Barely Legal Strippers Now Fully Illegal in Texas

The penalty for employing 18- to 20-year-olds to work nude, topless, or "in a sexually oriented commercial activity" is now 2 to 20 years in prison.

In a performative bid against "human trafficking," Texas has raised the legal age for working at a strip club from 18 to 21 years old, putting many employees out of work and putting clubs that hire them—even inadvertently—in risk of serious legal penalties, including up to 20 years in prison and a $10,000 fine. The state also updated part of its penal code to define "child" as anyone under age 21.

There's no evidence that legal strip clubs in Texas are rife with underage workers (which would already be against the law), nor that young adults working in these clubs are at higher risk of human trafficking. Texas lawmakers—and their counterparts in Congress and in states across the country—love to Do Something About Sexual Exploitation even if that thing has serious ancillary consequences and no chance in hell of accomplishing its stated goals.

What the new Texas law (S.B. 315) will do is make it illegal for young adult women inclined to work at a strip club to do so—driving up the likelihood that some of them will instead engage in more risky forms of sex work and/or fall into the arms of exploitative third parties (those who police call "traffickers" and "pimps"). Meanwhile, someone already under the control of a "trafficker" will still be, but in a location further underground.

"Those who pushed the bill may feel like heroes for 'rescuing' 18, 19, and 20-year-olds from what they believe to be the horrors of the sex industry," writes Jessie Sage—managing editor of Peepshow mag and a self-described erotic laborer—in a blog post about the Texas legislation and those who will be pushed out of employment because of it. "Yet, in the wake of a global pandemic that has devastated the economy, and a lack of employment protections for sex workers, the sure harms of such laws far outstrip any imagined benefit, particularly for the young dancers whose livelihoods now hang in the balance."

Checking to make sure no 18-, 19-, or 20-year-olds are employed by strip clubs also gives cops another excuse to conduct raids, demand to see business records, and harass owners and staff. And it provides a new and easier way to entrap places into lawbreaking in order to shut them down. Those who may have considered it unethical to send a minor with a fake ID into a strip club may have fewer reservations when the bait is a 20-year-old pretending to be 21.

Strip clubs aren't the only ones affected. The law—which was signed into law on May 24 and took effect immediately—says all "sexually oriented businesses" must comply with the new age limit. So working at shops selling sex toys, porn, or other adult goods is now off limits for adults under age 21, even though it's legal for these same adults to purchase sex toys, purchase porn, or go to strip clubs and other sex-related businesses. Adult modeling studios, webcam studios, and their ilk are off limits too.

Any sexually oriented business found employing someone 18 to 20 years old in any capacity (with the exception of as an "independent contractor solely performing repair, maintenance, or construction services at the business") is now guilty of a class A misdemeanor, punishable by up to a year in jail and a $4,000 fine.

Anyone employing an 18- to 20-year-old to work nude, topless, or "in a sexually oriented commercial activity"—that is, "a massage establishment, nude studio, modeling studio, love parlor, or other similar commercial enterprise the primary business of which is the offering of a service that is intended to provide sexual stimulation or sexual gratification to the customer"—is now guilty of violating the state's law against Employment Harmful to Children, a felony.

Employing someone ages 18 to 20 to work nude, topless, or in a sexually oriented commercial activity has become a second-degree felony, punishable by a mandatory minimum of two years in prison (and possibly as many as 20 years in prison), plus a fine of up to $10,000. "Conduct under this section constitutes an offense regardless of whether the actor knows the age of the victim at the time of the offense," the law states.

S.B. 315 passed the Texas Senate unanimously. In the House, it received 142 yeas and 0 nays, with eight lawmakers not voting.

With the law's passage, Texas follows the lead of New Orleans, which several years ago raised the legal age for nude dancing to 21.

