Civil Liberties Groups Plead With Biden To Stop Persecuting Julian Assange

Two dozen civil liberties and human rights groups are pleading with President Joe Biden to make things right with journalist Julian Assange. "We, the undersigned press freedom, civil liberties, and international human rights advocacy organizations, write today to share our profound concern about the ongoing criminal and extradition proceedings relating to Julian Assange, the founder of Wikileaks, under the Espionage Act and the Computer Fraud and Abuse Act," the letter opens.
It is signed by the American Civil Liberties Union (ACLU), Amnesty International USA, the Electronic Frontier Foundation, the First Amendment Coalition, Human Rights Watch, the Knight First Amendment Institute, PEN America, Reporters Without Borders, and more.
The groups urge Biden to give up on the Trump administration's appeal of a United Kingdom court decision denying the United States' request to have Assange forcibly returned to the U.S.
They argue that the prosecution and extradition attempt is "a grave threat to press freedom both in the United States and abroad," since the "criminal" conduct Assange is accused of "is conduct that journalists engage in routinely—and that they must engage in in order to do the work the public needs them to do."
"Some of the charges included in the indictment turn entirely on Mr. Assange's decision to publish classified information," their letter points out. "News organizations frequently and necessarily publish classified information in order to inform the public of matters of profound public significance."
The Assange situation "will present the Biden administration with an early test" of whether he plans to carry on the Trump administration's hostility to journalists and press freedom, suggests Jameel Jaffer at Just Security. While "Assange is a complicated figure, and he seems to have alienated basically everyone," there is still "near-universal agreement among human rights, civil liberties, and press freedom organizations that the case against him poses a major threat to press freedom not just here in the United States but around the world."

"If the code becomes law, Google would have no real choice but to stop providing search in Australia," Mel Silva, managing director of Google Australia and New Zealand, told Australian lawmakers last month. "It would have a significant impact on our ability to connect our content to our audience," Neil Ackland of Junkee Media told The Financial Times.
Ackland warned the code, which government sources expect will be enacted within weeks, could "potentially be fatal" for small publishers such as Junkee, which rely on Google and Facebook to drive 75 per cent of traffic to their websites….

If Google is threatening to shut down the Google app store, I strongly suspect that would violate their contractual obligations to various phone ,manufacturers. If they shut down their app store, it would certainly open them up to charges of abusing their market position a la antitrust, too.

First, Julian Assange is not, by reasonable standards, a journalist. At bottom, he is an organizer of thieves who penetrate public and private data systems, copy data, and provide it to him and his associates for publication. The publication, most often is in raw form. While the data might be used by journalists, that does not make Assange one.
Second, Assange is not being persecuted. He is plausibly accused of providing material assistance to Bradley Manning, who stole US government classified material for delivery to Assange. He is accused, in particular, of helping Manning crack a password he needed to gain unauthorized access to some of the data. The charge is a serious one, and Mr. Assange and the US government have a right to try it and others in court. Accordingly, the government has requested that the United Kingdom, where he was being held on a bail-jumping charge, extradite him for trial.
Whether Assange is a journalist by your definition doesn't matter. There isn't anything about being an official journalist in your book that gives them any special rights. He published information--full stop. Meanwhile, he's only guilty if a jury of his peers is willing to convict him. If I were on the jury, publishing the truth, when the government is violating our rights or behaving badly, doesn't merit a conviction--regardless of whether he broke the law. If Joe Biden and the Democrats want to take the side of the bureaucrats treating our rights like shit and behaving badly, then they should own that. Looks about right on them.

You want to publish the details of NSA malfeasance? I'm onboard, wouldn't vote to convict. But there's a lot of classified material that is of absolutely no public interest and he published it anyways, putting those people in danger for basically no reason. He should face consequences for that.

Yup. It's a near certainty that Assange will be prosecuted and punished more severely than Assange and from imposing the US's will abroad to abrogating free speech to defending a military occupation, it should be unconscionable from an American/libertarian POV.
I disagree slightly. Absent taking a sworn oath to protect the information and serve the people it protected, he simply reported facts as he knew them. Keep in mind, Assange is not and was not a US citizen. If a Canadian, British, German, or Saudi reporter uncovers reasonable evidence that the US committed war crimes outside the US, are they bound by the rules and procedures of the US State Dept.? There's a case that he, metaphorically of course, lent a pair of bolt cutters to someone who he knew would steal US secrets but, barring him being 'at the scene' of the theft, he should receive a slap on the wrist. Manning is the one who actually stole the secrets, violated his oath, and betrayed his country and fellow officers, and he's been shown obnoxiously excessive leniency.
I can't fathom the reasonable reason, libertarian or other, why Assange should face anything worse than Manning has received. This already is a pretty gross miscarriage of justice in defense of a violent military occupation and to punish Assange while letting Manning off easy is an effective end-around the concept behind whistleblower protections. Did Glen Greenwald have any idea as to the number of lives he would cost/save by publishing Snowden's intel/revelations? IMO, unless you can prove that Manning showed Assange how publishing information XYZ would lead to the death of (e.g.) Chris Stevens or every American operative in Benghazi or whatever, there's no crime. It's a journalist's job to weigh the consequences but there's a reasonable limit as to how deeply they can explore and consider those consequences.
And to address the issue Tom Dial raised above, yes, Assange is being persecuted. The bail-jumping trial he's being pursued for is groundless. The woman accusing him of assaulting her doesn't make any claims to his use of force, wasn't his employee, pursued the relationship, arguably more ardently than he did, both before and after the encounter, and didn't make any allegations of the assault until well after the event occurred. The US's pursuit of a non-citizen outside its/any borders is clearly exceptional and incongruous with the treatment of the actual perpetraitors within its borders and under its jurisdiction.
If Assange merely provided a bulletin board for publishing Manning's material, I might agree with you. My understanding though, is Assange went beyond passively publishing data Manning had already stolen, (as the Post did with the Pentagon Papers) and encouraged (in the criminal accomplice sense of the word) Manning to steal more stuff.
Which, if so, makes Assange a spy, if not an oathbreaker like Manning. And if so, he can rot like Manning should.

This demonstrates a profound faith in the ability of the US government to hold a fair and impartial trial and faithfully carry out justice. Given Snowden, Manning's release, Trump's impeachment, Butina's trial, Kavanaugh's trial, Biden's quid pro quo, Swalwell/Fang, Hunter Biden's laptop, mostly peaceful riots v. insurrection, Trump's being impeached again... I no longer have anything near that level of faith in the government.
Under a different administration at a different time, I think Assange should be brought to trial *if he sets foot on American soil*. In the current era, especially with the pursuit that has been and continues to be executed, it very much seems like an attempted lynching of a foreign national under the color of law.

His would-be company is walking about freely on American soil within the jurisdiction of pretty much any American government authority. Many took oaths to uphold the law and protect the Consitution and still show up every day to work. Several even perjured themselve in front of Congress. After we apprehend the fugitive who known as James Clapper, then maybe I'll believe Assange, if he showed up on American soil, could get a fair trail. I have a feeling that had such a thing happened, Snowden may've come home to stand trial too.
