Free Speech

Joel Pile Is a Petty Tyrant and an Overly Sensitive Ass

|

I feel comfortable writing that, because I don't plan to visit Valley Center, Kansas any time soon.

He was cuffed, fingerprinted, booked into the Sedgwick County Jail and released on bail. His crime: putting up a yard sign critical of the Valley Center city administrator.

Jarrod West is out on bail, facing criminal defamation charges for a sign he put in his front yard about persistent flooding issues he says cost him over $50,000 over the last three years. The sign says, "Dear Valley Center, I did not buy Lake Front Property! Fix this problem. This is what I pay taxes for. PS. Joel this means you!" Joel being City Administrator Joel Pile…

When City Administrator Joel Pile saw the sign, West was arrested and booked into the Sedgwick County Jail on a criminal charge of defamation. He spent the night behind bars and is now free on a $10,000 bond.

"I think it's an ego trip for somebody and I think somebody's abusing their ego and authority," said West.

"We've advised him of the process to come through the City Council," Pile told KSN.

Pile stands behind the criminal charge, saying West has acted with malice in criticizing him and he's been told any action to alleviate flooding has to come from the City Council.

"People and individuals have an absolute right to free speech," said Pile. "But however, when they do it and continue to do it within the realms of what we believe is actual malice for the purpose of holding me accountable to the public we believe that crosses a line."

Pile says the city will drop the charges against West if he stops blaming Pile for the flooding issues on his property.

How kind of Mr. Pile. Never criticize him, and you won't have to worry about him having you arrested.

  1. Sounds like Kansas is still the Old West.

  2. we believe that crosses a line.

So what? That doesn’t mean it isn’t protected speech you assclown.

What is it with these city council Admins these days? Are they all this retarded?

    1. If you were paid $800,000/year for doing Jack and shit (and Jack left town), you’d get retarded too. Super-retarded.

      1. Power retards, and absolute power retards absolutely.

        1. Buh-choo ain’t winnin’ no Oscars fo’ it.

  3. If it were defamatory–which I don’t think it is–the only remedy is to sue. Unilateral action without a court decision is, of course, completely and utterly unconstitutional and likely actionable since it was done under the color of law.

    1. Pro-Lib,

Some states still have criminal defamation statutes. Here’s a case from Puerto rico: Mangual v. Rotger-Sabat, 317 F.3d 45 (1st Cir. 2003). Most jurisdictions had them at one time, but they went the way of laws against black magic and wearing an onion on your belt.

      1. Of course, Puerto Rico isn’t a state. :-p

  4. I’m coming for you, Balko. I hope you have a great lawyer.

PS: I won’t pursue legal action if you stop calling me names.

    1. I was wondering how long before this info was posted here.

Time to write some fan mail.

    2. If that’s really him?

      What an asshole!

      1. It’s not him, but the contact info is legit.

        1. May he be stricken with his surname.

        2. Years ago, right here on Hit & Run, there was a story about this excessively litigious guy who was being a complete jackass…

I wrote a relevant comment with a story about a friend of mine when I was a kid… I started the story out by writing, “I knew this guy when I was in high school…”

But I didn’t mean I knew the guy in the story; I meant it like when you tell a joke that starts with, “This guy walks into a bar…”

Well the guy the Hit & Run post was about starts cc’ing me on emails threatening to sue everybody–Reason, me…

I sent the guy an email and said, listen, the story I wrote wasn’t about you–it was about “this guy” I knew when I was in high school…

          Sheesh!

It wouldn’t surprise me if Balko gets emails threatening to sue him weekly.

It’s sort of like my snarky comment below–I thought that seemed funny because it was so ridiculous, but then if you come across people out there who really think like that, it isn’t necessarily funny in the same way anymore.

          1. It wouldn’t surprise me if Balko gets emails threatening to sue him weekly.

Oh, he does. I send them on Monday’s and Wednesdays. Sometimes on slow Fridays.

            1. No clue what Monday is possessing.

            2. Wasn’t Lonewacko suing half the commenters on H&R at one point?

              1. Only the half that wasn’t him.

              2. edward or some such twat was threatening to sue the ur-kobold at some point.

