Police Officer Patrick Feaster Shoots Man Crawling From Wreckage of His Truck, Doesn't Tell Anyone Until Circumstances Force Him To; Of Course, Not Criminally Responsible [UPDATED]
Apparent logic is because he was so insanely negligent, he wasn't criminally responsible.

Officer Patrick Feaster in Paradise, California came upon the scene of a drunk driving wreck on Thanksgiving night. As the driver Andrew Thomas dragged his body out of the window, vertically, Feaster, very calmly from what the video shows, shot him, possibly twice though the official report says no to that, then calmly holstered his weapon.

Thomas was not killed, but "the shot hit Thomas in the C7 and T1 vertebrae and could lead to him being paralyzed for life," reports Action News Now. Video of the shooting can be found at that link as well.
Feaster then refers to his dispatch to a "man in the car who refuses to get out." Why might Thomas not be getting out? Well, Feaster had just shot him, though he does not mention that to dispatch.
According to this report from local Action News Now:
When backup arrived on the scene, Feaster did not mention anything about having fired his weapon. According to [Butte County D.A. Mike] Ramsey, Feaster notified his commanding officer about the discharge only after Thomas' gunshot wound was found.
As the commanding officer suggested an investigator return to Canteena and try to find out if Thomas had been shot at the bar, Feaster revealed that he may have shot Thomas.
Ramsey said nearly 11 minutes passed before any other officers, medics or firefighters learned Thomas had been shot.
Sounds like D.A. Ramsey knows a lot of startlingly damning things about Officer Feaster's behavior. Sounds like a case for book-throwing.
Except, as Ramsey explained in a letter contained within the Action News link above, Feaster's shooting seemed to him maybe not intentional and thus not criminally negligent. (It seemed pretty intentional to me, but those judging police see with eyes suffused with a soft gelscreen of bitter, bitter mercy.) Because he didn't shoot him twice, according to Ramsey, that proves merely that Feaster is the kind of officer who pulls out his weapon, finger on the trigger, aims it at someone who represents no conceivable threat to himself or anyone else, and shoots him without meaning to, and that apparently is just fine and deserves no criminal punishment.
Why didn't he tell anyone he'd shot him? He was in shock and not even actually sure he'd shot him!
So, reckless to the point of possible actual insanity. That's fine in a cop. Certainly not worthy of charges.

Paradise Police Chief Gabriela Tazzari-Dineen said Patrick Feaster remains on paid administrative leave pending an internal investigation.
UPDATE: Old news clip from 2012 shows that Feaster saw drunk drivers as a special crusade of sorts. From the News Review out of Chico, it reveals Feaster to have a personal longstanding interest in drunk drivers and enforcing the law on them, having lost his uncle, who he is named after, to one 10 years before he was born:
Recently, Feaster was recognized by Mothers Against Drunk Driving (MADD), having been the top DUI-arresting officer in the Paradise Police Department in 2011, citing 33 drunk drivers. Six months into this year, he's already more than halfway toward his goal of 50 DUI arrests. "I am always looking for DUI drivers," said Feaster. "I watch every car in front of me for signs of drifting."
When confronting a drunken driver, Feaster says he remains calm because it's unfair to classify all intoxicated drivers the same way. Many are unaware that they're over the 0.08 percent blood-alcohol limit. In fact, those types of stops are actually the most common and the excuses generally are sincere, he said.
"They usually say things like, 'I didn't think I was that bad,' 'I only had a few,' or 'I only live a few blocks from here,'" he said….
Feaster has less patience for drunken drivers on the other side of the spectrum. "These are people who are so impaired they shouldn't be walking down the street, let alone driving the car," he said…..
Most stupefying are the repeat offenders, whom Feaster called "the worst."
"People will still drive under the influence of street drugs and prescription medication, which is just as dangerous," said Feaster…
Besides, there's a depressing reality.
"There is no way of stopping them all."

This is too insane. But...this is who is going to be attracted to being a police officer. Because they can do this with impunity. And if there are enough of these complete psychos to be being caught on video...how many are there that aren't being caught on video and we never even hear about it?
He didn't flinch or do a double take after firing like he was disoriented, as supposedly seen by the investigators. There appeared to be two muzzle flashes, so he fired twice and only hit the guy once. (Batting .500 is pretty good for a cop.) He was rather blas? about the whole affair.
It's likely he was angry at what he suspected was a DUI, and being overweight knew he couldn't run for very long, so he fired. Local prosecutors either know him personally or simply didn't want to have to deal all that goes along with charging law enforcement with the crime they clearly committed.
All that time and money only to find him innocent. Skip to the end.
If you read the link, his wife was thrown from the vehicle and her dead body was laying next to the car. Doesn't justify what the cop did, but provides some explanatory context.

