I feel comfortable writing that, because I don't plan to visit Valley Center, Kansas any time soon.
He was cuffed, fingerprinted, booked into the Sedgwick County Jail and released on bail. His crime: putting up a yard sign critical of the Valley Center city administrator.
Jarrod West is out on bail, facing criminal defamation charges for a sign he put in his front yard about persistent flooding issues he says cost him over $50,000 over the last three years. The sign says, "Dear Valley Center, I did not buy Lake Front Property! Fix this problem. This is what I pay taxes for. PS. Joel this means you!" Joel being City Administrator Joel Pile…
When City Administrator Joel Pile saw the sign, West was arrested and booked into the Sedgwick County Jail on a criminal charge of defamation. He spent the night behind bars and is now free on a $10,000 bond.
"I think it's an ego trip for somebody and I think somebody's abusing their ego and authority," said West.
"We've advised him of the process to come through the City Council," Pile told KSN.
Pile stands behind the criminal charge, saying West has acted with malice in criticizing him and he's been told any action to alleviate flooding has to come from the City Council.
"People and individuals have an absolute right to free speech," said Pile. "But however, when they do it and continue to do it within the realms of what we believe is actual malice for the purpose of holding me accountable to the public we believe that crosses a line."
Pile says the city will drop the charges against West if he stops blaming Pile for the flooding issues on his property.
How kind of Mr. Pile. Never criticize him, and you won't have to worry about him having you arrested.

If it were defamatory--which I don't think it is--the only remedy is to sue. Unilateral action without a court decision is, of course, completely and utterly unconstitutional and likely actionable since it was done under the color of law.

A lot of municipalities don't have full time prosecutors.
I think most have a solicitor who will step in to slap someone who puts the municipality in jeopardy of a costly judgment.
On the other hand, if the solicitor bills by the hour, they might not mind getting the work even if they're going to lose.

Being that it is hard to prove, what facts did the DA consider before filing charges. It say the city will drop the charges, not Pile.
The DA probably considered the "facts" of: (a) Pile is his buddy (b) West is not (c) Pile and the DA are both public servants (d) West is an uppity little taxpayer who needs to be put in his place.

The First Amendment has never been understood to protect criminal defamation, slander or libel.
The key is in narrowly and specifically defining what can be criminally prosecuted as defamatory. And under no standard I have ever heard of is that sign remotely defamatory.
If the sign said "City Administrator Joel Pile fucks sheep," then yeah, that could be considered pretty high up there on the ol' purposeful defamation scale. But his complaint about his property flooding, with the statement "Joel, this means you" - no way - even under that statute.

As with libel laws, public figures, such as Pile, have a higher burden that they have to bear in terms of proving defamation.

Mr West might want to consider going after those who sold him his house and didn't disclose the risk, instead of going after the city's head peon who can only do what the city council directs him too. Mr West is the type of fellow that might fit in better in Park City.
Your facts are off. He was never arrested, never went to jail for this. Mr West went to jail for assaulting his elder neighbor (Pushed him down to the ground) While in jail he was presented with a complaint and notice to appear on the defamation stuff.
The VC City Council and Admin are highly arrogant and usually unnecessary, but the flooding has gotten better over the years, not worse. And they have plans in the works that will make it better still.

We are a laughing stock because the media runs with stories that have very little facts...and gullible americans eat that stuff up. West wasn't arrested for anything related to joel pile. He was arrested for physically assaulting his elderly neighbor. He only got served a notice to appear on the defamation charges while he was in jail for the other totally seperate event. Joel pile is a overly sensitive donkey...but not to any degree that this has been blown up. Ignorant news consumers and gossip junkies are the real idiots here.
A unconstitutional charge is unconstitutional no matter when it is given. West may be a dirt bag but abuse of power is wrong even if it is being used to put pressure on a criminal.
That would be accurate, so when he goes to court and the judge looks at the facts, which he will actually have, as opposed to the media and blogosphere who tend to chase rabbits down whichever hole seems the most lucritive, then he can decide if there is any merit. Sadly, the information you have received is incorrect. Jared West was not arrested for having a sign in his front yard. KSN News Channel 3 reported it as such, but you will find that the story from their website has been removed. In addition, they have made a retraction of the inaccuracies on the story. Jared West, a known trouble-maker in the City of Valley Center, was arrested for a felony threat and simple battery because he pushed down his 80 year-old neighbor and stated he would kill him. At the time of that arrest, the Valley Center PD served him with criminal defamation papers from the Municipal Court.
I agree, regardless of how a person behaves gives no right to violate their civil liberties; however, Jared West could have found other means to address his issue with the City than attacking someone that did not have the authority to change anything.
Jared West has acted so badly in the past that his family will have nothing to do with him- his sister has a restraining order on him because he physically attacked her. He has a rap sheet so long it is too long to list. His mother wrote a letter to the City apologizing for her son's behavior.
Again, no one's rights should be infringed upon, but maybe there is much more to this story and the "victim" than meets the eye. I really hope people will second-guess what they see, hear and read in the news- I assure it is often incorrect information being provided.
