Make Elections Not Matter So Much Again
That requires reducing government’s power to punish those who lose a vote.

My son's school, located near a polling place, is hosting online-only classes on Election Day and the day before. It's doing so "out of an abundance of caution," despite making a successful transition from a hybrid schedule to optional full-time in-person teaching, because supporters of America's two political death cults can't be trusted to behave themselves when encountering one another on the way to vote.
This, bluntly, is insane. Elections to government office shouldn't matter so much that they pose threats to the safety of school kids. And the only way to make who wins government office matter less is to lower the stakes by making government itself less important.
Schools aren't the only places worried about election fallout.
"We have seen some isolated civil unrest and as we have done on several occasions over the last few years, we have moved our firearms and ammunition off the sales floor as a precaution for the safety of our associates and customers," a Walmart spokesman noted last week. (On Wednesday, I witnessed staff hurriedly removing guns from the sales floor of a Phoenix-area store.)
Amidst much pushback, the company reversed the decision two days later. But the fact remains that a major U.S. retailer fears its customers might riot and try to kill one another if they're disappointed with the outcome of the vote.
Government officials are similarly worried. "Bracing for possible civil unrest on Election Day, the Justice Department is planning to station officials in a command center at FBI headquarters to coordinate the federal response to any disturbances or other problems with voting that may arise across the country," reports The Washington Post. NPR has a similar piece on "How Police, National Guard And Military Are Preparing For Election Day Tensions."
How did we get to the point that Americans might turn to violence if they don't like the outcomes of elections?
"The key to peaceful transition is that politicians and their supporters must be able to lose an election," writes Hoover Institution Senior Fellow John H. Cochrane. "Losers and their supporters understand that they may lose on policy issues, but they will have the chance to regroup and try again. They will not lose their jobs or their businesses. They will not be put in jail, dogged with investigations, prosecuted under vague laws, regulated out of business. Their assets will not be confiscated."
"The vanishing ability to lose an election and not be crushed is the core reason for increased partisan vitriol and astounding violation of basic norms on both sides of our political divide," Cochrane adds. He points to the growing use of regulations, legal interpretations, and criminal investigations by election winners to punish their enemies as making politics a game that nobody can afford to lose.
Chants of "lock her up!" aimed at Hillary Clinton by Donald Trump—or by any candidate at a political opponent—may rally the mob, but they raise the very real possibility that disappointment at the polls will have consequences far more dangerous than thwarted career aspirations. There are plenty of countries where coming out in the wrong end of a vote can land you behind bars.
Likewise, the weaponization of regulatory agencies by New York Gov. Andrew Cuomo and his ilk to strong-arm banks and other firms into denying services to political opponents is a threat to "the First Amendment rights of all organizations to engage in political advocacy without fear that the state will use its regulatory authority to penalize them for doing so," as the American Civil Liberties Union warns.
Yet these thuggish tactics have become regular features of our political life. Politicians thrill their supporters with promises to misuse the vast and dangerous power of the state to crush despised opponents. And then we're supposed to wonder why our political seasons turn into societal pressure cookers with election outcomes treated as existential threats. Well, our political class and their rabid partisans are doing their best to make sure that losing a vote really is an existential threat.
The pandemic has certainly exacerbated the situation. People suffering from economic distress and social isolation enforced by government lockdowns are fodder for civil disorder.
"Economic growth and the unemployment rate are the two most important determinants of social unrest," warns the International Labour Organisation (ILO).
"The domestic situation surrounding the COVID-19 pandemic creates an environment that could accelerate some individuals' mobilization to targeted violence or radicalization to terrorism," cautions the U.S. Department of Homeland Security.
But that's fuel added to an already-smoldering fire. The political culture in the United States was sick long before anybody heard of COVID-19. All too many Americans already hated each other and plotted to destroy their political enemies. Responses to the virus just add a little more chaos to the mix.
So, how to lower the temperature so that school kids aren't imperiled by their proximity to ballot-wielding Democrats and Republicans and retailers don't feel compelled to strip their sporting goods departments prior to Election Day?
"If government ran less of your life, you wouldn't have to spend so much time worrying about 'election fraud' this and 'deadlines for counting ballots' that, etc etc," the Goldwater Institute's Timothy Sandefur mused a few days before the latest Most Important Election Ever ™.
