Why OnlyFans Is Double-Crossing Sex Workers

Plus: FTC revives antitrust suit against Facebook, Planned Parenthood pushes back against Montana abortion laws, and more...

OnlyFans—a website popularized as a place for the sharing and monetizing of erotic imagery—will stop allowing "sexually explicit" content as of October 1. "In order to ensure the long-term sustainability of the platform, and to continue to host an inclusive community of creators and fans, we must evolve our content guidelines," the company said in an emailed statement. "Creators will continue to be allowed to post content containing nudity as long as it is consistent with our Acceptable Use Policy."

The company attributed this change to pressure from banks and payment processors. "These changes are to comply with the requests of our banking partners and payout providers," its statement said. Asked to elaborate, a spokesperson for OnlyFans told me "the platform has no further comments at this time."

Understandably, many sex workers who helped build up OnlyFans and now rely on the site for income are upset—and not mollified by promises that some nudity will still be allowed.

"Please consider telling sex workers that OF will still allow some nudity probably isn't helpful right now," tweeted podcaster and sex worker rights activist Phoenix Calida. "Some of the policy is vague, there's a history of targeting & deplatforming SWs even when their content is within the guidelines. The fears & concerns are justified."

When Facebook and Instagram "updated their terms to crack down on explicit content. What Happened? A bunch of sws got banned for non sw posts. Everything from gofundmes for pets to bikini pics at the beach. All Bc they were sws," Calida added.

A lot of folks have been blaming OnlyFans' pivot away from porn on its desire to be more palatable to venture capitalists. Earlier this year, the company launched a PG version that can be downloaded from Apple and Google's app stores and features things "like cooking tutorials, yoga routines and interviews," notes TechCrunch. "OnlyFans is profitable, but to continue to grow, it is seeking funding at a valuation of over $1 billion."

"OnlyFans would be nothing without the sex workers whose labor built it up into a major platform. Now it's tossing them aside," complained author Kim Kelly, in a sentiment that could be found across Twitter yesterday.

There's no doubt that OnlyFans is screwing over the very users who helped make it successful. But how much culpability the company has and how much anger it deserves are up for debate, since OnlyFans may be a victim in this too.

It's impossible to know how much of this decision relates to marketability and venture capital funding, and how much relates to insurmountable political and financial pressure. But the latter is a very real issue, and not one so easily overcome. It's plagued platform after platform that provide a digital home for sex workers.

We saw this with Craigslist and Backpage, when they were the biggest purveyors of online sex work ads. Authorities pressured them to accept credit card payments, since these would be trackable and usable by prosecutors to help find and punish people who did use the site for exploitation. When Backpage agreed, it was then accused of profiting off exploitation; some even went so far as to threaten Visa and Mastercard if they wouldn't stop doing business with Backpage. Faced with political pressure and public accusations that they were facilitating sex trafficking, the credit card companies complied. The case had to go all the way to a federal appeals court, which ruled that the bullying of the credit card companies to drop Backpage had been unconstitutional. As this all played out, Backpage went back to free adult ads and tried alternative payment methods, like cryptocurrency. Both actions—moves brought about by unconstitutional political pressure—have since been used by prosecutors as evidence of criminal activity such as "money laundering."

The debacle highlights the impossible situation that platforms friendly to sex workers find themselves in these days, where almost any move they make short of ditching all adult elements will be used—in public pressure campaigns, civil lawsuits, and criminal prosecutions—to accuse them of serious wrongdoing. Specifically, activists toss around words like "sex trafficking," "human trafficking," and "child sex abuse material" with abandon, arguing that anything except total capitulation to moral groups' demands is a decision to willfully facilitate these things.

Since Backpage was seized by the feds and Craigslist stopped allowing even personals ads, sites such as OnlyFans and Pornhub have become the next big targets of anti-porn and anti–sex work crusaders, with the media and lawmakers in their thrall.

We've seen the same playbook used against porn sites as was previously used against classified-ad sites, with conservative groups—like the old Morality in Media, now rebranded as the National Center on Sexual Exploitation (NCOSE), and Exodus Cry—targeting the banks, credit card companies, and payment processors that enable these sites. Meanwhile, the same lawmakers that pushed FOSTA (the 2018 law making hosting prostitution ads a federal crime) have been pressuring the U.S. Department of Justice to investigate OnlyFans.

