Tennessee Can Enforce Ban on Abortion Based on Sex, Race, or Down Syndrome Status of Fetus

Tennessee can start enforcing a law that criminalizes abortions occurring for non-state-approved reasons. After a lower court temporarily blocked the full measure over the summer, a federal appeals court ruled on Friday that the state may go ahead with the part of the law banning abortion based on the sex or race of the fetus or its likelihood to have Down syndrome. Performing an abortion under these prohibited circumstances could lead to 15 years in jail and a $10,000 fine.
"Tennessee Republican Gov. Bill Lee enacted the so-called 'reason bans' earlier this year as part of a sweeping anti-abortion measure," notes the Associated Press. "The law gained national attention because it banned abortion as early as six weeks—making it one of the strictest in the country—but it included several other anti-abortion components."
A judge temporarily blocked enforcement of the law not long after it was signed in July.
The new 6th Circuit Court of Appeals ruling does not totally undo the lower court's decision. Tennessee is still barred from enforcing the general ban on abortion occurring once fetal cardiac activity can be detected. However, it may begin enforcing the race, sex, and Down syndrome part of the ban.
It's unlikely that the state will enforce it, or even that it can, however. As it stands, no one getting an abortion is required to provide a reason why and, even if it were necessary, women seeking abortions on unapproved grounds could simply say it was for another reason.
More than a dozen other states have similar laws on the books, and as far I know, there have been no attempts at enforcing them. What's more, there's no particular evidence that U.S. women are seeking sex-selective abortions or race-selective abortions at all, let alone in significant numbers.
Abortions based on Down syndrome status or other genetic abnormalities in a fetus may be more common, because some families feel financially or emotionally unable to care for a child with special needs. Regardless, these are exactly the kinds of private, personal, and heart-wrenching decisions that should be left to families and medical professionals, not subject to state approval.
"Immediately following the appeals court ruling," concerning Tennessee's ban, "the plaintiffs' attorneys filed a request in lower federal court for a temporary restraining order to block the reason bans once again, but this time argued the law illegally prohibits a patient from 'obtaining constitutionally protected pre-viability abortion care,'" reports A.P.

This sinister "Great Reset" stuff suggests we really might be approaching the "end of history" this time - not with the worldwide acceptance of classical liberalism, but with its decisive rejection in favor of "soft" and "limited" authoritarianism.
The new consensus spreading among Western political elites is that some issues must be taken off the table, placed beyond the reach of voters, "settled" - and thus enforced - by power that cannot be subordinated to democracy.
In other words, the list of things "free people" don't get to vote against or refuse to accept grows longer. The size and power of centralized government swells to a scale undreamed-of by the founders of a constitutional republic. Very little of it can be voted out of office.

Whatever remains of free society after those authoritarian boundaries are drawn will become the new playground sandbox of liberty - smaller, but safer and more comfortable. All that is not steel will be velvet. All that is not demanded will be provided.
The elite will find just the right amount of authoritarian control to protect The People. You'll still be allowed to own some capital, provided you use it the "right" way. You can be ambitious, but not greedy. You can speak sort-of freely, but only about approved topics.
This is now the great illusion of the 21st Century, brought into focus by the coronavirus pandemic, which will be employed to kill classical liberalism by supposedly "proving" that the most important challenges can only be tackled with authoritarian control.
The delusion will be that authoritarianism can be tamed and harnessed to protect "free" societies. Authoritarianism will become the sleek scientific, industrial, and moral engine that pulls free people into the new century and beyond.
The political class will tell you this is a modest and necessary imposition on liberty. They're just putting a few dangerous things where your adorable childlike hands can't reach them. They're just requiring you to accept a few more points of "consensus."
The list of commands you cannot refuse will get just a LITTLE longer, as will the list of questions you are not allowed to ask, the words you're not allowed to use, the things you cannot buy or sell, the alternatives you are not permitted to seek.
Very Smart People of unimpeachable moral authority and unquestionable wisdom will draw some heavy lines. You will be permitted to color within them as you wish, using the acceptable colors provided to you. You won't be allowed to be dangerous or unpredictable any more.
In every respect, it's the end of classical liberalism - the end of universal freedoms and inalienable rights, of absolute limits on political control. Constitutional limits on what you can vote FOR will be replaced by lists of what you aren't allowed to vote AGAINST.
You may get to elect some of the deciders, but you won't be making the big decisions, and you will not be allowed to reject the "consensus." When capitalism is dominated by politics, risk is replaced by consensus, and reward by entitlement. It's "safer," and smaller.

Maybe it's just my lens, but I think this is a point that gets skipped over by or fails to be presented to lots of pro-mask people. Making sure every kid learns good nutrition is hard, you can't just show up with two goons and let the goons handle it. If you're really advancing public health, you can't just choose the two-goon option because it's easier.

Actually, I think they played this poorly. They assumed that Biden was gonna win big, so they didn't do anything until it was clear that Trump had won. Then they stopped the count in Georgia, Michigan, Wisconsin and Pennsylvania supposedly until the following morning. Then a couple hours later, while they were supposedly asleep, they added hundreds of thousands of votes to the totals, every single one of which was for Biden. 1. different counting. most of asia and africa are using the WHO covid death measure. it results in MUCH lower reported deaths than those used in the west.
...based on this analysis (which looks correct to me) US deaths would be ~45% lower if we followed this standard instead of reporting "death with positive covid PCR test."
I've been wondering why Africa's numbers have been largely sanguine since this all started. I guess it's easy to have lower case numbers and death counts when your bureaucrats don't have a vested interest in pumping the numbers up as much as possible.