That's true. Traditional philosophical arguments over the proper role of government and the balance of majority wishes with individual autonomy have been replaced by one important observation: the government we have now is so large, powerful, and dangerous that nobody can afford to lose control to their enemies. Politics is now an escalating struggle between death cults whose partisans realistically fear doom if vote totals don't go their way.
I've suggested before that the most promising short-term path is for individuals and localities to follow in the footsteps of Sanctuary Cities and Second Amendment Sanctuaries in ignoring commandments from further up the governmental food chain. That's relatively straightforward since it requires no agreements among factions. Better still would be formal decentralization that doesn't rely on defiance.
But one way or another we have to make elections less consequential so that people can afford to lose them without fearing their treatment by the winners. Given that power is inevitably abused by those who wield it, that means reducing government's authority over our lives so that ballot-box victors can't so easily punish their enemies.

And the walls came down
They'd all been warned
And the walls came down
They stood there laughing
They're not laughing anymore
The walls came down
Sanctuary fades
Congregation splits
Nightly military raids
The congregation splits
It's a song of assassins
Ringin' in your ears
We got terrorist thinking
Playing on fears
Well they blew the horns
And the walls came down
They'd all been warned
But the walls came down
I don't think there are any Russians
And there ain't no Yanks
Just corporate criminals

When I was in college concert band, our conductor pulled out this piece of music called the Election Day March. It wasn't a very good piece of music, and after we had run through it a couple of times, I made the comment "Election Day March? Sounds like it was written by a committee."
We didn't play that one again afterwards.

I think favorably of your aregument but it is perhaps necessary to acknowledge that suggesting that the federal government is too large and involved in local and private matters is, itself, a partisan attack.
To many, American history demonstrates that local and state governments are oppressive and the federal government the guarantor of liberty. It doesn't surprise me that Progressives tend towards centralization, towards an all-encompassing federal government, competent to prosecute pouring a can of waste oil into a hole in the ground.
To such ones, merely calling for a redistribution of power along the lines of what the U.S. Constitution envisioned is a direct threat, a direct attack.
Or, as we shorthand it here amongst the Reason commentariat, to many "progressives", the problem with American history is that the *right people* weren't in charge.
Is it too much to ask that we simply don’t give extra power to people who owned and raped slaves?
Since you’re not worth the minimal thought and effort of a sincere answer; yes, that’s EXACTLY what we want.
I want to know where T-Bot thinks we're finding these people. The last of the slaveowners must have died off at least 50 years go, and the bulk were gone 100 years ago.
How 'bout if we stop empowering the people who are actually looting and raping right now?
"To many, American history demonstrates that local and state governments are oppressive and the federal government the guarantor of liberty. It doesn’t surprise me that Progressives tend towards centralization, towards an all-encompassing federal government, competent to prosecute pouring a can of waste oil into a hole in the ground."
There is more than a grain of truth in this. But it also seems to me that it is a "hangover" effect from past years. While no States will ever be identical in their social or legal structure -- notice the wildly different laws regarding pot, as a for instance -- the intervention of the federal courts in securing the basic rights of the individual, against the States, over the past several decades, seems to me, to unload most of the fears of a rather more decentralized government.
We have two (major) political parties in the US. One of those parties is fairly explicitly the Party of Government, at pretty much every level. The other is (again, fairly explicitly) Not The Party of Government, but falls way short of being anything like a Party of Smaller Government. Too many snouts (in both parties) in the public trough.
Thanks for interacting, folks.
The winner of this presidential contest will declare a mandate. We expect this and are accustomed to it but it strikes me as a lie to claim that winning over slightly more than 50% of those who vote eradicates the concerns and ideas of the rest. Figure, north of 50 million voters will cast a ballot for the losing presidential contest. Those citizens aren't nothing.
This is why I share the view that politics can't be about federal government elected or appointed positions only. They should primarily be about state and local positions and I absolutely agree that we've separated into parties with a tendancy towards federalism and national centralization of authority. The responsibility for this seems to me to be fairly bipartisan though.
I think of most national GOP leaders as being every bit as establishmentarian as their Democrat counterparts. Are there really such differences between Rubio and McConnell and Feinstein and Pelosi? I'm not sure there are.
Perhaps we'd be a lot better off if we actually DID have a party opposed to centralizing all graft and corruption... er... I mean "authority" in D.C.
Tuccille is showing some naivete here.