I'm not saying that OnlyFans has made the right decision in choosing to stop allowing sexually explicit content. But maybe there is no right decision—and authorities have made sure that companies know that. The only ones to really stand up to political pressure and fight back in court have been the folks behind Backpage, and they've been shut down and criminally prosecuted for years, their assets seized and their founders facing the rest of their lives in prison. (The trial starts in September.) There's no doubt that officials wanted to send a message with Backpage, about what happens when platform operators refuse to just roll over and play along with the sex trafficking hysteria.

The most perverse part of it all is that authorities and activists claim to be doing this to "stop sexual exploitation" and save women and children, but their charade only forecloses safer opportunities for sex work, making risk and exploitation more likely while sending digital markets for sex work overseas or underground. They admit this was the case with the Backpage seizure and the passage of FOSTA, yet they plow right ahead with the same antics with whatever new digital platforms become the most popular for sex work.

Now, people are left with one fewer safe and profitable option to engage in sex work on their own terms.

"As anti-porn organizations celebrate, we brace ourselves for the crisis this will likely cause," said the Adult Performance Artists Guild in a statement. "Workers in our industry have families to care for, and this change will push many into potential homelessness."

It would be remiss to lay all the background blame on religious activists and government officials, of course. There are plenty of progressive and centrist feminists who crusade against sex work, too. And the progressive crusade in favor of devaluing free speech online and for holding the internet platforms and the infrastructure behind them (web hosting companies, email marketing companies, payment processors, etc.) responsible for user-generated content also puts us in this situation.

"This was the inevitable result not just of right wing fundamentalist moral panic over sex work, but also of DC based progressive nonprofits constantly calling for more deplatforming even at the infrastructure layer, and ignoring warnings about why it was a bad idea," tweets Evan Greer of the digital rights group Fight for the Future.

The Federal Trade Commission (FTC) has refiled its antitrust lawsuit against Facebook. The first time around, a federal court said the FTC hadn't proved Facebook was actually a monopoly. But the court left it open for the agency to amend its complaint and file again.

In the new complaint, the FTC's monopoly argument still leaves a lot to be desired. To "prove" Facebook's monopoly status, it defines the relevant market—the sphere Facebook is supposed to be dominating—to exclude many of Facebook's competitors, including Twitter.

Montana abortion laws challenged. Planned Parenthood has filed a lawsuit over Montana's latest abortion restrictions. From Fox News:

The laws are set to take effect Oct. 1. They would ban abortion after 20 weeks of gestation; restrict access to abortion pills; require abortion providers to ask patients if they would like to view an ultrasound; and prohibit insurance plans that cover abortion procedures from being offered on the federal exchange.

The lawsuit filed in Yellowstone District Court claims the laws violate Montana's constitution, which protects access to abortion before the fetus is viable, generally at 24 weeks gestation. It says the laws will reduce the number of locations where abortion services are offered and will threaten abortion providers with civil and criminal penalties.

      How many times have I drawn the line for them, connecting the dots from Obama's Operation Choke Point to the deplatforming of conservative voices? This was the point all along. And they really didn't hide it. Remember, they went after porn actors, check cashing stores and gun stores using the power of the federal government.

      It was blatantly unconstitutional and arguably directly fascist. But when it morphed into a quiet, back chanel arrangement reason spent their energy arguing against the critics instead of supporting free association and freedom of expression... All because they picked Alex Jones as the poster child.

    From what I hear, OnlyFans was not created to be a safe haven for sex work. It was created as competition to Patreon for artists sharing their work. They were never comfortable with the sex work that had been taking over their model. While they have profited from it, they do not want to be known as a porn site and are concerned that is what their reputation is becoming.

    Interesting that a platform trying to shed a reputation they do not want is a problem for ENB now that it is one of her interests being negatively impacted.

And when people used the same model to predict what would happen in Sweden, the model was catastrophically wrong. But people STILL let these experts tell them what is "reality".

              Why is your "Expert" better than my "Expert"? Why should Sullum, a guy with a degree in Psychology and Economics, be believed when he says Rand Paul- a trained medical doctor- is overstating certain scientific studies? Did you find an expert who backs up Sullum? Well what if I find an expert who backs up Paul? Am I right now? Or are you going to say, "Nah, Overt, your expert isn't as good as mine"?

