Michael Cohen Slated to Link Donald Trump to Wikileaks Today: Reason Roundup

Plus: Using "fake news" to justify censorship, and Elizabeth Warren's childcare plan

Roger Stone told candidate Trump that WikiLeaks would drop damaging Clinton emails. According to the president's former lawyer and personal henchman Michael Cohen—who is slated to testify before Congress later today—Donald Trump knew in advance that WikiLeaks founder Julian Assange planned to expose emails that could be bad for Hillary Clinton.

"I was in Mr. Trump's office when his secretary announced that Roger Stone was on the phone," says draft testimony from Cohen that was obtained by NBC. It continues:

Mr. Trump put Mr. Stone on the speakerphone. Mr. Stone told Mr. Trump that he had just gotten off the phone with Julian Assange and that Mr. Assange told Mr. Stone that, within a couple of days, there would be a massive dump of emails that would damage Hillary Clinton's campaign. Mr. Trump responded by stating to the effect of 'wouldn't that be great.'

Roger Stone was indicted last month on allegations of witness tampering, obstruction, and making false statements to federal officials. Cohen pleaded guilty last year to making a false statement to Congress (along with bank fraud, tax evasion, and campaign finance violations) and was sentenced in December to three years in prison.

Now, Cohen allegedly plans to tell Congress that not only did Trump know about Stone's dealings with Wikileaks, he also "knew of and directed the Trump Moscow negotiations throughout the campaign and lied about it. He lied about it because he never expected to win the election. He also lied about it because he stood to make hundreds of millions of dollars on the Moscow real estate project."

The project was a skyscraper hotel in Moscow which Cohen was helping negotiate. Last November, Buzzfeed reported that one of Cohen's duties had been to offer Russian President Vladimir Putin the $50 million penthouse of the building.

On Tuesday, Republican Rep. Matt Gaetz (Fla.) tweeted at Cohen:

Do your wife & father-in-law know about your girlfriends? Maybe tonight would be a good time for that chat. I wonder if she'll remain faithful when you're in prison. She's about to learn a lot.

Hours later, Gaetz apologized and said "it was NOT my intent to threaten, as some believe I did. I'm deleting the tweet & I should have chosen words that better showed my intent."

Let me put it this way: if one of my clients made a statement to a witness like @mattgaetz did, I'd be telling them to board their dogs so they don't get shot when the arrest team shows up.

"Beware the rise of censorship under the guise of stopping fake news," warns Mike Masnick at Techdirt. In the U.K., Damian Collins, a member of Parliament, is "using moral panic and fear mongering over 'fake news' to try to censor content he doesn't like," Masnick explains.

Recently, Collins' committee—the Digital, Culture, Media and Sport Committee—published its big report on fake news, in which it calls for new regulatory powers to "oversee" what content goes on sites like Facebook. With the report, Collins put out quite the bombastic comment about all of this. Here's just a snippet:

"We need a radical shift in the balance of power between the platforms and the people. The age of inadequate self regulation must come to an end. The rights of the citizen need to be established in statute, by requiring the tech companies to adhere to a code of conduct written into law by Parliament, and overseen by an independent regulator."

There are all sorts of sketchy and dangerous ideas in this report, but I want to focus on the one that is most scary. A plan to regulate the amorphous concept of "harmful content."

Against nationalizing childcare. Reihan Salam offers a good critique of Sen. Elizabeth Warren's national child-care proposal. The "program is nothing if not shrewd," he writes. But:

The dream of a comprehensive federal program that would liberate working parents from having to scrap for a seat in a safe, clean child-care facility that will provide for their little ones for a full day, and all for a price so low as to be negligible, has obvious appeal across the Democratic Party's class divide. But it's also an object lesson in the unseriousness of how we think about social policy. Instead of just helping working families, her proposal risks increasing the federal deficit, driving up the cost of child care, and squeezing stay-at-home parents. And that last risk is one Warren should understand particularly well because she made her reputation as a public intellectual by warning against it.

That's hardly a sound foundation on which to devise a strategic vision for the region," writes Damon Linker at The Week. "Yet…the outcome of the president's overtures to Pyongyang could well prove beneficial to the United States."

        Well, being a good Democrat used to be about relaxing the drug war, being anti-free trade, particularly in opposing NAFTA and GATT. Being a good Democrat was about being pro-first responder unions, working in trade policy to protect the interests of UAW workers, steel workers, other unions, and other blue collar workers.

        But the Democrats don't give a shit about that stuff anymore. Now, it's SJW issues all the way down. And, no, Trump isn't an SJW, so he's the enemy--just like average Americans are the enemy. Some of them are more Christian, more racist, more rapey, and more homophobic than others, but just about all of them are the enemy of the Democratic party somehow.

        And Trump is their leader!