                1. Apparently he didn’t know that Urkobold owns the American Bar Association.

              3. I wasn’t getting sued. I feel left out.

    3. How do we know that Joel Pile doesn’t fuck sheep?

I’m not saying he does. I’m just asking questions.

      1. Look at this mug. What do you think?

        1. Sheep Fucker.

        2. That’s a sheep fucker if I’ve ever seen one. And growing up in Ohio I’ve seen some sheep fuckers.

        3. What is it with bald politicians? Is he looking for a job with the US Treasury or something?

        4. I think he’s a bottom.

          1. Power bottom definitely

      2. “”How do we know that Joel Pile doesn’t fuck sheep?

I’m not saying he does. I’m just asking questions.””

And when you ask the sheep, they say nothing.

        1. And they all run away like they are scared victims.

      3. I negotiate a totally awesome package for my city manager job. Do they call me a totally awesome negotiator? No.

I rule this place like a king. Do they call be king? No.

I totally locked up this dude that talked shit about me. Do they call me master? No.

        You fuck one sheep…

      1. His shitty taste in movies (Will Farrell, Michael Bay, and The Motherfucking Notebook? The whiniest pile of shit since Joel?) befits his overall shittiness.

        1. Whoa, whoa, whoa, I think you’re taking it a bit far there including Will Farrell with Michael Bay. Sure, the stuff he’s done recently has been pretty formulaic, but you have to give him credit for Anchorman.

        2. The Motherfucking Notebook

That was an awesome movie, even if the premise of a lecherous, hyperdildonic notebook is a bit hard to swallow.

          1. >a lecherous, hyperdildonic notebook is a bit hard to swallow.
            reply to this

            That’s what she said!

    4. We should begin a email writing campaign.

      1. I submit that in the time it took you to type and submit that message, the “campaign” already had been underway.

        1. True, I just thought it’d be nice to make it official. A “let the games BEGIN!” sorta thing.

    5. Does he have a blog we can deface with pictures and blinking multicolored text?

      1. Lots of sheep. make sure there’s lots of sheep. He’ll appreciate it.

    6. I wrote him a very polite e-mail shaming him and telling him he should resign. As a city manager, being criticized is part of the job. If you can’t handle that without wrongfully arresting someone, you shouldn’t have your job.

    7. I hope the address is correct, I sent the tard a little message. I encourage all of you to do likewise.

  5. I’d understand criticizing him if he was anything but a public servant, but once someone is elected, it’s important to let them do their jobs without a bunch of people bothering them and complaining.

    1. Geez, here I was being all snarky…

It looks like it’s even worse than Balko said after that!

    2. My guess is he’s appointed/hired. Most city administrators are. That’s what makes this all the more ridiculous, that he’s griping about being “held accountable” to the public and complaining about how he doesn’t have power to do anything about the guy’s problem.

  6. “Joel Pile
    City Administrator”

What a name. A real thing of beauty on a business card.

    1. That’s the first thing I thought…

  7. Joel, you Pile…

  8. Hmmm…. methinks that said city is about to be bankrupted by the ensuing lawsuit from Mr. West.

Oh – Pile, in your actions as a city administrator, especially in regards this matter, you’re a fucking douchbag with a small penis complex.

  9. “I think it’s an ego trip for somebody and I think somebody’s abusing their ego and authority,” said West.

What are you going to do about it, Jarrod? Nothing, b/c you are a scared little sheep baaaaaaa. Pussy.

  10. Who were the arresting officers? Or does Pile have his own badge-carrying stormtroopers to piss on the Constitution?

  11. The prosecutor (or whoever the chief law enforcement official there is) took an order from the city administrator to arrest the guy? Did anyone with a law degree weigh in on this before the action was taken?

    1. “Did anyone with a law degree brain weigh in on this before the action was taken?”

      Fixed

    2. It’s not stated, but I wonder if the Joel just called the ole’ chief and had this evil bastard taken care of.

A lot of municipalities don’t have full time prosecutors.

      1. I think most have a solicitor who will step in to slap someone who puts the municipality in jeopardy of a costly judgment.

On the other hand, if the solicitor bills by the hour, they might not mind getting the work even if they’re going to lose.