If you had a party that was advocating with lowering the stakes of government by making government itself less important, Hordes of rabid democrats would come out in the street in black block, smash your F-ing face in with a bike lock and spit in your face that they have a right to healthcare, tuition forgiveness, cells phones, housing, food, and a host of other safety nets on your dime, and if you complained about it - then they would point a finger at you and yell that you didn't care about people with pre-existing conditions, followed by a black block team of a dozen people bum rushing you and literally kicking the feces from your rag doll body in the street. So don't feed me a bunch of horseshit about partisanship.
Amen to that.
A couple months ago, someone wandered into a comment section and started talking about "getting the money out of politics". So I replied that the reason there's money in politics is that there's power in politics, and money always follows power. I went on to say that the only way we'll ever get money out of politics is to get the power out and move it down to state and local levels where it belongs, since it's easier to escape tyrannical state laws than federal.
How about we try to get rid of power and tyranny ANYWHERE?!? As anybody who has ever been part of an HOA has discovered, petty tyranny is still tyranny.

The article's premise quite naturally assumes that election winners will punish election losers.
The remarkable novelty at present is the party in power DURING the 2016 presidential campaign (Democrat), LOST the 2016 presidential campaign, yet was able to continue its harrassment of Trump and those associated with his 2016 campaign, throughout Trump's entire first term as POTUS.
Democrats refused to accept the results of the 2016 presidential election, interfered with the peaceful transition of power in 2016, and appear hell-bent to repeat their tantrum (plus riots and violence this time) if they lose again in 2020.
And I trust that the Republicans will peacefully give up their power if Biden wins?
"...America's two political death cults..."
I love it.
Me too.
Bring back the Articles of Confederation.
The "just lie back and enjoy the inevitable" argument.
Well, it's an argument you have to consider. Do you make yourself miserable worrying about things you can't change, or do you get on with your life as well as you can? I've been making myself miserable for a while now. The other option seems pretty appealing. If we could just machine gun all of the political activists of whatever stripe, it would be so much simpler and normal people could just live their lives.
Exactly right. Every election is "the most important election of our lifetimes" and every crisis is supposed proof of imminent catastrophe and I don't think people can live well that way. As importantly, I don't think most of us can spare the passion, the attention; it is all so much distraction. To my mind, if we spent half as much time on our faith, family, health, and businesses as we throw at things we have nearly zero influence over, we'd be infinitely happier and more prosperous.
As the Victorians said, just close you eyes and think of England?!
I think it was more Edwardian.
I have to wonder if some of the problem is the development of a "anti" culture, where people are less concerned about what their own candidates platform and more frighten of the other candidate. The suggestion that Joe Biden will usher in socialism or that Donald Trump will declare himself President for life. We need to spend more time looking for a candidate we are for, than in looking for things in the candidate we are against. I have my preferences in this election but I will accept the outcome whatever it is.
It'll be a good day when the majority of people are anti both parties.
This. It would solve a lot.
No it wouldn't, because the parties are just vehicles for what occupies them - people.
"I have my preferences in this election but I will accept the outcome whatever it is."
Whoa! Now THAT is radical indeed! I hate to think of what happens if your infectious attitudes spread to far and wide!
(Better add "/Sarc" to that these days, sad to say!)
I like the comment. It made me laugh... I mean, not out loud or rolling on the floor, more in a "50 year old man chuckling while taking a break from drafting" kind of way.
Thank You Kind Sir!
But the fact remains that a major U.S. retailer fears its customers might riot and try to kill one another if they're disappointed with the outcome of the vote"
No they are worried that "peaceful protester" will loot the place and shoot anyone who votes different form them
Yes, and the "peaceful protester" who shoots is likely to be the guy who bought the AK-47 to "protect his home" but instead brings it to the polls.
Is it? We focus on shootings for good reason but they make up a fraction of the violence and anti-social conduct of the meanness we have experienced of late. We've got whole districts in Philadelphia destroyed in the name of social justice and many of the store owners and patrons are black and/or working class. The media focuses on big name stores like Footlocker but these are the ones which can most afford to take the hit; it is the boutique shops in West Philadelphia and above Kensington that no one cares about and should. What merit is there in destroying the livelihood of a small businessperson? What justice? Portland riots made inaccessible substantial portions of downtown for more than three months. Sure, courthouses and such were in the sector and the focus of the riots but there were also businesses made non-functioning by the conduct, setting aside the damage done to litigants and administration by cutting court houses off from their work. No, I don't think we can give lawlessness a pass because a misguided kid brought a rifle to a protest and opened fire. That conduct stands on its own and will be adjudicated but the other? The other matters and WON'T be adjudicated, giving license to continued and further reprehensible conduct.
