Redding, California, Uses Public Health Red Tape to Ban Sharing Food with Homeless
Is it good public health policy to deny charity to people experiencing homelessness?

Like many cities on the West Coast, Redding, California, is experiencing a homelessness crisis. And, like too many cities around the country—as I detail in my book and have highlighted in many columns over the years—officials appear to have determined the problem can be best dealt with by making it difficult or impossible to share food with people in need.
Homelessness in Redding is a challenge city residents have recognized and organized to address. Last summer, for example, a group of "regular guys" in Redding partnered with a local taco truck to offer free lunches to those in need. More recently, an obituary for a charitable local resident highlighted her compassionate history of sharing homemade coffee and sandwiches with hungry residents.
Many of Redding's homeless have come to rely on meals shared by another group in the city. That loosely organized group of charitable individuals, which a KRCR report this past summer notes, is not affiliated with any religious organization or government entity. Every Saturday for the last three years, its members have provided free meals from 9 a.m. to 11 a.m. to more than 150 people in Redding's Martin Luther King Park. The volunteers provide those in need with everything from haircuts to homemade meals that they can eat on-site and or take with them.
"Every Saturday morning, the Martin Luther King Jr. Park in central Redding is transformed into a public, popup potluck banquet," local outlet A News Café reported last week. "Although the meals are free to anyone who shows up, the intended honored guests are the unhoused, the hungry, the at-risk, the struggling, the poor, the weather-beaten and the lonely." Donated meals often feature "homecooked dishes prepared by volunteers in their own kitchens," the station reports. Volunteers abounded in the park—and included local politicians fishing for votes.
Recently, one volunteer approached the city, asking if it might be possible for Redding officials to provide volunteers with keys to unlock the park's restrooms (so they can be used by those giving and receiving services) and electric outlets (so volunteers could prepare some food on site). Those simple requests, detailed by A News Café's Doni Chamberlain in an excellent piece on the crackdown, opened a Pandora's box of red tape. Redding officials soon informed the group that it could no longer share freshly made food without jumping through a number of cruel and unnecessary hurdles.
"The requests for restroom keys and outlet access triggered official knowledge of the meals in the MLK Park," Chamberlain explains. "Therefore, the city couldn't feign ignorance about the potlucks in the park, or turn a blind eye, or un-ring the bell of information. Suddenly, potlucks in the park were in the city's crosshairs."
Redding city government aimed and fired.
"The immediate order: no more potlucks in the park, because what the volunteers were doing was against a host of food-handling safety regulations," Chamberlain writes. "For starters, if the group wanted to continue feeding people at the MLK Park, they'd need a crowd permit and a food permit."
The "food permit" requirement would mean any meals volunteers wish to donate must be prepared in a (costly) commercial kitchen.
Monique Welin, one of the founders of the charitable feeding operation in Redding, tells Chamberlain the group is optimistic it can navigate the new red tape and continue ultimately to feed those in need. Welin says she hopes someone can donate a food truck to the group so they can prepare food in the park. While donating a commercial kitchen on wheels would no doubt be perfect, that perfect is the enemy of all the good Welin's group has been doing for the last three years.
Though it's not clear yet if the Redding group will have to fight the city to continue their feeding operations—or even if they would be willing to do so—other cities and towns that have senselessly targeted people sharing food with those in need are increasingly facing such pushback. For example, a volunteer organizer in Oshawa, Ontario—a Toronto suburb—was fined recently (nearly $200) for sharing food with those in need. A woman in Arizona was arrested for doing the same last year. But those women are fighting back. Ashley Wickett is fighting the ticket she received under the Oshawa ban. At the same time, 78-year-old Bullhead City, Arizona, resident Norma Thornton, represented by the Institute for Justice, sued the city over its ban in October.
There's no shortage of people in need these days. Neither is there a shortage of good Samaritans volunteering to help hungry neighbors. Though there are no easy solutions to homelessness, prohibiting people from sharing food with those in need won't make the problem go away and unnecessarily infringes on the rights of the homeless and those who want to help them.