                Jeff is the one who constantly argues for subjective over objective realities. Ask him about CRT as an example. In this very thread see how he denies science because the experts said something different. If I point out 100 years of studies on masks showing no statistical deviation regarding their effectiveness against respiratory viruses, Jeff dismisses them on the idea that new studies by experts override old studies even when the new studies are subjectively created models and not based on primary data.

                Jeff is the last person that should discuss objective reality on this comment board.

                I think that he THINKS his conception of reality is objective, but he is interpreting his reality through a bias and a narrative and a curated set of information sources which heavily shapes his viewpoint. HIS construction of reality is socially constructed whether he wants to admit it or not, based on the choices that he has made in how he chooses to construct that reality.

                Several things:

                1. It is often very difficult to try to discern what objective reality is. Individuals will sometimes make good-faith efforts to do so and wind up being wrong. That they ended up being wrong doesn't necessarily mean that they were frauds or acted in bad faith and it shouldn't be a priori assumed that they were. If your definition of expert is "someone who is never wrong" then no one is an expert. Instead, an expert is someone who has highly specialized study or training in a particular field and makes reasonable, good faith efforts to try to discover new knowledge and uncover objective reality to the best of his/her abilities. Sometimes being wrong is part of the process.

                2. When the data are unclear, experts can disagree on how to interpret that data. That is fine too. That experts can disagree in ambiguous cases doesn't mean that experts are wrong in cases when the data are crystal clear.

                I guess the bottom line is, for individuals who have specialized study and training in a specific field, should their judgment in matters relating to that field bear more weight than the judgments of others? If your answer is "no", then we just have to agree to disagree. But if your answer is "yes", then the only difference here is how much weight that the judgment of experts should be given. Frankly I'm going to trust the judgment of experts in their fields of expertise more than the judgment of some rando with a YouTube channel.

            To put a finer point on it: we are not by nature critical thinkers. We do not seek out information to challenge our conclusions, but rather seek out evidence to support our conclusions. This is literally the pedagogy of our coursework through primary, secondary, and up until you get into some Masters Programs- here is a conclusion, now go find evidence.

            The internet feeds this bias by providing you all the "facts" you need to support your case. Social Media merely makes this easier because it allows you to network with the people who support your case, and it also uses algorithms to sift through the thousands of potential arguments, and surface the ones with the best crafted emotional hooks- like a petrie dish for memes.

            But the problem isn't social media or the internet- both are just tools. The problem is partially that the population doesn't have good critical thinking tools, but the biggest problem is that an over-expansive and intrusive government has made the stakes of our disagreements so fucking high. If conspiracy theorists elected some dog catcher, no one would care. But instead these people are electing the leaders of trillion-dollar budgets that interfere with pretty much every aspect of our lives.

      Populism isn't the same as mob rule though. Usually when populism is used, it is contrasting with Elitism. Generally populists' main platform is around returning power to the people that is being held by the Elites. That the populace may want to implement bad policies is not really much different than the fact that the Elites want to implement bad policies.

      I know that as someone who seems often enamored with the Elites and Experts, you might think that it is just giving the populace whatever they want- but it is really about giving the population a say.

      For example, today, it isn't the populace putting these controls in place. It is Elites. Absolutely, Passports are being implemented by executives and unelected bureaucrats. The fact that- in this moment, according to some specific survey- the populace may be in agreement IS COMPLETELY BESIDE THE POINT.     These concerns are understandable but unwarranted. Although scientists don’t have much data yet on how wearing masks during a pandemic affects children’s development, there is plenty of reason to believe that it won’t cause any harm. Children in cultures where caregivers and educators wear head-coverings that obscure their mouths and noses develop skills just as children in other cultures do. Even congenitally blind children — who cannot see faces at all — still learn to speak, read and get along with other people.

    Indeed, there is good reason to believe that wearing a mask at school could actually improve certain social and cognitive skills, helping to strengthen abilities like self-control and attention. This is not to say that masks are preferable to no masks, all things being equal. Masks are inconvenient, uncomfortable and bothersome. But as long as they are needed, we should take advantage of the fact that they offer distinctive opportunities for learning and growth.

    Take language learning. It’s true that masks cover our mouths and that seeing mouth shape and movement contributes to language development in infants. But learning how to communicate verbally involves a lot more than mouths — a reality that masks accentuate.

Professional teachers have an obligation to keep their opinions to themselves and should only teach rigorously verified facts or theories.