Burned buildings is not violence. Overturned trash cans is not violence. Dead bodies with bullets in them is violence.
Meaning no disrespect, that is nonsense. Yes, killing someone and shooting someone is violent. So is throwing things at people and hitting them but the suggestion that burning buildings and robbing people of their livelihoods isn't violent is absurd and counter to established law. I don't know what your experience in life is but I think that most of us who either own small businesses or work with folks who do think that destroying someone's home or business constitutes a violent act.
#AllBricksMatter
why doesn't Tuccille just say if democrats lose they should accept it and not riot, the right has shown no inclination to do so.
They will not lose their jobs or their businesses. They will not be put in jail, dogged with investigations, prosecuted under vague laws, regulated out of business. Their assets will not be confiscated."
the left has been saying they will do exactly that and have been pursuing such actions for teh last four years so yes the worry is real.
Yeah, Trump yells, "Lock her up" and WINS and he is the one who gets incessantly investigated and impeached. What happened to Hitlery Cliton? Nada. Judicial Watch cannot even get the opportunity to depose her for her criminality.
The present reality dispels any notion of impending peril for the losing candidate in America. On the contrary, it's a particular tribe of supporting sore losers that are clear and present danger and not any danger to the candidates themselves.
That said, Joe Biden and family would/should be sweating bullets given their criminal and corrupt actions. I would argue that the biases within the judicial bureaucracies, including regulatory agencies, are the real danger as they selectively prosecute and regulate, based on their unethical biases.
If true justice prevailed, a dozen state governors would be facing federal civil rights charges right now for the COVID-19 lockdowns of healthy people
Or maybe Hillary and Joe haven’t committed any crimes and you need to stop consuming news from rightwing propagandists.
No, Hillary certainly has. She kept a secret server to shield her from FOIA requests and kept classified information on the server. Both are crimes. Biden right now is just smoke. We have his son engaging in questionable business practices and that is about all.
Emkay, Biden on tape demanding that a Ukranian prosecutor be fired or he was going to withhold a billion in aid is just smoke. The same prosecutor that was attempting to prosecute Burisma of which his son was being compensated for what exactly.
If that's smoke then it's billowing from a wildfire.
Shokin was not attempting to prosecute Burisma. His firing was supported by virtually every Western country along with Ukrainian anti-corruption activists and every Republican senator who commented on the matter.
What troubles me most about the Wikileaks and now the Biden information is that I suspect they are just the smallest snippets of evidence of systemic corruption.
That so many become wealthy while theoretically serving our interests is disturbing. I'm sure some of it is illegal but the more alarming piece is that so much of it isn't. Vice President Biden, for example, is being paid more than $500,000 to be a University of Pennsylvania "professor," one who has no teaching, research, or publishing roles.
It may be perfectly legal but it is pretty awful to consider that our elected representatives can go from rags to riches, regardless of party, through legal graft and corruption.
Well the president made his offspring some of the most powerful people in the world, and by all evidence they are barely qualified to wipe their own asses.
If we can agree that corruption and graft are wrong and bad for the country, regardless of who is engaged in it or what party they are from, we're on the same page.
so both sides bad, as usual, even if only one side is on standby to burn everything to the ground if Trump is reelected.
the scattered violence between Blue and Red activists is worrying, but affects very few people. A Blue victory with trillions more in debt piled on top of 27 trillion already there, combined with the threat of a circus packed Court threatens everyone.
Which red violent activists would that be?
What is this both sides shit, Tuccille?
Newsflash...
Who is rioting in the streets? It is not Trump supporters.
Who is beating up people for the crime of wearing a red hat? It is not Trump supporters.
Who is calling for the defunding of police? It is not Trump supporters?
Who is threatening the judiciary? It is not Trump supporters.
Tuccille...get your head out of your ass.
But what if I really WANT to punish those dirty other people because THEY deserve it?
The substance herein is reasoned, but the timing of it a bit late. Obama and/or his apparatchik ( aka, the swamp) tried to depose a democratically elected president; we know now they employed the state to achieve their goal, for nearly three years.