I don't want to be mean, but honestly my experience is that most homeless people aren't just down on their luck earnest and hardworking people. Most seem to be lazy, drug addicts, or outright crazy. California offers plenty of examples of a feral human population.

A couple of years ago, when the Chron still had at least a hint of being a newspaper, it carried an article featuring an oh, so virtuous young woman who bought and delivered box lunches to the bums.
I'm sure most of them avoided laughing at her gullibility and idiocy.
30+ years ago, I lived in San Francisco next to an alley near a church which fed the homeless at 6am. They'd start lining up hours earlier, talking, fighting, shitting on doorsteps. You could hear them long before you got up to go to work. Some people got together, organized a meeting to discuss solutions, like feeding them later; the church's response was (1) to flood our meeting with the homeless and bullhorns, (2) to move feeding to 5am, and (3) to get the newspapers and TV stations on the homeless' side.
It was really obvious from hearing those early morning fights and talking that most of them were simply lazy bums who relished the freedom of no home to take care of, who loved bragging about shoplifting, keying cars and business windows, shaking down passersby, and generally living off society.
It was a real eye-opener for me. I always knew there were some bums, there always have been, no doubt going back to Sumerians and before recorded history. And maybe the lazy bums scared off the truly unfortunate who had no skills or were mentally incapable of functioning in modern society.
What really stuck with me was the media ignorance of the difference between the bums and the disabled. I think it was the first thing since the Vietnam War which made me realize how incompetent government really is, how it thrives on incompetence, and how the last thing any government burrocrat wants is to solve any problem.
I'd always been independent, even registered as Libertarian once before reregistering a week later as Decline To State, realizing that an organization of libertarians made no more sense than the Anarchists' Union which fought in the Spanish Civil War. But it took those bums to make me realize how incompetence is government's core competence.

Being a former resident of Redding (many years ago), this does not surprise me in the least. In the early 1980's, when Redding was still recovering from the recession of the seventies, the City of Redding, which operates is own electric utility, would summarily declare "uninhabitable" any residence whose power was cut off for nonpayment of the bill, since using candles or lanterns was considered "a safety hazard" Really -- that was the official reason.
Then they would move to evict the residents. Note: at this time, Redding was a pretty conservative town in a pretty conservative County, and a very large percentage of its population were retirees. The recession had hit many retirees hard. A public outcry was successful in putting a stop to the practice.
The town, along with the County, went "blue" well over twenty years ago. Somethings don't seem to change with the political "color." I guess they still hate folks who are down-on-their-luck.
Redding is R+20 and the county is R+30 currently. Try again.

I'm surprised the city would even have to get involved in that. Most landlords will evict tenants whose utilities have been shut off—maintaining utility service is a universal lease requirement.

Huh? Your example makes no sense. A post office, library and town office all have specific certain hours of operation. A park is open all the time. They're in the park feeding people on a Saturday morning, so clearly the park is "open".
Many parks have operating hours. “Closed after dark.” Some have seasonal hours; there are public restrooms here that are closed in the winter.
During times when a responsible party is not present, all of those three places are closed. Are park maintenance staff working at 2AM?

This is an excellent topic for a libertarian magazine. And it is tremendously complicated.
The first take is easy. "What do you mean they are banning handing out food to the hungry??"
This is something I personally do. I am heavily involved in my local church, and we feed the homeless daily. We also provide clothing and toiletries and other necessities. We even provide bicycles and backpacks.
So I am well aware of the need to do charitable works. My kids work at the lord's gift house, providing goods to the poor and homeless. We prepare and serve food. These people are in need and they are very grateful.
But that is not the end of the story.
We also attract a bunch of homeless to the area. One old guy brings a folding chair and sits across the street on the sidewalk watching the comings and goings. They try to sneak in at night to camp out and use the bathrooms.
My neighborhood is not far away and is not gated. Now that we provide bicycles so they can get to appointments and hopefully jobs, I see these guys with backpacks on bikes cruising my neighborhood. Crime undoubtedly follows. (The bikes are important, as many of them have lost their right to drive a motor vehicle, making employment more difficult.)
My nearest city park is an easy bike ride for the kids. But a homeless ministry meets at a pavilion there, so there are always a handfull of homeless hanging out at the pavilion. It is a tiny park, with 2 tennis courts and a playground for kids under 10. And a big field with grass and trees (but not big enough for soccer or baseball).
You can't let your kids go there alone. Even supervised, it is a bit creepy.
So this is a complex issue. Make the park easy to live in by providing food and other services and easy access to panhandling sites, and you have a park that is less available to the local homeowners.
This deserves a piece that goes beyond opinion. A piece that gets multiple perspectives on solutions to these conflicting needs.