        1. They do, but in my experience they are part time and not present at city hall 99% of the time.

This sounds a lot like The Pile sent his chief down to wrangle up some bad guy.

        2. I think most have a solicitor who will step in to slap someone who puts the municipality in jeopardy of a costly judgment.

You mean, costly to the taxpayers (ie little people).

          1. One thing municipal voters tend to remember is that the pothole in front of their house didn’t get filled because some asshole tied up public funds settling a suit.

If the town had any character at all, if property owners had any sense at all, tomorrow there would be rows upon rows of yards with signs asking Joel where he thinks the limit of his power lies.

            1. Sounds like we are going to need some stimulus money to build a bigger jail.

    1. Great film.

  12. “People and individuals have an absolute right to free speech,” said Pile. “But however,

FAIL! FAIL FAIL FAIL FAIL FAIL.

    1. You keep using this word “absolute”. I do not think it means what you think it means.

  13. 21-4004. Criminal defamation. (a) Criminal defamation is communicating to a person orally, in writing, or by any other means, information, knowing the information to be false and with actual malice, tending to expose another living person to public hatred, contempt or ridicule; tending to deprive such person of the benefits of public confidence and social acceptance; or tending to degrade and vilify the memory of one who is dead and to scandalize or provoke surviving relatives and friends.

    (b) In all prosecutions under this section the truth of the information communicated shall be admitted as evidence. It shall be a defense to a charge of criminal defamation if it is found that such matter was true.

    (c) Criminal defamation is a class A nonperson misdemeanor.

“Your honor, the statements I made were true to the best of my knowledge and I intended no malice against Mr. Pile when I made them.”

    1. “” knowing the information to be false and with actual malice, tending to expose another living person to public hatred, contempt or ridicule; tending to deprive such person of the benefits of public confidence and social acceptance; or tending to degrade and vilify the memory of one who is dead and to scandalize or provoke surviving relatives and friends.””

So every campaign is ran in an illegal manner?

      1. Pretty much, but you have to prove knowledge or reckless disregard, either of which is a pain in the ass to do.

        1. Very hard to prove.

“””Pile says the city will drop the charges against West if he stops blaming Pile for the flooding issues on his property.””

Being that it is hard to prove, what facts did the DA consider before filing charges. It say the city will drop the charges, not Pile.

          1. The DA probably considered the “facts” of: (a) Pile is his buddy (b) West is not (c) Pile and the DA are both public servants (d) West is an uppity little taxpayer who needs to be put in his place.

    2. How on earth does that statute not violate the First Amendment?

      1. The First Amendment has never been understood to protect criminal defamation, slander or libel.

The key is in narrowly and specifically defining what can be criminally prosecuted as defamatory. And under no standard I have ever heard of is that sign remotely defamatory.

If the sign said “City Administrator Joel Pile fucks sheep,” then yeah, that could be considered pretty high up there on the ol’ purposeful defamation scale. But his complaint about his property flooding, with the statement “Joel, this means you” – no way – even under that statute.

        1. What he said.

        2. Actually it could, if it could be proven that Joel did not have the power to affect the changes to fix the flooding and Jarrod knew that. However as the ACLU pointed out, Joel is directly responsible for addressing the issue at the heart of the drainage problem and bears supervisory responsibility for the provision of city services to residents.

          1. Yahbut – who’s “Joel” on that sign? Maybe he’s got a plumber named Joel who he’s blaming for his flooding problems.

        3. Do you not have to know for a fact what you said or wrote is false for this to apply given:

21-4004. Criminal defamation. (a) Criminal defamation is communicating to a person orally, in writing, or by any other means, information, knowing the information to be false and with actual malice

Only Joel himself knows whether or not he has actually fucked sheep. I don’t think we have an obligation to follow him around when he goes out to the pastors to do God knows what at night.

However, I do know for an irrefutable fact that Joel Pile, the city administrator of some bumfuck town in Kansas, is an animal.

          1. “I don’t think we have an obligation to follow him around when he goes out to the pastors to do God knows what at night.”

            “pastors”? Great joe’s law, alan.

