Sheriff in Burned Baby Raid Wants Your Prayers; Target of Warrant Could Be Charged For Injuries to Toddler


CNN has updates on the story of the Georgia SWAT team that threw a flash bang while executing a no-knock warrant that severely burned Bounkham Phonesavanh, a nineteen-month-old baby. Habersham County Sheriff Joey Terrell says the deputies involved are "devastated" and that they've been called "baby killers" and received threats. "All I can say is pray for the baby, his family and for us," the sheriff told CNN.
Terrell has insisted his officers and those of the local police department did nothing wrong and blamed the target of the warrant (not found at the house that was invaded) on the attack on the toddler. A chief assistant district attorney for the county, J. Edward Staples, says the target of the warrant could in fact be charged for the injuries the sheriff's deputies caused the toddler. In an obvious attempt to immunize himself and his office from liability, the sheriff has claimed the situation was unavoidable even as he attempted to offer reassurances that his SWAT team would be more diligent in the future. He told CNN that his officers "obviously would have done things different" (IF they knew there was a child in the home), like go in through a side door or not use a flash bang. Until using violence to crack down on non-violent "crimes" becomes politically untenable for "public servants," it won't matter how much ass-covering law enforcement does after the fact, these kinds of incidents will continue to happen.
The toddler's family, who was staying with a relative at the home that was attacked after their own home in Wisconsin was burned down, say they don't have insurance and a family friend has set up a website for donations.
A circuit district attorney is conducting a "review" of the incident, which should be done next week according to the chief assistant district attorney. Terrell had previously said neither the district attorney's office nor the Georgia Bureau of Investigation was investigating the incident.

This trend towards charging the target of a police action for every horrible or destructive thing the police do during that action is fucking surreal and really, really dangerous. Not only does it remove even more accountability from the cops (which will just cause terrible behavior to escalate even more), it is utterly unjust. What next; you get pulled over for speeding and the cop gets hit by a drunk driver while leaning into your window and you both get charged? Because by speeding you "forced" the cop to put himself in a dangerous situation? It's basically a weird form of crime by association. The cops commit the crime, but since you were the suspect associated with it, you pay.
This shit has to be nipped in the bud. And if this guy gets away with this, it sets a terrible, terrible precedent. I know cops have tried this before but this is the kind of case that should make people go "what?!?" But I'm really worried it won't.

There is more to this story than we are getting. I am familiar with at least one case here locally where a very dangerous and violent drug dealer was allowed to roam free and conduct his business because he was informing on others. Finally he got so far off the leash that he was going to cause their little operation to be exposed. In the attempt to apprehend him a gunfight ensued and he was killed.
If they did not know for certain the guy was in the house, only suspected it, and did not know who else was in the house then they had no business tossing bombs.

This gives me an idea. Since this poor toddler will undoubtedly need a skin graft, I propose that the skin used in that skin graft be taken from Sheriff Terrell's face.

I was very careful not to call for biblical-type retribution, here, as tempting as and that was.
It's not clear to me at this point, not having done a full read/watch on this, how much responsibility is the sheriff's, and how much is the deputies - both the ones on the raid and anyone who processed paperwork.
And the baby would have to live with the awful, awful knowledge that the people who caused him unimaginable pain and irrevocably altered his life were part of him. Not sure that I could deal with that, not sure if anyone could.
Now, a court sentence mandating the deputies undergo skin harvesting for burn victims other than the baby, very, very tempting, but also bothered by anything resembling medieval torture, cruel and unusual punishment, etc. Also, what about the doctors, nurses and other participants in the harvesting? That makes monsters of them and perpetuates the cycle of violence and dehumanization.
Chemical sterilization and a lifetime at hard labor is a sentence I could go for. Every penny above what they need for food subsistence goes to the victims. They have to beg for clothes, toiletries, etc, or do without.

I dunno, I really took heart that the grand jury refused to indict Magee. And in Texas, of all places. A couple more of these might turn the tide, who knows?
Not just the jury, don't forget the judge's role in excluding evidence, defense strategies, etc. I know sometimes jury decisions can be infuriating, but don't forget the entire legal system gears up to protect its own.
What evidence could possibly be excluded such as to improve the prosecution's case? What, like the jury is told only that a bomb got thrown (passive voice) in cx with a crime (unexplained) that this guy committed, none of the circumstances explained, and they'd convict on that?

It bugs me when I hear Harry Reid complain about the name.
UNLV's mascot is a Confederate soldier. UNLV's student newspaper is called "The Rebel Yell". They're called The Rebels!
None of which did anything to dissuade Harry Reid from letting UNLV name "The Harry Reid Center" after...ahem...Harry Reid.

Southern Nevada (...and the rest of Arizona Territory and Southern Utah) all sided with the Confederacy--which is why so much stuff in these areas is still called Rebel this and Rebel that and Dixie this and Dixie that.
Present day southern Nevada was drawn out of Arizona and into Nevada when the North brought Nevada into the union--so Lincoln could keep his hands on the Comstock Lode and finance the War.

Terrell has insisted his officers and those of the local police department did nothing wrong and blamed the target of the warrant (not found at the house that was invaded) on the attack on the toddler.

What ever happened to doing actual police work and surveillance ? If that had been in place, they would have known there was a baby and they would have known the "target" was not in the home before they went out to play their war games.

So, I used to live in my great grandparents old farm house. The previous renters were ex cons and had been re arrested for having the materials for making meth (some sedated and a small tank of anhydrous ammonia as far as I remember).
Anyway they trashed the house, kicked antique doors off the hinges, typical police stuff.
Later I moved in, and sherif's deputies started coming by constantly with search warrants for people I have never even heard of (this is a town of 400 people). They were clearly looking for a reason to check on the house, and would always come around 9 or 10 at night. Several calls to the sherif's department did not stop them.
Anyway, I always had a concern that one day they would just decide to get a warrant and go commando on my ass. And when someone breaks into your house at night, there is not really a lot of time do decide if it's just someone on "official business". I kept a kalashnikov in the back of the house, and if a door was to get kicked in, things were going to get fucking ugly.
