Woman Jailed for Saying 'Fuck the Police' Wins $100,000 Settlement


A Georgia woman jailed for criticizing police officers as she rode by on a bicycle has been awarded a $100,000 settlement in a civil suit against the local police department.
Cobb County resident Amy Barnes was bicycling to the store in April 2012 when she passed police officers questioning a suspect. She treated them to the middle finger and a cry of "Fuck the police!"
How you feel about the propriety of Barnes' actions will probably depend on how you feel about cops in general, but I hope most would agree that this wasn't criminal behavior. It did, however, hurt the fragile egos of Cobb County police officers. A dashcam video from the police car captures one cop's reaction: "That ain't happening."
So the officers arrested Barnes, charged her with disorderly conduct, and took her to the county jail, where she was held for nearly 24 hours. A judge eventually dismissed the charges, disagreeing with officers' claim that Barnes meant to incite violence. "The defendant's statements, although offensive to this court, clearly constitute political speech," wrote State Court Judge Melodie Clayton. "Her words were insulting, but as a matter of well-established constitutional law, they did not constitute 'fighting words.'"
Barnes filed a federal lawsuit in 2012, alleging that her First Amendment rights were violated. In the suit, Barnes claimed she was "unlawfully arrested for protesting via loud speech while riding a bicycle along a public street." Last week, the county approved a settlement with Barnes, who will now be receiving $100,000 from Cobb County.
Cynthia Counts, Barnes' attorney, told Fox Atlanta that this is a win for everyone's constitutional rights. "It's important to understand that people have a right to express their ideas," said Counts, "and no matter how offensive it's not a basis for penalizing someone."

It won't. It will just convince them a little more that it's them against us.
That's what it's coming down to. Things will continue on the current track until almost everyone in the country fears and hates the cops. And then the cops, never getting punished for anything, will just escalate their thuggish behavior.
You're wrong. There are plenty of people who will continue to side with the cops. Even when it's their rights being trampled, they will see the "greater good" done by the police and excuse it all away.
The fault therein lies with the lady that took the settlement. If her demand was $100K if the officers are NOT fired or $10 AND their firing, then you have an argument against the city council. Everybody looks for their payday you see.
Why would that be considered offensive? Uncouth, maybe.

Sounds like a judge didn't want to piss the cops off too much when ruling against them.
A braver judge would have written "Fuck the Police, this is protected speech" as the entirety of the ruling.
A really good judge would have made them write that on a giant blackboard in public, 10,000 times while having rotten fruit hurled at them from an angry mob.

If this prevents one cop from lowering his jack-boot on just one innocent person's neck, it'd be worth it. But it won't. So while I don't begrudge Amy her windfall, the only consequence is adding to the taxpayers debt burden.

Once, in Buffalo in the 80's, a friend and I left a bar just as a cop car was going by. He yelled out "Fucking pigs!" The car stopped, reversed, and the cop on the passenger side got out of the car and punched my friend in the face. I ran towards the cop and the other giant Polish cop picked me up and threw me down. Then they threw my friend in the back seat and drove off.
He got charged with everything - disorderly conduct, resisting arrest, assault.

Cobb County is well known in the area as Count On Being Busted. It is a very police intensive areas of the Metro Atlanta area. They will ticket you for pretty much anything. Got to pay for that new entertainment district for the (formerly) Atlanta Braves.
Definitely a win for the First Amendment right to protest the government.
Award was a bit steep but so it the fines for minor traffic offenses. Got to get their attention somehow.
Just wish it had been me that they had thrown in jail for this. Could have used the $100,000 tax free paycheck.
