getting shot. Seems pretty simple. I mean I don't break the law...so I don't interact with the police...therefore its very unlikely that I will be shot by them. Or, you know, you could go outside and start shooting a gun randomly in the air...maybe you kill someone...maybe you don't. Maybe you get killed...maybe you don't...but we do all know that when you play stupid games you win stupid prizes.