            1. Oh, I see what I did there, not so much slow, as I often forget there is suppose to be some kind of nebulously defined relationship between clergy and God. Like they are mob bosses and some dude named Yahweh is their enforcer. ‘Gimme my tithes or we gonna haf to send dis big guy over to rough you up, or somethin’.’

As for joe’z law, there is sectarian argument over interpretation, but knowing him, I cannot imagine a definition that did not involve comeuppance.

          2. Eh? I’ve never corrected anyone’s syntax or spelling in my life. It would be indicative of the greatest sin of them all, giving a damn. That is a necessary condition for invoking joe’z law.

        4. It would only be defamatory if West knew for a fact that Pile does not fuck sheep. And as has been pointed out above, we either haven’t investigated the question far enough to make a judgment, or we can look at him and make an affirmative judgment, based on his resemblance to Ohio sheep fuckers.

          1. That is a good point. It is nearly impossible to prove that someone knows something to be false. Even if I have no idea whether Joel Pile fucks sheep or not, it can certainly not be said that I know the statement “Joel Pile Fucks Sheep” to be false. I would have to have followed him around for his whole life to know that.
So, does Joel Pile fuck sheep? I don’t know, but maybe if we type it enough, “Joe Pile Fucks Sheep” will show up on Google when people search for his name.

            1. This thread is the fourth link down when you google Joel Pile. So that has to count for something.

              1. I wonder if when Joe Pile fucks sheep he is counting them as well?

BTW, I wonder, does anyone know whether Joe Pile fucks sheep Joe Pile fucks sheep Joe Pile fucks sheep Joe Pile fucks sheep Joe Pile fucks sheep Joe Pile fucks sheep Joe Pile fucks sheep Joe Pile fucks sheep Joe Pile fucks sheep Joe Pile fucks sheep Joe Pile fucks sheep Joe Pile fucks sheep Joe Pile fucks sheep Joe Pile fucks sheep Joe Pile fucks sheep Joe Pile fucks sheep Joe Pile fucks sheep Joe Pile fucks sheep Joe Pile fucks sheep Joe Pile fucks sheep Joe Pile fucks sheep Joe Pile fucks sheep Joe Pile fucks sheep Joe Pile fucks sheep Joe Pile fucks sheep Joe Pile fucks sheep Joe Pile fucks sheep Joe Pile fucks sheep Joe Pile fucks sheep Joe Pile fucks sheep Joe Pile fucks sheep?

              3. It’s first if you google “joel pile fucks sheep”. Wonder if that counts for anything.

        5. Wouldn’t the sentence, “City Administrator Joel Pile fucks sheep.” be covered under parody. Thanks to Larry Flynt and Pat Robertson fucking his mother in an outhouse.

          1. Wait – Pat Robertson made love to Larry Flynt’s mom?

            1. In a fucking out house?

          2. Jerry Falwell

            1. Thanks, knew it was one of them. None the less I think sheep fucking, at least with respect to non-NZ people in the US, is a parody.

              1. Thank you all, I learned something today from this thread. Without coming here I never would have known that Jerry Falwell and Pat Robertson double-teamed a sheep in an outhouse in Ohio.

      2. According to U.S. Chief District Judge John W. Lungstrum it is constitutional because “it only prohibits communication that is known to be false and communicated with actual malice” and that “the language of the law insures that criminal charges will only be brought when it can be proven that the statement, whether phrased as an opinion or otherwise, is false.

        1. As with libel laws, public figures, such as Pile, have a higher burden that they have to bear in terms of proving defamation.

        2. The language of the law doesn’t insure shit if the men in blue don’t follow it.

        3. How can a statement of opinion be false?

          1. It is my opinion that that the Earth is only 6000 years old. Also I believe that Joel Pile is not a sheep fucker.

            1. Your opinion may be false, but to determine whether your statement is false, I would need to be a mind reader.

              1. A statement is merely a method of conveying the opinion. What are you talking about?

                1. Well, you may be making a statement that conveys something that doesn’t reflect your opinion. If I were a mind reader I’d know.

      3. I’m actually good with civil defamation as being consistent with the 1A.

But I can’t quite wrap my head around criminal defamation being consistent with the 1A.

