Supreme Court Says Private Property Rights and Separation of Powers Do Still Exist in U.S.
Plus: Biden won't budge on Afghanistan, bad news for psychedelics measure in California, and more...

The U.S. Supreme Court has struck down the Biden administration's eviction moratorium extension. In a 6–3 ruling, the Court held that the Centers for Disease Control and Prevention (CDC) doesn't have the authority "to promulgate and extend the eviction moratorium."
The CDC claimed the Public Health Service Act gave them such authority. But that law specifically mentions measures like "inspection, fumigation, disinfection, sanitation, pest extermination, and destruction of contaminated animals and articles"—things that "directly relate to preventing the interstate spread of disease by identifying, isolating, and destroying the disease itself," the Court notes, continuing:
The CDC's moratorium, on the other hand, relates to interstate infection far more indirectly: If evictions occur, some subset of tenants might move from one State to another, and some subset of that group might do so while infected with COVID–19… This downstream connection between eviction and the interstate spread of disease is markedly different from the direct targeting of disease that characterizes the measures identified in the statute. Reading both sentences together, rather than the first in isolation, it is a stretch to maintain that §361(a) gives the CDC the authority to impose this eviction moratorium.
The ruling "is technically a procedural one, not a final decision on the merits of the case," explains Volokh Conspiracy blogger and George Mason University professor Ilya Somin. But "it nonetheless makes clear that a majority of justices believe the new version of the moratorium is illegal. In addition, the Supreme Court's reinstatement of the district court ruling against the moratorium may well have nationwide consequences, not limited to the specific parties in this case."
"Even if tonight's decision does not immediately put an end to the moratorium, it does create a precedent that lower court judges will likely use to rule against the CDC in all the other cases challenging the moratorium around the country," Somin adds.
In any event, the ruling is an important affirmation that private property rights still exist in this country.

It's also a good stand for the separation of powers. Congress can still pass a law extending the eviction moratorium—it's just unconstitutional for the executive branch to unilaterally make this decision. "We expect Congress to speak clearly when authorizing an agency to exercise powers of 'vast "economic and political significance,"'" the Court's opinion states.
Whether supporters of the moratorium are being disingenuous or just ignorant is hard to gauge, but many have been suggesting that the Supreme Court's ruling is somehow undemocratic. Ha! What's actually undemocratic is letting bureaucrats at the CDC make this decision instead of democratically elected officials.
"The Government's read…would give the CDC a breathtaking amount of authority," the Court points out. "It is hard to see what measures this interpretation would place outside the CDC's reach, and the Government has identified no limit in §361(a) beyond the requirement that the CDC deem a measure 'necessary.'"
"Could the CDC, for example, mandate free grocery delivery to the homes of the sick or vulnerable?" the Court asks.
Require manufacturers to provide free computers to enable people to work
from home? Order telecommunications companies to provide free high-speed Internet service to facilitate remote work? This claim of expansive authority under §361(a) is unprecedented. Since that provision's enactment in 1944, no regulation premised on it has even begun to approach the size or scope of the eviction moratorium. And it is further amplified by the CDC's decision to impose criminal penalties of up to a $250,000 fine and one year in jail on those who violate the moratorium.
Some critics of the Court's decision may very well wish President Joe Biden's CDC had this kind of power. But it's shortsighted to imagine that only administrations you like will wield extensive and authoritarian new powers once granted.
Notably, much of the rental assistance money that Congress granted to ease the eviction moratorium's burden has not been distributed. "The $46.5 billion rental aid program created to pay rent accrued during the pandemic continues to disburse money at a slow pace," The New York Times reported earlier this week. For instance, New York state had distributed just over 1 percent of its allocated funds.

Biden continues to have a spine about Afghanistan. The president—long an avatar of conventional wisdom, whichever way it blows—is actually refusing to give in to the warmongering hordes who insist that yesterday's tragic terrorist attack in Kabul somehow magically makes keeping American troops there wise. Meanwhile, media that largely ignored Afghanistan for years now give a voice to endless schlock about our deeds there, and partisan hacks who praised former President Donald Trump for negotiating with the Taliban and announcing the troop withdrawal from Afghanistan have been leaping at the chance to score opportunistic points against Democrats and/or reestablish their warmongering bona fides.
It was bad since last week, and even worse with the attack in Kabul yesterday by members of the Islamic State of Iraq and the Levant–Khorasan Province. For instance, Sen. Josh Hawley (R–Mo.)—who profusely praised Trump's withdrawal plans, and continued to praise withdrawal as recently as April—is now calling on Biden to resign. A number of other Republicans have done the same.
Certainly, the Biden administration has made mistakes in the way it has handled the withdrawal, particularly when it comes to getting out Americans and Afghan allies. (There are certainly lots of opportunities for the administration to continue to go wrong, too.) But it's nothing more than self-serving claptrap to pretend that there was a way it could have done this that would've left things in Afghanistan humming along perfectly or without any of the upheaval and violence we're now seeing.
These disturbing incidents are a shining indication of the lies at the center of our project in Afghanistan and a symptom of how badly we failed all along, not a reason to senselessly stay the course.

This is quite frankly bullshit. We might trust the "CDC's Judgement" that there will be health impact from people being evicted. But no one in their right mind could suggest that CDC has the data to know whether that outweighs the economic impact of millions of mortgages going into default.
And that is besides the fact of whether or not it is constitutional for any part of the government (congress or executive) to force you to quarter people on your property against your will and without compensation.
In the core of every progressive is a totalitarian. Why have any form of government, especially a big, comprehensive, and intrusive government, if they can't use it to both define and then strive for "the public interest"?