The cop saw the car speed past him, run a red light, hit a median, and once he got to the wreck there was a dead woman laying next to the car. He knew Thomas was the driver because he was coming out of the driver door.
I can see the cop thinking "this fucker just killed that woman" (which was essentially correct) and shooting him.
Disclaimer: That is not a justifiable shooting by any stretch of the imagination; the cop should be prosecuted for murder, and the DA is clearly lying through his teeth in his statement. BUT it's not beyond explanation.

I saw a video once a couple of years ago that I cannot find now.
Guy has a blowout and wrecks his car, which catches fire. He is burned badly enough that all of this clothing is gone and he is scorched head to toe. When the cops arrive he is sitting on the side of the road bloody, rocking back and forth and in shock.
Cops order him to stand, which of course he doesn't do, so they taze him. He is disoriented and in shock so he begins chasing the cops around. They avoid him easily. He eventually climbs on top of their patrol car. One of the cops shoots the guy dead.
No charges, of course.
His explanation? "I couldn't let him get any of that blood on me." He looks dead into the camera with flat eyes, no emotion on his face or i n his voice when he says it.
That guy and this one are on par with the Saudi that said he didn't rape that 17 yo girl, he just happened to have his hard dick out, slipped and fell on her and so accidentally penetrated her. (story linked to earlier today)

When I saw the video I was pretty sure he double tapped the guy in a very calm, deliberate manner, exactly as he would have done on the range demonstrating his proficiency with the technique. He didn't break stride, kept his eye on the target, drew, fired twice rapidly and then holstered his weapon. He wasn't agitated or excited during or after the shooting.
There was no distress or sense of urgency in his voice when he called in.
Two things crossed my mind.
1. He had just seen a drunk wreck a car and as a result a woman was thrown from the car, possibly killed (she was) or severely injured. Since he had already observed the vehicle leaving the bar at a high rate of speed with no lights on perhaps there was some other crime going on in his mind. He sees the guy climbing out of the vehicle right in front of him with no one else around, becomes very single minded, thinks "Fuck you, you piece of shit" and just shoots the guy.
2. Some other experience from his past and the current circumstances caused him to switch into 'if it moves, shoot it' mode.
What it most certainly was not was an accident. This guy is a menace and under either circumstance I mentioned this would be straight-up second degree murder.

I am using such harsh language because Thomas is not some hair-brained dingbat but other wise normal 18 year old using stunningly bad judgement while under the influence. He is 26.
If we're going to blame responsible people harshly, does his wife share any responsibility for getting in the car with him, knowing he had been drinking, and (presumably, as she was thrown from the vehicle) not wearing her seatbelt? For legal purposes, it only matters if she lives in a contributory negligence state...

He shoots better on accident than most cops shoot on purpose. It's amazing how these cops manage to accidentally draw a gun, point it at someone and pull the trigger. This case shows once again that ALL police shootings or other violent actions should be handled by an independent prosecutor, not the guy the pig goes fishing with.

Darien was clearly dead. There was gas leaking out of the engine compartment. Fire station was two blocks away, but took about 10 mins to arrive. Ambulance took about 20-35 mins to arrive, but were not in hurry to give emergency care to Thomas, and were in slow motion leaving.
There is relevant information in the unedited video which I think you will find both surprising and revealing. If you are wondering if the shooting was accidental, just watch and (listen to) the full unedited dash cam video, pay attention to the timing and focus of fire department and ambulance, and listen to EVERYTHING that is said, then make up your own mind. To those who have already watched the full unedited video, and who may know the history with Thomas, I don't have anything against you, however, the government was intentionally separated into three branches to protect citizens' rights and to prevent abuse of power. Police may enforce existing laws, but they do not have the right to make their own defacto laws by conducting executions based on possible (thought) crimes, withholding evidence from the public, then excusing the officer who conducted the execution, while broadcasting, "Sorry, it was just an accident."
Also note that Glock SAPs are double-action, so every shot is intentional.
