Utah Legislator: If You Don't Want to Be Attacked by Police Dogs, 'Stay Home'
The state legislature is considering reforms in response to the use of dogs against cooperative suspects.

After body camera footage showed that a Salt Lake City police officer had sicced a dog on a cooperative suspect, an internal audit revealed what Mayor Erin Mendenhall described as "a pattern of abuse": In two-thirds of the 27 cases where a police dog had bitten someone since 2018, the use of force was questionable enough to consider criminal charges against the officers. The scandal prompted state legislators to propose a bill that would codify the appropriate use of police dogs. But state Sen. Don Ipson (R–St. George) has a simpler solution: If people don't want to be attacked by police dogs, he said last week, they should "stay home."
Ipson made it clear that he was not keen on the proposed legislation. "I don't have a lot of sympathy," he told fellow members of the Utah Senate's Judiciary, Law Enforcement, and Criminal Justice Committee. "We don't want to harm the public. But if they don't want to get bit, stay home."
There are a few problems with Ipson's stance. First of all, Jeffery Ryans, the 36-year-old man who was bitten in the incident that prompted Salt Lake City to review the use of police dogs, was smoking a cigarette in his own backyard when he was accosted by cops on April 24. They were there because someone had called 911 after hearing Ryans arguing with his wife, who had obtained a protective order against him. According to Ryans, he had moved back in with his wife weeks earlier at her invitation. She told him she had asked that the protective order be lifted, but he did not realize it was still in force because her request was pending.
Whatever the circumstances of the encounter, body camera footage obtained by The Salt Lake Tribune clearly showed that Ryans was cooperating with police when Officer Nickolas Pearce told his dog to attack. "Get on the ground!" Pearce shouted. "Get on the ground, or you're going to get bit!" Ryans crouched, then kneeled on the ground with his hands in the air. Pearce nevertheless set the dog on Ryans, who said, "I'm on the ground! I'm on the ground! Why are you biting me? I'm on the ground! Stop! Ow! What the fuck?" But as far as Pearce was concerned, the dog was doing exactly what he was supposed to do. "Good boy," Pearce said.
Last month Salt Lake County District Attorney Sim Gill charged Pearce with second-degree aggravated assault, a felony punishable by up to 15 years in prison. Ryans "wasn't resisting arrest," Gill said. "He certainly wasn't posing an imminent threat of violence or harm to anyone, and he certainly wasn't concealed. He was fenced in an area and was being compliant."
Even if Ryans was not on his own property when he was attacked, of course, Pearce's use of force would have been excessive. "It is absolutely appalling that Sen. Ipson would make such a terrible statement in support of police violence," Lauren Simpson, policy director at the Alliance for a Better Utah, said in response to the legislator's comments. "Suggesting that people should just 'stay home' if they don't want to experience police brutality is truly one of the more obscene things to be uttered recently by a sitting lawmaker in Utah."
Contacted by the Tribune, Ipson revised his position. "Ipson apologized for misspeaking by saying Utahns should stay home if they want to avoid being bitten by police dogs," the paper reports, "but he stood behind his underlying argument—which is that committing crimes puts people at risk of encounters with law enforcement." And then, apparently, all bets are off.
"I'm 73 years old," Ipson said. "I've never been threatened by a K-9 dog. If you don't want to have a confrontation with a police officer or a K-9 dog…you don't break the law."
Ryans, who plans to sue the Salt Lake City Police Department, has a somewhat different perspective. The injuries that Pearce's dog inflicted on his lower left leg, which caused infections as well as nerve and tendon damage, required multiple surgeries and lost him his job as a train engineer. "I felt like a chew toy," he told the Tribune. "I didn't know why this was happening to me. That's what was going through my mind: Why?"
Ryans, who is black, thinks his race helps explain the police response. "People need to know black lives matter," he said. "Everybody matters, but you can't just treat people differently because of their religion or their skin color. I developed myself to get to where I'm at right now. I should have the same respect as others. We don't get it."
The attack on Ryans is reminiscent of a case that the U.S. Court of Appeals for the 6th Circuit heard in 2018. Alexander Baxter, a burglary suspect arrested in 2014, alleged that Nashville cops sicced a police dog on him while he was sitting on the ground with his hands in the air. Even if that was true, the 6th Circuit ruled, the officers "did not violate clearly established law" and were therefore entitled to qualified immunity. In other words, the court said Baxter was not allowed to sue police under 42 USC 1983 for the same alleged behavior—siccing a dog on a nonresisting suspect—that Utah prosecutors thought was clearly felonious.
In June, the U.S. Supreme Court declined to review Baxter's case. Justice Clarence Thomas dissented. "I have previously expressed my doubts about our qualified immunity jurisprudence," he wrote. "Because our §1983 qualified immunity doctrine appears to stray from the statutory text, I would grant this petition."