I am not sure there is an “answer” anywhere, much less a “solution.” In the tenth century in England, townships were required to set aside 10% of their assets (food, clothing, etc) to help the indigent. Homelessness hasn't changed all that much in the last 1100 years.

Depending on the type of "dole," one can be limited in what one is permitted to do. If one is on welfare or disability, one may, or may not, depending what the government says, be able to open up a business repairing cars in one's garage or bake cookies for resale to make a little more money.

Their value to their employer is just that they’ve gotten into a groove of the particulars of that firm. They could not take that “skill” anywhere else. By the same token, their employer would suffer considerably having to start someone green in the same job — in most cases. In some cases, as with salespeople, the employer could plug someone else in pretty quickly because the people the salesman has to deal with don’t think of hir as anybody special, but the salesman would suffer without that job.
Another example would be someone who works with temperamental equipment and knows every detail of how that machinery reacts. But it's a particular machine, in a particular state of dis/repair, whose characteristics are not reproduced elsewhere.

What you're describing is the ability to learn about that machine; a skill highly sought-after by many employers.

I work at a food bank several evenings a week that also provides clothing, toiletries, backpacks, etc., and the same thing happens in summer (not winter, it's northern Canada). A small fraction of people camp nearby shooting up, etc.
Nobody's figured out a solution yet. Thankfully our location isn't residential.
Relocate to the neighbourhood in Ottawa where the liberals reside.

Northern Canada is a big place so there are lots of different climate zones. The average daytime temp for this time of year where I'm at is -4°F. We'll often have a cold snap of between -35 to -45°F at the end of January, but sometimes we go the other way and have a few days as high as 22°F.
I have taken to thanking the panhandlers on the corner for setting good examples of bad decision making. Teach the young people what happens when you throw away your life.
I, too, have volunteered at the homeless shelters, fixing meals. Someone is sleeping on my inflatable mattress that I donated. Difference here is that it is often cruelly cold out here in Iowa. One winter is enough to send the homeless to warmer climates.

It is a complex issue and it deserves a serious discussion.
But the discussion has to start from the premise of respecting the dignity and liberty of each individual. Even homeless people.
Treating them like pests and vermin, akin to squirrels or pigeons, is not helpful.
But, dehumanizing the homeless does make the discussion easier. What to do about pests causing a nuisance? Exterminate them, of course. Or, if you're one of those hippy dippy types, you entrap them and then forcibly remove them elsewhere. Such as releasing mice or spiders outdoors. That is the 'humane' solution to homelessness when the homeless are treated as pests. Just round them up and send them elsewhere. It doesn't really matter where.
But, if the discussion is going to be predicated on a foundation of human dignity, then yes it is a complicated problem.
If the roads were private, there would be no question that the homeless are trespassing and can forced to leave. That's the libertarian answer.
From a public policy point of view, drug addicts need treatment, kids and the elderly who can't make it on their own need institutionalization, and everybody else needs to work in locations where the cost of living is cheap enough that they can make it.
Yet, you aren't giving the homeless what they actually need: guidance, instruction, and help. What you are doing is worse than nothing.
Every answer doesn’t have to fit into a specific ideological mold. Government parks aren’t libertarian. Government rules about parks needn’t be strictly libertarian.
The people of the community got together and decided creating the park is a public good. It should go without saying that the public can set rules, within the park, that protect the value of that public good, for the benefit of the public.
The people didn’t set aside the park to be a campground, nor did they create and maintain it for the benefit of criminals and drifters.
Homelessness doesn't have a single solution, since more than one factor brought it into being.
But a better solution than giving away either tax money or charity would be individual investment in profitable, affordable home construction and in profitable businesses that create cheaper, better products and services and create better-paying jobs for the poor. And that means no taxes on capital gains or investment income and less regulation on construction and business in general.
If investors want to spend dividends on charity, that could help too, but the primacy needs to be upon investment, not give-aways.