        When you go to the bar at the marina on the isthmus on Catalina Island, the local specialty drink is called a "buffalo milk". It's kind of like a white Russian with rum and . . . some other stuff. They play a lot of Jimmy Buffet and surfer music from the '60s. Hundreds of launches tied to the pier so that you have to walk through everybody's to get to shore. Best crowd I've been around in so long. It's like the fun Southern California crowd people used to picture back when people in Southern California were still fun.

    You know, when the ACA was under consideration years ago, and the social media derp was at its peak regarding health care, I used this as an example to ridicule the true believers copy/pasting the same twits/posts. They would paste in something like "I believe that health care is a fundamental right. That no one should go bankrupt because they can't pay their medical bills..." and I would say "Yes! But why stop there? I believe that CHILD CARE is a fundamental right! If the government is going to care for my heath, they should totally raise my children also!"

    Now, don't I feel like an ass.

      They're already feeding kids in the schools whose parents are too lazy to make them breakfast or lunch. This was just the next step; in countries like Sweden, children are effectively considered the property of the state.

          Apparently, not a crime. Or a partisan application of the law since Hillary's camp also received Russian help.

          Wikileaks did what wikileaks does. That's nothing new.

          Hillary's Russian information was according to Steele himself for the purpose of contesting the election. Interestingly that information was used in a secret court in an attempt to remove the President from office. Has any other candidate ever done anything like that?

          Hillary's actions are far more a threat to the concept of a free society than cheering Wikileaks for doing what Wikileaks does.

              Its funny. For a long time I made fun of White, who is a Reason Foundation board member, for seemingly begining every sentece with "I am a 1st Amendment Lawyer". It got under his skin so much he once came into the comment boards and fired back. Now, I never see him drop the "I am a first amendment lawyer" line at all.

              I got into a huge back and forth with him on email about the Flynn plea agreement. I think that it is potentially an involuntary plea because the government withheld exculpatory information from him before his plea. It is not clear to me at all that Flynn or his laywers knew that the agents who took his statement didn't think he lied. And that fact that the judge keeps putting off his sentencing makes me think there is something going on and its a bad plea.

              White, just dissmissed me as a crank. And when pushed on it basically reverted to credential dropping "I went to Harvard and worked as a US attorney how dare you question me" and staight up appeals to authority that DOJ is above reproach. It was some of the worst pro government shilling I have ever fucking seen. And to think that jerk calls himself a Libertarian.

                      I believe it was subsequent to that when Flynn plead guilty. Far as I'm concerned, the Mueller probe lost the benefit of the doubt after that one. And not only because of they were willing to force guilty pleas by going after family.

                      When all the Mueller probe can get is someone to become a witness for the prosecution by getting the witness to plead guilty to lying, then the reasonable assumption is that the prosecutor is scraping the bottom of the barrel to justify the continuation of his mandate. When a prosecutor gets his star witness to testify for the prosecution in exchange for the witness pleading guilty to lying, he's undermining his own case.

                      If the only witnesses Mueller has are witnesses who've plead guilty to lying, then he has no credible witnesses. If this were a standard criminal defense case, that would be a defense attorney's dream come true. You might even get the charges dismissed before it ever went to trial.

                As you laid out in your comments about the Flynn plea, how can a contract (plea) be valid if there was fraud (DOJ withholding exculpatory evidence)? Why would a Libertarian be against making sure a plea was not induced via fraud?

                I just laugh at anyone who considers the FBI, DOJ, and other government agencies above reproach. There is ample evidence that many agencies/bureaucrats are intentionally violating the Constitution (NSA domestic spying without warrants).

    Holding a hearing designed to set up the impeachment of the president while the president is meeting with a foreign adversary and negotiating to get our adversary to give up his nuclear weapons and ICBM ambitions is kind of . . . what's the right word, "treasonous"?

    They should have delayed the hearing until the end of Trump's summit with Kim. Even if you want Trump to be impeached, all Americans should hope the president is wildly successful in his negotiations to rid North Korea of nuclear weapons, and if any Nancy Pelosi's "henchmen" can testify that she knew this hearing would undermine Trump's effectiveness in his summit with Kim, then . . .

        It has lots of incentive to give up its nuclear program. Giving up its nuclear program would enablt it to come back into the community of nations and function to some degree as a regular nation and no longer rely on criminal enterprise to survive. That would make things much better for the regime.

        The problem is that giving up nukes could cause them to be percieved as weak and cause the regime to collapse entirely. So, the trick is to convince them that giving up nukes will not lead to their doom.

          For the rest of you, I also think it's important to remember that the nuclear disarmament in North Korea may be closely tied to Trump's trade dispute with China.

          North Korea's incentive to denuclearize is also associated with China's incentive for North Korea to denuclearize. Assuming that China isn't throwing this in as a factor in Trump's trade negotiations with China is probably unreasonable.

          Trump's decision to suspend tariffs on China's exports to the U.S., which were set to increase on March 1st, coincided with the announcement that there would be another summit between Trump and Kim.

          If those talks don't go well, watch to see if the stock market reacts with the assumption that it means those March 1st tariffs are back on again.
