Justice Department Reportedly Asks Congress for Indefinite Detention Powers To Fight Coronavirus
Congress should loudly and unanimously reject this insanity.

The Justice Department is using the COVID-19 outbreak to press for sweeping new powers that include being able to detain Americans indefinitely without a trial, Politico reports.
The department is asking Congress to allow the U.S. attorney general to ask courts to suspend court proceedings. These include "any statutes or rules of procedure otherwise affecting pre-arrest, post-arrest, pre-trial, trial, and post-trial procedures in criminal and juvenile proceedings and all civil process and proceedings," reports Betsy Woodruff Swan, citing DOJ documents presented to Congress.
In other words, the Justice Department would be able to postpone trials, hearings, and other procedural steps that follow arrest. That represents a potentially huge violation of the constitutional right to a speedy trial.
Those powers would apply "whenever the district court is fully or partially closed by virtue of any natural disaster, civil disobedience, or other emergency situation," Woodruff Swan writes, and would remain in place for "one year following the end of the national emergency."

Perhaps the Justice Department is attempting to find out whether there are any libertarians in a pandemic. The right to see a judge and seek release from detention after an arrest—known in legal lingo as habeas corpus—is one of the fundamental building blocks of a democratic society, one in which the state cannot deprive individuals of their freedom without due process. The times in American history when that right has been suspended or circumvented are some of the darkest. We should not be seeking to repeat them.
"The DOJ proposal is deeply troubling and would raise a whole host of constitutional concerns," says Scott Bullock, president and general counsel for the Institute for Justice, a libertarian law firm. "History demonstrates again and again that governments use a crisis to expand power and violate vital constitutional principles. And when the supposed emergency is over, the expanded powers often become permanent."
Clark Neily, vice president for criminal justice at the Cato Institute, says the Justice Department should not be trusted with more expansive powers.
"If history is any indication, it's a near certainty that these powers will be abused and that DOJ will try to hide those abuses when they occur," says Neily. "This is simply not an agency that has earned the kind of trust implied by these requests for increased authority and discretion."
It's also unclear how allowing indefinite detention would help fight the coronavirus outbreak. It seems more likely that the DOJ is learning from members of Congress and the president that the crisis provides a convenient excuse to ask for things it already wanted in the first place.

This is horrible if true, but Politico who's the source of this story has lied and twisted shit in recent years so badly that they are now pretty much Pravda.
Boehm doesn't provide any links to or quotes from the DOJ documents themselves, so I clicked the link to the Politico story, and they didn't have anything either.
There are a few quotes scattered about that say absolutely nothing but are there to pad the authors assumptions; “whenever the district court is fully or partially closed by virtue of any natural disaster, civil disobedience, or other emergency situation.” then “any statutes or rules of procedure otherwise affecting pre-arrest, post-arrest, pre-trial, trial, and post-trial procedures in criminal and juvenile proceedings and all civil process and proceedings” and finally “in a consistent manner.”

And I'm sorry, but after Politico has spent the last four years publishing pure horseshit and lie after lie, I'm not going to trust them without available documentation first.

One reason might be because most likely it was transmitted from bat to human in China, possibly due to relatively primitive or even unhygienic practices in China.
A second, more actionable reason is because the information needed to slow and limit its spread and build remedies was suppressed, including by harming medical people, by the local and national government people and system of China.
Trump inexplicably touts his great relationship with the leader and the government, so he limits his credibility at speaking directly against the government and the system that's the problem. Making up this label and making it stick, the way he does as marketing against opponents, gives him an end-around to still forcefully focus attention on this highly-consequential problem.
CDC has for decades had someone embedded in the Chinese CDC - training with them, creating relationships, going out with them to the scene of new outbreaks, etc. Similar to the military-military exchanges we have with countries. That job was eliminated last Jul - by the US not China - as part of our pissing trade war with China. That job was never replaced. Which means all those contacts with field people in Chinese CDC also vanished. It is usually those field people from CDC, WHO, RKI, ECDC, etc who provide a channel for people to whistleblow.

The power of indefinite detention is likely reserved for individuals who test positive. A few weeks ago an infected person defied quarantine orders and went outside and apparently went missing. Cops are already making arrests on people who defy quarantines.
Courts are closing down in some states already. The police declared their intention to scale back on making arrests. If that's legal, then that means due process isn't "essential" in a pandemic. Everything can be pushed back and delayed.
The libertarian solution is the least restrictive means to address a pandemic. Most of us in 40-45 states should be working and travelling while observing precautions, while the elderly sick should be quarantined. An immediate lockdown on travel at the initial wave is not libertarian but a right thing to do. Foreigners do not have a constitutional right to arrive on our territory.
Reason sort of timidly asks "Does the state government have the right to shut down their economy" but during the impeachment they characterized some of Trump's actions as "not a question of if he could, but if he should". So far only two writers came out in force against the current containment strategy.
Where is the sense of urgency that we saw during impeachment and Obamacare saga? Is morale down here because the corona virus put a serious cramp on open borders society?
