Zero Tolerance Insanity: Gifted & Talented Kid Suspended for a Year for Maple Leaf

The leaf you see to the right is not a marijuana leaf. It's from a Japanese maple leaf and despite its possessing no psychoactive qualities, its possession was enough to get an 11-year-old boy suspended FOR A YEAR from a Virginia public school.
Writes Dan Casey in the Roanoke (Va.) Times:
An assistant principal finds a leaf and a lighter in the boy's knapsack. The student is suspended for a year. A sheriff's deputy files marijuana possession charges in juvenile court.
All of the above and more happened last September to the 11-year-old son of Bedford County residents Bruce and Linda Bays. He was a sixth-grader in the gifted-and-talented program at Bedford Middle School.
There was only one problem: Months after the fact, the couple learned the substance wasn't marijuana. A prosecutor dropped the juvenile court charge because the leaf had field-tested negative three times….
Their son remains out of school — he's due to return Monday on strict probation. But in the meantime, the events of the past six months have wreaked havoc on the formerly happy-go-lucky boy's psyche. His parents say he's withdrawn socially, and is now under the care of a pediatric psychiatrist for panic attacks and depression.
The couple — both are schoolteachers — have filed a federal lawsuit against Bedford County Schools and the Bedford County Sheriff's Office.
Welcome to the beyond-Kafkaesque world of zero-tolerance policies, in which gifted-and-talented kids get bounced for a year for no good goddamn reason. This is why school choice is winning, folks, and why it will continue to do so despite all the might forces arrayed against it. We're getting too old for this shit, as parents, as taxpayers, as a country, for god's sake.
All's well that ends well, right? Well, no.
The Bays are out money for lawyers and doctors, and they're out the time they've taken to homeschool their child. Meanwhile, his psyche is very fragile now compared to its state before Wilson found the leaf in his knapsack.
Linda Bays said that based on scuttlebutt she's heard since his suspension, she believes one or two students who dislike her son put the leaf in his knapsack, probably on the bus, and then informed school officials about it.
That's left a situation in which, Bruce Bays said, "any kid can tell on another kid and set that kid up. And a principal or assistant principal could potentially push a kid out of school."
Linda Bays added: "Why would you want an 11-year-old gifted-and-talented student out of school for 364 days?" That's a good question. It seems out of proportion to the offense.

In many ways, this situation sums up virtually all that is wrong in twilight America: an educational system that is more devoted to stupidity than teaching; brutal and unresponsive and mostrously idiotic authority; a fear of pot that outmatches the fear of witches in colonial Massachusetts; and an expensive and bureaucratic court system and school boards fully capable of exploiting it against the very parents and taxpayers who support it.

Oh, and that actually is a cannabis leaf if I'm not mistaken. There are Japanese Maple trees all over this neighborhood and that looks more like cannabis than any maple leaf I've ever seen.

I would say 99% positive it is. I've never seen any other leaf look that much like it if it's not, and I've been an avid gardener for decades. And I've seen plenty of cannabis leaves. (note, at no time were any of those ever in my possession).
There are variations among the leaves of different types of Japanese Maple. Some look more "ganja-y" than others.

It varies between 5 and 9 depending on cultivar I think.
More like 1-11 in my experience, depending more on maturity, peaking usually at 7-9 in mid-life (3-4 months).
Often at maturity you will see single bladed leaves protruding from the buds.

So, is a year suspension normal now if you get caught with drugs in school? Seems like it was 2 weeks at most when I was a lad, for a first offense (plus whatever the cops did to you, which never seemed to amount to much).

When you know you're in the wrong, rather than become a target yourself, you 'reduce the charges' to something like disturbing the peace *cough*2007 Boston Bomb scare*cough* while scolding them as to how things are different now and they should be more careful.
I can't quite put my finger on it, but I think it's sort of similar, or in a similar vein as insulting a woman, or giving her a backhanded compliment in an attempt to bed her.

Most of the teachers I had that were worth a damn came to teaching after doing something real for a while.
Putting aside insulting the the education establishment itself, that's long been an adage, and my father first introduced it to me decades ago in relation to professional sports. And the adage really had nothing to do with insulting teachers.
As a very young boy, I was curious why people who taught or coached sports weren't the best players.
My father introduced me to the concept where there were people who were very good at intellectualizing a process, such as swinging a tennis racket or dunking a basketball, but didn't have the physical talents to actually swing the racket or dunk the basketball, at least not well enough to beat Michael Jordan or Jimmy Connors in a game of one-on-one.

I would agree with that. Outside of community college, I don't know many who have.
They did, but it's rare that a coach was a TOP player. Larry Bird is a good example of someone who was a top player, and could also intellectualize the process to be an effective coach.
Magic Johnson was someone who was a top player, but couldn't coach his way out of a damp paper bag.
Phil Jackson wasn't a great player.

All I can say is that sometime you need someone who isn't yourself, but is still knowledgeable about what you do to point out what you are doing wrong. I would guess coaches of pro athletes are also really good at motivating.
Yes, but almost anyone who's willing to put in the work can be a good athlete at the youth/ high school level. Competing at the large college or pro level in a major sport takes work+ talent.
Yeah, there's a different skill set needed to lead and develop people as opposed to actually doing that thing. Whether sports and coaching or a team of programmers and their leader, there's a human dimension to developing a strong team that is not required to be a team member.
Having said that, there's no obvious reason why any given individual cannot be very good at being both a team member and the leader, but it appears that to be really good at the human piece takes considerable effort. & To be one of the best players also takes considerable effort. So much effort in both cases, that it's extremely rare that an individual has both skill sets or enough time to devote to both disciplines to an extent where they can excel in each.
And note, it's not just possible, but likely some gravitate and focus of the leadership pieces for survival in that they recognize they will never be a prime player, but this shouldn't discount the fact that there are very skill sets to successfully develop and lead a strong team are both real and different from those required to be a player.
I always liked a simpler explanation- the "star" that hits .350 all through the minors doesn't see nearly as much coaching as the guy struggling to hit .240. It's the guys that have seen numerous coaches who learn to work with a variety of players.
I would like to point out that every single official in charge during this process is college educated.
Though, to be fair to college education, many are probably education majors.

Around here, e-cigs are treated as drug paraphernalia by public schools. Since it is possible to put pot extract in them, they are all treated as if they were used as such. Zero tolerance means zero judgement. Just mindlessly follow policy like a robot.

About 5 years ago I was driving east on route 40 into Baltimore, when you get close to the city there are several overpasses you have go under. Traffic suddenly slowed down and I couldn't see what happened at first. But a backhoe that was on a flatbed truck had fell off the truck and went over the the rails on the overpass and landed upside down on top of a van and a car. The entire front of the van was gone and the roof of the backhoe looked to be about a foot deep embedded into the pavement. The driver of the car was probably a lot luckier as just the the trunk section of it had been sheared off.

I have some friends and family going through the adoption process now and it is a big thing to say "placed" for adoption and not "put up" for adoption because in the past kids were literally put up on a stand for adoption and the stronger kids were adopted for farm work. Also don't say "gave up" for adoption because that's negative. I put up a small fight about how the world has gone crazy and then gave up since I was the only dude at the table.

The government schools are now government prisons. Drug laws create careers and promotions for; judges, cops, lawyers, and prison guards. It prevents competition to alcohol and big pharmacy.