Texas is also following a regrettable trend toward infantilizing young adults in America, carving out ages 18 to 20 as a liminal period between being a child and full adulthood. Not only is this cohort unable to consume alcohol legally, but the legal age for purchasing cigarettes, e-cigarettes, and tobacco products is now 21. Alaska considers anyone who "causes or induces" an 18- to 20-year-old to be paid for sex to be a criminal sex trafficker, even if no force, fraud, or coercion is used. The FBI lumps 18- to 20-year-olds in with children for purposes of missing kids statistics. And so on.

In addition to raising the age to work at Texas sex shops, strip clubs, etc., to age 21, S.B. 315 also bans anyone under age 18 from so much as entering the premises of a sexually oriented business. Violations of this are considered a Class A misdemeanor, and can lead to fines, jail time, and an injunction. An alcohol-serving sexually oriented business can also have their its permit or license suspended for 30 days upon a first violation, suspended for 60 days upon a second violation, and canceled upon a third violation.

Criminal penalties notwithstanding, any sexually oriented business that "habitually employs or contracts with a person under the age of 21 to provide work or services or allows persons under the age of 18 to enter the business premises would be designated a common nuisance, subject to a lawsuit seeking injunction and abatement."

Like so many laws sold to the public as "fighting sex trafficking," the new Texas law comes down hardest on sex workers themselves.

"Rather than pearl-clutching moralism, law makers would be better off listening to the chorus of sex workers who tell them that these laws are harmful to their community and young people who will be pushed into making more dangerous choices when clubs are no longer available to them," suggests Sage. "If they were actually interested in protecting young sex workers, they would listen to them; sex workers know what they need, and it's not less opportunity."

    3. One of the strangest aspects of modern American society is that a teenager can go from a zero-tolerance high schools, where they could get in trouble for making a gun out of cardboard, to fighting in a foreign war zone in little time.

          AIT is 4 weeks.

            Being four months in and sent to a combat zone mostly only serves to increase the danger to, and reduce the readiness of your unit.

              For most soldiers its going to be 6 months from induction to reporting – Basic, MOS training, sent off to your first unit.

              Which might be deployed already.

              With that, depending on needs, you might sit in the rear echelon detachment for a while – receiving no training – or you might be told to keep your bags packed and sent out to meet your deployed unit.

              That’s what happened to me. Basic, A school, showed up to my ship’s base, spent a few days there, sent to Italy, spent a week there, sent on to meet the ship in Turkey. Right in the middle of Desert Shield, heading into Desert Storm.

In WWI, we made our new allies wait nearly a year until the new troops were trained in sufficient quantity – but we didn’t use our allies’ 3 years of trench warfare experience in that training, so maybe we might as well have sent the troops as fast aw we could swear them in and issue uniforms and rifles. (Most of the heavier weaponry had to be supplied by the allies…)

                In WWII, we immediately had units facing the enemy, which desperately needed more warm bodies. So both schools and colleges were persuaded to graduate students early, they rushed through training, were assigned to units, and often deployed into combat with inadequate training in general and no training with their unit. IIRC, the new 2nd Lieutenant platoon leaders from the accelerated program were derisively known as “90 day wonders”, and their men often died from their inexperience.

                But this was not policy, but an emergency suspension of policy. And there were units that trained together for a year or two before they were committed to combat, for instance the paratroopers whose first combat jump was on D-Day.

                OTOH, the WWII American Army excelled in one way – they often improvised effective solutions on the spot, both to unexpected problems and failures of the established procedures. Perhaps under-training allowed this flexibility and creativeness…

                1. In WWII we had units facing the enemy from the get-go. See, eg, Boyington and the Flying Tigers fighting Imperial Japanese forces in China while the US was still trying to sit out the war.

          2. AIT ranges up to several moths depending in the MOS. Mine was seven weeks.

          3. AF basic training was 6 weeks long when I did it. Then again, in the AF, most of the fighting happens WAY OVER THERE, and the people doing the fighting are officers. That’s why AF Basic Training includes all of half a day of rifle training before heading off the the rifle range for half a day, then they take the rifles away and don’t give them back.
            They do give the AF two-thirds of the nuclear triad, though.
