America is awash in poultry-focused lawsuits.


Q: Why did the chicken cross the road?
A: To sue the other side.
Each week, typically I address some serious federal, state, or local food-law issue. After this week, though, I could use some levity. Maybe you could, too.
There's no better time than now, then, to point out that America's been beset by a recent slew of lawsuits. Over chicken.
Let's dig in.
Last month, a federal judge in Los Angeles allowed a California synagogue to slaughter chickens as part of its observance of Yom Kippur, Judaism's most important holiday. The lawsuit had been filed by a Maryland animal-rights group that opposes the Yom Kippur slaughter.
"We believe the rabbis' true motivation is tremendous profit," said attorney Bryan Pease, attorney for the animal rights group, United Poultry Concerns, in comments to the Los Angeles Times that may as well have been ripped from the noxious anti-Semitic screed Protocols of the Elders of Zion.
Across the country, in Mississippi, an attorney recently filed—then dropped—a lawsuit against fried-chicken chain Popeye's. Paul Newton Jr. had claimed he choked on a piece of the fast-food restaurant's chicken because the restaurant failed to provide him with a plastic knife.
"Newton says the only utensil he was given last November at the Gulfport restaurant was a spork," the AP reports. "The lawsuit says because Newton didn't receive a plastic knife, his only option was to hold the piece of chicken with his hands and tear off pieces with his teeth, causing him to choke."
In New York State, another lawsuit targeted fried-chicken chain KFC.
Plaintiff Anna Wurtzburger alleges that KFC engaged in deceptive trade practices because the food they advertised on television differed from what she received at her local KFC.
"[T]he advertisement on television showed a bucket of overflowing chicken and when the plaintiff received a bucket of chicken there were only eight pieces of chicken in it," the complaint alleges.
Wurtzburger—who sued KFC for $20 million, a figure she later halved—had ordered the 8-piece bucket.
Finally, in what may be the most important recent poultry-related court challenge, a lawsuit filed earlier this year in federal court by Maplevale Farms, an independent New York State foodservice distributor, charges that the nation's largest poultry producers—including defendants Purdue, Tyson, Koch, Pilgrim's Pride, and several others—are colluding illegally to restrict "broiler" supply in an effort to set poultry prices artificially high.
The lawsuit hinges in part on something known as the "Georgia Dock," which the New York Times describes as "a chicken pricing index that is obscure outside the food industry but widely used by grocery stores in America when buying chicken from producers."
Besides its obscurity, the Georgia Dock is a quaint and outdated method for negotiating poultry sales that was established by the Georgia Department of Agriculture in 1966. The Times describes how it relies on a series of phone calls placed weekly by one Arty Schronce, a GDA employee.
In a report on the case and the Georgia Dock, The Progressive Farmer, an agricultural news source, refers to at least one part of the Times's analysis as "very strange."
Sure, but then aren't all of these poultry lawsuits at least a bit strange?
It may seem that poultry lawsuits have come to roost, but the fact is they've always been around. A Lexis-Nexis search this week revealed 981 state and federal cases historically in the United States pertaining in some way to poultry or chicken. And most American constitutional law students learn about the famous 1935 "sick-chicken" case, Schechter Poultry Corp. v. United States, a Supreme Court ruling that struck down a key element of Pres. Franklin Roosevelt's New Deal legislation.
Thanks to factors like increased regulation and eager plaintiffs' lawyers, I suspect poultry lawsuits are only likely to continue to grow in the coming years. It's only a matter of time before someone—a farmer in Iowa, say—sues to overturn Massachusetts's unconstitutional and wrongheaded new law creating rules for confining chickens and other farm animals, which voters approved by a more than 3:1 margin this week.

If you're too incompetent to eat without somone cutting up your food for you, perhaps you should be allowed to be removed from the gene pool via natural selection. The plaintiffs almost certainly did time the TRO to be as obnoxious as possible.
The defendants cry "religion" as their excuse for not responding to the TRO, claim to do so would not only violate their religion, but show that they violated their religion, thus undercutting their need to ritually slaughter chickens as observant Jews.

U.S. EPA employees were in tears. Worried Energy Department staffers were offered counseling. Some federal employees were so depressed, they took time off. Others might retire early.
And some employees are in downright panic mode in the aftermath of Donald Trump's victory.
"People are upset. Some people took the day off because they were depressed," said John O'Grady, president of American Federation of Government Employees Council 238, a union that represents thousands of EPA employees. After Election Day, "people were crying," added O'Grady, who works in EPA's Region 5 office in Chicago. "They were recommending that people take sick leave and go home."

