Two Who Dared

Reader Evan Daze (of the Dazed Reader blog) points to this interesting Houston Chronicle catch-up story with John Lawrence and Tryon Garner, the two men at the center of last year's Supreme Court case invalidating the nation's remaining sodomy laws.

Lawrence and Garner remain friends and date other people. Neither were activists before their case, and they still aren't. Neither is fond of President Bush. Both support the right of gay people to marry but aren't interested themselves….

Both laugh at the idea of cashing in with a book or a TV movie deal, and they shun comparisons some have made to Jane Roe of abortion rights fame or Rosa Parks, a civil rights icon.

Michael: I thought this all happened in Texas, not Georgia? I believe part of the reason the neighbor called was that they were worse than a gay couple, they were an interracial gay couple.

Does anyone know if Texas was one of the states where all sodomy was illegal or only male-male? If it was the latter, it seems like a lot of conservative commentators are getting upset over a repealed law that actually was an equal protection violation rather than a right to privacy violation.

In TX, only homosexual sodomy was illegal. However, there was a "rational basis" for this unequally applied law -- heterosexual sodomy may lead to offspring, which is something the state encourages. This is why the SCt made their policy choice based on the "right to privacy," not equal protection.

joe at 3:31: Yes it is true, the thinking was that hetero sodomy may lead to offspring because the NEXT time the happy couple undertakes the nasty deed, they might choose the "right" orifice. So, protecting even their less-than-optimal...activities, encourages their relationship and promotes a state interest in their possible future procreative activities. But gays, you see, can never, ever opt for the right orifice. So, there is no reason to tolerate their sodomy and so they, unlike sodomite heteros, ought to be locked in cages if they do that. (I know this is the reasoning from reading an amicus brief in the Lawrence case submitted by a former law prof of mine, who defended this, er, thinking.)