        1. Neither can most reasonable people, which is why criminal defamation is only on the books in 16 states.

        2. Seeing as how the court system is set up by legislatures (analogous to Congress), if civil punishments for certain speech acts are compatible with 1A, so are criminal ones, no?

        3. I mean, if Congress passed a law saying that an incumbent who loses a federal election can sue anyone who criticized him for damages, would that be compatible with the First Amendment because it involves civil litigation rather than criminal?

  14. That sign didn’t cause Joel any harm, the arrest of West did.

So Joel shitbag’s philosophy is say something I don’t like, and I will cause you harm.

  15. “People and individuals have an absolute right to free speech,” said Pile. “But however, when they do it and continue to do it within the realms of what we believe is actual malice for the purpose of holding me accountable to the public we believe that crosses a line.”

I certainly hope Mr. West can get some legal support so a judge might explain to that asshat Pile that it isn’t up to him to draw the line in the sand.

    1. How dare anyone hold him accountable to the public.

  16. Want to bet this guy’s nickname has been “Steaming” ever since 4th grade?

    1. I can see the yearbook photo and caption.

      1. I’d like to see it on an APBA card.

        1. American Power Boat Association?

          1. LOL, no, this APBA:

            APBA Games

They make sports sims played with dice and cards. Let’s say it was a bit more relevant 20+ years ago, before the Show came out on PS3.

But they always had guys’ nicknames that you might not have known. Like Tim “Big Head” McCarver, or Keith “Taco” Hernandez.

  17. I hope that the city can find a way take the money from the resulting civil rights suit from Pile himself. Also, hopefully the judge will bar him from ever holding public office again. While we’re at it, I’d like a pony.

  18. Sounds like a pile of something. Too bad this particular pile can’t be flushed away. What a dick.

  19. Joe Pile comes across as a CUNT in every sense of the word.

  20. Here’s the Pile’s info in case anyone wants to thank him for the great job he’s doing.

  21. I think we have The Jackets and Balkos (still no good name) arch-nemesis. The Pile.

    1. Lady and the Tramp
      Chico and the Man
      Balko and the Jacket

      1. Did you really just call Balko “Lady” and Gillespie “Tramp”?

      2. The Captain and Tenille

  22. I grew up in Valley Center. My parents still live there.

I suppose Joel Pile can still point to Dennis Rader and say “I’m not the worst person from the neighborhood”

  23. Oh, and I thought it was too much when I was suspended from college for calling a professor “a biased socialist who doesn’t understand reality” because he showed us a video footage claiming Hugo Chavez was a hero to prove his point that globalization was sick.

  24. It may be worth noting that the Kansas legislature repealed this law this year, and don’t appear to have replaced it with anything.

  25. Back in the day, tar, feathers and pitchforks would be deployed and it would be generations before any damn fool would try this again.

This is a fine measure of the wimpificationa and feminzation of the Nation.

  26. Well, what do you expect from a guy named Joel Hemorrhoid?

  27. My mistake. Upon further research it appears that the relevant provisions of the prior criminal defamation statute have been reenacted as Sec. 173 of the new code, entitled Criminal False Communication.

  28. My goodness. Quite the little emperor this Pile. Or is it quite the little Pile, this emperor. Oh, never mind.

  29. Just so. It’s about time the law did something about the unwashed masses criticizing their leaders for failing to do their jobs.

Oh, and why is anywhere in Kansas known as “Valley” anything? Did two groundhogs kick up mounds on either side of this burg?

  30. But he’s so pretty!

    Joltin Joel

  31. Dammit.

    He’s so pretty!

    Joltin Joel

  32. Joel is a douchebag.

  33. Mr. Pile, are you familiar with Steve Smith? I think he’d like you.

  34. Joel Pile is really funny! He’s a big tickle monster!

  35. http://www.arkvalleynews.com …check…..the works.
Mr West might want to consider going after those who sold him his house and didn’t disclose the risk, instead of going after the city’s head peon who can only do what the city council directs him too. Mr West is the type of fellow that might fit in better in Park City.