Anyone who says they have all the answers is a liar. In the face of uncertainty, people should at least be able to choose whether they want to wait and see or not.

So yes he deserves criticism for not realizing how much of a fiction it really was. But it was always a fiction, and therefore there would have always been chaos in any evacuation plan.

Troops may have died anyway, but the fact that they died as a result of chaos that could have been mitigated by better planning is squarely on them.

Once the US and allied contractors had been refused entry or told to withdraw, there was nobody to refit, fuel maintain the equipment about which Biden and so many of you folks that support him like to prattle. Aircraft, but also ground vehicles, communications, and weapons require upkeep, Their components fail and need to be replaced. They need batteries, fuel, filters. With no means for providing this and facing a sustained fight, without much of the know-how, and in many cases being caught unaware by the withdrawal, the Afghan forces were abandoned. Or, in the parlance of your in-group, many of them felt abandoned -the difference here, they actually were physically abandoned by the US. And by an enormous geographic space. This is not difficult to understand, but it is apparently not something you want to accept.

To cop Orwell and turn his famous statement around, the real difference here is not between libertarians and authoritarians but between conservatives and revolutionaries. Because libertarians can and do make libertarian arguments that conflict with each other, does not mean that one side is the real libertarian side and the other one isn't. It just means that libertarianism can and does legitimately encompass more than one strain of legitimate libertarian thought.
It MAY BE necessary for an argument to be libertarian to be correct, but being libertarian is not a sufficient condition for being correct. Sharpen your pencils. Do some thinking. Figure out why Cathy Young is wrong on the facts or wrong in logic. If you can't accomplish that task, then formulate a libertarian counterargument of your own that conflicts with Young's--and then thank Cathy Young for making you smarter than you were before.

Apparently the agreement with the Taliban and the Afghan government would have kept the air base under US control to help keep the peace and serve as a base for intelligence gathering. I don't know if that is a good idea or not... But it certainly is better than abandoning the base before you evacuate.
What else?
Well, how about not announcing that you are breaking the agreement with the Taliban unilaterally and then announcing that you are going to pull all troops out on a date certain without consulting with any of the vested parties? This directly and immediately lead to the fall of the Afghan government (well, coupled with pulling authorization for contractors to work on Afghan military equipment supplied by the US.).
And then?
Well, how about not advising people to leave before the pullout? How about making proclamations that you cannot keep?
Stop with the Rachel Maddow spin. The question has never been "what could Biden have done to leave and guarantee that the Afghan government would be successful and stable?".
It isn't like this required 4D chess. There was already a process in place and it already was working. Instead of the knee jerk "I am tossing out the previous administration's process for a spring departure and we are leaving on Sept 11 because that is symbolic for domestic partisan reasons", they could have just gone with the process and taken credit for it.
Pulling out civilians first and the military last would have avoided everything they are being criticized for. And if things did go tits up, you'd still have a huge airbase for contingencies instead of a tiny, 1 runway airport in the middle of a city.
None of that would have guaranteed a Taliban-free future. Far from it. In all likelihood they would be in exactly the same place in 2022 either way. But without all of the negatives we are witnessing in real time.

Let's not talk about every member of the media. Just look in the mirror. How much of a pass would you have given Trump on that one? How about the president's refusal to take questions? If this had happened in December, how would you have covered it? Would your primary worry have been that Democrat hacks were criticizing the pullout? Can you even make an honest assessment of that question?
Most of us have been on the "Ok, can we be done with this?" Side of Afghanistan (and Iraq) for at least 12 years. This is a pretty anti war crowd. So picking out Biden for special praise for "sticking to his guns" on the withdrawal is a bit weird.
First: he didn't stick to his guns. He broke the US government's agreement on day one, probably without bothering to even read it. Then he got criticized for the 9/11 cheeseball date, so he changed it, seemingly on a whim. Then he made some unilateral announcements that sounded quite extemporaneous and were possibly simply designed to appease a particular audience that he happened to be standing in front of at the time. Nobody seems to even know who decided that contractors were not going to be allowed to work on equipment for the Afghans, but the net result of that was the local afghan government officials and commanders knew that they were being hung out to dry, so they immediately negotiated surrender for cash.
That is a pretty high level of ineptitude for us on the "I disapprove of everything the government does" to just give a pass to, particularly with a guy who could have advocated for a withdrawal at any point in the 8 years he was the number 2 executive in the White House.
And that leaves off the optics of having the same general who just told us with great passion that it was vital to national security that our military confront white rage now being the guy who thinks it is a good idea to pull the military out of a combat zone before getting all the civilians out. You'd think a pro-free-thinking, anti-authoritarian magazine could squeeze a few think pieces out of that dichotomy.
This is a target rich environment. I'm not sure praise for Biden because he is tough enough to withstand criticism for how he handled the draw-down in Afghanistan without folding to some nonexistent pressure to send 30,000 troops in to retake the country. Once he screwed the pooch, he really couldn't unscrew it. Going back in now would be extremely difficult, and not just politically.
I keep telling myself that there's GOT to be a market for a real libertarian look at the news, maybe on Substack.

By definition, real property can't move across state lines, so the courts can't weasel around it by invoking their magical mantra of 'interstate commerce'.