The usual homeless-feeding situation in the Sun Belt city in which I used to live was this: Charitable individuals would drive down to a park near downtown and spend a couple of hours ladling soup and basking in their moral superiority. They'd then drive back up to cul-de-sac country in the Foothills, while the recipients of their charity would disperse through the neighborhood of the park, urinating and defecating on lawns, cadging change from passersby, and snatching unwatched items that could be turned into cash. When the residents of the neighborhood complained about the feces on their lawns and the theft of their bicycles, they'd be condemned for their hatred of Society's Most Vulnerable Members.
I suspect that something very much like this motivates Redding's desire to restrict homeless-feeding operations; and I suspect that if our charitable individuals had to deal with the negative externalities of their altruism, they'd be a lot less enthusiastic about it.

Under current law, we can't institutionalize the mentally ill and our elected officials don't arrest and imprison people who choose to take drugs and live on the street because drugs are supposedly benign and passing out on the street on drugs is some kind of human right.
If people get free food, free medical care, all the drugs they want, and the promise of free housing, why would many not choose to be homeless?

What? Nothing tying homelessness to immigration and “free trade”? No three paragraphs about how letting in tens of millions more illegals and letting the Chinese dump even more stuff on the US with impunity would solve homelessness? Well, let me try.
There are about 22 million illegal aliens in the US, almost all of them in low-paid, low-skill, blue collar jobs like agriculture and construction. Their presence has driven up housing costs and caused housing shortages. They pay nowhere near enough in taxes to account for the infrastructure, services, education, etc. that they require. And on top of government services, there are many non-profits catering to them. Furthermore, unlike Americans, they have a sense of community and help each other.
On top of that, low/no-tariff imports have destroyed much of the US manufacturing sector and turned us into a service economy, essentially making Americans under US labor laws compete with third world labor working under near slavery conditions.
Both illegal immigration and Chinese imports are also major contributors to the drug crisis in the US, further contributing to homelessness.
Those are the primary drivers of the decay of the social fabric in the US. That’s why we have nearly a million homeless in the US.
And Reason wants to double down on those policies. But there is nothing “libertarian” about such policies in the context of a social welfare state. Homelessness in the US is the result of a dysfunctional mix of a huge social welfare state with an inconsistent sprinkling of libertarian policies.
The cause isn't immigration, the cause is California politics which end up jacking up home prices and eliminating small businesses. The jobs are gone and the homes are gone thus you have homelessness. And not just the old fashioned substance abuse homelessness.
The jobs are gone because they have been taken by illegals or outsourced overseas.
And the homes "are gone" because California limited building while at the same time bringing in large numbers of foreign workers.
Yes, it is. Without immigration and illegal migration, California's population would have been shrinking for years, meaning labor shortages, better pay, and cheaper homes.
It's simply supply and demand.

What's crazy is that Redding is a essentially a small town, not in a blue county. Mostly an Ag community. So why so much homelessness? It's California. Stupid dumbass SF/LA policies are affecting the hinterlands. Home prices are hitting everywhere, jobs for the non-techies are disappearing. And city councils are still run by the worst of the worst: Karens and control freaks.

A real libertarian would be promoting ways to privatize parks and other places where bums gather, so that they can either be kept out by the owners, or that at the very least, the people who insist on having letting the bums in can be held responsible for cleaning up the resulting ongoing messes.
