Star College Student Nadia Habib Is Safe From Deportation--For Now
The Associated Press reports that Nadia Habib, the Bangladeshi college student who moved to the U.S. when she was 20 months old and who was set to be deported Thursday, is staying in the U.S. for the foreseeable future:
The two women arrived at a federal courthouse in lower Manhattan for their deportation meeting prepared to say goodbye to their family and board a plane. But instead, they emerged from the courthouse smiling as about 100 supporters cheered and chanted "education not deportation!"
"We still have a lot of waiting and hoping to do," Nadia Habib told supporters. "I'm just nervous. Tomorrow's my birthday, so this is kind of a great birthday present."
Immigration officials fingerprinted them, confiscated the Habibs' passports and put them under an order of supervision, which requires them to meet periodically with an immigration officer while their case is being reviewed. They weren't told when a decision would be made, though immigration officers said it was a high-priority case, Charles said.
Sen. Kirsten Gillibrand, who has been working with immigration officials on behalf of the family, released a statement praising the decision not to deport them.
"I am thrilled that Nadia will be celebrating her 20th birthday tomorrow at home with her family and will be continuing her studies in the only country she's ever known," Gillibrand said.
Not having your life wrecked by bureaucracy is one hell of a birthday present.

It's interesting - a lot of times, the same people who complain about these "foreign" students taking away admission spots from "natives", will also, on other issues like taxes and pay inequality, talk about meritocracy and "earning your way". Guess what: Those foreign-born students have to meet the same academic standards as everyone else. If whitey didn't cut the mustard, it ain't Ackmed's fault.

Unfortunatelly, one thing does not follow the other. There's no justification to give something to someone because of a previous lack of knowledge.
The issue with immigration stems mostly from gross economic ignorance and politics. People have this strange idea that they're entitled to someone else's money (e.g. jobs) by virtue of where they were born. Politicians provide the fuel to keep this fire growing, just to score some points. Politics is about division.

If there were any chance that the bulk of the world's population would try to move to the US, your question might be worth considering. As it is, rates of immigration seem to be closely tied to supply and demand for labor. When there are far more workers than jobs, people will stop coming.

I agree with Abdul here. I'm for totally open borders but we don't have them. If we have a law that says children brought in illegally get deported, Nadia shouldn't really get an exception. That's not fair to all the immigrants that jump through the hoops. The right answer is to dump the stupid law, IMO, but until then it should be applied consistently.

That rule applies to adoptive parents as well, naturalized or native-born. But they still have to go through the whole green card process.
It also applies to citizens who have childred abroad who do not qualify to become citizens at birth (usuall when one parent only is a citizen and they have not met certain residence requirements).
Believe me immigration and citizenship law is hard. Attorneys who specialize in it do very very well.

Green card holders can also sponsor immediate family members (spouse, minor children, parents). The rules are just slightly different than they are for citizens.
There is a lot of information missing from the story. The lack of information leaves a lot of questions.
I can only assume that the husband got his green card some time after the wife arrived, and for whatever reason, maybe bad advice from an immigration lawyer, they decided to go the asylum route for her so as not to mess up his application.
Who knows. There's certainly hasn't been enough said about the history of the case to draw any firm conclusions from.

It wouldn't matter if the husband is a citizen ... the wife and daughter have been in the US illegally, and the government knows it. They will not - in fact CANNOT - give them a visa. Unless a judge orders it.
Hazel, if I had to guess the circumstances here, I would say that the mother came over with the baby while the husband's paperwork was still wending its way through the INS/ICE bureaucracy (who knows how long he was here on some other kind of visa before his green card came through?).
By the time they found out that her presence here had queered the deal (you normally have to apply for a spouse and/or child green card in your native country and stay there till it's issued, even if the sponsor is in the USA) it was too late for the reason you give.
Then, either a friend or an immigration lawyer told the to try the asylum route.

H1-B is basically indentured servitude anyway. You can't chance H1-B or green card sponsor mis-process, so you basically have to work for that employer for the duration of the 6-7 years it takes to get your green card.