And just as bad was their McCarthyism redux, indulged and condoned by the complicit media, that portrayed as a Russian proxy anyone who dared to question the coup.
You can bemoan big government-and you should-until the cows come home. Ditto authority abused. But the real threat is when the latter employs the former to deny the consent of the governed.
Rebellion, then, becomes a duty.
Trump withheld foreign aid as leverage to get campaign dirt on his opponent. That was the crime he was impeached for, but he deserves to be impeached for countless others. Do you not have eyes and ears dude?
Says the man with no functioning sense of irony. Somehow you forgot the Clintons’ $200 million ‘foundation’, and babbling Uncle Joe’s cut off the top of any graft his kids got.
Two wrongs don't make a right. Tony is, in this case, correct. Donald Trump is a criminal who should have been removed from office and in any sane timeline would never have achieved it in the first place. That he is more or less of a criminal than his political opponents isn't important. Breaking the law isn't acceptable if someone else breaks it worse.
Funny story, the Clinton foundation is legit despite countless Republican witch hunts into the matter, and the Trump foundation got shut down due to corruption.
Trump had a duty and there was an agreement he was honoring by pursuing corruption. The fact that it was Biden is irrelevant. Biden does not get protection because he comes out of retirement to re-insert himself in the political process and to likely protect himself from prosecution.
Trumped was impeached because the crazies control the House. Do you not have a brain, dude?
Whining, desperate, bigoted clingers are among my favorite culture war casualties.
Have fun tomorrow, guys!
No, the fun starts Wednesday when the likes of Springsteen board their private jets to leave the US in waves. The one's that don't off themselves, that is.
I hope the Korean store owners have plenty of ammo.
Children take their games very seriously.
"If the right to vote were expanded to seven year olds ... its policies would most definitely reflect the ‘legitimate concerns’ of children to have ‘adequate’ and ‘equal’ access to ‘free’ french fries, lemonade and videos." ~ Hans-Hermann Hoppe
“Grown men do not need leaders.” – Edward Abbey
The Night Before Voting
'Twas the night before voting when all through the land,
Collectivists were clamoring to take command.
Their platforms were posted on Facebook with care,
In hopes that Control! soon would be theirs.
Bernistas were nestled all snug in their beds,
While dreams of “free” college danced in their heads.
And the socialists of the left, and the protectionists of the right,
Had a common enemy: free trade, to fight.
When down in the market there arose such a clatter,
They suspended debating to see what was the matter!
Away to their telescreens they flew like a flash.
Horror of horrors! Prols with cash!!
The storefront displays and the new fallen snow
Revealed Prols toting packages! How could it be so?
When what to their statist eyes should appear,
But imports from China and lands far and near!
Happy people exchanging with opportunism,
They hissed at each other: “capitalism!”
More rapid than rats, the bureaucrats they came.
They pointed and shouted, “Your greed is to blame!”
Now taxes! Now tariffs! Now more legislation!
It must be the state that directs all creation!
Medicare without limits, and we must build a wall.
Now tax away, tax away, tax away all!
As party loyalists do when dear leader extols,
Collectivists dutifully went to the polls.
Then to campaign rallies, the followers they flew.
For the promise of benefits and Saint Sanders, too!
The scene at the rallies was like deja vu.
Blind loyalty to party, flawed candidates, too.
As I choked back my lunch and was looking to hide,
To their respective podiums, the candidates did stride.
Adoring acolytes cheered wildly and they soaked it all in,
Each one convinced they’d make America great again.
They gave well-rehearsed speeches designed to divide
Along race, creed, and income, and national pride.
Their vision, it twinkled! A future so sweet!
But their vision’s foundation was The Fatal Conceit!
Their faces were frozen in a permanent smile.
And no one noticed that their words dripped with bile.
Were they confident? Oh yeah! Each one full of themselves.
And I laughed when I saw them in spite of myself.
But the leer in their eyes and the ideas in their heads,
Soon made me realize I had plenty to dread!
They finished their words as confetti came down,
And shook all the hands while bodyguards frowned.
Our eyes met just briefly, but that was enough.
My face said quite clearly, "I’m calling your bluff!"
You’re no saint to the poor, no egalitarian.
Your method is force, tending totalitarian!

Your ideas produce rationing, misery, starvation!
But I heard them exclaim as they drove out of sight,
Collectivism hasn’t failed—it’s just never been done right!
~ Erik P. Brown
