Another drug raid gone bad
Two years ago the Chesapeake, Virginia, police made some decisions that led to an officer's death, then tried to convict a scapegoat of capital murder. In April, following an outcry, the police department announced a change in how it will conduct drug raids. But it wasn't the change you might have expected.
In January 2008 Chesapeake cops raided the home of 28-year-old Ryan Frederick. Days earlier, an informant had broken into Frederick's house. He spotted several marijuana plants and stole some of them, giving police the probable cause they needed to obtain a search warrant. During the raid, police put a battering ram through part of Frederick's door. Frederick says he awoke, saw someone breaking into his home, remembered the burglary of several days earlier, panicked, and fired his gun through the broken door. His bullet struck and killed one of the police officers, Det. Jarrod Shivers.
Police and prosecutors claimed that the cops announced themselves and that Frederick killed Shivers intentionally. The state sought to convict him of capital murder. A year later, Frederick was convicted of manslaughter instead and sentenced to 10 years in prison.
The case spurred a flurry of discussion in the Chesapeake-Hampton Roads area about the use of informants and of SWAT-like forced-entry tactics to serve marijuana warrants. Readers' comments on a local newspaper's website, initially pro-police, soured against the department as details about the shoddy investigation came to light. The police, for example, had done almost no investigation to corroborate their informant's tip.
So what did the Chesapeake Police Department announce in April? It won't be reconsidering its policy of sending cops on volatile, forced-entry raids into the homes of low-level, nonviolent drug offenders. Nor will it change the way its narcotics officers deal with drug informants. Instead, the department announced, Chesapeake narcotics officers will be using a new and improved battering ram.

The law looks good, but I don't think anybody has ever gotten off from shooting a cop using the 9.31c defense. I could be wrong, but I think I would have heard about it.
Ruby Ridge?
To be clear, Ruby Ridge didn't use a Texas statute, but unless I am mistaken at least one of the civilians beat murder charges from shooting a US Marshal by claiming self defense.
Then they tried to bring up criminal charges against the officers involved (specifically, the one who shot an unarmed woman in the back of the head from a quarter of a mile away while the woman was holding a baby), but the government pulled its sovereign immunity trump card.
And by the time the state appealed the decision and won at the 9th Circuit, the former D.A. had been replaced, and the new D.A. decided not to continue against Horiuchi. Disgusting that he walked without even a negligent homicide sanction. One of the supposedly best high-power shooters in America misses a 200 yd shot so badly that it goes through a glass door panel and hits the principal fugitive's wife in the head. I remember reading a rumor that Ms. Weaver was, like many wives, the psychological leader of the family group, and wondered just how accidental that shot was, especially as the bullet struck her head before wounding his original target, Kevin Harris.

We will never get the problem solved by pretending cops with a warrant is the same as being burglars. Fredericks was growing pot, despite what he initally led people to believe. I'm pro-legalization, but until it's legalized, cops have the authority get warrants and raid your house.
It's not the lack of a better battery ram that was the problem with this case. The informant is the issue. He knew the cops were going to Frederick's and he broke into the garage which made Frederick fear a burglar.
A better battery ram would of made things better for the cops in that they probably would have shot and killed Frederick as he was running to the door with a firearm. That would have saved them the embarrassment.

When they kick in the door you often don't know. But Frederick has reason to believe it was the return of the burglar. Which led to him firing at a yet to be identified target on the other side of the door.

The informant had almost everything to do with it, execpt for cops behaving like cops. He reported Fredrick to the cops, he broke into garage and stole what would have been evidence. That break in put Fredrick on the alert. If it wasn't for that informant. The raid wouldn't have happened.
That does not excuse the use of dynamic entries to arrest non-violent offenders.

Amazing. So their probable cause is based on a buy who robbed the house a few days earlier? How does this not violate illegal search and seizure? If a cop can't do it, a private citizen can't break the law and then pass on sensitive information that was gained illegally to the authorities. So if I'm a cop trying to make a case all I have to do is pay some thug to do my dirty work for me? Secondly, how about knocking? Or better yet, just hang out in front of his house until he leaves to go to work or the store and have a conversation with him. Let's try to be fair guys. I think we should give the new battering ram a chance. It doesn't seem beyond the bounds of reason that most of these problems were the result of inferior battering rams.
It might be time to start thinking out of the box though. My proposition: Outlaw doors. Face it, if you're not doing anything wrong, you don't need a door to hide yourself. Doors are a small price to pay in light of our desperate fight against the nightmares of marijuana.

Actually, it seems like all thoughtful non-violent offenders should invest in good security doors with steel frames sround the door, with 8 locking bolts.
Of course, then the peace officers will respond with using C4 to knock the door and part of the wall in, but it's important for officer safety and preventing the non-violent offenders from flushing all the pot plants down the toilet.

He got 10-years for rightly defending himself against cops gone bad, and I'll do the same, completely undeterred. Thats right, I'll put a bullet through the face of every man woman or child that forces entry into my home and I dont care WHAT you yell before smashing the door down.
There are other ways to make an arrest. More legitimate, respectful (the the accused and to bystanders), safer ways. I'm not asking police to consider them, I'm just noting that busting down doors is deadly, and thats the way I like it. Thats freedom.
