Doherty Talking About Guns and Heller in Chicago Area Thursday Night

I'll be giving a talk about my out-any-day-now book on the historic Heller case and all the interesting debates--legal, empirical, constitutional--surrounding it, called Gun Control on Trial, in the home area of the next president of these United States tomorrow (Thursday) night.

Doesn't it require waiting a while to see if a case is historic? United States v. Lopez was considered a landmark case in restoring federalism, but it wasn't taken seriously and any gains have proved illusory or been beaten back, I'm not sure I'd call it historic.

There's still a while to go to see the impact of Heller, especially now that one untimely retirement or death could see it reversed.

I really don't see how we get out of the Obama administration without at least two new Justices that are hostile to Heller, and seize on the gaping loopholes the court went out of the way to craft into the Heller opinion to approve any gun control law short of an outright and broad-based ban.

I am surprised. I would not have thought you would be so accommodating of "common sense regulation" of enumerated rights under the constitution. It's not generally a pretty picture.

Then again, when in the shadow of impending doom and apparently a number of voters who still base their primary decision making on race alone, I guess "common sense regulation" of such is relatively low on the list, so I can understand somewhat.

Do you mean two Justices who are new and who are hostile to Heller, but who may be replacing Justices already hostile to Heller, or do you mean actually flipping votes?

In a first Obama term, I think replacing two of the Heller majority would be unlikely. Replacing two or three Justices in general is, however, quite likely.