The sad fact is that the news media has driven its credibility into the ground in this country, over the course of the last four years, especially, and that is at least half of the reason so many average Americans refuse to believe what the news media is telling them about the results of the election. There are market solutions to that problem, and they're already at work. In the meantime, yelling at the townspeople for refusing to believe the Boy who Cried Wolf anymore is missing the point. If your bullshit was so thick for so long that people won't believe anything you say anymore, the fault is all yours.
The other half of the reason people are so reluctant to accept that Joe Biden won the election is because they have legitimate and genuine concerns about what the Democrats plan to do with them when Joe Biden makes it into the White House.
It's the same kind of thing that ultimately drives their reluctance to accept anything scientists have to say about man-made climate change. Because progressives are promising to destroy our standard of living using the excuse of climate change, people who don't want their standard of living to be destroyed are highly reluctant to concede on anything that might suggest climate change is a legitimate concern.
Likewise, the progressives, who have spent the last four years demonizing the white, blue collar middle class, are promising to remake the economy by way of the Green New Deal, launch a war on guns like we've never seen before, keep social media free from Republican views under the guise of hate speech, and effectively, to send private insurance packing with the introduction of Medicare for All. And they aren't kidding about any of it.
Under those circumstances, it would be irrational of the white, blue collar, middle class NOT to question the validity of any election results that will put Joe Biden in the White House. In the absence of a news media in which average non-Democrats have much trust at all, the Democrats could publicly make clear that they have no intention of doing all the awful things I listed above--but they fully intend to pursue each of those goals to the extent that the results of the Senate election in Georgia will let them.

Driving my new car gives me severe anxiety ever since I rolled the last one. The longer I am driving the more anxious I get. Therefore, I have to get to my destination as quickly as possible before I start to feel uncomfortably anxious. Thankfully, with the help of my doctor and other support people, I have a letter stating my medical need to drive as fast as I need to without regard to speed limits and other such advisories. School zones really make me anxious so I've really got to get through them quickly. I love my doctor- she's so... accommodating and affirming.
I neglected to mention my "other support people". Let me introduce you to my emotional support dog Roscoe. Roscoe is my 120lb Great Pyrenees. You know the airlines always push back that I can't bring him in the cabin but thankfully my doctor wrote me a note to allow it. Similarly, Roscoe himself also suffers from anxiety so he has an emotional support animal. Jimmy is a 100lb pot bellied pig. Pigs are known for their emotional intelligence. Thankfully, my veterinarian was able to write a note to allow Jimmy to travel with Roscoe. It's really incredible how much you can accomplish with a good doctor's note. For my vet, I have updated my original Yelp review to reflect the changes.

The decision to end a pregnancy can be very difficult and is best made by a woman or couple supported by their medical provider and their support group (relatives, friends, spiritual advisers, etc.). Nor for that matter is Downs syndrome. In cases like these where genic conditions will result in an individual facing difficult medical conditions, the mother or the parent couple faces really terrible choices. My contention is that choice is best made close to the people most affected. Not the Tennessee legislature.

There's nothing wrong with holding off on a new vaccine to see what the potential side effects might be, especially one that's been rushed out this quick. Hell, a commercial variant of the Salk polio vaccine actually gave 40,000 people polio one year, because they didn't practice proper QA to ensure the vaccine virus variant was dead instead of active.
The slippery slope I'm seeing come up is that state governments are VERY likely to require people to show they've been vaccinated before entering public buildings or allowing businesses to open. 1. What is the typical % turnout and rate of disqualifications in OR, CO, and other long-standing mail-in states in a Presidential year?
2. What is the turnout and disqualification rate in each newly-adopted states, and how does it compare to that control group?
3. What was the % of single-candidate ballots this year and in prior Presidential elections in each state?

I agree. A few takeaways from 2020, that should be applied to making elections better *in the future*:
1. Voting machine software should be open source so that anyone can examine it.
2. Sending out ballots, as opposed to applications, is a bad idea.
3. There should be systems in place for handling massive amounts of mail-in voting. There will be another pandemic someday.
4. As a libertarian, I find it offensive that canvassing boards consist of two Republicans and two Democrats, and that is considered non-partisan. WTF, that is ensconcing two-party rule.
I'd expect there to be big differences with mail in ballots this year. What doesn't make sense is that while most states are fairly similar, the swing states, especially the few metro areas in those swing states, run contrary to the trends seen everywhere else in the country.

The 'science' in deflategate was bad in major ways.
1. There was never an initial measurement of the ball's psi. There was a process whereby the refs and ball managers inflated and deflated the balls as needed and then did a cursory check, with two different measuring tools, and called the balls ready. None of this information was recorded.
2. Temperature most definitely has an effect of air pressure. That is 4th grade science. As the weather got colder and wetter, the wetness helping to keep the cold on the balls, the air pressure naturally deflated.
3. The balls were then assumed to be at 13 psi and measured with the same two measurement devices which yielded differing results on the same ball.
Shit science to conflate a result that would then punish the Patriots.
The final proof came at the end of the year when in spite of Goodell's sanctions the Patriots won anyway, and though the process of measuring the balls throughout the season was instituted, the results were not shared.