The EPA was created so that Congress wouldn't have to do their job and get rid of lead in gasoline. It was the beginning of Congress's rush to irrelevance that was finalized with the AUMF.
There is a role for environmental legislation, particularly concerning heavy metals and other persistent pollutants, however the EPA has grown far beyond its original mandate. That is solely the fault of Congress.
This is what all bureaucracies do. They get a budget and their sole purpose of existence is to then protect their little fiefdom, get a bigger budget, and expand their empire. They've all went rogue and get very little congressional oversight.
The problem best suited to being resolved through bureaucracy is that of having too little bureaucracy.

It has had an actual inverse effect in that it actually keeps Quebec as a laggard when measured against other jurisdictions in North America. I have to say this. I know Trump is in no way a libertarian and that he's probably going to appoint horrible people to important jobs. But still, we just dodged a HUGE fucking bullet by denying Hillary the presidency. The damage that witch could do to liberty is nearly unfathomable. I can't think of a single other person in American politics who could even come close to the damage she could inflict.
Trump is saying he supports and will ask the Congress to enact national conceal and carry. If that happens, that would be HUGE. It won't mean anything to the Reason staff since in their defenses of Weld they made it clear gun rights really don't matter much to them. It will however be a huge win for liberty.
The thing I'm most hopeful for with Trump is foreign policy. And SCOTUS picks, that alone could save the 2nd. But there are far too many regulations on guns as it is. They all need repealed. Shall not be infringed, period. Now the left are getting ideas about restricting people's gun rights for mental health reasons, IOW if you smoke cannabis, no more guns for you. I don't smoke weed, but people who do should not be denied their rights, it's a slippery fucking slope and we all know where that goes.
I can't believe Trump is going to walk into office and pick a fight with the Republican Senate by choosing some liberal for the Court. That never made any sense. He is going to pick an UBER conservative if for no other reason than to stick it to those in the GOP that refused to vote for him. Think how stupid and discredited people like Romney and the Bushes and the rest of them will look the moment he replaces Scalia with someone who will keep the five vote majority for Heller and Citizens' United. I was entertaining theories about how I might be wrong.
I was saying, even on election day, that it all depended on Pennsylvania, and that he would almost certainly lose Pennsylvania.
I did not expect him to win Wisconsin or Michigan.
I'd like to wait and see how that's done. Setting bad precedent for 10th Amendment interpretation could work against gun rights in the long run. But I think there is already some precedent about states being constitutionally required to recognize each other's marriage licenses and drivers licenses et cetera.
I don't see how Congress forcing states to fully recognize a federal right and also fully recognize the privileges and immunities of other states, sets a bad precedent.

My sarcastic point was that it's this kind of attitude of religious freedom that probably cost Johnson and Weld votes.
Of course, they went a bit further than your average H&R commenter, in actually saying religious freedom should be abridged, but there is obviously a tolerance in the LP for religious persecution that there isn't for, say dope prohibition.
If Johnson wasn't a dope smoker and wanted to lock up those who were, the LP would never have nominated him in a million years, because they actually think the right to smoke dope is important.
Obviously, they think the 1st Amendment freedom of religion is one of those negotiable issues which only purists would waste energy on.

In this case, the anti-slaughter idiots were abusing the justice system, no doubt, but the defendants were playing victim just as much -- ohh waa hoo, they are taking advantage of our religious rituals to abuse us, waaaa! when they themselves would be quite happy to ignore their rituals under other circumstances (fire, earthquake, burglary), and then blame the judge for not knowing the arcane details of their rituals.
In my world, self-ownership would rule the roost, so to speak, and there would be no justice system to abuse as in this case. They'd have to file a private complaint and loser pays would hold them accountable for abusing the system. But no one lives in my system, we all live in the current system, and two sides abusing the system only shows how corrupted the system is.

I denounce the religious hypocrites for abusing the religious rights laws by claiming that their ancient superstitions are so pure and holy that they must be excused from ALL secular laws, when they damned sure obviously would violate their own holy customs for their own reasons (crime, natural disaster).

Both laws limit the choices of the employer.
But in the case of this lawsuit, only one side is trying to restrict the choices of the other. The Orthodox Jews aren't seeking an injunction prohibiting the animal rights weirdos from doing whatever voluntary crap they do.