            You can teach kids human biology without speculating on the origins of life. You can teach kids about the science of ecosystems without speculating on climate change. You can teach kids the history of the United States without speculating on the impact of race. You can teach kids how government functions without speculating on current politics. You can teach kids basic psychology without speculating on the intelligence of their parents.

            What you can't do is present fallacy as truth. It is a particularly egregious abuse of the trust that children have in their teachers.

So McMahon had to go find other cable outlets that weren't owned by Turner and compete with Turner. But how do you compete with a major corporation with deeper pockets?

    The correct answer is that you start creating content that people want to watch--but a major corporation like Turner's won't emulate because it's too raunchy.

    Turner simply couldn't emulate a "bra and panties" match--where one woman had to strip another to her bra and panties to win. Turned couldn't have the Dudly Boyz slamming women through tables. Meanwhile, ECW was doing things that the WWF wouldn't even show--and generating a cult following with that content that could never translate to national audience and gain big time national sponsors as advertisers. There were things the WWF couldn't do for fear of losing the sponsors they had, and even more things that Turned couldn't do--because he had bigger and better advertisers.

    OnlyFans made their name doing things that Patreon wouldn't or couldn't do, and now that OnlyFans has become big enough, they want to go after the kinds of sponsorships that stopped Patreon from hosting that kind of content in the past. The main libertarian lesson that should be drawn from this is that government censorship of pornography is unnecessary because entrepreneurs are far better at gauging the tolerance of their audiences for offensive content.

    The secondary question is why so many libertarians have a hard time seeing that this kind of thing isn't at play when we're talking about what average audiences are willing to tolerate on social media in terms of misinformation, racism, sexism, homophobia, etc. Why are the social media companies so much more prudish, in this regard, than half of their users? They're no doubt subject to the same pressures of advertisers, but another fat part of the answer has to do with these standards being imposed on them by the government through the Democratic party. There's no doubt in my mind but that if the Democratic party weren't trying to break these companies up, they'd do a much better job in moderating their content to the standards of their users--rather than the standards of the social justice warriors who control the Democratic party.

    Yes, I acknowledge the pressure, but they absolutely could and should have come out swinging. This move will likely end them as a company and they not acting like it. It has been obvious for a long time now that they needed to create a separate brand for the clothes-on side of the business. They didn't need to dump explicit content to grow that side, and I doubt that the policy change will even help remove the stigma anyway.

    If you get outraged over one violation of your principles, but not any others, then you don’t have ‘principles’, you just have an excuse.

    No that's just not true. Principles are not about one's outrage factor. Principles are principles. People are not robots and they care about some issues more than others. Expecting individuals to have an equal *emotional* connection to every single issue is ridiculous, and not even necessary in order to support the principle of the matter.

    If you accept that it’s okay to silence Nazis and Klansmen, then you can extend that justification to just about anyone you want. And then you don’t have freedom of speech.

    No one is saying that it is OKAY to silence Nazis and Klansmen. That is the principle of the matter. But it is perfectly fine and acceptable to not be as *emotionally sympathetic* to the "plight" of Nazis and Klansmen as to the plight of other groups who actually have suffered at the hands of oppression.

    Uh, the level of "caring" shouldn't be relevant here, you moron. If "principles are principles," then "MUH PHREE ASSOSIASHUN!" doesn't matter when it comes to principles of free speech and free expression on any social media platform.

    Again, just like Tumblr in the past, OnlyFans is trying to keep from getting choked off from bank and credit financing streams, so they're shutting down the pr0n in an effort to keep their business growing. I think it's stupid just like ENB, but this is the endgame of the government colluding with Big Tech and the banksters to determine what's "acceptable" and what isn't.

    My problem is that they're amost universally actually saying "Stop being mean to the pimps and johns."

    I mean, a lot of sex worker activism is focused on that, and maintaining access to sex workers--that's why they insist that sex trafficking doesn't exist, because otherwise? Oh noes, they have to actually care about if the sex worker they pick is a fellow consenting adult.

    The thing is, if you're a libertarian? That should be automatically what you want. Slavery, under any name, is antithetical to libertarianism. (And the claims you can't find convictions are very much ignoring that it generally gets pled down because the laws are written to make it very difficult to get a conviction. Some laws are bad simply because they just functionally aren't enforceable...)