The Fanchers by this point knew something was up, and they rallied the wagons in circle, enclosing the women and children, while defending with limited guns and ammo.
The mormons made a big mistake though when they were discovered to be dressed like Indians during the siege. Not knowing what to do now that the entire Fancher party was aware that Mormons were attacking them, not just Indians, the mormons tricked them in to giving up their guns in a fake truce. After the guns were surrendered, each Mormon unloaded on one of the Fanchers.
But they didn’t stop there, in the end, over 120 women and children were savagely massacred - bludgeoned, brain bashed, scalped, shot and ddecaptitated. Two 15 year old girls begged for their lives, and they were gang raped before being scalped - by Mormons.
The bodies were left in the sun to rot, the Mormons did leave all children under 7 alive, and took them back to town. The children would later wonder why their new guardians were wearing their parents jewelry or clothes. Sick, sick fucks.
The troops arrived and saw the dead people, now stripped and looted. They gave them a proper burial and erected a rock cairn memorial.
Brigham Young denied and covered up the incident for twenty years. Finally he gave one man up as a scapegoat to the feds. Eventually Brigham made it down to the battleground and desecrated the rock cairn, stating “veangence is mine, and I have had a little.”

By the time you are thinking about shooting a police dog because it's attacking you, things have already turned out badly.
The reason why people don't shoot these dogs is twofold.
First, they're seldom facing the dog while armed. If they even had a gun to begin with, the cops disarm them BEFORE sending in the dog.
Second, if they do harm the dog, the cop will shoot them for it. You have to be alive to get any benefit from suing. Even if they survive being shot by the cops, many states have laws that make attacking a service dog of any kind - which includes police dogs - for any reason a crime. In some states, it's even a felony equally as severe as inflicting the same level of harm on a human officer. Civil courts generally won't let you sue a cop for something if there is a pending criminal charge against you related to that incident.
Cops send in dogs to find suspects, so you dont know what your talking about.

Your wrong on Floyd - other coroners have come to different conclusions and there is apparently enough evidence (probable cause) to keep Murder 2 charges going. BTW, the first coroner noted there was fentanyl in the system but came to no conclusion. Other reports have suggested it may or MAY NOT have had an effect - everyone is different.

I've had the fun of being a victim of a crime and then getting threatened with arrest because I insisted the cop actually look at the videos of the crime taking place and speak to the witnesses who saw it. Turns out the guy the that assaulted me, my daughter and a women who worked next door my business was an employee of the ex-cop's business across the street.

Assuming for a moment that he did something to get the protective order issued, it doesn't follow that the police had to sic the dog on him.
I believe the story goes on to say the police officer was ultimately charged with aggravated assault.

When we lose sight of the market data on things like this, as libertarian capitalists, we're taking our eye off the ball. In fact, St. George, Utah is one of the fastest growing areas in the country--and a lot of that has to do with the combination of economic freedom and law and order policing.

This guy is saying that they don't need to change the law because the family people living in St. George like the way things are just fine. Anyone who literally believes that the local politicians there want people to stay home if they don't want to be bit is missing the point. I know local politicians in places like Minneapolis and New York have made all kinds of ridiculous statements to virtue signal--like talk of defunding the police. This is basically the same thing from the other side, but one of the big differences is that people are fleeing Minneapolis and New York because the crime is so bad, and they're driving up housing prices in places like St. George because of the law and order.

Not saying that I actually agree with the sentiment, but a dog trained to attack people *can* "go off" by itself, unlike pepper spray or a nightstick. The two categories are not equivalent.
That's why you keep them on a chain or behind a well locked fence behind your business or in your backyard. Keep the gate locked.
If you steered your car into oncoming traffic, you could potentially hurt other people. The way to avoid that isn't to confiscate everybody's cars. It's to avoid steering your car into oncoming traffic.
We are dog people. So we are looking at moving and high priority is a dog ready yard with a fence or do we need to install one. Because they need that in addition to walking on a leash.
They are great dogs and never hurt anyone. So one of them is very bonded with my wife. I know from his behavior that if anyone was aggressive to her they would have 80 pounds of very pissed off lab to deal with. That is good. It is not why we have the dog.
The smaller one is a great watch dog. If anything is around he warns and goes right for it. There was a recent encounter with a skunk which did not go well.

Most cops in Utah are Mormon, so this doesn't surprise me. I'm sure Ipson is Mormon. The people on here that say Mormons are usually libertarian are delusional. Mormons say they're libertarian, but they're not. They support the war on drugs(and will outlaw alcohol if given the chance). They're pro death penalty. They love big government as long as it's far right authoritarian. It's impossible to reason with them. They refuse to even consider they aren't 100% right about everything.

This has a smell about it if the account is true. I am not saying that is or not but there is a smell. Now this is what the politicians were elected for. When an officer misbehaves it is the responsibility of the politicians to see that justice is done. In this case this officer appears to be involved in about two thirds of the attacks by police dog over the last 18 months. The question is why did it take the POLITICIANS so long to do something about this officer.

If a suspect is not resisting no matter what the crime that person does not deserve to be attacked by a police dog nor shot. What the suspect deserves is his/her time in the criminal court. If found guilty then time in prison as defined by the law with modifications according to the situation.
If the politicians would take care of the police officers who are not performing their duties as prescribed by the rules and regulations and by the training that they have been trained. It is the politicians who sets the rules and regulations the police are to conduct themselves. So if the politicians fail their responsibility then soon the officers will fail theirs. So to correct this type of misconduct by officers is to replace the politicians who have oversight of the police and any other politicians that pass regulations or agree to with the police unions to put any regulation in the rule books that allow this kind of activity.
Now if this is a true case of improper police conduct the city should be liable for compensation to the victim and depending how egregious the actions is also the officer would have liability in addition to the city/state. The city/state's liability would be handed out as a punishment to the city/state to insure that it did its job to prevent such activity by the officers.
Cops are too militarized and that needs to change.
