CQ Profiles Libertarian Legal Scholar and ObamaCare Foe Randy Barnett
CQ offers a nice profile of Georgetown law professor Randy Barnett, one of the leading figures in the libertarian legal movement and a key architect of the legal case against the Patient Protection and Affordable Care Act:
"If Congress can mandate this, then it can mandate anything," read a Heritage Foundation paper [Barnett] co-wrote, published in December 2009 during the House debate over the proposed law. By that reasoning, "Congress could require every American to buy a new Chevy Impala every year, or pay a 'tax' equivalent to its Blue Book value, because such purchases would stimulate commerce and help repay government loans."
Most constitutional scholars dismissed such arguments as far-fetched, but Barnett's reasoning was soon adopted by many Republican lawmakers and other critics of the law, leading The New York Times to describe him as the "intellectual godfather" of the argument that the health care law is unconstitutional. That moniker is a bit of a stretch. Other lawyers such as David Rivkin and Lee Casey had made similar arguments on the opinion pages of The Wall Street Journal and The Washington Post before Barnett did.
But Barnett undeniably deserves credit as an early advocate for the legal theories later incorporated into the many court challenges filed as soon as the law was enacted in March 2010.

Speaking of which, what happened to The Derider?? Maybe it's TimBits? I kind of liked The Derider?.
I tried to read the Fox thread. I'm pretty sure I now know the distinct sensation of being sprayed with goat diarrhea.
It's amazing that common sense can be considering "far fetched" and that the NYT was impressed enough by someone displaying common sense to call him the "godfather" of that position.
Actually, not everyone dismissed the argument as far-fetched. That fool Charles Freid contended that of course the government can order you to do anything. In fact, he said it's a no brainer.
maybe the govt can "order" you to do anything. but its your decision to decide to actually do it.
I mean, so what if they send men with guns after you if you refuse?
No matter who's arguing the case, remember David Rivkin was the one who originally said ObamaCare did not pass the smell test. He is the founding father of this case and America owes a debt of gratitude to Rivkin.
It amazes me that 3 years into the Obama administration and we are still talking about Health Insurance. The economy is still a mess too. When will the US regain its swagger?
I can't believe that Health Insurance is still an issue for politicians. I thought they would have solved that one by now. We need to move on to other important issues too.
