IRS Rules That As Long As Gay Couples Are Legally Wed, State of Residence Doesn't Matter

So now that nitpicking about the difference between legalizing gay marriage (a phrasing that makes certain people grind their teeth) and recognition of gay marriage has a purpose. As a result of the Supreme Court striking down part of the Defense of Marriage Act, the feds have announced that a gay couple who was legally married can file as a couple with the IRS even if they live in a state that refuses to recognize it.

The U.S. Department of the Treasury announced Thursday that when it comes to taxes, it will recognize same-sex couples' marriages even if they live in a state that does not.

The decision, which was prompted by the U.S. Supreme Court's ruling to overturn the Defense of Marriage Act, marks the latest political progress for the lesbian, gay, bisexual and transgender community.

Prior to this spring, the IRS did not recognize same-sex married couples pursuant to section 3 of DOMA. Once DOMA was overturned in June, the question became: What about same-sex married couples who moved to a state that didn't recognize their marriage (a couple married in Massachusetts who moved to Arkansas, for example)?

The ruling is that the state where the officials signed off on the marriage is what counts, not where the couple lives. It makes sense, but certainly makes things complicated for some gay couples.

  1. Having never been married, and making little enough that a 1040 is always sufficient for my few deductions, does filing jointly make a tremendous difference for gay couples? And how does such a couple prove their marriage to the IRS without a state-issued certificate?

    1. The will have a state-issued certificate from the state where they were married.

    2. To my understanding, it doesn’t make much difference if there are no dependents. However, in the case of dependents and one spouse making very little, if they file separately, the spouse making very little can claim head of household and the dependents and get a shit-ton of deductions.

      1. The number of dependents doesn’t matter much. What matters is that the tax rate for a given joint household income is much lower for married versus single.

        So, if a gay couple is married, and one earns a butt ton of money and the other not very much, they can save a lot of money filing as married.

        If they both earn about the same amount, it is roughly a wash for married versus single.

                      Aside from the objectively obvious number of (present) military installations and the use of atomic weapons, all of that is quite debatable (tax rates and tax compliance are significantly higher in some parts of the world; the ‘war on drugs’ is fully international due to UN treaties; asset forfeiture in a good many nations is summary, and far more arbitrary than here; depending on what constitutes ‘firebombing’ there are regimes with more war casualties under their belt, etc).

                      And still irrelevant as a retort.

They may have taken into account the difference between a front-line combat operator and the mental ramifications of the job (especially in light of the fact that we’ve spent 40 years since Vietnam blaming PTSD for every hangnail a vet gets once he comes back home) vs. a desk jockey pulling in $300k a year who never seen a day of combat and spent his time variously proselytizing and threatening his colleagues whose religion differed from his own.

    1. Bingo. As far as the federal government is concerned, you shouldn’t have a marital status. I don’t think the state should be in the marriage industry at all, but to the extent it is, it certainly shouldn’t be at the federal level. However, as you said, correct decision with that in mind. If the fedgov is going to recognize a straight marriage license from a given state, it is obligated to recognize all marriage licenses from that state.
