New Jersey Cops Sued Over Alleged Assault, Death Threats

The original charges against the plaintiff were dropped

A Monmouth County man is claiming in a newly filed, approximately $11 million lawsuit that his constitutional rights were violated more than a dozen times during the course of one night in 2011 — when he says he was assaulted, threatened with death, refused access to an attorney and even denied the use of a bathroom by a pair of Bound Brook police officers.

Plaintiff Matthew T. Miller lived in North Plainfield at the time of the night in question and filed the lawsuit against the officers, the borough, a municipal court administrator and the woman who placed the 911 call that led to what his attorney described as a nightmare.

"They're appalling allegations," attorney Nicole Babnick said Monday. "In just one evening, police made numerous violations of (Miller's) civil rights … and nobody seemed to care."