  36. Your facts are off. He was never arrested, never went to jail for this. Mr West went to jail for assaulting his elder neighbor (Pushed him down to the ground) While in jail he was presented with a complaint and notice to appear on the defamation stuff.

  37. The VC City Council and Admin are highly arrogant and usually unnecessary, but the flooding has gotten better over the years, not worse. And they have plans in the works that will make it better still.

  38. My email:

Let me get this straight, Mr. Pile…

…You don’t have the authority, as an administrator, to issue work orders — but you do have the authority to use the police force as your own personal rentacops and send them to arrest a political enemy?

This story has gone viral, and has done more to make you look like an idiot — nationwide — than anything a thousand Jarrod Wests could have done. What’s more, it’s made your community the laughingstock of the nation. The people of Valley Center should have YOU arrested for defamation, you clown.

You really should Google “Streisand Effect.” Thanks to your own stupidity, you’re about to learn just what it’s all about.

    Sincerely,
    Kevin Carson

  39. We are a laughing stock because the media runs with stories that have very little facts…and gullible americans eat that stuff up. West wasn’t arrested for anything related to joel pile. He was arrested for physically assaulting his elderly neighbor. He only got served a notice to appear on the defamation charges while he was in jail for the other totally seperate event. Joel pile is a overly sensitive donkey…but not to any degree that this has been blown up. Ignorant news consumers and gossip junkies are the real idiots here.

    1. A unconstitutional charge is unconstitutional no matter when it is given. West may be a dirt bag but abuse of power is wrong even if it is being used to put pressure on a criminal.

      1. That would be accurate, so when he goes to court and the judge looks at the facts, which he will actually have, as opposed to the media and blogosphere who tend to chase rabbits down whichever hole seems the most lucritive, then he can decide if there is any merit. I cant think of a better outcome than for this to drive Mr Pile out of his job, he should have never been hired, but Mr West isn’t exactly a man of integrity, and this is over more than a stupid sign and a couple of news clippings.

  40. Fer shame, fer shame, fer shame…

  41. Freedom of speech up to the point of criticizing your elected officials. I wonder how long it will take for the ACLU to get this case kicked out.

  43. Sadly, the information you have received is incorrect. Jared West was not arrested for having a sign in his front yard. KSN News Channel 3 reported it as such, but you will find that the story from their website has been removed. In addition, they have made a retraction of the inaccuracies on the story. Jared West, a known trouble-maker in the City of Valley Center, was arrested for a felony threat and simple battery because he pushed down his 80 year-old neighbor and stated he would kill him. At the time of that arrest, the Valley Center PD served him with criminal defamation papers from the Municipal Court.

I agree, regardless of how a person behaves gives no right to violate their civil liberties; however, Jared West could have found other means to address his issue with the City than attacking someone that did not have the authority to change anything.

Jared West has acted so badly in the past that his family will have nothing to do with him- his sister has a restraining order on him because he physically attacked her. He has a rap sheet so long it is too long to list. His mother wrote a letter to the City apologizing for her son’s behavior.

Again, no one’s rights should be infringed upon, but maybe there is much more to this story and the “victim” than meets the eye. I really hope people will second-guess what they see, hear and read in the news- I assure it is often incorrect information being provided.

  44. I suppose when Mr. West’s mother was out comitting forgery, theft, shoplifting, and vandalism she thought she had rights too. Same as Robert L. Thomas jr when he was in prison I imagine he thought he had rights as well??? Of course Mr. West’s mother had rights under, Marilyn K. Thomas. Marilyn K. Duke, Marilyn K. West, Marilyn K. Sinklier, Marilyn K. Strausberg, And finally Marilyn K. McMillain. Mr. West had such GOOD role models. He is lucky to have a restraining order to keep him away from them. The only time he has ever had anything good in his life is when they weren’t talking to him. But they are such great pillars in there community now that they have there records expunged and they take in foster children for the money. They are only pissed off at there son because his ignorant step father dared him to start his own business and compete against them and he did just that and put them in bankruptcy court. Although Marilyn had a huge part in that as she has never been able to manage money. With all that said is Jarrod a saint?? No But he still has rights.

  45. The city settled for $8,000 after a judge forced them to respect First Amendment rights.
