Drug Warriors Will Pay $3.6 Million for Maiming a Toddler
The parents of a boy who was nearly killed by a flashbang grenade settle the last of their legal claims.
The parents of a toddler who was maimed by a botched Georgia drug raid in May 2014 have reached settlements with the last two plaintiffs facing claims as a result of the shocking home invasion. On Friday a federal judge approved payments totaling $1.65 million by Rabun and Stephens counties, which participated in the anti-drug task force responsible for the late-night, no-knock raid that nearly killed 19-month-old Bounkham "Bou Bou" Phonesavanh when a flashbang grenade exploded in the portable playpen where he was sleeping. The boy's parents, Bounkham and Alecia Phonesavanh, had earlier reached settlements totaling almost $2 million with Habersham County and the city of Cornelia, which also particpated in the operation.
"The legal part is over, but the medical and emotional consequences will be with [the Phonesavanhs] the rest of their lives," the family's lawyer, Mawuli Davis, told The Atlanta Journal-Constitution. Bou Bou, who was severely burned and mutilated by the explosive device, has had to undergo a series of reparative operations that will continue into adulthood. "He's got a painful road ahead," Davis said. "The whole family, they still struggle with the trauma of what they went through, and every medical procedure is a reminder."
The raid, which was aimed at Bou Bou's cousin, a suspected methamphetamine dealer, discovered no drugs, no weapons, no drug money, and no suspects. The cousin was arrested later that day without incident at a different location. In October 2014 a Habersham County grand jury blamed the horrifying incident on a "sloppy" and "hurried" investigation but declined to approve charges against Charles Long, the deputy who threw the grenade that nearly killed Bou Bou, or any of the other officers involved. Last December a federal jury acquitted Nikki Autry, the only officer to be prosecuted as a result of the incident, of civil rights charges based on crucial misrepresentations in her application for the warrant authorizing the raid.

$3.6 million sounds like a lot, but it still won't teach them damn taxpayers a lesson. I've heard plenty of them bitching about how this family isn't taking responsibility for their part in this incident - they did actually have a family member who was selling drugs, after all - but I haven't heard any of them bitching about their own part in allowing the cops to get away with this crap. You could have made it $36 million and these taxpayers would have bitched all the more about the family, not the cops or their own culpability in defending the cops.
BTW, that headline isn't entirely incorrect - the taxpayers are footing the bill, not the cops - but I'd throw the lawn order shitheads supporting the cops right in with the "drug warriors". But "the taxpayers" includes all the ones who aren't drug warriors so it's not entirely accurate either.

Even many of your typical 'law & order' types are often sensible enough to understand that misconduct is best reduced via professional disincentives rather than huge legal $ payouts by the county. Voters should learn to hold district attorneys (and by extension the police forces) accountable. #BLM style protesting only goes so far.

Here we have a family pretending to harbor a petty drug lord, cravenly hiding behind their own infant inside their crack den, forcing out of police an expensive and harrowing raid to bring criminals to justice, and now those law enforcement professionals are the ones who have to hand over money? The loss of hose funds will no doubt hamper future efforts at keeping at bay drug criminals like these who have certainly hit the jackpot today.

There were criminal charges, against the officer who lied to the judge to get the warrant. The officer was acquitted of course.
Of course, you might as well ask the DA to prosecute one of his brothers.
In the current scheme of our courts in this nation, no one who would convict a cop is getting any way near a jury. Just by that simple fact, you can always know the outcome.

They have it all wrong. The teenager was holding a "boomstick," and "boomsticks" are pretty damn dangerous, so it made sense that the officer shot quickly.

Police do what politicians and their laws order them to do. Politicians write the laws they think will get their hands into the public till. Changing what works for politicians is a better approach than blaming the hired help. Incentives matter.

It is getting to the point where part of me would cheer if some vigilante started taking out these animals with badges. The other part of me dreads the possibility of that happening because the reaction by the government would make "Boston Strong" look like freedom.
